Although blame for systemic sexual abuse in the Catholic church primarily rests with the perpetrators and institutional actors who engaged in cover-up, regular people also failed in their duties, both their secular or civil duties and their moral and religious duties. Using the language of social sin, this article examines responsibility for social sin and the structures of sin that contributed to the abuse of children within the church community. Using the tools of Catholic social teaching—especially the (...) framework of “conversion, communion, and solidarity”—the article articulates some tenets of social morality in the wake of sexual abuse and cover-up. A conversion experience is needed to see how ordinary actions unintentionally contribute to injustice and social sin, and how structures of sin lead to intentional decisions that would not otherwise be pursued. Catholic social teaching helps to provide a framework for thinking through some of the obligations of ordinary folks in the aftermath of the collective failure to protect children from abuse and the structural injustices that encouraged it to continue. Sexual abuse of minors by Catholic priests has been a persistent and widespread problem in the Church. Although more than 80 percent of victims have been boys, prior studies have rejected the idea that the abuse is related to homosexuality among priests. Available data show, however, that the proportion of homosexual men in the priesthood is correlated almost perfectly with the percentage of male victims and with the overall incidence of abuse. The sexual abuse of women and girls, such as sexual harassment, battery, varieties of rape, prostitution, and pornography, is statistically pervasive in late modern society. Yet this fact does not register adequate ethical concern. I explore this gap in moral perception. I argue that sexual abuse is conceptually supported by an ontology of women that considers a lack of bodily integrity as natural and by a sex-specific idea of freedom that considers sexual violations as (...) liberating. This conceptual framework is pernicious because it supports abuse and interferes with our moral perception of harm, encouraging us to see harms as normal and as positive. I argue that Heidegger’s idea of philosophy and the resources of his epistemological and ontological project in Being and Time can help show the pernicious function of this conceptual framework and thus help us better understand this abuse. While the Catholic Church has taken a number of steps to create a safe environment for children, its largely procedural approach to the sexual abuse crisis leaves a lot to be desired. If the Catholic Church wants to identify and counteract the elements that precipitated this crisis, it needs to enlist Catholic universities and parents, as universities possess the intellectual resources to understand the crisis in its full depth and breadth and parents are the most capable protectors of (...) children in the Catholic Church. Empowering these two constituencies and relying on them to lead child protection efforts represent the best chance to overcome a legacy of pain and distrust and to create a Church that is nurturing and safe for its children. Nurses and doctors who deal with human lives have started questioning their own decisions and practices particularly when there is an ethical dilemma. To survive competently within the profession and to make ethical decisions for the client’s safety, one needs to be equipped with knowledge pertaining to Bio-Ethics. This paper brings attention to a real life dilemma of a sixteen year old female child who had been sexually abused by one of her family friends. She insisted the school health nurse (...) to keep the information confidential, particularly from her parents. Consequently, the nurse had to confront a real dilemma regarding the disclosure of information to the parents of the victim. If the nurse respected the client’s autonomy to take her own decisions, then probably she may have put the client’s life at stake as she would not get any support, guidance and protection from further abuse. This paper will examine the role of health nurse or professionals in school setting for client safety. This paper documents the growing awareness of the sexual exploitation of women who seek help from priests and ministers. Over the six years that MACSAS has been in existence, 100 women and three men have contacted the organisation concerning sexual abuse as adults by clergy and ministers. Typically leaders of Christian denominations to whom they have reported this abuse characterise it as 'an affair' and often blame women for seducing male clergy. Drawing from literature on the (...) sexual abuse of clients by professionals, this paper vigorously calls for clergy and ministers to be regarded as professionals and for women and men who seek the pastoral help of clergy to be viewed as clients. Concepts of 'vulnerability' and 'consent' are also explored in order to clarify the nature of clergy abuse. (shrink)

