The purpose of this paper is to assess the emergence of the pirate movements in the European Union. Our goal is to sketch the steps towards a research agenda for this grassroots political movement which gained momentum since 2009. To attain our goal we showed the re-signification of the concept of piracy in the debate around intellectual property and its institutional settlement. Afterwards we analysed the big political themes of several European Pirate Parties and their struggle to follow (...) the preferences of the median voter. We concluded with a set of hypotheses of which the most important is that the pirates will inscribe neither to the left nor to the right part of the political spectrum. (shrink)

The ongoing expansion of new communication technologies is inseparably linked to the transformation of political communication. The new thinking behind communication is embedded directly in the code of popular social networks. Can a formal political party successfully implement a decentralized mode of communication based on personal connections and weak social ties, or is it against the very logic of both the hierarchical organizations and the technology itself? Our case study describes the vast spectrum of various types of behavior of (...) political actors on Twitter through computer-assisted analysis of Twitter communication in Czech Republic before the elections to the European Parliament in May 2014. The research is based on the concept of connective action, as defined by Bennett and Segerberg. Preliminary results show an emerging typology of campaign strategies, from formal and centralized campaigns on one hand to various hybrid overlaps of traditional and new forms of communication on the other. The attacks on commercial shipping vessels by Somali pirates have introduced a business dilemma for ship-owners. While maritime piracy has been outlawed by the United Nations Convention on the Law of the Sea, ship-owners must determine whether to pay ransom demands to Somali pirates or not. There is no easy answer to solve this ethical dilemma for ship-owners and other interest groups, however, this article proposes a solution which takes into account all of the parties involved.

Much of today’s geopolitical conflict is taking place online, carried out in significant measure by volunteers, even as governments seek to emphasize information technology cooperation. Computational social scientists have discovered multiple online environments in which to collect relevant statistical data, including Wikipedia pageviews, archives of government research grant abstracts, and behavior in massively multiplayer online war games. Three very different examples of the dynamics of collaboration and conflict provide alternative perspectives: (1) the Pirate Parties that seem to have been (...) an overly ambitious attempt to transform democracy in the Information Age, (2) citizen science that had some success attracting volunteers to donate labor to academic research projects, but generally avoided controversial research projects in areas such as human conflict, and (3) a genre of online role-playing games that emphasized spontaneous organization of volunteer armies to develop skills and resources for victory. Without claiming to offer strict rules for success, this article considers the organizational structures and practical methodologies that might be adapted for achievement of goals by ethical social movements. Ce texte traite de piratage en ligne à travers la pratique du peer-to-peer au Québec, c’est-à-dire une forme d’échange non autorisé de produits culturels sur Internet (pratique appelée « piratage culturel »). Une approche strictement juridique de la pratique y voit un simple détournement de copyright, tandis que d’autres approches (mouvement Copyleft, Parti pirate, etc.) postulent qu’un gain social est généré par une telle circulation de l’information à grande échelle. Peu de recherches empiriques ont documenté toutefois les contenus circulant (...) réellement dans ces réseaux de piratage culturel. Une première étude canadienne utilisant l’observation directe amène donc un éclairage nouveau. L’étude montre que le peer-to-peer est régulièrement utilisé au Québec pour transmettre des œuvres du patrimoine national (musique, films, livres, émissions de télévision, etc.), dont plusieurs sont non disponibles autrement. Cela suggère que le piratage culturel ne se limite pas à l’acquisition gratuite ou au « vol » de produits culturels (plusieurs produits n’existent pas en magasin), ni ne dessert en soi la diversité culturelle (des produits québécois y sont largement échangés). La réflexion éthique sur le phénomène se situe dès lors sur deux plans : au plan individuel (avec l’ethos des « pirates ») et au plan collectif (avec le rôle du piratage culturel dans la circulation du patrimoine québécois). Enfin, la pratique pourrait contribuer à la constitution et à la circulation d’archives nationales accessibles sur Internet, dans le contexte d’une migration généralisée des produits culturels du format physique au format numérique. Bayle and I "erroneously" take this text to be Saint-Evremond's, it is certain