The issue of sex trafficking has become increasingly politicized in recent years due to the efforts of an influential moral crusade. This article examines the social construction of sex trafficking in the discourse of leading activists and organizations within the crusade, and concludes that the central claims are problematic, unsubstantiated, or demonstrably false. The analysis documents the increasing endorsement and institutionalization of crusade ideology in U.S. government policy and practice.

The essays in this volume blend historical and philosophical reflection with concern for contemporary political problems. They show that the causes and motivations of civil religion are a permanent fixture of the human condition, though some of its manifestations and proximate causes have shifted in an age of multiculturalism, religious toleration, and secularization.

Many people assume that the claims of scientists are objective truths. But historians, sociologists, and philosophers of science have long argued that scientific claims reflect the particular historical, cultural, and social context in which those claims were made. The nature of scientific knowledge is not absolute because it is influenced by the practice and perspective of human agents. Scientific Perspectivism argues that the acts of observing and theorizing are both perspectival, and this nature makes scientific knowledge contingent, as Thomas Kuhn (...) theorized forty years ago. Using the example of color vision in humans to illustrate how his theory of “perspectivism” works, Ronald N. Giere argues that colors do not actually exist in objects; rather, color is the result of an interaction between aspects of the world and the human visual system. Giere extends this argument into a general interpretation of human perception and, more controversially, to scientific observation, conjecturing that the output of scientific instruments is perspectival. Furthermore, complex scientific principles—such as Maxwell’s equations describing the behavior of both the electric and magnetic fields—make no claims about the world, but models based on those principles can be used to make claims about specific aspects of the world. Offering a solution to the most contentious debate in the philosophy of science over the past thirty years, Scientific Perspectivism will be of interest to anyone involved in the study of science. Debate over the nature of science has recently moved from the halls of academia into the public sphere, where it has taken shape as the "science wars." At issue is the question of whether scientific knowledge is objective and universal or socially mediated, whether scientific truths are independent of human values and beliefs. Ronald Giere is a philosopher of science who has been at the forefront of this debate from its inception, and Science without Laws offers a much-needed mediating (...) perspective on an increasingly volatile line of inquiry. Giere does not question the major findings of modern science: for example, that the universe is expanding or that inheritance is carried by DNA molecules with a double helical structure. But like many critics of modern science, he rejects the widespread notion of science--deriving ultimately from the Enlightenment--as a uniquely rational activity leading to the discovery of universal truths underlying all natural phenomena. In these highly readable essays, Giere argues that it is better to understand scientists as merely constructing more or less abstract models of limited aspects of the world. Such an understanding makes possible a resolution of the issues at stake in the science wars. The critics of science are seen to be correct in rejecting the Enlightenment idea of science, and its defenders are seen to be correct in insisting that science does produce genuine knowledge of the natural world. Giere is utterly persuasive in arguing that to criticize the Enlightenment ideal is not to criticize science itself, and that to defend science one need not defend the Enlightenment ideal. Science without Laws thus stakes out a middle ground in these debates by showing us how science can be better conceived in other ways. (shrink)

Aristotle's De Anima is the first systematic philosophical account of the soul, which serves to explain the functioning of all mortal living things. In his commentary, Ronald Polansky argues that the work is far more structured and systematic than previously supposed. He contends that Aristotle seeks a comprehensive understanding of the soul and its faculties. By closely tracing the unfolding of the many-layered argumentation and the way Aristotle fits his inquiry meticulously within his scheme of the sciences, Polansky answers (...) questions relating to the general definition of soul and the treatment of each of the soul's principal capacities: nutrition, sense perception, phantasia, intellect, and locomotion. The commentary sheds light on every section of the De Anima and the work as a unit. It offers a challenge to earlier and current interpretations of the relevance and meaning of Aristotle's highly influential treatise. (shrink)

In this paper I explore the extent to which a perspectival understanding of scientific knowledge supports forms of “scientific pluralism.” I will not initially attempt to formulate a general characterization of either perspectivism or scientific pluralism. I assume only that both are opposed to two extreme views. The one extreme is a (monistic) metaphysical realism according to which there is in principle one true and complete theory of everything. The other extreme is a constructivist relativism according to which scientific claims (...) about any reality beyond that of ordinary experience are merely social conventions. (shrink)

Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both insightful (...) and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making. Second, at a minimum it points out serious pitfalls for analytical or empirical studies of juridical proof. (shrink)

Despite both positive and negative perceptions of the current state of higher education, the contemporary debate over what it is to be a university is limited. Most of all, it is limited imaginatively. The range of imagined options is narrow. The imagination has not been given anything even approaching a wide scope. As a result, our sense as to what a university could be and could become in the modern age is itself impoverished. If we are seriously to develop a (...) wide range of ideas of the university that is adequate to the challenges of the modern world, the imagination itself needs to be freed. Imagining the University seeks to address each of these sets of issues and will do so by first, identifying a very wide range of ideas of the university as it is now unfolding and could become; secondly, by evaluating those conceptions of the university with a classification of ideas of the university; and thirdly, by reflecting on the imagination itself, its current impoverishment and its possibilities. Whether studying, researching or deciding policy, this book is vital reading to all those involved in the planning and delivery of higher education. (shrink)

