本书以海外华人以及海外华人社会为主要研究对象,总结和提炼海外华人社会适用中国传统法律的方式方法与特征,考察中国传统法律文化对于华人日常生活所起的作用.对海外华人与中国传统法律文化保存与传播的互动作用进 行解析.以中国传统法律在东南亚诸国之影响为主线,借重国际关系史,汉学以及文化交流史等方面的史料和现有的研究成果,以法律史的角度重新解读, 深化中国传统法律文化域外影响,尤其是对'中华法系'以外国家的影响研究.

Resource saving has become an integral aspect of manufacturing in industry 4.0. This paper proposes a multisystem optimization algorithm, inspired by implicit parallelism of heuristic methods, to solve an integrated production scheduling with resource saving problem in textile printing and dyeing. First, a real-world integrated production scheduling with resource saving is formulated as a multisystem optimization problem. Then, the MSO algorithm is proposed to solve multisystem optimization problems that consist of several coupled subsystems, and each of the subsystems may contain (...) multiple objectives and multiple constraints. The proposed MSO algorithm is composed of within-subsystem evolution and cross-subsystem migration operators, and the former is to optimize each subsystem by excellent evolution operators and the later is to complete information sharing between multiple subsystems, to accelerate the global optimization of the whole system. Performance is tested on a set of multisystem benchmark functions and compared with improved NSGA-II and multiobjective multifactorial evolutionary algorithm. Simulation results show that the MSO algorithm is better than compared algorithms for the benchmark functions studied in this paper. Finally, the MSO algorithm is successfully applied to the proposed integrated production scheduling with resource saving problem, and the results show that MSO is a promising algorithm for the studied problem. In January 2019, What is Peppa?, a promotional video for a Chinese New Year movie, received widespread attention in China immediately after its release. This paper explains the success of the video from the perspective of visual framing, and employs Systemic Visual Grammar to analyze how visual semiotics are applied to frame prominent topics so as to achieve promotional purposes. The results show that: (i) visual semiotics are used to frame the topic of empty nesters, implying that this issue brings (...) negative consequences and evoking the audience’s empathy and concern; (ii) visuals frame the topic of family love, in which the main protagonist’s actions are highlighted; and (iii) the topic of family reunion is mainly framed and realized by delicate compositional arrangements. Using various visual semiotics at the denotative, stylistic-semantic, connotative, and ideological levels, this video establishes both visual and emotional communication between the main character and the audience, making the promotional purpose more successful. The results highlight and specify the important roles of visual frames in promotional videos, and the integration of Peppa with traditional Chinese culture, love, and family reunion represents a visual approach to glocalization. Poverty alleviation consumption, which we call altruistic consumption, has become a new effective way to help vulnerable groups, but there are a few empirical researches on poverty alleviation through consumption. This article takes China's poverty alleviation actions as the research object, investigates and studies the relationship between altruistic consumption motivations and altruistic consumption behaviors that aim for vulnerable groups. It is found that altruistic consumption behavior is mainly affected by benefit group motivation, benefit morality motivation, benefit demander motivation, and benefit (...) supplier motivation. There is a correspondence between the four altruistic consumption motivations and the four altruistic consumption behaviors. The strength of altruistic consumption motivations changes with changes in altruistic buying behavior. The strength of benefit group motivation decreases with the increase in the times of altruistic purchases, while the strength of benefit morality motivation, benefit demander motivation, and benefit supplier motivation increase with the increase in the times of altruistic purchases. Among the four kinds of altruistic consumption motivations that affect the times of altruistic purchases, the benefit demander motivation has a relatively greater influence. The results of this study have important guiding significance for vulnerable groups to formulating targeted proactive marketing strategies, preventing the altruistic consumption relationship dissolution, and realizing sustainable altruistic consumption. Bioethical debates on the use of human embryos and oocytes for stem cell