Previous research indicates that students in engineering self-report cheating in college at higher rates than those in most other disciplines. Prior work also suggests that participation in one deviant behavior is a reasonable predictor of future deviant behavior. This combination of factors leads to a situation where engineering students who frequently participate in academic dishonesty are more likely to make unethical decisions in professional practice. To investigate this scenario, we propose the hypotheses that (1) there are similarities in the decision-making (...) processes used by engineering students when considering whether or not to participate in academic and professional dishonesty, and (2) prior academic dishonesty by engineering students is an indicator of future decisions to act dishonestly. Our sample consisted of undergraduate engineering students from two technically-oriented private universities. As a group, the sample reported working full-time an average of six months per year as professionals in addition to attending classes during the remaining six months. This combination of both academic and professional experience provides a sample of students who are experienced in both settings. Responses to open-ended questions on an exploratory survey indicate that students identify common themes in describing both temptations to cheat or to violate workplace policies and factors which caused them to hesitate in acting unethically, thus supporting our first hypothesis and laying the foundation for future surveys having forced-choice responses. As indicated by the responses to forced-choice questions for the engineering students surveyed, there is a relationship between self-reported rates of cheating in high school and decisions to cheat in college and to violate workplace policies; supporting our second hypothesis. Thus, this exploratory study demonstrates connections between decision-making about both academic and professional dishonesty. If better understood, these connections could lead to practical approaches for encouraging ethical behavior in the academic setting, which might then influence future ethical decision-making in workplace settings. Recent iterations in international legal thought of the debate over the transformative potential of law have tended to echo the long-standing assumption that radical movements, when they employ law-based tactics, do so in the same manner as reformist movements: they mobilise the legitimacy of law for short-term goals, only with more radical long-term goals in mind. However, movements such as the 2012 student strike in the Canadian province of Quebec demonstrate more diverse, creative engagements with law that openly mock the (...) legal system in an effort to simultaneously delegitimise the current legal order. This article argues that this movement’s approach is consistent with the notion of an ‘impudent’ use of law as politics but also extends it further to include ideas raised by this movement’s theatrical ‘over-compliance’ with law, through which the movement turned law itself into a public spectacle. The article examines instances of the state’s unprecedented mobilisation of the legal system to contain the student strike and the student strikers’ creative and subversive engagements with law in response, illustrating how the ideas thrown up by this movement can advance theoretical discussion in legal scholarship about law’s transformative potential. Graebe (Steubenville, OH: Emmaus Academic, 2021), 351 pp.Though Mary's undiminished virginity in giving birth (virginitas in partu) was long understood to be an event as miraculous and a teaching as authoritative as her virginity in conceiving (...) (virginitas ante partum), virginitas in partu underwent a kind of existential reinterpretation in the middle of the twentieth century. Authors such as Albert Mitterer and Karl Rahner suggested that, physically speaking, Jesus's birth might have happened like any other, rupturing the hymen, distending the birth canal, and causing Mary pain, albeit not in the spiritually disintegrating way common to postlapsarian humanity. These arguments effectively "unsettled" the traditional understanding of virginitas in partu, leading theologians of the highest stature to distinguish between the doctrine itself and the anatomical aspects attached to it over time. Fr. Brian Graebe has written a fine book arguing that the bodily dimensions of the virgin birth, including the physical "seal" of virginity, belong to the substance of the doctrine. This more inclusive understanding not only does better justice to the data of tradition, he argues, but illuminates the ecclesiology of the Second Vatican Council. The book impresses by its theologically reflective method, its clarity of exposition, [End Page 1106] and its depth of research—especially into the archival and antepreparatory sources of Vatican II.Vessel of Honor responds in effect to Rahner's argument that physical intactness is peripheral to the dogmatic core of Mary's virginity in partu. To show otherwise, Rahner contended, one would need to show that such a doctrine can be found directly in the apostolic teaching, or that it, "being implicitly contained therein, has grown out of the apostolic doctrine, by a legitimate historical, logical, and theological process, as its authentic development" (68–69). If the bodily aspects of this doctrine really belonged to the deposit of faith, in other words, one would need to show how they are implied in the traditio divino-apostolica, as well as how they cohere organically with the rest of the deposit. The two major parts of Vessel of Honor respond in turn to each aspect of Rahner's challenge.The first three chapters argue that Mary's bodily integrity in parturition belongs at least implicitly to the traditio divino-apostolica. Turning first to the postapostolic tradition, Fr. Graebe shows that—apart from the early exceptions of Origen and Tertullian—patristic sources either affirm or strongly imply a miraculous delivery. This constant witness culminates in the Lateran Council (649 AD), which, while not itself an ecumenical council, was received into the magisterium of Pope Martin and affirmed by the Third Council of Constantinople (680 AD). Its teaching that Mary "gave birth without corruption" (incorruptibiliter... genuisse) would be defended by Paschasius, Ratramnus, Thomas Aquinas, and others. This consensus remained undisturbed until the eve of Vatican II.Even at Vatican II, Fr. Graebe argues in the next chapter, the Council Fathers intended to reaffirm the more inclusive idea of virginitas in partu against those who would marginalize its bodily dimensions. Here he really breaks new ground, delving deep into the antepreparatory, preparatory, and conciliar drafting history. He shows convincingly that many of the chief drafters of the final formula—"Our Lord, who did not diminish his mother's virginal integrity but sanctified it..." (Lumen Gentium §57)—saw it as excluding Rahner's and Mitterer's minimalizing interpretations. Drawing on material from the Vatican Apostolic Archives, Fr. In Helen Frowe’s book, Defensive Killing, she argues that some cases of seemingly futile self-defense are actually instances of justifiable defense of the victim’s honor. This paper explores Frowe’s claim, first by isolating the central cases and then by examining her rejection of punitive reasons. From there, the paper examines Frowe’s understanding of “defense of honor,” ultimately suggesting that Frowe’s conception is best construed as action that has expressive, but not defensive, value. From there, I turn to two more (...) general puzzles. First, what if the defender mistakenly believes that she can successfully defend and acts for that reason, but the reason that actually supports her action is not one she is acting in light of? And, second, how ought we to understand the interests of an aggressor who has forfeited his rights? (shrink)

