In 1942 California corporate agribusiness seized upon racist hysteria and pseudo "national security" issues to manipulate social ideology so that it could unlawfully seize tens of thousands of acres of productive farm land from law-abiding American citizens. It was such seizures that then allowed already existing large-scale capital to further consolidate California's agricultural resources while at the same time restructuring and increasing its concentration of the state's agricultural production and food manufacturing capabilities. Meanwhile, in "the most striking mass interference since (...) slavery with the right of physical freedom," over 120,000 Japanese Americans were placed in concentration camps and illegally deprived of their property and human rights. Traditionally, the fiduciary duty of loyalty is implicated where corporate directors have conflicts of interest. In a major new decision, Stone v. Ritter, the Delaware Supreme Court determined that directors may also be disloyal when they act in bad faith. As a consequence, directors may be disloyal even when they have no conflicts of interest, and even when they intend to benefit their corporation. This Article reconciles this expanded fiduciary obligation with existing concepts of loyalty. The new loyalty is not (...) incoherent. Courts have adopted a recognizable understanding of loyal behavior - being “true” - that exists in other social spheres. Under this conception, loyal directors must not only act in the best interests of their corporation and its shareholders, they must also be honest with shareholders and comply with positive law. This Article then offers insights into the function of these expanded fiduciary duties. Although the new loyalty duties pose risks, there are good reasons to think they will provide net benefits. Following the recent Lyondell decision, it appears that the Stone case and its progeny will not result in significant revisions to the business judgment rule. However, the recent change in a director’s loyalty obligation may substantially lower information costs, giving better guidance to directors and simplifying coordination. In addition, the new conception of loyalty can also serve an important expressive function, enabling a more efficient level of trust among corporate actors, investors, and those who transact with the firm. This paper reflects on affect and emotion as they relate to poetics — her/histories — in twenty-first century museums. Using specific examples, it considers the ways in which collections of material culture hold diverse meanings and how ideas are communicated to audiences over time and space but might also be challenged through imaginative activity. Key objects, exhibitions and activities discussed highlight masculinities at work in museums and include the temporary art installations by Yinka Shonibare and Fred Wilson in the Victoria (...) and Albert Museum's (V&A) Norfolk House Music Room in 2007; the portrait in oils of the Jamaican scholar Francis Williams, painted by an anonymous artist around 1745; and a contemporary oral commentary by Benjamin Zephaniah in the V&A British Galleries, which are considered through a feminist lens of poetics. The principle of bivalence is the assertion that every statement is either true or else false. Its legal analog, however, must be formulated relative to particular legal systems and in terms of validity rather than truth. It asserts that every statement of law that can be formulated in the vocabulary of a given legal system is valid or else invalid in that system. A line of New York cases is traced, beginning with Thomas v. Winchester . This case, which involved (...) a poison mislabeled as a medicine, established an exception to the rule that a manufacturer or supplier is never liable for negligence to a remote purchaser. The court made an exception because a poison is an “imminently dangerous” thing. How far may this exception be applied to other fact‐situations? Some subsequent cases are examined, and it is considered whether there is no correct answer in these instances and, more dramatically, whether more than one correct answer is tenable. This paper publishes a gold ring until recently in private hands in the United States. The former owners, private persons with no scholarly background, brought the ring to the present writer's attention upon learning that he had some knowledge of Greek inscriptions. The one deplorable fact is that this ring was removed from its context, so that much of its scientific value is forever lost to us. Nonetheless, the damage was done by others years ago, and its owners deserve (...) praise for making the ring available for study. The dedicatory inscription on it is an invaluable example of early Argive script. The details of acquisition are unclear. I have been able to ascertain only that the ring was acquired in ancient Mycenae from some Greeks who claimed to have dug it up in the area. As will be seen, in all probability it comes from the Argive Heraion. (shrink)

Randomized control trials (RCTs) are the gold standard for estimating causal effects, but often use samples that are non-representative of the actual population of interest. We propose a reweighting method for estimating population average treatment effects in settings with noncompliance. Simulations show the proposed compliance-adjusted population estimator outperforms its unadjusted counterpart when compliance is relatively low and can be predicted by observed covariates. We apply the method to evaluate the effect of Medicaid coverage on health care use for a (...) target population of adults who may benefit from expansions to the Medicaid program. We draw RCT data from the Oregon Health Insurance Experiment, where less than one-third of those randomly selected to receive Medicaid benefits actually enrolled. (shrink)