This article illustrates the practical usefulness of transdisciplinary work for practical theology by showing how input from an occupational therapist informed my understanding and interpretation of the story of Hannetjie, who had been sexually abused as a child. This forms part of a narrative practical theological research project into the spirituality of female adult survivors of childhood sexual abuse. Transdisciplinary work is useful to practical theologians, as it opens possibilities for learning about matters pastors have to face, but (...) may not have knowledge about. A short retelling of Hannetjie’s story is given to provide information about the context of the research. Next, the transdisciplinary process that was followed is mentioned, and the questions that the transdisciplinary team had to respond to are discussed. Following that, I focus more specifically on the occupational therapist’s answers, and the knowledge gained from her contribution, as an example of how a co-researcher from a divergent discipline can inform a theological study. In this case, knowledge was shared about sensory integration and how the brain processes traumatic stimuli, such as sexual abuse. Lastly, the interrelationship between Hannetjie’s body stories, mind stories and spirit stories is discussed to show how the learning received from occupational therapy affected my thinking about Hannetjie’s stories and the relationships between them. Thus, it is concluded that transdisciplinary work has great value for practical theology, especially in the pastor’s daily work with people who are struggling with difficult stories, because we cannot listen to people’s spirit stories in isolation. In a recent issue of Feminist Review Camille Guy argued, focusing on selected controversies in New Zealand and Australia, that radical feminists have had a prescriptive hegemony in defining issues of sexual abuse, and that this has resulted in injustices and a censorious climate in which people who disagreed were too intimidated to speak out. This article replies to Guy's assertions and, while disagreeing with much of her argument, also suggests that it does point to more broadly sig-nificant (...) issues for feminists trying to analyse and oppose sexual violences at the end of the twentieth century. These include the legacy of the western feminist sex wars in a frequently polarized set of approaches to sexual abuse controversies, and the usefulness of postmodern/poststructuralist theories in helping feminists to make sense of the increasing complexities of the relationship between the mass media and feminist discourses against rape and child sexual abuse. The claimants brought civil suits against child care institutions and authorities for the sexual abuse to which they were subject whilst under the defendants’ responsibility. These cases were not initiated until the claimants were well into adulthood and began recognising the harms they had suffered, and as a result, their claims were time-barred at first instance. However, after A v Hoare (and Other Appeals), in which the House of Lords significantly altered the laws on limitation, their cases were (...) reheard and allowed to proceed. In this respect, AB and Others v Nugent Care Society; GR v Wirral MBC demonstrates the benefits of the ruling in Hoare; but at the same time, this note argues that the Court of Appeal utilises a problematic conceptualisation of the harm of sexual abuse and the case highlights the potential for inconsistency and uncertainty in such delayed claims following the decision in Hoare—which is not the panacea it initially appears to be. Objective: The aim of the current study was to investigate associations, unique and interactive, between mothers’ and children’s histories of childhood sexual abuse (CSA) and children’s psychiatric outcomes using an intergenerational perspective. Further, we were particularly interested in examining whether maternal reflective functioning about their own trauma (T-RF) was associated with lower likelihood of children’s abuse exposure (among children of CSA-exposed mothers). Method: One hundred and eleven children (Mage= 9.53 years; 43 sexual abuse victims) and (...) their mothers (Mage= 37.99; 63 sexual abuse victims) participated in this study. Mothers completed the Parent Development Interview (PDI), which yielded assessments of RF regarding their own experiences of abuse, and also reported on their children’s internalizing and externalizing symptoms. Results: Children of CSA-exposed mothers were more likely to have experienced CSA. A key result was that among CSA-exposed mothers, higher maternal T-RF regarding their own abuse was associated with lower likelihood of child CSA-exposure. Mothers’ and children’s CSA histories predicted children’s internalizing and externalizing symptoms, such that CSA exposure for mother or child was associated with greater symptomatology in children. Conclusions: The findings show that the presence of either maternal or child CSA is associated with more child psychological difficulties. Importantly in terms of identifying potential protective factors, maternal T-RF is associated with lower likelihood of CSA exposure in children of CSA-exposed mothers. We discuss these findings in the context of the need for treatments focusing on increasing Trauma - RF in mothers and children in the context of abuse to facilitate adaptation and reduce the intergenerational risk. The problem of false accusations of child sexual abuse requires explanation. Investigators uncritically accepted theories and techniques from mental health authorities because of our society's traditional faith in such "experts." The history of this development is reviewed, illustrating the confusion resulting from a blending of investigative and therapeutic roles. Similarly hasty acceptance of unsupported medical interpretations are also reviewed. Recommendatons for reform stress a separation of investigators from mental health ideology, as well as more responsible investigative techniques.

