Dans le cadre de cet article, je veux démontrer la nécessité de développer et d’incorporer les perspectives féministes dans le champ de l’éthique des relations internationales à travers l’examen des contributions respectives de J. A. Tickner, C. MacKinnon, S. Ruddick et M. Nussbaum. Mon hypothèse générale consiste à arguer que la force critique des perspectives féministes en théorie politique représente non seulement une ouverture épistémologique incontournable, mais que celles-ci ouvrent la voie à des méthodes d’investigation et de conceptualisation (...) que l’on doit explorer en vue d’enrichir les théories de justice globale d’une portée pratique plus grande. This paper aims to demonstrate the necessity of developing and incorporating feminist perspectives in the field of international ethics, through the examination of important contributions of J. A. Tickner, C. MacKinnon, S. Ruddick and M. Nussbaum. My general hypothesis argues that the critical impact of feminist perspectives in political theory consists not only in the epistemological avenue that they open, but that their methods of investigation and of conceptualization must be thoroughly explored in order to enrich theories of global justice of a greater practical scope. Cet article esquisse un rapprochement entre un courant de pensée politique, le néoréalisme, et une méthode en sciences humaines, le structuralisme. Ce courant et cette méthode ont suivi des trajectoires séparées, de l’après-guerre à la fin des années soixante-dix, jusqu’à ce que Kenneth Waltz croise ces deux problématiques. Après avoir défini respectivement réalisme et structuralisme, cet article établit leur connexion et tente d’éclairer les raisons pour lesquelles ce rapprochement n’avait pas été conduit jusqu’alors.

The creation of ad hoc international penal tribunals and of a permanent international penal court symbolizes the will to extend penal law from the national state to international relations, thus giving rise to the concept of a punitive intervention. This contribution seeks to establish whether this extension of penal law to international relations should be strictly modeled on national penal law or whether it should follow a paradigm of its own. This could well be the same paradigm, which (...) some authors have suggested for the national level, i. e. the paradigm of reconstructive justice. Though it does not radically exclude the penal dimension of justice, reconstructive justice nevertheless relativizes this dimension, thus leaving room for a more constructive reaction to crime. Les études sur la migration ont mis l’accent sur la dimension relationnelle du processus de migration, cependant le sujet a rarement été analysé systématiquement à l’aide de l’analyse des réseaux sociaux. À partir d’entretiens avec des jeunes et adultes espagnols installés à Toulouse entre 2004 et 2014, cet article montre la diversité des configurations de réseaux. Cette diversité est due à la variété des processus de mobilité et des parcours biographiques. Au fil des mois et après quelques années de résidence (...) à Toulouse, ces personnes ont subi une reconfiguration de leur entourage qui associe principalement des relations avec des personnes résidant dans le lieu d’origine et d’autres qui sont locales. Cette reconfiguration aura comme points forts la rupture avec certains liens dans la société d’origine mais aussi l’activation de nouvelles relations, ainsi que l’intensification de nouveaux et d’anciens liens à cause de la mobilité. Cette diversité est expliquée dans l’article en examinant les caractéristiques et les circonstances vécues avant la mobilité, ainsi que les caractéristiques de leurs contacts prémigratoires. Meeting of the Minds records the proceedings of the S.I.E.P.M. conference held in Boston from June 14-16, 1996. The conference participants centred their attention on the relationships between medieval and classical modern philosophy. These relationships have been painted in dramatically different ways by those who have presented overviews of the two eras. Hans Blumenberg, in The Legitimacy of the Modern Age and his subsequent works, discovers the seeds of modernity in the medieval authors themselves. Leo Strauss and his followers see (...) a radical difference between the classical world views of the ancients and medievals and the successive layers of modern thought. These general portraits demand specifics, and the strength of the conference, whose results are contained in this volume, was that it provided many specific examinations of concrete relations between the philosophical positions of celebrated medieval and modern thinkers. Our hope is that this collection of papers will suggest the direction for further cooperative efforts on the interplay of the philosophical views represented by these two eras, and that the issues commonly debated by the medieval and early modern thinkers represented in this