Many contemporary discussions of forgiveness assume forgiveness is fundamentally admirable. Examining Aristotle’s account, however, demonstrates that there is a tension between desert and forgiveness that is often overlooked in contemporary discussions. Through examining the neglected concept of sungnōmē, which forestalls blame, I conclude that Aristotelian blame is justified only on grounds of fairness. This conclusion is evidence that Aristotelian blame is not merely an instrumental or descriptive tool, but rather a way of holding agents morally accountable. Through examining the emphasis (...) Aristotle places on the role of blame and its role in maintaining honor, I show that forgiveness is incompatible with Aristotle’s account because when the victim decides to forgive, she lets go of blame on grounds other than desert. For Aristotle, when she does so, she accepts less than she is worth, and so forgiving a wrongdoer undermines the victim’s honor. As a result, Aristotle rejects forgiveness as positively vicious. Aristotle’s response to the tension is to reject forgiveness as positively vicious since it involves accepting less than what one deserves. -/- In my dissertation, I resolve this impasse by both defending the value of forgiveness and seeking to resolve the tension by explaining why we can choose to forgive without undermining our own honor. Contra Aristotle, I argue that cultivating the disposition to be forgiving is part of flourishing individual and communal life. The choice to let go what of one deserves, however, need not mean that honor is relinquished. Instead, I defend an alternative account of honor in which honor lies not in demanding what is deserved but instead in committing to the consistent pursuit of the good. On this account, honor is related to the ongoing commitment to a coherent and compelling identity rooted in seeing ethical values as central to the conception of one’s self, rather than outwardly-mediated Aristotelian honor. Honor is thus bound up in commitment to the good life generally, and does not rely on getting what one deserves. My account thus reconciles Aristotelian blame with forgiveness, demonstrates what is valuable about honor, and why it is still worth pursuing in our modern world. (shrink)