Solidarity is one of the primary principles of Catholic Social Teaching. Pope Francis invoked it and called for prayer and fasting in his August 20, 2018 letter addressing the sexual abuse scandal and attendant cover-up in the church. Offering some thoughts regarding what the duty of solidarity requires in light of the Catholic Church sexual abuse scandal and subsequent cover-up, this article suggests a number of concrete things that lay Catholics can do in claiming our place (...) as church. As a distortion of God's created designs, sexual abuse carries a unique devastation-factor. Abuse that is sexual in nature damages a spectrum of internal and external aspects of personhood. In particular, the core realities of: self-identity, community, and spiritual communion with God can be deeply fractured through SA. In light of the significance of the image of God, movement toward healing includes strengthening personal agency, processing profound boundary ruptures, and managing disillusionment with God. ABSTRACTThis paper examines in detail the quality of the relationship the Catholic Church in its Sydney Archdiocese had with its lawyers in the John Ellis matter as revealed in the Royal Commission into Institutional Responses to Child Sexual Abuse inquiry. It identifies the particular moral perspective embedded in its lawyers' adversarial approach and asks whether a different approach involving explicit moral conversations might have better served the Church's avowed pastoral ethos.

An anonymous vigilante attack by six women on an Auckland University lecturer in 1984 took place in the context of ongoing feminist reframing of rape and sexual abuse. Most feminists’ responses to this incident assumed the man's guilt and uncritically accepted the allegations made against him. This was not surprising in view of the prescriptive radical feminist hegemony that prevailed in New Zealand throughout the late 1970s and 1980s. Recent feminist writings on sexual harassment have been more (...) ready to grapple with the complexities and ambiguities of issues of sexuality and pedagogy – a shift that enables women to have a wider range of responses to unwanted sexual attention. Some of the earlier and problematic radical feminist notions about rape and sexual abuse have been absorbed into the treatment discourse, with some distressing consequences. In 1988 an over-zealous Christchurch doctor believed she had detected signs of sexual abuse in fifty-six children at a health camp. Her intervention resulted in some girls being removed from their families, even though they denied they had ever been abused. One New Zealand doctor, a pioneer in sexual abuse work in this country, has published a book documenting developments in this area, and expressing grave misgivings about over-intervention and false allegations of abuse. There are persistent attempts to discredit her concerns. However, there is a groundswell of public disquiet over some aspects of sexual abuse work, which cannot be dismissed as backlash. (shrink)

Soon there will be sex robots. The creation of such devices raises a host of social, legal and ethical questions. In this article, I focus in on one of them. What if these sex robots are deliberately designed and used to replicate acts of rape and child sexual abuse? Should the creation and use of such robots be criminalised, even if no person is harmed by the acts performed? I offer an argument for thinking that they should be. (...) The argument consists of two premises. The first claims that it can be a proper object of the criminal law to regulate wrongful conduct with no extrinsically harmful effects on others. The second claims that the use of robots that replicate acts of rape and child sexual abuse would be wrongful, even if such usage had no extrinsically harmful effects on others. I defend both premises of this argument and consider its implications for the criminal law. I do not offer a conclusive argument for criminalisation, nor would I wish to be interpreted as doing so; instead, I offer a tentative argument and a framework for future debate. The purpose of this study was to establish the personal impact that managing sexually abused learners had on primary school educators working in an East London (South Africa) community. In addition, the researchers sought to establish what support these educators felt they needed in order to help alleviate the personal impact that managing sexually abused learners might have on them.A phenomenological approach was employed to address the research questions. Using availability-sampling methods, four educators from a local primary school were interviewed (...) and the data systematically analysed in accordance with Morrisette’s (1999) seven–step procedural model.The present study confirmed the finding