that Lennon erroneously takes it to be Sarasin's. In fact, the text quoted by Bayle is not taken from Sarasin's Discours sur Epicure, but, as Bayle explicitly points out ("Xénophanes," K, note 124), from a "Discours des ennuis et des déplaisirs." This "Discours" is chapter 5 of De l'usage de la vie, a text published in many editions of Saint-Evremond's works (see the Barbin 1692 in-4° ed., Seconde Partie, p. 326). The paternity of De l'usage de la vie is doubtful and controversial, but it possibly contains some passages taken from Saint-Evremond's unpublished manuscripts, especially in chapters 3-6, as reported by an important source quoted by Ternois in Saint-Evremond, Œuvres en prose, IV, 3-4, note 1.2) Lennon's text (pp. 338-39): "The significance of two of the other texts advanced by Mori is fully vitiated, for in them Bayle makes the same mistake."In my article, I did not fail to state that these texts (OD I, 158 and Dict., "Epicure," M) are taken from an apocryphal source. On page 329 I wrote: "[Bayle] mistakenly attributes to [Saint-Evremond] a text on Epicurus's morals [i.e., Sarasin's Discours] included in that volume." However, it was absolutely impossible, for seventeenth-century readers, to distinguish between Saint-Evremond's original and apocryphal texts: the author himself—as is widely known—did not want to clarify this point (with a few exceptions, including the Saint-Evremoniana, which, as we have seen, Bayle never attributed to Saint-Evremond). This article investigates the formal purpose of declaring wars for Hugo Grotius. Grotius was adamant that states always use justification in a duplicitous way to conceal their real motivation to go to war. As such, the purpose of declaration is not to assert the just cause of war. Rather, what any public declaration does, is provide recognition that confers legal validation to the disputing parties. The legal rules of war were described by the law of nations and occasionally permitted states (...) to commit certain ‘war crimes’ with impunity. For Grotius, this was not a moral sanctioning of such crimes but rather a means to prevent the occurrence of wars, which such endless repudiations risked causing or exacerbating. Grotius’s concern for the effects of war is conspicuous; and recounting his maxim that war should always be a last resort, this article argues that declaration of war has a distinct moral purpose for Grotius. In fact, public declaration of war is, together with constraints on the conduct of war, a ‘principle of moderation’ Grotius insists should be upheld in times of war. Declaration of war gives the parties avenues to seek peace and reconciliation, and, therefore has a humanitarian purpose for Grotius by ultimately seeking to prevent the disparaging effects of war. Even in wars that do not demand a public declaration, such as those regulated by natural law such as punitive wars or defensive wars, Grotius cautions that declarations of war are advisable. The remaining lingering issue is how to engage with unlawful enemy combatants, such as pirates - a distinct problem that the international community still faces with increasing regularity. Grotius was certainly aware of the legal consequences of recognising belligerency we cannot possible hope to build moral relations with, and, this article claims, ‘unlawful’ enemies ultimately demarcates the boundary of international society. A few years ago, I found myself sitting next to a renowned Language poet at a poetry reading in a crowded downtown Manhattan venue. A longtime fan, I introduced myself and shared with him that I had just taught some of his infamously challenging poems in a poetry class at Tel Aviv University and that students were very responsive. When I mentioned that it was hard to get hold of some of his books but that we had found the poems (...) online, he told me how glad he was that, thanks to the internet, his work is accessible in Tel Aviv and everywhere else. Unable to resist the temptation to play language games with a Language poet, I responded by saying that his work was actually far from accessible. This pun/paradox seems to me to apply as well to the online archive UbuWeb—a “pirate library consisting of hundreds of thousands of freely downloadable avant-garde artifacts.” Founded in 1996, UbuWeb provides access to cultural artifacts in the form of video, text, and sound, works that are difficult to access not just because they are obscure, forgotten, unknown, rare, out of print, or otherwise hard to find, but because, as avant-garde, part of their operation involves, let us say, problematizing accessibility.UbuWeb's story is the subject of Duchamp Is My Lawyer, an accessible memoir/manifesto, deftly written by its founder and near-sole operator, the luminary conceptual artist Kenneth Goldsmith (“UbuWeb is mostly just me”). Its title, which Goldsmith takes from Virgil Abloh, raises at least two questions: Why does Ubu need a metaphorical lawyer, and why would Duchamp fill the bill? The first question has to do with the precarious legality of the website, which, as Goldsmith tells us in detail, almost never asks for permission from copyright