Atendiendo al título de esta mesa, deseo centrar mi presentación sobre el estado de la cuestión en algunas reflexiones hechas desde la filosofía sobre el pluralismo en la política y, más concretamente, sobre el pluralismo en el espacio o esfera de lo público político. Para ello, asumiré, aquí, varias cuestiones: en primer lugar, asumiré que en las sociedades contemporáneas (de una modernidad tardía o postmodernidad) tiene sentido seguir hablando de esferas diferentes y, concretamente, de la esfera pública como una esfera (...) distinta a la esfera privada; en segundo lugar, asumiré lo público político como el espacio en el que tienen lugar los asuntos comunes, aquellos que nos interesan como comunidad política, y respecto de los cuales conversamos, deliberamos, decidimos y actuamos en nuestra condición de agentes o actores políticos; y, en tercer lugar, asumiré también el espacio de lo público político como un espacio de aprendizajes distintos, entre ellos, aprendizajes morales, aprendizajes éticos y aprendizajes de virtudes políticas. RESUMEN Nunca más se refiere al intento de nombrar el horror y la atrocidad, como en el caso de Auschwitz o el "Nunca Más" del informe sobre la desaparición forzada durante la última dictadura en Argentina. Se sostiene que, al ser la violación sexual un acto atroz, la justicia transicional, entendida como la búsqueda de la no repetición de la atrocidad, estaría normativamente comprometida con su no repetición, al igual que lo está con la no repetición de la tortura o (...) de la desaparición forzada. ABSTRACT Never again refers to the attempt to name horror and atrocity, as in the case of Auschwitz, or the "Never Again" of the report on forced disappearances during the last dictatorship in Argentina. The article argues that because rape is an atrocious act, transitional justice, aimed at the non-repetition of any atrocity, would be normatively committed to its non-repetition, just as it is committed to the non-repetition of torture or forced disappearance. En aquest article pretenem fer una crítica, des de postulats ètics de caràcter republicà, al mode actual d’entendre i, per tant, posar en pràctica el principi d'autonomia de la bioètica. Pretenem mostrar que, en l’estat actual d’aplicació d'aquest principi, emprant una definició liberal de llibertat i de la natura humana, aquest idea de llibertat i autonomia que es pretén protegir, no es compleix en deixar fora de l’equació tot un seguit de circumstàncies socials, polítiques o econòmiques que poden dificultar al (...) pacient prendre una veritable decisió sobirana sobre quin ha de ser el fet d'actuar dels professionals sanitaris sobre el seu cos en cada cas. The archive of Gustav Shpet contains scattered preparatory materials for his “Lectures on the Theory of Cognition” and his major philosophical work History as a Problem of Logic. Some of these handwritten rough notes are devoted to Kant, indeed some of them have already seen the light of day in the “Kant­ian Journal” (2022, № 3). The notes published below continue to acquaint the reader with Shpet’s creative laboratory. His method of work with the concepts and ideas is instructive in (...) that it enables us to raise questions about the meaning of “positive critique”, its difference from Kant’s own “critical method” and why contemporary historical-philosophical attempts to actualise Kant’s concept of critique have more to do with Shpet’s rather than Kant’s methodology. Of particular relevance today is the authors’ attempt to immerse the Kantian understanding of critique in the context of Shpet’s phenomenologically oriented hermeneutic methodology. (shrink)