of Skinner (1999) and Mzamo (2003) that managing cases of sexually abused learners had a profound personal effect on the participants. What was most commonly felt was a sense of frustration with the justice system, as well as a sense of personal responsibility. In addition, the participants felt that they needed support structures to assist them in managing sexual abuse cases in the school. In particular, they felt that they needed a forum where they could share their own experiences and feelings, as well as receive guidance on how to deal with problems in their class. A need for more support from professional psychologists was also expressed, as well as a need for counselling skills training and general training in the area of child sexual abuse. It is hoped that these findings will prove useful in providing guidelines for the development of appropriate support structures for educators managing cases of child sexual abuse in South African schools. More research on the subject needs to be conducted within South Africa, however, in order to ensure that the support structures implemented address context-specific needs. (shrink)

Although there is now some recognition that sexual abuse, particularly that which occurs in religious settings, has spiritual implications for women who have been abused, the spiritual implications of sexual abuse which occurs beyond the confines of specific religious practices and beliefs tend not to be acknowledged. Taking a stance that all people, irrespective of their involvement in a formal religion, are inherently spiritual, this paper identifies the key concepts associated with spirituality as meaning, identity, connectedness, (...) transformation and transcendence. Examples as to how each of these may be issues following the experience of sexual abuse are provided. This approach challenges prevailing notions that sexual abuse only has spiritual implications for women who identify with a particular religious tradition. Instead it is argued that an experience of sexual abuse can be critical for the spiritual life of any woman who is subjected to abuse. (shrink)

Questions about when it is right for police forces to investigate alleged offences committed in the more or less distant past have become increasingly pressing. Recent widely publicized cases of child sexual abuse (CSA) and exploitation, sometimes involving high profile individuals, have illustrated the ethical, psychological, and forensic complexities of investigating non-recent child sexual abuse. Hannah Maslen and Colin Paine have developed the Oxford CSA Framework to assist police to weigh the various ethical considerations that militate (...) for and against initiating a CSA investigation. While such a tool is to be welcomed, and while there is much that is helpful in Maslen and Paine's approach, we suggest that the Oxford CSA framework could be strengthened. Our first suggestion is to abandon a proposed distinction between a set of considerations that is said to generate a “presumption” in favor of investigation and other considerations that may supplement or oppose this presumption. Our second suggestion is to review the weightings applied to the considerations within the model, which lack clear justification and create problematic effects. Finally, we suggest that referring the Oxford CSA Framework to a panel with lived and professional experience of CSA could serve important procedural justice goals and enhance the Framework's recommendations. In the last few years, many countries have introduced laws combating the phenomenon colloquially known as ‘revenge porn’. While new laws criminalising this practice represent a positive step forwards, the legislative response has been piecemeal and typically focuses only on the practices of vengeful ex-partners. Drawing on Liz Kelly’s pioneering work, we suggest that ‘revenge porn’ should be understood as just one form of a range of gendered, sexualised forms of abuse which have common characteristics, forming what we are (...) conceptualising as the ‘continuum of image-based sexual abuse’. Further, we argue that image-based sexual abuse is on a continuum with other forms of sexual violence. We suggest that this twin approach may enable a more comprehensive legislative and policy response that, in turn, will better reflect the harms to victim-survivors and lead to more appropriate and effective educative and preventative strategies. Non-recent (historic) childhood sexual abuse is an important issue to research, though often regarded as taboo and frequently met with caution, avoidance or even opposition from research ethics committees. Sensitive research, such as that which asks victim-survivors to recount experiences of abuse or harm, has the propensity to be emotionally challenging for both the