research have often been criticized for the lack of empirical insights into the perceptions and experiences of the women and couples who are asked to donate these tissues in the IVF clinic. Empirical studies that have investigated the attitudes of IVF patients and citizens on the donation of their embryos and oocytes have been scarce and have focused predominantly on the situation in Europe and Australia. This article (...) examines the viewpoints on the donation of embryos for stem cell research among IVF patients and students in China. Research into the perceptions of patients is based on in-depth interviews with IVF patients and IVF clinicians. Research into the attitudes of students is based on a quantitative survey study. The empirical findings in this paper indicate that perceptions of the donation of human embryos for stem cell research in China are far more diverse and complex than has commonly been suggested. Claims that ethical concerns regarding the donation and use of embryos and oocytes for stem cell research are typical for Western societies but absent in China cannot be upheld. The article shows that research into the situated perceptions and cultural specificities of human tissue donation can play a crucial role in the deconstruction of politicized bioethical argumentation and the assumptions about “others” that underlie socio-ethical debates on the moral dilemmas of technology developments in the life sciences. Offers the first focused study of the shifei debates of the Warring States period in ancient China and challenges the imposition of Western conceptual categories onto these debates. In recent decades, a growing concern in studies in Chinese intellectual history is that Chinese classics have been forced into systems of classification prevalent in Western philosophy and thus imperceptibly transformed into examples that echo Western philosophy. Lin Ma and Jaap van Brakel offer a methodology to counter this approach, and illustrate their (...) method by carrying out a transcultural inquiry into the complexities involved in understanding shi and fei and their cognate phrases in the Warring States texts, the Zhuangzi in particular. The authors discuss important features of Zhuangzi’s stance with regard to language-meaning, knowledge-doubt, questioning, equalizing, and his well-known deconstruction of the discourse in ancient China on shifei. Ma and van Brakel suggest that shi and fei apply to both descriptive and prescriptive languages and do not presuppose any fact/value dichotomy, and thus cannot be translated as either true/false or right/wrong. Instead, shi and feican be grasped in terms of a pre-philosophical notion of fitting. Ma and van Brakel also highlight Zhuangzi’s idea of “walking-two-roads” as the most significant component of his stance. In addition, they argue that all of Zhuangzi’s positive recommendations are presented in a language whose meaning is not fixed and that every stance he is committed to remains subject to fundamental questioning as a way of life. Since March 14, 2020, Spanish citizens have been confined to their homes due to the impact of the COVID-19 pandemic. Participating in musical activities has been associated with reduced anxiety and increased subjective wellbeing. The aim of this study is to analyze how Spanish citizens used music during the lockdown period. We also study perceptions of the impact music has in everyday life, in particular examining the respondents’ insights into the effects of listening to music in situations of isolation. The (...) study was conducted using the MUSIVID19 questionnaire administered to a total of 1868 Spanish citizens. The results indicate that during lockdown, respondents perceived an increase in the time they devoted to musical activities such as listening, singing, dancing or playing an instrument. The participants also reported using music to cope with the lockdown, finding that it helped them to relax, escape, raise their mood or keep them company. The findings suggest an improvement in their perception of the value of music in personal and social wellbeing during the lockdown. However, the study reveals significant differences in the use and perceptions of music according to respondents’ personal situations. Age and feelings of vulnerability may lead to more conservative uses of musical practice and to more moderate perceptions of the positive values of music. (shrink)

