Wprowadzenie. U podstaw syntezy wiedzy.

How to Deter Financial Misconduct if Crime Pays?Karol Marek Klimczak, Alejo José G. Sison, Maria Prats & Maximilian B. Torres - 2022 - Journal of Business Ethics 179 (1):205-222.
Financial misconduct has come into the spotlight in recent years, causing market regulators to increase the reach and severity of interventions. We show that at times the economic benefits of illicit financial activity outweigh the costs of litigation. We illustrate our argument with data from the US Securities and Exchanges Commission and a case of investment misconduct. From the neoclassical economic paradigm, which follows utilitarian thinking, it is rational to engage in misconduct. Still, the majority of professionals refrain from misconduct, (...)

The Ethical Crisis in Microfinance: Issues, Findings, and Implications.Marek Hudon & Joakim Sandberg - 2013 - Business Ethics Quarterly 23 (4):561-589.
ABSTRACT:Microfinance is often assumed to be an ethically progressive industry, but in recent years it has been the target of much ethical criticism. Microfinance institutions have been accused of using exploitative lending techniques and charging usurious interest rates; and critics even question the ability of microfinance to alleviate poverty. This article reviews recent research on the microfinance sector that addresses these ethical issues. We show how this research is relevant to a number of theoretical issues, such as how to define (...)

Fairness and microcredit interest rates: from Rawlsian principles of justice to the distribution of the bargaining range.Marek Hudon & Arvind Ashta - 2013 - Business Ethics, the Environment and Responsibility 22 (3):277-291.
This paper addresses the fairness of microcredit interest rates. Since microfinance institutions provide credit for the poor at relatively high prices, the fairness of their interest rates has been repeatedly debated. We first apply Rawls' principles of justice to the case of microcredit interest rates and suggest some limitations related to the hypothesis of rationality of the borrowers and the level of inequality. We then suggest another framework based on the analysis of the distribution of the benefits generated by the (...)

    Should Access to Credit be a Right?Marek Hudon - 2009 - Journal of Business Ethics 84 (1):17-28.
Discussion on financial ethics increasingly includes the problem of exclusion of the poorer segments of society from the financial system and access to credit. This paper explores the ethical dimensions surrounding the concept of a human right to credit. If access to credit is directly instrumental to economic development, poverty reduction and the improved welfare of all citizens, then one can proclaim, as Nobel Prize Laureate M. Yunus has done, that it is a moral necessity to establish credit as a (...)

A Study of Codes of Ethics for Mexican Microfinance Institutions.Lauren Kleynjans & Marek Hudon - 2016 - Journal of Business Ethics 134 (3):397-412.
Most scholarly interest in codes of ethics or conduct has focused on traditional companies. Little is known about the codes of social enterprises or hybrid organizations such as microfinance institutions. Our paper provides a comparative case study of the codes of a Mexican microfinance network and seven MFIs. Using the corporate integrity model, we analyze the content of MFIs’ codes compared to those of traditional organizations. We then examine to what extent some specific features of MFIs such as their mission, (...)

What is a Fair Level of Profit for Social Enterprise? Insights from Microfinance.Marek Hudon, Marc Labie & Patrick Reichert - 2020 - Journal of Business Ethics 162 (3):627-644.
Although microfinance organizations are generally considered as inherently ethical, recent events have challenged the legitimacy of the sector. High interest rates and the excessive profitability of some market leaders have raised the question of how to define a fair profit level for social enterprise. In this article, we construct a fair profit framework based on four dimensions: profitability, social mission, pricing, and surplus distribution. We then apply this framework using an empirical sample of 496 microfinance institutions. Results indicate that satisfying (...)

The historical resources of China’s model: Relevance to the present.Marek Hrubec - 2020 - Human Affairs 30 (2):134-145.
The article focuses on the historical resources of the China’s model. Understanding the model is one of necessary preconditions of an analysis of China’s dynamic rise and development in recent decades. First, the article analyses the concept of historical development of multiple civilisations and modernities. It then examines the characteristics of China’s old civilisation and the associated model. It ends by showing how the historical Silk Road lives on in an updated modernised global version.