The occurrence of sport-related concussions (SRCs) has emerged as a significant health concern in professional sports, with millions of concussions occurring worldwide each year. Current return-to-play (RTP) protocols after SRCs involve a multi-disciplinary approach with growing interest in genetic testing technology. Numerous studies have indicated that the gene Apolipoprotein E4 (APOE4) holds promise as a predictive factor for developing diseases after concussions and other traumatic brain injuries. Nevertheless, there is an ongoing and contentious debate surrounding the impact of SRC genetic (...) testing on the RTP decision, encompassing concerns about the potential adverse effects on individual athletes, coaches, and even the whole sport community at large not in a small degree due to incidental findings. Hence, the purpose of this article is to explore the clinical and ethical components of SRCs genetic testing and its potential integration into RTP protocols by utilizing the ACCE framework to assess the validity, utility, and ethical aspects of SRCs. The new industrial paradigm Industry 4.0, or smart industry, is at the core of contemporary debates. The public debate on Industry 4.0 typically offers two main perspectives: the technological one and the one about industrial policies. On the contrary, the discussion on the social and organizational effects of the new paradigm is still underdeveloped. The article specifically examines this aspect, and analyzes the change that workers are subject to, along with the work organization, smart digital factories. The study originates from (...) an empirical survey conducted by the author together with a multidisciplinary research group between 2014 and 2015 in some of the largest Italian factories.In particular, the article analyzes the links between digital society, digital culture and Industry 4.0, focusing on the issue of people’s participation in the process of change, within a specific case study from the railway sector.Many elements of the Industry 4.0 paradigm are widespread outside the factory, in society; they are not only technological elements but also cultural. One of the key aspects of the analysis is the question of participation and the “person-centered” culture. The subject is addressed critically by presenting both the RE-personalization processes and the new processes of DE personalization caused by digital automation. (shrink)

In the treatise “Suprematism. The World as Objectlessness or Eternal Peace” (1922), Kazimir Malevich positions himself as a “bookless philosopher” who did not consider theories of other philosophers. In fact, the treatise contains a large number of references to philosophers belonging to different traditions. A careful reading shows the extent to which Malevich’s theory is linked to the Russian religious philosophy of the early twentieth century. In my view, Nikolai Berdyaev, Sergei Bulgakov, Pavel Florensky—philosophers of “Religious Renaissance,” as well as (...) some other intellectuals—acquaint avant-gardists with Neoplatonic conceptions of apophasis. Malevich had access to ideas of fourteenth-century theologian Meister Eckhart, and I will refer to two sources to demonstrate this, including Margarita Sabashnikova’s translation of Eckhart and works of Sergei Bulgakov. Without any reference, Malevich retells the concepts of Dionysius the Areopagite, Meister Eckhart, and Gregory Palamas. I will demonstrate parallels between the treatise on Suprematism and Meister Eckhart’s Sermons concerning the concepts of apophaticism, Platonism, and Nothingness. I will also touch on the theme of Divine Light in the theology of Palamas (fourteenth century) to show the diversity of the avant-garde’s sources of inspiration. (shrink)

El problema de la estetización y la reconfiguración de la experiencia en la filosofía de Walter Benjamin. Resumen de Tesis de Doctorado en Filosofía de Tatiana Staroselsky.

Normative case studies are designed to offer richly detailed “worlds of possibility” that invite complex reflection and discussion about authentic ethical dilemmas in education. In this essay, Tatiana Geron and Meira Levinson argue that authors' choices of what details to include in a case are themselves ethical decisions that require significant ethical responsibility. Case details can shape which avenues of ethical inquiry are open to readers, whether and how institutional and structural conditions get considered, whose perspectives are included and (...) legitimized, and what political issues are understood as “open” or “closed.” At its best, case “world-building” can help readers understand the full complexity of ethical decision-making in education. However, for this to occur, case authors must seek out expert and dissenting perspectives, field test the case with diverse audiences, and remain reflexive about their own perspectives and how these shape their world-building decisions. ABSTRACT This article re-examines the affinities and differences between the thought of Bakhtin and Benjamin. Both are important to that branch of contemporary philosophy which analyzes the destinies of the 20th century and belong to the present-day post-secular epoch. Both understand our world by reviewing our lived experiences, to find elements that help us evaluate it and provide an orientation for our present situation. There are similarities in the reception of their ideas. In Latin America, Bakhtin and Benjamin are frequently (...) interpreted in a political sense and serve as a basis for thinking about historical events and the facts of contemporary culture. The works of Benjamin are more frequently published, disseminated, and commented upon than those of Bakhtin. The main focus of this article is to study how Goethe served as a catalyst or pivot for the particular illuminations of both thinkers. In this perspective, Bakhtin and Benjamin are seen as two communicating vessels, despite their differences on questions of language, the role that Kant plays in their thinking, or the texts that interested them. Bakhtin’s materialistic conception of language is quite opposed to the messianic mysticism of Benjamin. (shrink)

