This paper is concerned with what I believe is the epistemological mission of Kant’s doctrine of taste. The third Critique inherits two problems from the first. The evident one is that the categorial constitution of nature must be complemented with the notion of purposiveness. The less evident one is that the transcendental theory of experience needs a common sense in order to secure a common objectivity. The judgment of taste, conceived of by Kant as a ‘cognition in general’ not restricted (...) to either the particular subject or the particular object, offers a solution. It turns out to be a judgment that cannot be made without assuming the purposiveness of nature and the uniformity of the cognizing subjects. (shrink)

This paper explores the meaning of the word “felony” in thirteenth and fourteenth century England, i.e., during the first two centuries of the English criminal trial jury. To compile a working definition of felony, the paper presents examples of the language of felony drawn from literary and religious sources, in addition to considering the word’s more formulaic appearance in legal records. The paper then analyzes cases ending in acquittal or pardon, highlighting the factors that might take a criminal case out (...) of the realm of felony. It suggests that the very definition of felony and felonious behavior—and thus the essence of criminal responsibility—may be bound up with the idea of mens rea during this period. The paper aims to uncover broader societal understandings of the nature of guilt and innocence, and to highlight connections and disconnections between the formal criminal law of felony, with its heavy emphasis on capital punishment, and popular and ecclesiastical understandings of culpability. The historiographic tradition of the history of science that originated with Auguste Comte bears all the marks of narratives with roots in the Enlightenment, such as a view of religion as an underdeveloped stage in the ascending road in humanity's quest for a more mature understanding. This article explores the development of the peripheral branch of a tradition that developed in Argentina by the mid‐twentieth century with authors such as the Italians Aldo Mieli, José Babini, and the Hungarian Desiderius (...) class='Hi'>Papp. It is argued that, contrary to the historiographic program of the conflict thesis developed in English‐speaking countries, those scholars who cultivated the kind of “positivist” history of science that thrived in continental Europe were inclined to see science as a social and epistemological replacement of a fossilized religious outlook. In the final section, I suggest a way to relate the more or less strong versions of the conflict thesis to different patterns of secularization. (shrink)

For some years now, an opposition has been drawn, not only among Israeli academics but among politicians and journalists as well, between Jewish nationalist or Zionist thought and the kind of thinking that is called “postmodern.” The argument is that a Zionist cannot be a postmodernist and vice versa, the two being incompatible. It appears that this opposition originated with an identification made between “post-Zionist” historical revisionism (of the kind associated with Ilan Pappe, Benny Morris, Avi Shlaim, Simha Flapan, and (...) Tom Segev) and postmodernist methods, assumptions, and claims. In some cases, the identification was made by the “new historians” themselves. While there is considerable bad blood between post-Zionist scholars and those, inside and outside the academy, who defend one or another version of the Zionist narrative, it needs to be demonstrated that postmodernism has nothing to do with their adversarial relations. The effort of this article is to show that, even before postmodernism was heard of, nationalist thinkers such as Rabbi A. I. H. Kook (1865 – 1935), Rabbi M. A. Amiel (1883 – 1946), Rabbi Abraham Hazan (1920 – 2003), and Professor André Neher (1914 – 1988) mounted Zionist arguments of a sort that we now regard as poststructuralist or postmodern. (shrink)
