La idea de la Unión Europea entendida como la había soñado Häberle como un conjunto unido, formado por Estados independientes que colaborarían entre sí para ayudarse mutuamente, es un bello sueño que no parece tener un reflejo real. Existe una Unión Europea que ha funcionado como tal en múltiples ocasiones, pero no termina de ser eficaz. Situaciones como la de la pandemia del COVID o la guerra de Ucrania, así lo demuestran. Es preciso cambiar esta tendencia. Debemos potenciar la idea (...) de «más Europa» y para ello debemos buscar, creo, la vuelta a los valores que configuraron en su día esa unión y que son los únicos que pueden recordar a Europa cual es su destino. En este artículo se analiza la fuerza actual de Europa tomando como base la epidemia del COVID tanto en España como en los países limítrofes. ¿Funcionó en este caso la Unión como verdadera Unión? O ¿es preciso fortalecer esta Unión para que nunca vuelva a desfallecer? Creo que este trabajo ofrece respuestas a estos interrogantes. (shrink)

I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. The resulting chronology is complex, and I here only indicate it in rough form in a way which [End Page 272] brings out what I take to be its major points. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. All other dialogues, including the Theaetetus, were written prior to the Parmenides with the exception of the Republic, which Thesleff proposes is in its ultimate shape a late work, representing "only and purely Plato's 'own' and personal philosophy" (115). Resumen La categoría de participación permite observar empíricamente cómo las interacciones sitúan a las personas de maneras específicas en el marco de prácticas sociales concretas. El objetivo de este trabajo es caracterizar el modo en que se organiza la participación en las reuniones de un equipo interdisciplinario de salud en un hospital de Buenos Aires, Argentina. Para ello, analizamos las interacciones orales atendiendo a la manera en que se gestionan los turnos de habla y se interpretan las instancias de habla (...) simultánea en el contexto de dos actividades vinculadas con la toma de decisiones y la resolución de obstáculos en la interacción: una propuesta de escritura y una secuencia de reparación. A través del análisis, definimos la participación conjunta como una forma de participación en la que se prioriza la construcción colectiva por sobre las voces individuales y en la que el habla simultánea tiene naturaleza cooperativa, no disruptiva. Asimismo, identificamos los efectos que produce en las reuniones, orientados a la construcción del consenso, el establecimiento de la continuidad temática y el mantenimiento de las relaciones interpersonales. A la luz de estos resultados, observamos que la participación conjunta tiene un rol central en el proceso de construcción y mantenimiento de una identidad grupal, reforzando la inscripción de los profesionales en ella. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

In the present work we explore the effects that an H impurity produces upon the geometry and electronic structure of the CaTiO 3 crystal considering the cubic and orthorhombic crystallographic lattices of the material. A quantum-chemical method based on the Hartree-Fock formalism and the periodic large-unit-cell model is used throughout the work. The analysis of the results shows that the interstitial H impurity binds to one of the O atoms forming the so-called O-H group. At equilibrium, the O-H distances are (...) found to be equal to 0.89 and 1.04 Å for cubic and orthorhombic lattices respectively. Atomic displacements and relaxation energies are analysed comparing the obtained results in the cubic lattice with those in the orthorhombic lattice. In the cubic phase the computed relaxation energy of vicinity of the O-H group is found to be equal to 1.1 eV and the atomic displacements generally obey the Coulomb law. So, the negatively charged O atoms move outwards from the defective region by about 0.09 Å while the positively charged Ti and Ca atoms move towards the defective region by about 0.05 and 0.01 Å respectively. A similar effect is observed in the orthorhombic lattice of CaTiO 3 doped with an H atom. It is necessary to mention that different O positions in the orthorhombic structure are considered for the O-H bond creation. The computed relaxation energies of the atomic displacements in this structure are found to be equal to 2.3 and 2.1 eV depending on the crystallographic type of the bonding O atom. (shrink)

This paper argues that the linguistic approach to analyzing induction, according to which induction is a type of inference or argument composed of statements or propositions, is unsuitable to account for scientific reasoning. Consequently, a novel approach to induction in model-based science is suggested. First, in order to show their adherence to the linguistic treatment of induction, two strategies are reviewed: (i) Carnap and Reichenbach’s attempts to justify induction and (ii) Norton’s recent material theory of induction. Second, three reasons are (...) provided to support the claim that the linguistic treatment of induction is insufficient in accounting for model-based reasoning in science. Finally, a framework focused on models—rather than statements or propositions—is suggested to address induction in science. William Whewell’s theory of induction is briefly outlined as an example of a non-propositional treatment of induction that is consistent with model-based scientific practice. (shrink)

The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy. Contrary to the outstanding simplistic view of the taste system, learning studies show a more complex picture. Behavioral data using conditioned taste preference and aversion tasks support the idea that mixtures involve complex interactions between individual taste cues. Evidence from taste conditioned blocking, taste perceptual learning, and taste learned preferences is considered to support such a view. Greater support for research in taste learning and memory is required for a complete understanding of taste recognition.