In this book, Aleksandr V. Bezgodov and Konstantin V. Barezhev formulate planetary ethics--the most important part of the philosophy of the Planetary Project. Planetary ethics represent the moral basis and value code for building a biocompatible, harmonious, and manageable civilization. They analyze the moral and ethical views of those Russian cosmists who belonged to the natural science branch of this unique philosophical, scientific, and cultural phenomenon. Despite tendencies to compete for a prime place in moral theory, neither virtue ethics nor the four principles approach should claim to be superior to, or logically prior to, the other. Together they provide a more adequate account of the moral life than either can offer on its own. The virtues of principlism are clarity, simplicity and (to some extent) universality. These are well illustrated by Ranaan Gillon’s masterly analysis of the cases he has provided. But the vices of this (...) approach are the converse of its virtues: neglect of emotional and personal factors, oversimplification of the issues, and excessive claims to universality. Virtue ethics offers a complementary approach, providing insights into moral character, offering a blend of reason and emotion, and paying attention to the context of decisions. The cases provided can be more adequately understood if we combine the approaches. Both should foster the virtues of humility and magnanimity. (shrink)

The experience of organizing the educational process during the quarantine caused by the COVID-19 pandemic is considered. Using of interactive technologies that allow organizing instant audio communication with a remote audience, as well as intelligent tools based on artificial intelligence that can help educational institutions to work more efficiently. Examples of sufficient use of artificial intelligence in distance learning are given. Particular attention is paid to the development of intelligent chatbots intended for use in communications with students of online courses (...) of educational web portals. The use of technologies of ontology formation based on automatic extraction of concepts from external sources is offered, what can lead to greater acceleration of construction of the intellectual component of chatbots. Artificial intelligence tools can become an essential part of distance learning during this global COVID-19 pandemic. While educational institutions are closed to quarantine and many of them transitioned to distance learning lecturers and schoolteachers, as well as students and schoolchildren faced with the necessity to study in this new reality. The impact of these changes depends on people's ability to learn and on the role that the education system will play in meeting the demand for quality and affordable training. The experience of organizing the educational process at the University of Education Management of the National Academy of Pedagogical Sciences of Ukraine in the quarantine caused by the COVID-19 pandemic showed that higher and postgraduate institutions were mostly ready to move to distance learning. However, most distance learning systems, on whatever platform they are organized, need to be supplemented: the ability to broadcast video, providing fast transmission of various types of information, receiving instant feedback when voting, polls and more. The structure of each section of the training course for the online learning system should fully cover the training material and meet all the objectives of the course. Appropriate language should be used, and wording, syntax, and presentation of tasks should be considered. One of the areas of application of artificial intelligence technologies in online learning is the use of chatbots which are characterrized by the following properties. It is advisable to use computer ontologies to ensure the intellectualization of chatbots. In this case, the metadata must be understandable to both humans and software and meet the requirements of modern standards in the field of information technology. Algorithmic software for mathematical modeling of structural stability is considered, which is reduced to solving a partial generalized eigenvalues problem of sparse matrices, with automatic parallelization of calculations on modern parallel computers with graphics processors. Peculiarities of realization of parallel algorithms for different structures of sparse matrices are presented. The times of solving the problem of stability of composite materialsusing a three-dimensional model of "finite size fibers" on computers of different architectures are given. In mathematical modeling of physical and technical (...) processes in many cases there is a need to solve problems of algebraic problem of eigenvalues with sparse matrices of large volumes. In particular, such problems arise in the analysis of the strength of structures in civil and industrial construction, aircraft construction, electric welding, etc. The solving to these problems is to determine the eigenvalues and eigenvectors of sparse matrices of different structure. The efficiency of solving these problems largely depends on the effectiveness of mathematical modeling of the problem as a whole. Continuous growth of task parameters, calculation of more complete models of objects and processes on computers require an increase in computer productivity. High-performance computing requirements are far ahead of traditional parallel computing, even with multicore processors. Today, this problem is solved by using powerful supercomputers of hybrid architecture, such as computers with multicore processors and graphics processors, which combine MIMD and SIMD architectures. But