The present book is the first to undertake a systematic study of Peirce’s conception of historical knowledge and of its value for philosophy. It does so by both reconstructing in detail Peirce’s arguments and giving a detailed account of the many ways in which history becomes an object of explicit reflection in his writings. The book’s leading idea may be stated as follows: Peirce manages to put together an exceptionally compelling argument about history’s bearing on philosophy not so much because (...) he derives it from a well-articulated and polished conception of the relation between the two disciplines; but on the contrary, because he holds on to this relation while intuiting that it can easily turn into a conflict. This potential conflict acts therefore as a spur to put forth an unusually profound and multi-faceted analysis of what it means for philosophy to rely on historical arguments. Peirce looks at history as a way to render philosophical investigations more detailed, more concrete and more sensitive to the infinite and unforeseeable nuances that characterize human experience. In this way, he provides us with an exceptionally valuable contribution to a question that has remained gravely under-theorized in contemporary debates. (shrink)

Systemic risks are risks produced through interconnected non-wrongful actions of individuals, in the sense that an individual's action is a negligible cause of the risk. Due to scale effects of interaction, their consequences can be serious but they are also difficult to predict and assess via a risk assessment. Since we can have good reason to engage in the interconnected activities giving rise to systemic risk, we incur a concurrent collective responsibility to ensure that the risks are fairly distributed and (...) well regulated. James argues that fairness in this context requires taking reasonably available precautions ensuring for each risk-bearer a favourable ratio of expected benefits over expected losses. In sections 2 and 3 we argue that such a conception of fairness applies but only on the condition that the systemic risks created are irreversible risks and that the general background conditions of justice are imperfectly fair. When risks are reversible, compensatory justice can correct for unfairness in risk imposition. Where risks are irreversible, compensatory justice necessarily fails, giving rise to a collective responsibility to regulate fairly ex ante. Additionally, where background conditions of justice are fully fair and the systemic risk is well understood, risk bearers can be said to have consented to the systemic risk. If they are not fair, we argue that the primary political obligation should lie in fixing the fairness of the backgrounds of justice. A related reason for addressing the general background conditions of fairness is that James’ account of fairness in systemic risk imposition encounters a baseline problem. If expected risks and benefits are calculated again an unfair historic background condition, systemic risk imposition would not be fully fair. Section 4 shows why differences in evidentiary uncertainty as to probability and levels of harm and effective responses require a normatively appropriate response in the form of additional precautions. We show that the evidentiary standards set for risk-based cost-benefit analysis have a connection with deontology because they express a postulate of equal treatment in formal terms. Systemic risks can have different possible degrees of epistemological certainty due to factors of social and natural origin, such as more available research funding or higher degrees of complexity for some systemic risks but not others. These differences have to be mitigated by taking even greater precautions in difficult-to-research systemic risks. (shrink)

“[I]t is the belief men betray, and not that which they parade which has to be studied.” This short Peircean sentence has been the subject of important yet underrated attention in the reception of Peirce’s philosophy, passing through the art historians Edgar Wind and Erwin Panofsky and arriving finally at Bourdieu. This paper explores the affinities between Peirce’s and Panofksy’s thinking, as well as their historical connections and their common sources, taking its cue from an analysis of the similar arguments (...) the two authors offer to justify the analogy between Gothic architecture and Scholasticism. The fulcrum for the comparison between Peirce and Panofsky is located in the writings of Edgar Wind: a leading figure, this article proposes, in the history of European pragmatism. (shrink)

Whenever disagreement arises, dialogue is often presented as a natural remedy to conciliate opposing subjects. Absence of dialogue resulting in conflict appears thus as being somehow unnatural, a behavioural trait artificially induced by a variety of cultural forces, religion in particular. In this paper I would like to argue that the opposite case might be truer. Dialogue is in fact a most unnatural and unlikely event and, for this reason, to consider it as the natural foundation for a shared universal (...) ethics is a potentially dangerous oversight. Dialogue is heavily dependent on consciousness and language, which are not discreet natural entities, but rather complex culturally-influenced constructs. We shall then explore the problem of the constructions of meaningful dialogues in the light of considerations on the formation of consciousness, taking into account the way in which metaphysical beliefs delimit and shape our epistemological possibilities and our understanding of self and alterity. This paper examines the relationship between The Good Society by Walter Lippmann and the ordoliberal ideals. The first part analyses the core elements of a new liberalism – centered on the axiomatic theory of the competition to which the subjects and their jobs must be aligned by the representative government. The second part shows how this approach used by Lippman is in the background of the Colloque Walter Lippmann, that took place in Paris in 1938, and that is often considered (...) as the moment in which the neoliberal discourse emerged. Eventually, the third part focuses on the idea of the neoliberal government of society and on the meaning of the Liberalism Agenda developed during the works of the aforementioned Colloque. (shrink)

Throughout Pope Emeritus Benedict XVI's pontificate he spoke to a range of political, civil, academic, and other cultural authorities. These speeches reveal a striking sensitivity to the fundamental problems of law, justice, and democracy. He often presented a call for Christians to address issues of public ethics such as life, death, and family from what they have in common with other fellow citizens: reason. This book discusses the speeches in which the Pope Emeritus reflected most explicitly on this issue, along (...) with commentary from distinguished legal scholars. It responds to Benedict's invitation to engage in public discussion on the limits of positivist reason in the domain of law from his address to the Bundestag. Although the topics of each address vary, they are joined by a series of core ideas whereby Benedict sketches, unpacks, and develops an organic and coherent way to formulate a 'public teaching' on justice and law. It is well known that Charles S. Peirce's first attempt to construct a theory of metaphysical categories, already displaying the triadic pattern that would later become the keystone of his philosophy, directed itself towards the three English personal pronouns: I, IT, THOU.2 As many scholars have already noted, these three spheres of the phenomenal world identified by the young Peirce prelude to the 1867 "New List" (Quality, Relation and Representation) as well as to the later categories of Firstness, Secondness and (...) Thirdness.But apart from their documentary significance as the seed of Peircean metaphysics, the writings on I, IT and THOU also have a philosophical interest in their own right, one which deserves to.. The article focuses on the link between memory, folk narratives, and critical thinking. I suggest in particular that there are instances in which the transmission of a folkloric story, such as a legend or a tale, can intersect with a person’s life experiences and facilitate the articulation of critical perspectives on society that might otherwise go unexpressed. The opportunity for discussing this idea is offered by the work of early twentieth-century Chicago sociologist Jane Addams. In her book The Long Road (...) of Woman’s Memory (1916) Addams dealt with the modern revival of an ancient legend and investigated its interplay with the recollections, grievances, and aspirations of working-class women. Peirce bildet den Ausgangspunkt für eine neue Sicht auf das Denken des amerikanischen Naturwissenschaftlers, Philosophen und Begründers des Pragmatismus und der Semiotik. Peirce war ein obsessiver Zeichner. Neben einer graphischen Logik entwickelte er eine zeichnerische Praxis, die untrennbar mit seinem Denken verwoben war, in ihrer philosophischen Relevanz aber bislang übersehen wurde.
