This book addresses the question: "What should be the appropriate limits to free speech?" The author claims that it is the state, rather than abstract principles, that must provide the answer. The book defends a version of Hobbesian absolutism and rejects the dominant liberal idea that there is a right (human or civil) setting the boundaries of free speech. This liberal view can be known as the "principled defence of free speech", in which speech is established as a constitutional principle (...) that has priority over the state. The author instead offers an "unprincipled approach to free speech", suggesting that the boundaries of speech must necessarily be set by the state, which in liberal democracies means through social and political contestation. The final chapter applies the argument to the topic of hate speech and argues that it is appropriate to limit such speech when it causes harm and offense. Liberalism is the political philosophy of equal persons, yet liberalism has denied equality to those it saw as black sub-persons. In Black Rights/White Wrongs: The Critique of Racial Liberalism, political philosopher Charles Mills challenges mainstream accounts that ignore this history and its current legacy in the United States today.

Pring-Mill's study depicts the prevalent, but often neglected worldview of the Middle Ages, according to which the macrocosm is a chain of created being ascending from the four elements of the material world to the numerologically structured celestial spheres up to the creator himself. Pring-Mill's work reveals a fundamental correspondence between the three major religions: medieval Christians, Jews and Muslims all sought to describe their religious beliefs using the structures of the macrocosm. Ramon Lull's (1232-1316) philosophy makes use (...) of this idea in order to render Christian doctrine intelligible. In his dynamic conception, man is depicted as a microcosm, thus becoming the archetype of the macrocosm and, at the same time, the image of divine trinity. Although the best-known Hegelian objection against Kant's moral philosophy is the charge that the categorical imperative is an ‘empty formalism’, Hegel's criticisms also include what we might call the realizability objection. Tentatively stated, the realizability objection says that within the sphere of Kantian morality, the good remains an unrealizable ‘ought’ – in other words, the Kantian moral ‘ought’ can never become an ‘is’. In this paper, I attempt to come to grips with this objection in two steps. In the first (...) section of the paper, I provide an initial reading of the objection, according to which Hegel agrees with Kant's formulation of the realizability problem but disagrees with the specific Kantian solution, namely, with the Kantian idea of the highest good and the doctrine of the postulates. In the second section, I go on to argue that this reading is potentially too superficial and offer a more far-reaching interpretation whereby Hegel is ultimately targeting fundamental distinctions of Kant's moral theory. I end by employing these more far-reaching results of Hegel's objection to sketch some features of Hegel's alternative ethical view. (shrink)

Originally printed as a series of three articles in Fraser's Magazine in 1861, the work sought to refine the 'greatest happiness' principle that had been championed by Jeremy Bentham, defending it from common criticisms, and offering a justification of its validity. Following Bentham, Mill holds that actions can be judged as right or wrong depending on whether (...) they promote happiness or 'the reverse of happiness'. Although attracted by Bentham's consequentialist framework based on empirical evidence rather than intuition, Mill separates happiness into 'higher' and 'lower' pleasures, arguing for a weighted system of measurement when making and judging decisions. This essay tries to develop a “black radical Kantianism”—that is, a Kantianism informed by the black experience in modernity. After looking briefly at socialist and feminist appropriations of Kant, I argue that an analogous black radical appropriation should draw on the distinctive social ontology and view of the state associated with the black radical tradition. In ethics, this would mean working with a (color-conscious rather than colorblind) social ontology of white persons and black sub-persons and then asking what respect for (...) oneself and others would require under those circumstances. In political philosophy, it would mean framing the state as a Rassenstaat (a racial state) and then asking what measures of corrective justice would be necessary to bring about the ideal Rechtsstaat. Reissued in its revised 1866 second edition, this work by John Stuart Mill discusses the positivist views of the French philosopher and social scientist Auguste Comte. Comte is regarded as the founder of positivism, the doctrine that all knowledge must derive from sensory experience. The two-part text was originally printed as two articles in the Westminster Review in 1865. Part 1 offers an analysis of Comte's earlier works on positivism in the natural and social sciences, while Part 2 considers (...) its application in areas such as religion and ethics. Mill states that Comte is the first philosopher who has attempted to extend positivism 'to all objects of human knowledge'. Despite being critical of a number of Comte's views, such as the exclusion of psychology from positivist science, Mill acknowledges his fellow philosopher's influence in the face of common negative perceptions of the positivist movement. In this novel re-examination of the archetype construct, philosopher Jon Mills and psychiatrist Erik Goodwyn engage in spirited dialogue on the origins, nature, and scope of what archetypes actually constitute, their relation to the greater questions of psyche and worldhood, and their relevance for Jungian studies and analytical psychology today. Arguably the most definitive feature of Jung's metapsychology is his theory of archetypes. It is the fulcrum on which his analytical depth psychology rests. There is currently intense debate about the significance of user consent to data practices. Consent is often taken to legitimate virtually any data practice, no matter how invasive. Many scholars argue, however, that user consent is typically so defective as to be ‘meaningless’ and that user privacy should thus be protected by substantive legislation that does not rely (or does not rely heavily) on consent. I argue that both views rest on serious mistakes about the validity conditions for consent. User (...) consent is sufficiently impoverished that it does not guarantee legitimacy but is not so impoverished as to be ‘meaningless’; it can legitimate data practices that are independently reasonable but not those that are exploitative. Since many valuable data practices must be consented to if they are to be legitimate (or so I argue), our privacy legislation should continue emphasizing the importance of user consent, even if auxiliary protections are also desirable. The Collected Works of John Stuart Mill was directed by an editorial committee appointed from the Faculty of Arts and Science of the University of Toronto and from the University of Toronto Press, and it was published from 1963 to 1991 in thirty-three hardcover volumes. The primary aim of the edition is to present fully collated, accurate texts of those works which exist in a number of versions, both printed and manuscript, and to provide accurate texts of those works (...) previously unpublished or which had become relatively inaccessible.