holders, uploading materials first and dealing with consequences later. Much of the book deals with the maneuvering involved with “hiding in plain sight”—interpreting “fair use” broadly, and standing up to scary-sounding cease-and-desist letters that sometimes come from parties who are not even the actual rights holders of the material. Instead of playing the game of compliance, Ubu partakes in an anti-capitalist, free-for-all gift economy, never paying or asking for payment for the priceless treasures it houses. The democratic vision seeps into the selection and organization of the material on the website, which throughout the book Goldsmith describes as boundary-blurring, jumbled, unstable, biased, subjective, incomplete, fluid, idiosyncratic, and nonhierarchical.But again, why Duchamp? Ushering in an entire avant-garde tradition that Ubu celebrates, archives, and manifests in its own rebellious, outlaw spirit of operation, Duchamp, a hero in the book and, presumably, for its author, functions as both precedent and justification. After all, Ubu duplicates what Duchamp did in his most famous artistic intervention: the repurposing of found objects. In that sense, as Goldsmith writes, “UbuWeb can be considered one enormous appropriative artwork, a giant collage, which appropriates not a single object but rather the entire history of the avant-garde.” While the word entire is perhaps a stretch (and inconsistent with Goldsmith's many descriptions of the site's collection as inevitably partial and subjective), UbuWeb is best appreciated, I think, as a giant work of art made of works of art (some of which are themselves, in the tradition of “found art” and collage, made of works of art), a creative noncreation and akin to Goldsmith's own notion of “uncreative writing.” The radical accessibility it offers, from which so many users around the world continue to benefit, has thankfully not curtailed the equally radical inaccessibility of the material within. As a libertarian studying, embracing, and teaching a philosophy of individual freedom, John Hospers, like many of us, was heavily influenced by the philosophical writings of Ayn Rand. Rand’s major novels The Fountainhead and Atlas Shrugged continue to delight and empower readers through embracing the heroic creator or inventor, technological and scientific progress, and the competent individual. These are some of the archetypes of the Randian hero. At the other end of the scale were the incompetent looters and moochers who (...) could only function in her world by controlling those with ability and the savages of ancient or undeveloped cultures who could not comprehend ability, seizing the means of progress before killing the inventor, then retreating into mysticism and magic. Rand was not an archaeologist and wrote at a time before scholars of prehistory focused on the rational and productive aspects of ancient civilizations upon which enabled the present to emerge in fits and starts. These aspects include technology, record keeping, maritime trade, and pre- monetary economies. This paper will consider the emergence of globalized connectivites in the Mediterranean during the Late Bronze Age (ca. 1700-1300 BCE) which was arguably the first age of globalization in human history. It was also one of the first ages of social acceleration characterized by a confluence of increasing technological and economic interdependency, yet fragile in its susceptibility to climate change, plagues, and authoritarian city-states and small empires ruled by kings claiming divinity or divine authority. Thus, the Late Bronze Age was also an economically fragile era with a high concentration of wealth distributed among supra-regional global elite plutocrats unified more by wealth and shared symbolism than by cultural tradition or ideology. This era was susceptible to populist resistance in the form of piratical activity and banditry. This paper explores the globalist and populist aspects of the ancient Mediterranean. In doing so, I suggest that some globalized elites of the present day perpetuate another Randian archetype, the moochers and looters. In doing so, it transcends ideology to focus on how the non-productive in current society acquire vast concentrations of wealth and power. (shrink)

Feminist Policymaking in Turbulent Times offers a unique and timely reflection of the critical debates around the institutionalisation of feminist and gender-focused ideas and norms into policy. Many states and non-governmental organisations are increasingly invested in 'feminist policymaking' at the domestic and international levels. Yet, this liberal (feminist) agenda is also vastly disputed by critical, intersectional and decolonial voices on the one hand, and by anti-gender movements around the world on the other. Indeed, while opposition to 'gender ideology' is mounting (...) from reactionary, religious and secular forces, feminist policymaking is also being challenged in important ways from within. Thus, this book situates feminist policymaking in a challenging and 'turbulent', global context. This book explores feminist policymaking in multiple areas of policy, examining various