the potential of high-performance computers can be used to the fullest only with algorithmic software that takes into account both the properties of the task and the features of the hybrid architecture. Complicating the architecture of modern high-performance supercomputers of hybrid architecture, which are actively used for mathematical modeling means a significant complication of efficient use of these resources in creating parallel algorithms and programs. here are problems with the creation of algorithmic software with automatic execution of stages of work, which are associated with the efficient use of computing resources, ways to store and process sparse matrices, analysis of the reliability of computer results. This makes it possible to significantly increase the efficiency of mathematical modeling of practical problems on modern high-performance computers, as well as free users from the problems of parallelization of complex problems. he developed algorithmic software automatically implements all stages of parallel computing and processing of sparse matrices on a hybrid computer. It was used at the Institute of Mechanics named after S.P. Tymoshenko NAS of Ukraine in modeling the strength problems of composite material. A significant improvement in the time characteristics of mathematical modeling was obtained. Problems of mathematical modeling of the properties of composite materials has an important role in designing the processes of deformation and destruction of products in various subject areas. Algorithmic software for mathematical modeling of structural stability is considered, which is reduced to solving a partial generalized problem of eigen values of sparse matrices of different structure of large orders, with automatic parallelization of calculations on modern parallel computers with graphics processors. The main methodological principles and features of implementation of parallel algorithms for different structures of sparse matrices are presented, which ensure effective implementation of multilevel parallelism of a hybrid system and reduce data exchange time during the computational process. As an example of these approaches, a hybrid algorithm of the iteration method in subspace for tape and block-diagonal matrices with a frame for computers of hybrid architecture is given. Peculiarities of data decomposition for matrices of profile structure at realization of parallel algorithms are considered. The proposed approach provides automatic determination of the required topology of the hybrid computer and the optimal amount of resources for the organization of an efficient computational process. The results of testing the developed algorithmic software for problems from the collection of the University of Florida, as well as the times of solving the problem of stability of composite materials using a three-dimensional model of "finite size fibers" on computers of different architectures. The article describes the application of the cassette method of passenger transportation, taking into account the dynamics of passenger traffic during the day by means of an intelligent transport system based on unmanned electric vehicles. The calculation of the required number of electric cars for the cassette for a one-time fulfillment of the delivery plan is presented.

The proposed article is devoted to the description of an intelligent urban passenger transport system based on unmanned electric vehicles, sequentially moving along a separate line. This system is a passenger transport system of a new urban mobility, formed under the influence of social conditions generated by high population density in cities, that suppose the development of pedestrian zones and ecological modes of transport, "transport as a service", etc. In this historical context, public transport systems acquire special relevance. The described (...) transport system belongs to intelligent systems, since it is capable of functioning in autonomous mode without human intervention, adaptively responding to changes in the dynamics of the flow of passengers during the day. Passengers are transported by electric cars, which can be combined into cassettes according to the principle of road trains based on the transportation plan drawn up by the intelligent center of the transport system according to the matrix of correspondences, filled in taking into account the incoming requests for service from passengers. When drawing up a transportation plan, the algorithms of the transport system give preference to transportation according to the "source-destination" principle, that is, when the passenger goes to the destination with a minimum number of intermediate stops, and ideally without them. The paper formulates also a criterion of arising of a conflict in the movement of vehicles, which allows to identify situations when an electric vehicle driving in front can detain vehicles following after. The work has relevance because the criterion will allow to make adjustments in the schedule of movement of vehicles and exclude the loss of time and energy that carries the transport system during braking and acceleration of electric cars, as well as to reduce waiting time and travel of passengers. The controversies in Bristol, Alder Hey and elsewhere in the UK surrounding the removal and retention of human tissue and organs have led to extensive law reform in all three UK legal systems. This paper reports a short study of the reactions of a range of health professionals to these changes. Three main areas of ethical concern were noted: the balancing of individual rights and social benefit; the efficacy of the new procedures for consent; and the helpfulness for professional practice (...) of the new legislation and regulation.