volume will give renewed consideration to important philosophical points that have been ignored in more recent debates. Jede Herrschaftsordnung bedarf der Legitimation. Das Werk befasst sich mit der Legitimation derjenigen Instrumente internationaler Institutionen, die nicht zum verbindlichen Völkerrecht gehören, deren Anzahl und Bedeutung mit der Globalisierung massiv angestiegen sind. Dazu zählen das Soft Law, aber auch Informationsakte wie Indikatoren oder Indizes. Legitimationsbedürftig, so die These, sind neben dem verbindlichen Völkerrecht alle Akte, die als "internationale öffentliche Gewalt" einzustufen sind. Dieser Begriff wird auf Grundlage der Diskurstheorie von Jürgen Habermas konzipiert, die dazu in einigen Punkten fortzuentwickeln ist. Das (...) Werk entwirft sodann eine Handlungsformenlehre, mit der sich der abstrakte Begriff der internationalen öffentlichen Gewalt auf vergleichbare Instrumentenkategorien herunterbrechen lässt, die durch ein einheitliches Rechtsregime legitimiert werden können. Oder einen Theoretiker mit verblüffend praktischen Kenntnissen über Höhenmedizin und der unter bestimmten Umständen lebensrettenden Fähigkeit, panischen Berggefährten den Anblick der Tiefe erträglich zu machen. Oder den lead-Sänger einer (...) ziemlich professionellen Musikgruppe, die sich die öffentliche Pflege des Liedgutes der Rolling Stones zur Aufgabe gemacht hat und als Meister der Reproduktion die Bewunderer des Originals in Taumel versetzt - von Stockholm bis OfIenbach. Auf keinen Fall aber sollte man sich einen Autor vorstellen wie man ihn sich vorstellt, wenn man dieses Buch zur Hand nimmt. Oder doch? Doch! Es könnte ja sein, daß jemand dieses Buch nicht nur als lohnende Strapaze erlebt, sondern auch als Vergnügen, wenn er erst einmal über den Untertitel hinweggekommen ist. Zur Sache:,,Fallen der Welt-Ordnung" - die Fallen oder das Fallen? Das Thema verrät es nicht; denn zwischen Moderne und Postmoderne ist ein weites Feld, auf dem alles mögliche passieren kann. Worum also geht es? Mathias Albert versteht das Arbeitsgebiet der Internationalen Beziehungen (also der Lehre und Forschung über diesen Gegenstandsbereich) als jenen Teilbereich der Sozialwissenschaften, der sich mit der Weltordnung befaßt. Le but de cette these consiste a degager l'influence constitutive de l'heritage kantien dans l'elaboration contemporaine du paradigme cosmopolitique en ethique internationale. Cependant, une certaine ambivalence caracterise les ecrits politiques de Kant, oscillant entre un realisme politique et un idealisme moral. L'interpretation rawlsienne du foedus pacificum, quant a elle, reconduit une conception fondamentalement etatiste du projet de paix kantien. Face au fait du pluralisme, Rawls tente d'accommoder certaines preoccupations communautariennes au detriment de l'individualisme normatif et de l'egalite politique des citoyens (...) constitutifs de la democratie liberale. Nous soutenons, contre Rawls, qu'une perspective cosmopolitique d'obedience kantienne ne peut accorder une telle preseance indue aux droits collectifs au prejudice des droits fondamentaux des individus. ;Par contraste, nous soutenons la justification normative d'une theorie particuliere de la democratie cosmopolitique fondee sur la notion de souverainete differenciee dont les representants les plus importants sont David Held et Thomas W. Pogge. Ce modele de gouvernance globale sans gouvernement s'inspire du foedus pacificum kantien qui concoit la possibilite d'une communaute cosmopolitique sans Etat mondial. Nous affirmons que la theorie de la souverainete differenciee, fondee sur le principe de l'autonomie, permet de concilier le fait du pluralisme avec l'universalisme moral des droits fondamentaux. ;Une telle perspective cosmopolitique s'appuie sur une approche pragmatique qui tient compte des criteres de plausibilite historique et institutionnelle. De sorte qu'elle tente d'articuler les prescriptions normatives a partir des caracteristiques empiriques de la globalisation. Or, une analyse attentive du phenomene de la globalisation atteste d'un changement de paradigme en relations internationales qui bouleverse les parametres conceptuels en relations internationales. Ce changement de paradigme libere de nouvelles possibilites conceptuelles en ce qui a trait aux notions traditionnelles de la souverainete de l'Etat et de la democratie. C'est dans la foulee de ces transformations, a la fois structurelles et philosophiques, que l'ideal regulateur d'un partage plus equitable de la souverainete, audela et en deca des bornes territoriales de l'Etat, parait plausible. Dans l'esprit de certaines intuitions kantiennes, il est possible d'elaborer une conception de la citoyennete cosmopolitique et de la sphere publique transnationale capable de surmonter, d'une certaine facon, le deficit de democratie et de representation electorale qui caracterisent presentement les changements