participant and the researcher. However, most research suggests that any distress experienced is usually momentary and not of any clinical significance. Moreover, this type (...) of research offers a platform for voices which have often been silenced, and many participants report the cathartic effect of recounting their experiences in a safe, non-judgemental space. With regard to the course of such research, lines of inquiry which ask adult participants to discuss their experiences of childhood sexual abuse may result in a first-time disclosure of that abuse by the victim-survivor to the researcher. Guidance about how researchers should respond to first-time disclosure is lacking. In this article, we discuss our response to one research ethics committee which had suggested that for a qualitative study for which we were seeking ethical approval (investigating experiences of pregnancy and childbirth having previously survived childhood sexual abuse), any disclosure of non-recent (historic) childhood sexual abuse which had not been previously reported would result in the researcher being obliged to report it to relevant authorities. We assess this to be inconsistent with both law and professional guidance in the United Kingdom; and provide information and recommendations for researchers and research ethics committees to consider. Child sexual abuse is a global phenomenon that affects many families and appears to be increasing dramatically in South Africa. The literature on child sexual abuse focuses mainly on the victims and perpetrators while largely ignoring the experiences of non-offending mothers. The objective of this study was to explore the lived experiences of mothers whose children were sexually abused by their intimate male partners. Existential phenomenology was employed in the study, and Braun and Clarke’s six-phase thematic (...) analysis was used to analyse the data. The results indicate that the participants experienced emotions similar to those following loss including disbelief, anger, guilt, depression, trust and blame. (shrink)

As the suspect interview is one of the key elements of a police investigation, it has received a great deal of merited attention from the scientific community. However, suspect interviews in child sexual abuse investigations is an understudied research area. In the present mixed-methods study, we examine Swedish and Norwegian police interviewers' self-reported goals, tactics, and emotional experiences when conducting interviews with suspected CSA offenders. The quantitative analyses found associations between the interviewers' self-reported goals, tactics, and emotions during (...) these types of suspect interviews. Interviewers who reported experiencing more negative emotions were more likely to employ confrontational tactics. Specifically, anger was positively associated with the goal of obtaining a confession and with aggressive tactics like raising one's voice and emphasizing the seriousness of the crime. Frustration and disgust displayed similar patterns. Somewhat contrasting these quantitative results, the thematic analysis identified a strong consensus that emotions should not and do not affect the police interviewers' work. Furthermore, the police interviewers described a range of strategies for managing emotions during the interview and for processing their emotional reactions afterwards. The present findings highlight the relevance of emotional processes in CSA suspect interviews and provide an initial exploration of the potentially complex relationship between the goals, tactics, and emotional experiences of police interviewers who question CSA suspects. Due to evidence that traumatic experience impacts the brain, the body (concerning sensory sensitivity), and the mind, a recent study that attempted to answer the question of whether the effects of CSA can be reversed by using a multidisciplinary approach consisting of dual treatments: hyperbaric & psychotherapy, was conducted. Its results showed that in addition to improvement of brain functionality, symptoms of distress were significantly reduced. The current paper aims to present the process as experienced by the 40 female childhood (...) sexual abuse survivor participants. Data included participants’ daily journals and drawings, and participants’ summaries presented verbally and written, 6-months after the study ended. A phenomenological analysis was used. Results showed three phases, the initial phase – remembering the trauma from both physical and cognitive aspects, the second phase - physiological relaxation as well as positive memories emerge; and, the third phase – bouncing back to life. The results are discussed in light of the study theoretical model and Lev-Wiesel (2014) childhood sexual abuse conceptualization. (shrink)