Résumé L’une des théories les plus répandues concernant le rapport de l’art à l’éthique s’appelle parfois la Vicarious Experience Theory. Cette approche basée sur la notion d’une expérience par procuration va toutefois avoir du mal à expliquer la valeur (morale ou autre) de tout art « abstrait », non figuratif et/ou non narratif. Il faudrait alors démontrer que l’art (abstrait ou pas) provoque également une expérience directe – et non pas uniquement une expérience par procuration – et que cette expérience (...) directe est toujours déjà « métaéthique ». Cet effet méta-éthique serait inscrit au sein d’une définition (pragmatiste, pluraliste et institutionnelle) de l’art dans son ensemble, alors que la théorie de l’expérience par procuration s’appliquerait uniquement à quelques arts. Le concept d’authenticité sert de base à la valorisation de la thématique de « l’identité » qui domine aujourd’hui. Anish Kapoor présente toutes les garanties de cette « hybridité » actuellement très à la mode. Toutefois, il résiste explicitement à toute tentative de « mise en boîte » qui le cantonnerait à l’expression d’une quelconque « indianité ». Kapoor est connu pour l’aspect sensoriel et aléatoire de son travail. Shooting into the Corner est un excellent exemple d’une œuvre qui évacue (...) l’identification culturelle ; elle trouble par ailleurs les catégories goodmaniennes habituelles d’autographique et d’allographique. Son slogan – « Je n’ai rien à dire » – semble confirmer ce rejet de l’authenticité. Je compte démontrer que même l’aléatoire et l’auto-engendré sont reliés au critère d’authenticité, si cette notion repose sur l’intentionnalité et « l’intensionnalité » de l’œuvre d’art. Redéfini ainsi, le concept d’authenticité deviendrait une « règle constitutive » de notre institution. (shrink)

In a market place crowded with practical rhetoric books what educational value could a challenging work such as Kenneth Burke’s A Rhetoric of Motives possibly have? Burke knows but doesn’t use the terminology of the classical art and rather than analysing the persuasive rhetoric of well-known speeches to equip us with strategies, he weaves his way around literary texts, teasing out meanings that their authors something intended, sometimes did not. Yet, despite such difficulties, A Rhetoric of Motives is a practical (...) rhetoric book. It is just that its process of explication teaches us to think well. This essay tries to explain Burke’s rethinking of the purpose and contents of a traditional teaching tool—the rhetorical handbook—and defends the value of literary-rhetorical reading that aims to ‘equip’ citizens to think openly. This essay notes a resurgence of interest in rhetorical studies on the appeal of form, grounded in the work of rhetorical theorist Kenneth Burke. The essay argues that form is not only a way to structure discourses, it is a way to structure experience. Form is foundational in creating perceptions and thus experiences. Form is also highly rhetorical, in that how we structure our world carries social and ideological implications. The essay thus argues that an understanding of form as foundational (...) and rhetorical should be central to the educational curriculum. This way of understanding form is then a way of making rhetoric central to education in ways surpassing even the efforts of the ancient Greeks and Romans. A rhetorically centered curriculum based on teaching students how to understand form in their lives is empowering and liberating for students at the same time that it instills in them a strong awareness of ethics. This essay takes a rhetorical pragmatist perspective on current questions concerning educational goals and pedagogical practices. It begins by considering some challenges to rhetorical approaches to education, placing those challenges in the theoretical context of their posing. The essay then describes one current rhetorical approach—based on Kenneth Burke’s dramatism and logology—and uses it to understand and redescribe another rhetorical approach—Jesuit teaching of eloquentia perfecta. This introduction sets the stage for the Special Issue and the manuscripts that follow. Interest in work hours, work intensification and work addiction has grown over the past decade. Several factors have come together to increase hours spent at work, the nature of work itself, and motivations for working hard, particularly among managers and professionals. The introduction first reviews some of the known causes and consequences of long work hours and the intensification of work. A case is then made as (...) to why individuals, families, organizations and society should care about hours spent at work and work addiction. Individuals and organizations have some choice here. Most employees would in fact prefer to work fewer hours though few actually realize their preferences. This collection lays out these choices and hopefully encourages thought and discussion of their merits. Long work hours and work addiction harms individuals and their families and does not make organizations more effective. The introduction concludes with a brief summary of the diverse contributions of an international group of leading researchers in this area. (shrink)

An extremely important Jewish writer and thinker of the first century AD, Philo of Alexandria exercised through his ideas and language a lasting influence on the development and growth of Christianity in the New Testament period and later. This article addresses the implications of rapid and uncertain ecological change, and global climate change in particular, for reserve oriented and restoration oriented ecosystem management. I argue for the following conclusions: (1) rapid and uncertain ecological change undermines traditional justifications for reserve oriented and restoration oriented ecosystem management strategies; (2) it requires rethinking ecosystem management goals, not just developing novel strategies (such as assisted colonization) to accomplish traditional goals; (3) species preservation ought to be deemphasized as an ecosystem management goal; (...) Taking the reader behind the stage door, I discuss the playwright’s intentions for each act, paying special attention to the expected audience for the play as a whole. The result, therefore, supplements the review from the standpoint of the playwright.
