The article presents a set of articles on the present and projection of the scholastic tradition. The starting point is the anthropological turn that, within scholasticism and at the beginning of the fourteenth century, privileged the study of ethics, law and politics and, consequently, the forced development of a moral theology concerned with the human coexistence. The second scholasticism, prolonging this tradition throughout the 16th and 17th centuries, could not remain oblivious to the implications of the profound changes that were (...) taking place: the Discovery of America, the Protestant Reformation, the development of a commercial proto-capitalism and the strengthening of the monarchies. As the Reformation was consolidated in a good part of the European territories, intellectual borders were raised between the various confessions. However - and this is the focus of the papers presented - these borders were porous and, despite the climate of confrontation, various indirect communication channels managed to maintain a single intellectual republic. The purpose of our article is to contemplate, from an aesthetic-artistic vision, the principles of the Universal Declaration on Bioethics and Human Rights, adopted by UNESCO in 2005. As a result of a restful, attentive and calm look (contemplation), we believe that the development of a line of thought capable of proposing answers to the great questions posed by the current existential and historical paradigm shift requires an effort of transdisciplinary dialogue. On the one hand, reason, as a specific and (...) differential faculty of the human being, must overcome the limits of its reduction to mere empirical scientism and redefine itself as a reason with an open horizon. On the other hand, the creation of works of art and the aesthetic experience constitutes a way of understanding the complexity and multiplicity of reality. Based on two classic works of art: "The kidnapping of the Sabinas" (Da Cortona) and "Liberty leading the people" (Delacroix) we propose a bio-aesthetic experience on the two fundamental axes on which the principles of the Declaration of UNESCO navigate, which are the centrality of the person and of society. Knowing and deepening such principles, through bio-aesthetic contemplation, is shown as a valid educational instrument, which entails the art of stimulating the capacity to reverberate the beauty existing in the world when good is manifested in human behavior and recognizing the transforming power of art, which facilitates a pedagogical and comprehensive assimilation of the principles of the UNESCO Declaration. Following Thomas Aquinas, Francisco de Vitoria's analysis of justice in exchanges takes place by commenting on the corresponding questions of the Summa Theologica. The identification of the just price with that of common estimation occurs under a sufficient concurrence of sellers and buyers. A high level of concurrence limits the ability to take advantage of the need on the other side of the market. This fact guaranties a full consent of the parties involved in trading. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. This work deals with the long trajectory that goes from Roman legal thought to Locke's explanation of the origin of property, money and, ultimately, political power. Vitoria, Suárez and Locke start from considering a primordial prepolitical state of equal freedom for all and common property, in which humanity could have been before the establishment of the characteristic institutions of the civil state. Despite the presence of elements of continuity with respect to Vitoria and Suárez, by replacing the prelapsary state of (...) innocence with a status naturae that does not require any theological reading, and that Locke places in a truly existing historical time, the English author formulates a strictly secular theory, based on the long tradition of ius naturale, on the origins of civil government and private property. Quisiera asumir el título de este panel -"Pluralismo y éticas de la vida buena"- no como un tema, sino como un problema. ¿Son, o al menos pueden ser pluralistas las éticas de la vida buena (EVB)? Se trata, con toda evidencia, del pluralismo ético, que, en nuestra época, sigue -y a veces acompaña- al pluralismo político, el cual, por su parte, tiene sus más lejanos antecedentes en el pluralismo físico-ontológico de los presocráticos e implica siempre algún tipo de pluralismo epistemológico. El trabajo ofrece una revisión de la literatura sobre la Justicia Terapéutica (TJ)en España durante los últimos cinco años (2017-2021) procedente del mundode la Psicología que incluye, asimismo, una revisión jurisprudencial que incide,mayormente, en la vía penal. La TJ ha pasado de ser una corriente dentrodel Movimiento del Derecho Integrativo a convertirse en un nuevo paradigmaiuspsicológico cuyo presupuesto es el estudio del «Derecho como agenteterapéutico». La distinción entre enfoques y aplicaciones trata de articular larecepción de la TJ tanto desde la (...) vertiente teórica como práctica. Complementariamente,se relaciona un conjunto de resoluciones judiciales sobreTJ recaídas en nuestro ordenamiento jurídico provenientes, en su mayoría, de la jurisdicción penal y, solo puntualmente, de la jurisdicción civil referida al Derecho de Familia. El concepto de salud, como estado completo de bienestar físico, mental y social, en general, y el constructo del bienestar psicológico y emocional del justiciable, en particular, apuntan, pues, hacia la «humanización del Derecho». La construcción del americanismo filosófico fue una de las preocupaciones aglutinantes, y las reflexiones que se produjeron se entroncaron con las circunstancias políticas, ideológicas, sociales, culturales y económicas de cada uno de sus miembros. The correspondence (...) of the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. El artículo analiza el problema de la expulsión de extranjeros sospechosos de ser delincuentes o anarquistas, tomando como marco temporal la acción de la policía de Buenos Aires durante la jefatura de Francisco Beazley (1896-1904). A partir del cruce de dos tradiciones historiográficas diferentes —aquella que toma como objeto a la institución policial y el mundo del delito y la que se ha preocupado por el surgimiento del anarquismo—, busca reflexionar sobre los mecanismos de deportación de inmigrantes antes y (...) después de la aprobación de la Ley de Residencia en 1902. Si bien el foco está puesto en el accionar de la policía de Buenos Aires, una de las ideasvertebradoras del análisis es que la comprensiónde la acción policial frente a la expulsión de extranjeros requiere un estudio detenido en los enlaces entre las ciudades portuarias del litoral atlántico sudamericano y europeo. De esta manera, el artículo se propone reconstruir una cartografía de la actuación transnacional de la policía,conectando a Buenos Aires con Rio de Janeiro, Montevideo y la costa española. Para ello, se ha consultado