Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

Previous studies in Western contexts have examined the relationships between various board characteristics and CSR, yet the relationships need to be re-examined in non-Western contexts given differential theoretical premises across contexts. We specifically propose that the effects of board characteristics on CSR in Korea should be patterned distinctively from Western-based existing literature, focusing on three important board characteristics, such as a board’s independence, social ties, and diversity. Using a panel dataset from large Korean firms, we found that various relationships between (...) board characteristics and CSR were non-linear, whereas most of the previous research on Western contexts found that the same relationships were linear. Specifically, curvilinear relationships were found between CSR and board independence, CEO-outside director social ties, and educational diversity. Our findings suggest that there is no universal feature of CSR-supportive board characteristics due to the unique characteristics of various institutional contexts. (shrink)

In the age of digitalization, social media has played a significant role in quickly spreading the news about current affairs. From December 2019 to now, coronavirus disease 2019, with its several mutated shapes, has more transmissible potential catastrophe and has become a severe phenomenon issue worldwide. The international spread of the epidemic has created fear among people, especially employees working physically in different organizations. The present research aimed to measure the impact of social media on its users in the China. (...) The social media users more often were influenced by shocking news instructively and destructively. The research analysis was based on service sector employees and data collected from 630 respondents via a structured questionnaire. This research was confirmed the negative impact of fear on social media on the performance of employees. This research was also confirmed the moderation impact of the COVID-19 vaccine on the relationship between social media fear and employee performance. This research recommends that the China Censor Board checked the news and its validity to reduce the fear of COVID-19 among employees. This research will become a roadmap for organizations and media controllers to understand the impact of social media during an intense situation. The telecommunication sector will reduce psychological disease and enhance the work capability of employees by controlling unnecessary and unapproved material about sensitive issues. (shrink)

Ibn Wasil (d. 1298), perhaps better known today as a historian and an emissary to the court of King Manfred in southern Italy, was also an eminent logician. The present work is a critical edition of his main work in the field, a commentary on his teacher Khunaji's (d. 1248) handbook al-Jumal. The work helped consolidate the logic of the "later scholars" (such as Khunaji). It also shows that commentators did much more than merely explain the original work and instead (...) regularly discussed and assessed received views. Ibn Wasil's work was an influential contribution to a particularly dynamic chapter in the history of Arabic logic. (shrink)

Creativity in accordance with an ideal, the shaping of natural materials in accordance with an ideal, constitute a specifically human form of life-activity distinguishing it from the activity of animals. As a universal aspect of goal-directed activity, the ideal appears in all spheres of the life of society: social, political, moral, esthetic, etc. The category of the ideal (...) has profound social meaning. Over the centuries, progressive classes have, in the struggle against outdated forms of societal relations, embodied their enthusiasm in the high ideals of liberty, equality, and fraternity. In our day, the ideal of the laboring masses of the entire world is communism, the building of a communist society, which is being effectuated in the USSR. "Each new step toward the shining peaks of communism," states the CPSU Program, "inspires the laboring masses of all countries, and constitutes vast moral support in the struggle for the liberation of all peoples from social and national oppression, accelerates the triumph of the ideas of Marxism-Leninism on a world scale". For that reason it seems necessary to me to list the points on which neither I nor, as I understand it, F. T. Mikhailov desires to take issue with the author of "Brain and Mind," because on these matters (...) we are entirely in agreement with him. To proceed in this fashion is necessary not for the sake of academic courtesy, but precisely in order to denote more clearly the actual points of difference between our positions, and then to let the reader decide which path he prefers.