gender-focused programmes that states and international organisations have undertaken in the last decade, offering critical interventions and rethinking the relationship between feminism and policy. The book not only reflects on the advances of feminist policymaking globally, but also critically assesses the intersectional challenges embedded within it and lying ahead. It moves the field forward by creating opportunities, based on lived experiences, for re-imagining the transformative potential of the nexus between feminism and policymaking. Interdisciplinary in scope and bringing to the fore the voices of both academics and practitioners, the book is the product of an international collaboration, forging links and dialogue that are increasingly necessary to question some of the exclusionary, militaristic and hierarchical assumptions of policymaking which is labelled as feminist. Feminist Policymaking in Turbulent Times will be of interest to all scholars, students and practitioners interested in the role of gender in policymaking and concerned with contestations around gender-focused projects. Consumers of software often face an acquisition-mode decision, namely whether to purchase or pirate that software. In terms of consumer welfare, consumers who pirate software may stand in opposition to those who purchase it. Marketers also face a decision whether to attempt to thwart that piracy or to ignore, if not encourage it as an aid to their software's diffusion, and policymakers face the decision whether to adopt interventionist policies, which are government-centric, or laissez faire policies, which are (...) marketer-centric. Here in order to assess the decision-making of all three of these stakeholders, we focus on the consumer's point-of-view as central and examine it by considering on a comparative basis the ethical dimension versus other dimensions, including economic, legal, and other salient consumer behavior considerations. Based on a survey of 689 software consumers conducted over the Internet, the results indicate that ethics as a factor is embedded in a multidimensional set of determinant factors influencing software piracy, including attitudes, legal aspects, social support, perceptions of economic loss and age. Policy and research implications, based on these findings, are provided. (shrink)

It has long been held that humans need government to impose social order on a chaotic, dangerous world. How, then, did early humans survive on the Serengeti Plain, surrounded by faster, stronger, and bigger predators in a harsh and forbidding environment? Pirates, Prisoners, and Lepers examines an array of natural experiments and accidents of human history to explore the fundamental nature of how human beings act when beyond the scope of the law. Pirates of the 1700s, the leper colony on (...) Molokai Island, prisoners of the Nazis, hippie communes of the 1970s, shipwreck and plane crash survivors, and many more diverse groups--all existed in the absence of formal rules, punishments, and hierarchies. Paul and Sarah Robinson draw on these real-life stories to suggest that humans are predisposed to be cooperative within limits. What these "communities" did and how they managed have dramatic implications for shaping our modern institutions. Should today's criminal justice system build on people's shared intuitions about justice? Or are we better off acknowledging this aspect of human nature but using law to temper it? Knowing the true nature of our human character and our innate ideas about justice offers a roadmap to a better society. (shrink)

A company of buccaneers invites comparison with states founded on the social contracts of Hobbes and Locke. These companies were formed by an explicit contract, the articles of agreement, and transgressors risked being marooned in a literal state of nature. Buccaneers were relatively powerful and their authority structure and share system was relatively democratic. The role of venture capitalists in organizing buccaneering may explain why parallels with Locke's social contract are particularly striking. Matthew Tindall attempted to exclude pirates and include (...) privateers in the social contract, but conceded that sufficiently powerful pirates themselves formed states. These comparisons highlight the problem of basing human rights on contract theory. (shrink)

As software piracy continues to be a threat to the growth of national and global economies, understanding why people continue to use pirated software and learning how to discourage the use of pirated software are urgent and important issues. In addition to applying the theory of planned behavior (TPB) perspective to capture behavioral intention to use pirated software, this paper considers perceived risk as a salient belief influencing attitude and intention toward using pirated software. Four perceived risk components related to (...) the use of pirated software (performance, social, prosecution and psychological risks) have been identified, measured and tested. Data were collected through an online survey of 305 participants. The results indicate that perceived prosecution risk has an impact on intention to use pirated software, and perceived psychological risk is a strong predictor of attitude toward using pirated software. In addition, attitude and perceived behavior control contribute significantly to the intended use of pirated software. However, the proposed direct relationship between subjective norm and intention to use pirated software is not supported. Implications for research and practice are discussed. (shrink)