The relevance of the topic of research of humanitarian capital as a set of values of social sciences today plays an exceptional role, because human capital is a great character and its goal is the process of mastering the world through the development of humanistic knowledge and methods of cultural education, aimed at personality formation. The Central problem for modern conditions is management education with a view that human capital formed by all humanist-oriented sciences, must be directed to the development (...) and fulfillment of personality. The main task of higher school is the identification, preservation and effective use of human knowledge as a set of humanistic values, which together constitute the human capital needed to ensure a comprehensive and creative personality. The article explains the essence, objectives and main directions of human capital with the aim to form comprehensive and creative personality, based on cultural development of man as his self-development and self-actualization. Objectives of the study are the conceptualization of human capital as a set of humanitarian values, which are implemented in practice of educational process of higher school. The methodological basis for the formation of humanitarian capital in the information society is a synergetic methodology aimed at revealing the intellectual and creative personality, which incorporates all the values of the Humanities, presented by specific synergistic tools. Conclusions – management of education in modern conditions should be directed on formation of mechanisms of human capital as a set of values created by mankind and implemented by social sciences and disciplines. In the paper the joint Logic of Proofs and Provability is presented that incorporates both the modality □ for provability 287–304) and the proof operator tF representing the proof predicate “t is a proof of F” . The obtained system naturally includes both the modal logic of provability GL and Artemov's Logic of Proofs . The presence of the modality □ requires two new operations on proofs that together with operations of allow to realize all the invariant operations on proofs (...) admitting description in the modal propositional language. Logic is proved to be decidable and complete with the intended provability semantics. (shrink)

Se examina la idea de un vínculo directo entre modernización y pérdida de plausibilidad de la creencia religiosa, se explora la imagen contemporánea de la relación entre religión y racionalidad, y se muestra cómo no puede afirmarse que el avance de la ciencia conduzca a la secularización. Ante la pregunta, si la postsecularización conlleva una mutua exclusión de religión y racionalidad, se examinan las propuestas de J. Habermas y N. Wolterstorff, buscando criterios normativos para el diálogo entre racionalidades religiosas y (...) no religiosas. The article examines the idea of a direct link between modernization and the loss of plausibility of religious belief, explores the contemporary image of the relation between religion and rationality, and shows why it is not possible to say that the advance of science leads to secularization. In view of the question regarding whether post- secularization entails the mutual exclusion of religion and rationality, it examines the proposals of J. Habermas and N. Wolterstorff, in a search for normative criteria for the dialogue between religious and non-religious rationalities. (shrink)

WINNER OF THE SIMON HAILWOOD ESSAY PRIZE. This paper discusses the problem of alienation from nature, considered through the phenomena of reification and de-objectification. I propose understanding alienation as the result of a distorted relation between the subjective and the objective and I suggest a tentative solution via the combination of two ethico-political practices: releasement and reappropriation. In doing so, I put forward a structural-ethical critique and response to our current ecological crisis.

Las Instituciones Nacionales de Derechos Humanos cumplen, fundamentalmente, con dos funciones: proteger a las personas a partir de recomendaciones, garantizándoles una reparación si se comente una violación a sus derechos, y prevenir futuras violaciones a los derechos humanos. Sobre esta base están llamadas a ser los organismos que guíen hacia una cultura ciudadana a favor de los derechos humanos. Para lograr la culturización en este campo, se requiere educar en derechos a través de la educación formal e informal. En el (...) caso de México, la Comisión Nacional de los Derechos Humanos es la institución encargada de realizar esta labor. Su posición flexible y dinámica, así como su autonomía dentro del Estado mexicano, le dan la posibilidad de propiciar esa cultura, ya que es una institución de configuración diferente al sistema tradicional de impartición de justicia, por lo que hace que mantenga una línea de investigación enfocada en los derechos humanos. La culturización empieza por el ámbito nacional o interno y se debe extender hacia el exterior, como un movimiento social internacional. (shrink)