inherents a la globalisation. ;Cette these tente de demontrer en quoi le projet de paix kantien constitue la genese philosophique du modele de gouvernance cosmopolitique, fondee sur la theorie de la souverainete differenciee, nous permettant d'envisager certaines propositions de reformes institutionnelles en relations internationale. In The Law of Peoples , Rawls tries to develop a theory of international justice by extending a liberal conception of domestic justice to a society that consists not only of reasonable and well-ordered liberal peoples, but also of decent nonliberal peoples. Within the boundaries set by his theory of political liberalism Rawls hopes to convince us that a reasonably just Society of Peoples might be possible. Such a society, according to Rawls, consists of all those peoples who observe the (...) different ideals and principles of the Law of Peoples in their mutual relations. It is a society that can at least eliminate the ‘gravest forms of political justice’ and prevent new ‘great evils of human history’ from taking place’. The target that Rawls sets for himself is of course very admirable, but one has to remain cautious about the way in which he tries to develop such a political conception of international justice. One has to keep a keen eye on the different steps that take place in the extension of a liberal conception of domestic justice to a reasonably just Law of Peoples. We try to claim that Rawls loses an essential element of international justice in this extension, that is the idea of equal liberty. (shrink)

Il s’oppose à la fois à la solution soviétique d’une indépendance pour les nations opprimées et au pan-américanisme de (...) l’Alliance populaire révolutionnaire américaine (APRA). Cet article étudie les relations compliquées de Mariátegui avec l’Internationale communiste sur les questions paysannes et indigènes. Cet article prétend expliquer l'invisibilité relative du conflit armé colombien par rapport à d'autres situations de crise internationale. Au lieu de présupposer que le problème repose sur une faible médiatisation des événements rapportés à la Colombie, il se penche sur les tentatives de mise en sens des événements effectuées par les journalistes au moment de leur médiatisation. L'argument central est que l'opacité du « problème colombien » sur la scène internationale est surtout liée à la difficulté de parvenir à élaborer (...) un récit capable de rendre intelligible ce qui se passe en Colombie.This article tries to explain the relative invisibility of the Colombian armed conflict in relation to other international crisis situations. Instead assume that the problem lies in a low media coverage of events reported to the British, it focuses on the attempts of making sense of the events conducted by journalists at media coverage. The central argument is that the opacity of the "Colombian problem" on the international scene is mainly due to the difficulty of reaching to develop a story that can make sense of what is happening in Colombia. A journey through sound, memory, and landscapes, questioning the origins, perception, and cultural implications of music. A lifelong relation to sound and music underlies Latifa Echakhch’s work. On the occasion of her representation of the Swiss Pavilion for the 59th Venice Biennale, she has edited a volume on sound, memory, and perception. In the book, images of her installation in the Swiss Pavilion, The Concert, accompany her own writings along with this by Alexandre Babel and Francesco Stocchi, the co-curators of (...) the pavilion. The volume also includes interviews with and collected texts by François J. Bonnet, Emanuele Quinz, Maxime Guitton, Alvin Curran, Salomé Voegelin, Antoine Chessex, Jonathan Sterne, Juliette Volcler, and Raphaël Brunner. Confronting knowledge, reflection, and intuition, their combined concert of thoughts confirms how sound and music—and their absence—play a crucial role in our physical and cultural perception of the world, and how they allow us to expand our bodily and cognitive experience. Distributive justice, like every other value, is not suspended in mid-air: its implementation depends on certain conditions, the well-known ‹circumstances of justice›. In this paper, I attempt to spell them out, first for justice proper , then for international justice. Those circumstances relate to the conceptual parts of justice and are four in number: scarcity, needs and merit, social cooperation, and authority of distribution. As far as international justice is concerned, there is a problem with the last circumstance: as yet (...) no international authority of distribution exists. This does not, however, mean that international justice is impossible or undesirable; only that we have the task to create such an authority. (shrink)

