The relation between virtue and nature, including human nature, depends on the different meanings and uses of the concept of “nature” as well as its change in the history of thought. Under the influence of modern sciences, nature as an object of “value-free” causal explanations increasingly loses its normative significance for ethics and virtues. In contemporary philosophy, there are basically three principal conceptions of their relation: ethical naturalism based on natural science, anti-natural ethics of reason, and virtue-ethics based on evaluative (...) concepts of nature. Only in some versions of the third option have virtues more than just an instrumental value. Hegel only published five books in his lifetime, and among them the Phenomenology of Spirit emerges as the most important but also perhaps the most difficult and complex. In this book Ludwig Siep follows the path from Hegel's early writings on religion, love and spirit to the milestones of his 'Jena period'. He shows how the themes of the Phenomenology first appeared in an earlier work, The Difference between Fichte's and Schelling's Systems of Philosophy, and closely examines the (...) direction which Hegel's thought took as he attempted to think through the possibility of a complete system of philosophy. The themes encompassed by the Phenomenology – anti-dualistic epistemology, autonomy, historicality, the sociality of reason – are thoroughly discussed in Siep's subtle and elegantly argued assessment, which appears here in English for the first time. In cultural history the human body has been the object of a great variety of opposing valuations, ranging from "imago dei" to "the devil's tool". At present, the body is commonly regarded as a mere means to fulfill the wishes of its "owner". According to these wishes it can be technically improved in an unlimited way. Against this view the text argues for a conception of the human body as a valuable "common heritage". The "normal" human body as the result (...) of natural and cultural history is an essential condition of the modern social and legal order. Nanotechnology is an important platform technology which will add new features like improved biocompatibility, smaller size, and more sophisticated electronics to neuro-implants improving their therapeutic potential. Especially in view of possible advantages for patients, research and development of nanotechnologically improved neuro implants is a moral obligation. However, the development of brain implants by itself touches many ethical, social and legal issues, which also apply in a specific way to devices enabled or improved by nanotechnology. For researchers developing nanotechnology such issues (...) are rather distant from their daily work in the lab, but as soon as they use their materials or devices in medical applications such as therapy of brain diseases they have to be aware of and deal with them. This paper is intended to raise sensitivity for the ethical, legal and social aspects (ELSA) involved in applying nanotechnology in brain implants or other devices by highlighting the short term problems of testing and clinical trials within the existing regulatory frameworks (A), the short and medium-term questions of risks in the application of the devices (B) and the long-term perspectives related to problems of enhancement (C). To identify and address such issues properly nanotechnologists should involve ethical, legal and social experts and regulatory bodies in their research as early as possible. This will help to remove pressure from regulatory bodies, to settle public concern and to prevent non-acceptable developments for the benefit of the patients. (shrink)

Die philosophische Theorie der Anerkennung, vom 18. Jahrhundert bis in die Gegenwart, thematisiert eine Reihe unterschiedlicher Formen dieser Beziehung. Zumindest für die klassischen Autoren liegt ihnen eine gemeinsame, unterschiedlich konkretisierte Struktur zugrunde. Zumeist geht man auch davon aus, dass es eine Norm oder ein Ziel der Anerkennung gibt, das durch diese Formen erreicht werden soll, entweder komplementär oder in einer aufsteigenden Stufenfolge. Je nach den sozialphilosophischen Prämissen kann die Annäherung als ein notwendiger Prozess konzipiert sein oder von den Anstrengungen der (...) Akteure und der Beschaffenheit der sozialen Bedingungen und Institutionen abhängen. Formen als Stufen zu betrachten, bedeutet, von einer hermeneutischen Rekonstruktion zur Kritik der in einer Gesellschaft realisierten Anerkennungsformen überzugehen. (shrink)

Johann Gottlieb Fichte (1762–1814) was never Kant's student. But when he, as a private teacher without any university degree, anonymously published his first book, the Kritik aller Offenbarung (Critique of all revelation, 1791), even some of the most prominent German philosophers took it to be Kant's long‐expected philosophy of religion. Three years later he became the successor of one of the most influential Kantian philosophers, Karl Leonhard Reinhold, at the famous University of Jena. There he taught and published his theory (...) of the “Science of Knowledge,” which the famous poet and critic Friedrich Wilhelm Schlegel hailed as among the “greatest influences of the age,” together with the French Revolution and Goethe's Wilhelm Meister. It became the origin of post‐Kantian philosophy, later called “German Idealism.” Fichte himself supported the French Revolution and soon got into trouble with conservative student “orders” and with the church authorities (because of his Sunday lectures). In 1798, an article by a friend in his Philosophisches Journal was accused of atheism. Fichte defended it and withdrew from the university in Jena, after troubles with Goethe – the “minister of education” in Weimar – and Herder. (shrink)

Wie weit in die Zukunft und wie weit in die Vergangenheit reicht die Verantwortung, die wir für unsere Handlungen haben? Ist es plausibel, dass die Verantwortung für eine Handlung verjährt? Und welche Bedeutung kommt dem Verstreichen von Zeit bei der Allokation (...) knapper Güter und für die Gewährleistung von Chancengleichheit zu? Der moderne Rechtsstaat beansprucht, seine Bürger unterschiedslos als freie und gleiche Personen zu behandeln. Aufgrund dieses allgemeinen Anspruchs sind von der Legitimation staatlicher Normen partikulare ethische Konzeptionen ebenso ausgeschlossen wie Willkür und Privilegium. Eine besondere Frage entsteht aber im Verhältnis zu den großen Religionen, die einerseits selbst mit universalen Geltungsansprüchen auftreten, andererseits als Offenbarungsreligionen durch ihre Geschichtlichkeit aber auch partikular sind. Aus dem Verhältnis von Politik und Religion vor dem Hintergrund moderner Rechtsstaatlichkeit ergeben sich eine Reihe von philosophisch-historischen sowie von (...) rechtssystematischen Problemen, die in diesem Band von Philosophen und Rechtswissenschaftlern eingehend erörtert und diskutiert werden.