This article aims to make public part of the research on the concept of ‘light’ in the theological and, above all, liturgical tradition of the Greek Orthodox Church, based on its representation of the concept of ‘hypostasis’. Taking as a point of departure the interpretation of the expression ‘light of light’ [φῶς ἐκ φωτός (phôs ek phōtos)] of the text of the Niceno-Constantinopolitan Symbol, the article presents a proposal for the interpretation of the concept of ‘representation’ for this specific case, (...) based on the idea of apomímesis, and applies this concept to a reading of the place of ‘light’ in the Holy Scripture, in the Patrology and in the Greek Eastern Liturgies. Introduction. The condition of fixed assets and their rational management largely determine the competitiveness of an enterprise. Updating the production base is possible both at the expense of their own funds and at the expense of borrowed funds. When choosing sources of financing for renovating fixed assets, it is important to assess the impact of the chosen acquisition method on cash flows and the financial result of an enterprise. The purpose of the article is to assess the impact of the (...) chosen method of financing the acquisition of fixed assets on the company’s financial results and cash flow. Methods. Comparison, induction, analysis, synthesis, direct counting, the author’s methodology for assessing the impact of the source of renovation on the financial result of the enterprise and cash flow. Scientific novelty of the research. The authors propose an additional criterion for assessing the efficiency of managing fixed assets of an enterprise: choosing the most optimal method of acquisition, based on assessing its impact on the financial results of activities, and they also proposed to supplement the options for renovating the main environments using leases, since, depending on the economic situation, this option may have financial advantages over credit, loan and leasing. Results. The authors predict the influence of the method of financing the acquisition of fixed assets (credit, leasing, rent, own funds) on the financial result of an enterprise and cash flows; develop the general approaches to the method of choosing the optimal source of financing for the renovation of fixed assets. Conclusions. The acquisition of ownership of fixed-capital assets is not always advisable. The article shows that not only credit or leasing operations, but also rent are comparable in efficiency. When choosing a source of financing for renovating fixed assets, it is necessary to compare the costs of acquiring property and their distribution by periods, to analyze the impact of the method of acquiring them on the financial result of the enterprise and cash flow. Se explora la relación entre las dimensiones proposicional y no proposicional de la creencia religiosa para mostrar que la última dirige el proceso de justificación y representa su límite. Se defiende que la no proposicional también tiene valor cognitivo, porque constituye una suerte de elección epistémica preteórica que no es exclusiva de la fe religiosa. Se explora la noción de ambigüedad religiosa, tanto a nivel intelectual como experiencial, y se sostiene que la relación entre la dimensión proposicional y la no-proposicional (...) de la fe está mediada por la función directiva de las presuposiciones metafísicas instauradas por la experiencia religiosa. This paper argues that the impact of individual higher education institutions’ strategies on system diversity should be explored. By looking at how universities respond strategically to governmental policies as well as to the actions of other (competing) institutions, our understanding of determinants of diversity can be enriched. A conceptual framework focusing on institutional positioning is explained using the dimensions deliberateness of organizational actions versus environmental influence, on the one hand, and differentiation versus compliance, on the other. We posit institutional positioning (...) as the mechanism through which organizational and environmental levels are linked. Our model features multiple dimensions and relations reflecting how higher education institutions locate themselves in specific niches, i.e. positions where they are able to gather the necessary resources for their core activities. The implications for research on diversity and for policymaking are discussed. (shrink)