Under the intentionality that leads to promoting the liberation of the oppressed in global coloniality, considering planetary decoloniality as the urgency of complexity as transmethod, in the present investigation from rhizomatic deconstruction as a transmethod, the properties of rhizomes are analyzed as the essence of planetary-complex decolonial investigations; That is the complex objective of the investigation. It is framed in the lines of research: education-transcomplex transepistemologies and transepistemologies of knowledge-knowledge and transcomplex transmethodologies. In the reconstruction, the philosophical significances of the (...) properties of the rhizomes are specified: connection and heterogeneity, multiplicity, asignifying rupture and cartography and decal we obtain contributions in complex planetary investigations with an anti-method criticality that is deeply complex and transdisciplinary in the anti-Eurocentrist project. We have reconciled the complex conceptions that were occurring in postcolonialism that perspectives of theoretical articulation between transmodern decolonial criticism with the reflections of Michel Foucault, Felix Guattari and Gilles Deleuze as possible collaborations in the liberating mission of planetary decoloniality. El conflicto surge entre las posibilidades técnicas reales, y las consecuencias éticas de implementarla hasta sus últimas consecuencias. El presente trabajo analiza alguna de estas problemáticas y sostiene que la IA, es un instrumento al servicio del ser humano y sólo así debe ser utilizado, so pena de convertirse en un recurso ingobernable. Urge, por tanto, un ejercicio de responsabilidad que proteja el humanismo y los (...) derechos fundamentales, defendiendo que, el ser humano es, y debe seguir siendo, el centro de la creación. Se usa la hermenéutica comprensiva, diatópica y ecosófica como transmétodo de construcción teórica para sustentar la con-formación de los investigadores educativos venezolanos desde la tríada transdisciplinariedad-ecosofía-antropoética, como retos urgentes en Venezuela. Existen problemáticas profundas en el accionar del ciudadano que se conforma en la educación universitaria, ya que el ser humano, en su parcelación del conocimiento, ha olvidado que somos seres biológicos, psíquicos, espirituales, sociales, ambientales, etéreos, culturales, y que cada aspecto no se puede estudiar por separado ya que es (...) un complexus. Todo ello, aunado a la mercantilización, a temas como la inclusión, la pertinencia y la con-formación, junto a la formación docente en los posgrados, se analiza frecuentemente. Se concluye que con la antropoética se debe alcanzar la toma de consciencia que se necesita en la investigación y en la formación de educadores y que, por encima de la mercantilización, existe la responsabilidad social compleja de la formación de ese docente como ciudadano planetario. Lo realizamos con el transmétodo la hermenéutica comprensiva, ecosófica y diatópica; en los momentos analíticos, empíricos y propositivos. (...) What is the cash value of Richard Rorty’s philosophy and politics of religion? This paper analyzes the political promise of Rorty’s shift from atheism to anticlericalism in the last decade of his life. It seeks to deliver primarily a concise summary of this shift, and of its transformative motivation. Then a critique of this shift is followed by the suggestion of a friendly amendment: its extension towards a pragmatic pluralism. The outlined Rortyan conception of a serene, and, at the same (...) time robust, politics of religion is proposed as a promising answer to the question of how secular liberal citizens should react to the “return of the gods.”. Suárez es uno de los más insignes juristas españoles. La profundidad y originalidad de su pensamiento ha inspirado a muchos autores posteriores hasta la actualidad de manera que puede decirse que existe una escuela suareciana conocida y activa. Este hecho que engrandece nuestra tradición jurídica, debe ser conservado y acrecentado. El artículo que ahora se presenta quiere llegar un poco más allá. Quiere buscar la influencia indirecta de Suárez en aquellos autores que sin mencionarlo expresamente siguen los cauces de su (...) pensamiento aplicándolos a ámbitos de conocimiento no estrictamente jurídicos. Este es el caso de Andrés Bello, un personaje americano de gran importancia. Político, diplomático y jurista de formación humanista clásica, organizó la vida de los seres humanos en sociedad buscando la justicia y la paz. Creo que la influencia de Suárez en personajes de este tipo debe ser considerada, conocida y valorada porque expanden su magisterio de forma insospechada. (shrink)

Clemente de Munguía (1810-1868) fue un f ilósofo del derecho mexicano. Su pensamiento fue iusnaturalista de corte historicista y escolástico, con influencia suareciana. Su visión sobre el derecho lo convierte en un neoescolástico adelantado cuyo pensamiento engrandece la f igura de Francisco Suárez (1548-1617). El conocimiento de su f igura y de su obra resulta tanto más interesante por el momento histórico en que se produce, que en el ámbito mexicano coincide con la independencia del país; y en el euro (...) americano con la expansión de los positivismos jurídicos. Pese a ello, el pensamiento munguiano muestra la pervivencia de la obra de Francisco Suárez, como uno de los grandes pensadores jurídicos del mundo hispano. (shrink)