This paper addresses the relation between explicitation and translation expertise in the rendition of nominalisation and participles in the legal Qurʾānic verses specific to purification and prayer. It uses a corpus-based method: _The Qurʾānic Arabic Corpus_. The paper argues that most of the expert Qurʾān translators explicitate in rendering nominalisation and participles in the legal verses specific to purification and prayer into English in the said corpus. They explicitate in the form of both addition and specification with varying degrees as (...) the former is adopted twice as much as the latter. The paper claims that most explicitations specific to the rendition of nominalisation and participles in the legal Qurʾānic verses peculiar to purification and prayer in the corpus have been superfluous, albeit justifiable. This may confirm the relation between explicitation and translation expertise in _The Qurʾānic Arabic Corpus_ in the sense that although the meaning of nominalisation and/or participles is wholly translated into English, the Qurʾān translators still explicitate through addition or specification to further facilitate the comprehension process. This paper offers a baseline for examining explicitation exercised on nominalisation and participles in the legal Qurʾānic verses particular to purification and prayer, which may have implications for future studies conducted on the same topic in other similar legal contexts. Based on a extensive computation of power capabilities, the position of Belgium in international politics can reliably be assessed. Belgium belongs to a first stratum of followers states. Its best functional fields are international economie relations and those concerning science and technology. A globalisation of all functional fields runs at the expense of its international position.A splitting up of the country would relegate the emerging states, Flanders and Wallonia, to the second more numerous stratum of still less powerfull followers. This article about a just interntional financial order is centered on the gap between a normative and a scientific-technical perspective. Instruments of financial policy are connected to concepts of economic ethics to give a more differentiated view about the ethical and economic elements in the discussion about regulating international financial markets. The central issue is in relating economic concepts and the implicit value judgements. This frequent antagonism could also be transferred to sectors of tax-, growthor social policies where economic and (...) ethical aspects are juxtaposed. (shrink)

L'exploit du vol en lui-même ne suffit pas, il doit aussi être régulier et sûr, et en somme s'articuler au mieux au reste de la chaîne postale pour satisfaire les usagers. (...) Seule une coopération, au sens strict une opération en commun du réseau par les acteurs concernés, le permet: les offices postaux d'une part et les compagnies aériennes d'autre part ont à travailler en étroite relation, et donc à communiquer. Dans les années 1920, la genèse de la poste aérienne se fait à travers la construction d'un espace de sens commun, mêlant institutions et signes. With it, it is not only to fly planes, but inserting them into a complex system of collection, transport and delivery of mail across territories. The feat of flying itself is not enough, it must also be smooth and safe, and in fact is the best articulate the rest of the mail stream to satisfy users. Only cooperation in the strict sense a joint operation of the network by stakeholders, allows: post offices on the one hand and the other airlines have to work closely, and thus communicate. The aim of this paper is to analyse the legal record on civil litigation from mid-March 2020 to mid-July 2021 and examine COVID-19 pandemic-related arguments in a sample of litigated cases heard in Polish courts, more precisely 41 cases. In an attempt to establish the number and types of court cases in which such arguments have been raised, the population of individual case records was accessed electronically from the Ordinary Courts Judgments Portal. The analysed research material consists of texts of (...) written justifications published along with rulings of courts of the first instance in the Portal, except for texts regarding criminal cases and widely understood labour cases. This paper refers to certain theoretical aspects of argument and argumentation. Then, it sheds light on the use of COVID-19 pandemic-related arguments by the parties involved in litigation—as reported by the courts in written justifications—considering, amongst others, whether those arguments were found convincing by the courts. Based on a survey of relevant cases, an attempt was made to identify categories of COVID-19 pandemic-related arguments of the parties involved in litigation, raised in their legal submissions. Also a look into the tendencies in this regard was taken to see whether any patterns emerge and it is possible to discern different trends in the analysed phenomena.