This paper argues that there is a thread in the philosophy of E. Tugendhat binding together his moral and justice theories with his conceptual analysis. Oriented by the thesis that a conceptual analysis is necessary to explain what justice is, this paper reconstructs some aspects of Tugendhat’s philosophy. It is divided in four sections: First, I delve into the author’s definition and use of conceptual analysis. Second, I describe some features of Tugendhat’s moral theory of contractualism. Third, I examine his (...) theory of justice. Fourth, I conclude by framing my analysis within the debate between Rawls’s and Tugendhat’s theories of justice. (shrink)

This paper argues that the historical character of our knowledge is compatible with both ontological and epistemological realism. The first part critically analyses the thesis according to which the situated nature of our cognitive practices implies that they do not refer to an extra-linguistic reality. The second section explores the claim that realism is a necessary presupposition of our communicative practices and the final part outlines the principles of a pluralist realism.

:This article reexamines the “prostitution objection” to paid surrogacy, and argues that rebuttals to this objection fail to focus on surrogates as embodied persons. This failure is based on the false distinction between “selling one’s reproductive services” and “selling one’s body.” To ground the analysis of humans as embodied persons, this article uses Kant’s late ethical theory, which develops the conceptual framework for understanding human beings as embodied selves. Literature on surrogacy commonly emphasizes that all Kantian duties heed to the (...) categorical prohibition to treat persons as mere means. What this literature leaves out is that this imperative commands us more specifically to engage ourselves and others as embodied persons. This article aims to relate this point to a specific issue in assisted reproduction. It argues that a Kantian account of human beings as embodied persons prohibits paid surrogacy on exactly the same grounds as it prohibits prostitution. (shrink)

Book 1 of Plato’s Laws, and particularly the image of the puppet introduced near its end, has been traditionally interpreted as presenting the moral psychology model that underlies the educational system delineated by the Athenian Stranger, which construes virtue as consonance between the non–rational and the rational elements of the soul. But a different and competing conception of virtue looms large in Laws 1, virtue as victory of the best part of the soul in psychic conflict. This paper argues that (...) the Athenian’s conception of education as the correct conformation of originally conflicting psychic forces requires the simultaneous presence of the harmony and the conflict models of virtue in Laws 1. Education is in turn defined by calculation, the rational activity which persuasively leads the conflicting non–rational forces towards a consonant reciprocal rapport. By strategically developing his understanding of education and calculation in Laws 1, the Athenian shows how the harmony model of virtue overcomes the conflict model, while at the same time recognising that there is some truth to the conflict model after all and integrating it within the harmony model. The past decade has seen an explosion of work on calculi of explicit substitutions. Numerous works have illustrated the usefulness of these calculi for practical notions like the implementation of typed functional programming languages and higher order proof assistants. It has also been shown that eta-reduction is useful for adapting substitution calculi for practical problems like higher order unification. This paper concentrates on rewrite rules for eta-reduction in three different styles of explicit substitution calculi: λσ, λse and the suspension calculus. (...) Both λσ and λse when extended with eta-reduction rules, have proved useful for solving higher order unification. We enlarge the suspension calculus with an adequate eta-reduction rule which we show to preserve termination and confluence of the associated substitution calculus and to correspond to the eta rules of the other two calculi. We prove that λσ and λse as well as λσ and the suspension calculus are non-comparable while λse is more adequate than the suspension calculus in simulating one-step beta-reduction. After defining the eta-reduction rule in the suspension calculus, and after comparing these three calculi of explicit substitutions , we then concentrate on the implementation of the rewrite rules of eta-reduction in these calculi. We note that it is usual practice when implementing the eta rule for substitution calculi, to mix isolated applications of eta-reduction with the application of other rules of the corresponding substitution calculi. The main disadvantage of this practice is that the eta rewrite rules so obtained are unclean because they have an operational semantics different from that of the eta-reduction of the λ-calculus. For the three calculi in question enlarged with adequate eta rules we show how to implement these eta rules. For the λse we build a clean implementation of the eta rule and we prove that it is not possible to follow the same approach for the λσ and λsusp. (shrink)