The Global Financial Crisis of 2007–2009 exacerbated two distinct concerns about the independence of central banks: a concern about legitimacy and a concern about economic justice. This paper explores the legitimacy of independent central banks from the perspective of these two concerns, by presenting two distinct models of central banking and their different claims to political legitimacy and distributive justice. I argue primarily that we should avoid construing central bank independence in binary terms, such that central banks either are, or (...) are not, independent. I will argue that we should instead construe central bank independence in scalar terms, so that independence admits of degree, thus allowing us to develop an account of independence in which central banks can retain it to the extent necessary for economic efficiency, while meeting reasonable concerns regarding democratic legitimacy and economic justice. ObjectiveThis study aimed to examine the effectiveness and safety of the Brain-computer interface in treatment of upper limb dysfunction after stroke.MethodsEnglish and Chinese electronic databases were searched up to July 2021. Randomized controlled trials were eligible. The methodological quality was assessed using Cochrane’s risk-of-bias tool. Meta-analysis was performed using RevMan 5.4.ResultsA total of 488 patients from 16 RCTs were included. The results showed that the meta-analysis of BCI-combined treatment on the improvement of the upper limb function showed statistical significance [standardized (...) mean difference : 0.53, 95% CI: 0.26–0.80, P < 0.05]; BCI treatment can improve the abilities of daily living of patients after stroke, and the analysis results are statistically significant ; and the BCI-combined therapy was not statistically significant for the analysis of the Modified Ashworth Scale.ConclusionThe meta-analysis indicates that the BCI therapy or BCI combined with other therapies such as conventional rehabilitation training and motor imagery training can improve upper limb dysfunction after stroke and enhance the quality of daily life. BackgroundRepetitive transcranial magnetic stimulation applied to the mylohyoid cortical region has positive clinical effects on post-stroke. Therefore, we conducted a meta-analysis to investigate the efficacy of rTMS for patients with post-stroke dysphagia.MethodsAccording to PRISMA guidelines, we searched the databases of MEDLINE, Cochrane Library, Embase, Web of Science, CNKI, Wangfang. We searched for studies of randomized controlled trials of rTMS to treat dysphagia after stroke and screened by inclusion and exclusion criteria. Features of RCTs were extracted. The heterogeneity of the trials (...) was measured by I2 statistic.ResultsIn total, 11 RCTs with 463 dysphagia patients fulfilled our inclusion criteria. In our analysis, rTMS demonstrated a great beneficial effect for post-stroke dysphagia when combined with traditional swallowing exercises. Moreover, a greatly significant difference was noted based on stimulation frequency. Additionally, no significant difference was observed based on stimulation site.ConclusionsOverall, rTMS can effectively accelerate the improvement of swallowing function in patients with post-stroke swallowing disorders. Auf makropolitischer Ebene gilt das besondere Interesse dem Entstehen und Vergehen von Staaten, entscheiden sich doch hiermit existenzielle Fragen des Seins einer politischen Gemeinschaft. Auf mikropolitischer Ebene geht es um die Frage, inwieweit dem Bürger "aufgegeben" ist, sich in Gesellschaft und Staat zu integrieren. Supranationalisierung und Globalisierung lassen die Kraft des Nationalstaates schwinden. Dem Übergang der Moderne in die Postmoderne entspricht der Übergang von der Welt der Staaten mit ihren durch Grenzen (...) abgeschlossenen Territorien zur Welt der Kontinente, Gemeinschaften und Netzwerke. Doch gibt es viele Stimmen, die meinen, der Staat sei auf absehbare Zeit nicht wegzudenken und als politische Gemeinschaft zu schützen.Werner Mäder ist anderer Auffassung: "Deutschland ist kein Staat mehr..." lautet sein Befund. Der Autor zieht Parallelen zu Hegels Schrift "Kritik der Verfassung Deutschlands" aus dem Jahre 1801 und seinen Kriterien des Staates. Nach Mäder ist das Grundgesetz nur noch eine "Gedankenverfassung", seine fundamentalen Voraussetzungen Staat, Souveränität, Nation, Volk und Demokratie substanziell ausgezehrt. Für Europa bedeutet dies, sich mit eigener Identität selbst zu behaupten, um den Souveränitätsverlust seiner Länder auszugleichen und auf eine neue Multipolarität der internationalen Beziehungen hinzuarbeiten. Umso erstaunlicher ist es daher, dass eine gründliche Erforschung des Marxschen Fortschrittsdenkens bislang noch aussteht.