The article deals with the theme of updating of Cuba’s economic model mainly from the perspective of economic and political philosophy and its interdisciplinary contexts. First, it examines the historical origins of Cuba’s socialist model and the subsequent changes after the fall of the Eastern Bloc. Second, it analyses the actualization of Cuba’s model in the first two decades of the 21st century, that is, mainly the introduction of market and private ownership to complement planning and public ownership. On Conditions of Participation: The Deficits of Public Reason The paper analyzes the conditions of civic participation that are elucidated by criticism of the deficits of public reason. The interpretation proceeds in three steps. First, the idea of public reason and discourse is analyzed, followed by an explanation of democratic deficit and of the social deficit in the second and third steps, respectively. These deficits are analyzed as an essential limit to political and social conditions of the participation of citizens. (...)

The aim of this paper is very modest. First, we want to assess how different strategies of naturalization might deal with the need of using folk psychology in legal domain. Second, we want to check whether folk psychology is indeed indispensable in the legal domain. Third, we want to describe possible problems with one strategy of naturalization, i.e. radical naturalization with classical elimination. Our conclusion will be that despite various attempts, every project of naturalization of law will have to resolve (...)

Nudge Theory and Legal Protection of Whistleblowers.Marek Jakubiec - 2023 - Studies in Logic, Grammar and Rhetoric 68 (1):555-571.
The issue of whistleblower protection has been gaining more attention in recent years, especially after the passing of Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019 on the protection of persons who report breaches of Union law. However, there is a fundamental question as to whether the regulations are sufficient to provide real protection for whistleblowers in organizations. In this regard, it seems crucial that the various actors (legislators, managers, employees) work together to (...)

The abstract Everyone who gets to know deeper with the Nietzsche philosophy is forced to think about a mutual relationship of a culture and a biology. The main problem to correct show of above relationships is the understanding of the meaning of a language with reference to the culture and the biology. Considerations which are represented here are inspired by the Nietzsche philosophy. They are split by three parts. In the first part there is shown the meaning of the language (...)

This article was written on the occasion of the 100th anniversary of the Institute for Social Research in Frankfurt am Main, where the Frankfurt School was founded and continues to evolve. From philosophical and interdisciplinary perspectives, the article focuses on the trichotomic characteristics of critical theory, specifically: critique, explanation, and normativity. It looks first at the founding of the Institute for Social Research; second, at the emergence of critical theory at the Institute; and third, at how these ideas evolved. It (...)

It articulates of an extra-territorial recognition of right-holders by means of the development of a philosophical theory of recognition on the global level. It examines contemporary possibilities of extra-territorial recognition that are bound to the nation-states hitherto. This paper uses a game-theoretic framework to formalize the Hayekian notion of equilibrium as the compatibility of plans. To do so, it imposes more structure on the conventional model of strategic games. For each player, it introduces goals, goal-oriented strategies, and the goals’ probabilities of success, from which players’ payoffs are derived. The differences between the compatibility of plans and Nash equilibrium are identified and discussed. Furthermore, it is shown that the notion of compatibility of plans, in general, differs from (...)

Nash meets Samuelson: the comparative-statics interpretation of Nash equilibrium.Marek Hudik - 2022 - Journal of Economic Methodology 30 (2):122-134.
This paper suggests that Nash equilibrium can be interpreted as a conceptual tool for addressing comparative-statics issues on an aggregate level. Together with additional assumptions, Nash equilibrium helps generate testable predictions about changes or differences of behavior induced by changes or differences of exogenous variables. However, Nash-equilibrium behavior, as such, is not subject to empirical testing. Instead, widespread and persistent behavior is modeled as a Nash equilibrium by assumption. The paper argues that this interpretation is in line with the traditional (...)

The character of norms is a relevant issue in the contemporary legal philosophy and in the metaethics. The analysis of Lewis’ sugguestions concerning the fictional statements (sentences “describing” the fiction) prima facie may seem to be useless from the perspective of law. However, the situation is different, due to the fact that it is possible to treat the legal text as the description of possible world. The issue is analyzed in the paper.

The primary purpose of the paper is to present the issue of extrapolation, which is interesting from the perspective of contemporary philosophy of science. For its proper explanation, it is crucial to distinguish it from terms of similar meaning, such as analogy, induction or statistical inference. The second goal is to indicate key differences that exist between extrapolative inference and analogical reasoning. Because of this the ascertaining of the identification of these concepts would be a mistake though, of course, there (...)