The article explores court forms as an interactive genre essential for legal-lay communication in civil and family proceedings: court forms elicit key information from predominantly lay users for the purposes of court administration and the judiciary. The information presented in court forms defines the agenda and communicative focus of the subsequent hearings and settlement negotiations, and in some instances even the path the proceedings would take. It is thus important to consider court forms in terms of their comprehensibility as well (...) as functionality for eliciting legally coherent narratives and facilitating efficient engagement of lay participants with the proceedings. The case study presented in the article draws on the combination of corpus linguistics and discourse analysis to explore two versions of the court form most frequently used by self-represented parties in England and Wales, ‘Form C100: Apply for a court order to make arrangements for a child or resolve a dispute about their upbringing’. The comparison of the paper form and its redesigned online version identifies the improvements made as part of the digitisation process but also indicates communicative challenges which can prevent the lay person from presenting the relevant information. The discussion provides an opportunity to reflect on the role of language in online courts. (shrink)

This paper makes the claim that the overall structure of Plato’s Laws follows the principle of indirect access to the knowledge of human soul, which consists in the understanding that a philosophical approach to the soul is only possible initially through an image of it. The structure of the Laws can be interpreted as a movement towards the soul’s interior, beginning with the famous image of the puppet. According to this image, the movement opens with the analysis of the non-rational (...) elements of the soul, which are capable of an harmonic relation with the rational element, and advances bit to bit to the rational or epistemic element. The political necessity of undertaking the dialectical investigation in order to attain a philosophical knowledge of the human soul and its specific excellence appears only at the end of the dialogue. In this way, the structure of the Laws dramatizes the progressive birth of philosophy, conceived as the dialectical investigation of the unity of virtue, starting from the initial understanding of the human soul contained in the myth of the puppet. As part of the response to the COVID-19 pandemic, many jurisdictions across the world introduced remote hearings as an alternative way of continuing to offer access to courts. This practice-based article discusses the report prepared by the author for a judicial review case which revolved around the claim that in immigration settings the quality of interpreting conducted in fully online hearings is inferior to interpreting in face-to-face hearings. In the absence of pre-existing research comparing the impact of the physical and (...) fully online settings on interpreting, the author’s expert witness report explored linguistic principles governing conversation and turn-taking management, power relations and narrativisation and discursive practices in online and physical settings to illustrate communicative advantages and disadvantages of each environment. The article draws on the investigations conducted for the expert witness report and pursues the following aims: (1) reflect on the role of linguistic expertise required for the case; (2) detail the conclusions drawn and recommendations endorsed in the report; (3) discuss the importance of effective communication in immigration settings; (4) challenge common misconceptions in relation to how narratives are elicited, shared and perceived; (5) explore safeguarding strategies for enhancing discursive practices in fully remote hearings in order to improve non-native speakers’ access to justice. Rethinking philosophy of history we see that the main concepts must be revised or specified especially and. It’s very important to use adequate notions. The world history is an integral process having dialectically contradictory tendencies. Humanism is an objective tendency of the world history but the alienated tendency prevails in the epoch of globalization. Collisions between civilizations are outcomes of the alienated capitalist world system. Many problems both in practice and in theory are connected with a fortune of humanism and (...) a problem of mutual understanding between representatives of different cultures is among them. So philosophy of history must be revised in humanistic way and we must do our best to put the humanistic tendency into practice. (shrink)

Logic of proofs LP was introduced by S. Artemov in. It describes properties of the proof predicate “t is a proof of F” formalized by the formula ⟦t⟧ F. Proofs are represented by terms constructed by three elementary recursive operations on proofs. In this paper we extend the language of the logic of proofs by the additional storage predicate x ∋ F with the intended interpretation “x is a label for F”. The storage predicate can play the role of syntax (...) encoding, so it is useful for specification of operations on proofs, especially those that require formula arguments. We give a definition of a specification of an operation on proofs and introduce logics that describe such operations. For a large class of operations we prove the completeness of these logics with respect to the intended semantics. We also study the logic describing the operation of substitution. (shrink)