un heterogéneo conjunto de fuentes que van desde informes consulares y prensa policial, hasta periódicos de Brasil y Argentina, pasando por escritos anarquistas y socialistas. In 1860 he began publication in Cincinnati of The Dial, successor to the New England transcendentalist journal, and used its pages to promote religious liberalism, philosophical transcendentalism, and social reform. In 1863 he went to London where he became the head of the Ethical Society. Under the influence of Feuerbach and "left-Hegelians" he travelled widely in the (...) interests of "free thought." The most amazing of these four, however, is August Willich: an East Prussian soldier, ready to fight again to restore the 1848 revolution in Germany, discouraged by Marx from doing so, emigrating to Cincinnati to raise funds among the German 1848 refugees there and urging them to continue the lost cause in Germany, then wholeheartedly fighting for the Union Cause as a General in the Civil War, and finally joining the Populist revolt. As Easton points out, these four all illustrate the close relation between Hegel and the spirit of 1848. In addition to the stories of these men and their ideals, the volume contains a hundred pages of excellent specimens of their writngs, and copious references to obscure source-materials. The late Argentinian philosopher Francisco Romero, who died unexpectedly in 1962 after a brilliant career of more than thirty years of teaching and writing, was by common acclaim of his fellow-philosophers in Latin America their most distinguished philosopher in recent years. He received many honors and distinctions both at home and abroad, including the grand award of honor of the Argentinian Society of Writers. The most eminent philosophers in Latin American prepared a notable Festschri]t in honor of his 70th birthday, whose publication was unfortunately delayed and, therefore, could not be presented to him personally in his life time.1 Franci~o Romero was in fact as well as in acclaim the "Dean of Latin American Philosophy." It was high time that his central work Teorga del Hombre 2 should be translated. It is his magnum opus and represents the most comprehensive and systematic development of his philosophy. Romero was fortunate in having as his translator William F. Cooper who knew Romero personally, and was intimately acquainted with his philosophy. This article explores the political dimension of algorithmic face recognition through the prism of Gilles Deleuze and Félix Guattari’s notion of faciality. It argues that algorithmic face recognition is a technology that expresses a key aspect of contemporary capitalism: the problematic position of the individual in light of new forms of algorithmic and statistical regimes of power. While there is a clear relation between modern disciplinary mechanisms of individualization and the face as a sign of individuality, in control societies this (...) relation appears more as a contradiction. The article contends that Deleuze and Guattari’s concepts of machinic enslavement and social subjection offer a fruitful perspective from where to identify the power mechanisms behind the problematic position of the individual in the specific case of algorithmic face recognition. A number of people have recently argued for a structural approach to accounting for the applications of mathematics. Such an approach has been called "the mapping account". According to this view, the applicability of mathematics is fully accounted for by appreciating the relevant structural similarities between the empirical system under study and the mathematics used in the investigation ofthat system. This account of applications requires the truth of applied mathematical assertions, but it does not require the existence of mathematical objects. (...) In this paper, we discuss the shortcomings of this account, and show how these shortcomings can be overcome by a broader view of the application of mathematics: the inferential conception. (shrink)

The recent emergence of generative AI software as viable tools for use in the cultural and creative industries has sparked debates about the potential for “creativity” to be automated and “augmented” by algorithmic machines. Such discussions, however, begin from an ontological position, attempting to define creativity by either falling prey to universalism (i.e. “creativity is X”) or reductionism (i.e. “only humans can be truly creative” or “human creativity will be fully replaced by creative machines”). Furthermore, such an approach evades addressing (...) the real and material impacts of AI on creative labour in these industries. This article thus offers more expansive methodological and conceptual approaches to the recent hype on generative AI. By combining (Csikszentmihalyi, The systems model of creativity, Springer, Dordrecht, 2014) systems view of creativity, in which we emphasise the shift from “what” to “where” is creativity, with (Lievrouw, Media technologies, The MIT Press, 2014) relational-materialist theory of “mediation”, we argue that the study of “creativity” in the context of generative AI must be attentive to the interactions between technologies, practices, and social arrangements. When exploring the relational space between these elements, three core concepts become pertinent: creative labour, automation, and distributed agency. Critiquing “creativity” through these conceptual lenses allows us to re-situate the use of generative AI within discourses of labour in post-industrial capitalism and brings us to a conceptualisation of creativity that privileges neither the human user nor machine algorithm but instead emphasises a relational and distributed form of agency. Based on da Costa's and French's notions of partial structures and pragmatic truth, this paper examines two possible characterizations of the concept of empirical adequacy, one depending on the notion of partial isomorphism, the other on the hierarchy of partial models of phenomena, and both compatible with an empiricist view. These formulations can then be employed to illuminate certain aspects of scientific practice.An empirical theory must single out a specific part of the world, establish reference to that part, and say—by (...) way of contingent, substantial claim about the world—that its models fit that. While human rights law has evolved to provide guidance to governments in realizing human rights in public health emergencies, the COVID-19 pandemic has challenged the foundations of human rights in global health governance. Public health responses to the pandemic have undermined international human rights obligations to realize the rights to health and life, human rights that underlie public health, and international assistance and cooperation. As governments prepare for revisions of global health law, new opportunities are presented to harmonize global health (...) law and human rights law, strengthening rights-based governance to respond to future threats.