Is there a political philosophy of conservatism? A history of the phenomenon written along sceptical lines casts doubt on the existence of a transhistorical doctrine, or even an enduring conservative outlook. The main typologies of conservatism uniformly trace its origins to opposition to the French Revolution. Accordingly, Edmund Burke is standardly singled out as the ‘father’ of this style of politics. Yet Burke was de facto an opposition Whig who devoted his career to assorted programmes of reform. In restoring Burke (...) to his original milieu, the argument presented here takes issue with 20th-century accounts of conservative ideology developed by such figures as Karl Mannheim, Klaus Epstein and Samuel Huntington. It argues that the idea of a conservative tradition is best seen as a belated construction, and that the notion of a univocal philosophy of conservatism is basically misconceived. (shrink)

I aim to develop an alternative theoretical model for the direct cognition of the elementary states of others called the theory of interaction (henceforth TI), also known as the “second person” approach. The model I propose emerges from a critical reformulation of the displaced perception model proposed by FRED DRETSKE (1995) for the introspective knowledge of our own mental states. Moreover, against Dretske, I argue that no meta-representation (second-order representation of a first-order representation as a representation) is involved in the (...) process, but only concepts, rudimentary enough, of others’ emotions: contentment and discontentment. Strictly speaking, all the empirical data and findings in developmental psychology only support the hypothesis that children in the pre-linguistic phase understand perceptual facial expressions of contentment and discontentment. My proposal consists of the following thesis: The direct perception of others' elementary mental states is not a perception in the usual sense of the word according to which we just perceive things, but rather a “perception of facts.” But how to understand that? It is nothing more than an epistemological process that is automatic and reliable at the same time. It is reliable in the epistemological-externalist sense of not involving any inference, reflection, theorizing or epistemic justification: a baby’s perception of her mom’s facial expression of discontentment (in the usual sense of “per- ception”) does not constitute a reason supporting the belief that mommy is discontent. The very word “belief” should not be understood in the usual sense but rather in the sense of a natural inclination for truth. But at the same time, it is automatic because the belief is a result or output of a process entirely subliminal and computational in nature. Thus, for instance, a child perceives that her mom is discontent (fact-awareness) by perceiving consciously (“perception” in the usual sense) a facial expression of discontentment (sensorial input) but recognizes that her mother is discontent as a result (output) of an entirely subliminal process. PurposeWith the rise of the internet, the act of sharing copyrighted material has received a lot of attention, culminating in a flood of lawsuits against file‐sharers as well as studies concerning the costs of file‐sharing for the entertainment industry. This paper attempts to judge whether file‐sharing really is an ethically problematic act and, upon achieving this, goes on to propose strategies to avoid file‐sharing and discuss ethical considerations surrounding those distribution alternatives.Design/methodology/approachThe paper limits its discussion to the medium of moving (...) images. It tries to achieve above aims by applying the ethics of Immanuel Kant to the phenomenon of file‐sharing on the internet and borrowing ideas for alternative, file‐sharing avoiding, strategies from practitioners and media commentators and applying Kant's ideas to those.FindingsThe paper argues that file‐sharing cannot, per se, be considered to be unethical. While file‐sharing has positive and negative aspects, the proposed alternative distribution strategies, a one‐stop shop and giving films away for free, seem to avoid the negative implications of file‐sharing while not impeding with its positive facets. The paper concludes that, since the suggested strategies exist but are not yet implemented by the commercial film industry, the moral responsibility for file‐sharing lies with the commercial film industry, not with the individual file‐sharer.Originality/valueThe paper hence adds to the discussions surrounding online files haring by shifting the focus towards the entertainment industry as well as by providing alternative, file‐sharing avoiding, distribution solutions.