This volume is presented in honour of Heinz Post, who founded a distinc tive and distinguished school of philosophy of science at Chelsea College, University of London. The 'Chelsea tradition' in philosophy of science takes the content of science seriously, as exemplified by the papers presented here. The unifying theme of this work is that of 'Correspondence, Invariance and Heuristics', after the title of a classic and seminal paper by Heinz Post, published in 1971, which is reproduced in this (...) volume with the kind permission of the editors and publishers of Studies in History and Philosophy of Science. Described by Paul Feyerabend in Against Method as "brilliant" and " . . . a partial antidote against the view which I try to defend" (1975, p. 61, fn. 17), this paper, peppered with illustrative examples from the history of science, brings to the fore some of Heinz Post's central concerns: the heuristic criteria used by scientists in constructing their theories, the intertheoretic relationships which these criteria reflect and, in particular, the nature of the correspondence that holds between a theory and its predecessors (and its suc cessors). The appearance of this volume more than twenty years later is an indica tion of the fruitfulness of Post's contribution: philosophers of science continue to explore the issues raised in his 1971 paper. This article centres on some of the dilemmas contained within victim positioning. Such dilemmas are often overlooked by the authorities involved with people subjected to relational aggression. 2 For example, when teachers rule out cases of bullying because the victim has ‘participated in’ or ‘laughed at’ some of the bullies’ initiatives, or when a rape victim’s status as a victim is questioned because, in the lead up to the assault, she was supposedly friendly to the rapist. In these cases, (...) it could be useful to explore the reason for the bullying victim’s apparent collusion or to better understand the premises for the rape victim’s positioning options in relation to the perpetrator. In other words, it could be fruitful to explore the dynamics and dilemmas of the victim position. In this article, I aim to reflect on the motivational conditions of the victim phenomenon. These reflections are based on an analysis of qualitative data produced through interviews with school children as well as on relevant secondary literature. (shrink)

Fifteen essays are contained in this collection, all relating to Heinz Post ’ s article ‘ Correspondence, Invariance and Heuristics ’, also reprinted. In this article, written in the heyday of the post - positivist movement, Post aims to convince his fellowphilosophers of science to bring the issue of heuristics back to the philosophical stage. Examining a wealth of theories and models from the physics and chemistry of the last 300 years, Post extracts several strategies of theory construction of which (...) he considers the General Correspondence Principle to be the most important. According to this principle, any acceptable newtheory should explain the well - confirmed part of its predecessor. Later Post states the General Correspondence Principle more precisely and uses it with what he considers its de facto validity to argue against incommensurability, Kuhn - losses, 1 and relativism. Post himself seems to support a kind of convergent realism which is most notably expressed in his credo that science progresses linearly. (shrink)

While discovery of error provides personal gain for the entrepreneur, does this process automatically allocate value equitably among all stakeholders? We argue that the entrepreneurial process can be used to generate or maintain an entrepreneur’s personal wealth through the exploitation of a stakeholder group. Thus entrepreneurship can be both an equilibrating and a disequilibrating process and that both the visible hand of government and the decisions of an entrepreneur can speed or slow our movement toward value equilibrium. Speed toward value (...) equilibrium is likely to be important to a victimized stakeholder group and deserves further scholarly attention. (shrink)

This is an examination of Aristotle's notion of an "accidental being" -- something intermediate between a substance and a property. An accidental being (sometimes called "accidental compound" or "kooky object") is an ephemeral object, typically the compound of a substance and a property, that exists for only as long as its components are united. I set out the role that accidental beings play in Aristotle's solutions to several philosophical problems. I also investigate the similarity between these beings and the individual (...) non-substances of Aristotle's Categories. Finally, I propose that accidental beings can be assimilated into a more contemporary conceptual scheme as events -- the states or conditions that substances are in or undergo. (shrink)

This work proposes research on a still unexplored psychical world: thoughts, emotions, and real events experienced by racket victims of the three largest criminal organizations of the South of Italy: Mafia, Camorra, and ‘Ndrangheta. The purpose is to understand the multifaceted psycho-anthropological and social issues criminal organizations have settled on, and particularly which psycho-relational dynamics and sociocultural codes come into play in the complex and controversial relationship between victim and criminal system, between victim and support systems. With entrepreneurs and tradesmen (...) victims of organized crime, we have analyzed lived experiences—in particular fear—and psychological problems they had to cope with; events and motivations that allowed them “breaking” the silence and asking for help; the representation of a support network before and after their possible pressing charges; the kind of help offered by support systems. Sometimes victims cannot defend themselves against the threat posed to them, but they can nevertheless harm or even kill their aggressors. Since they cannot defend themselves, it is unclear how such harming can be justified under the title of self-defense. According to the “Honor Solution,” by violently resisting their aggressors, victims do (partially) defend themselves because they protect their honor. Blake Hereth recently argued that this solution is incompatible with the feminist commitment that sexual assault victims ought not to be (...) shamed or dishonored. The purpose of my paper is to reject Hereth's criticism and defend the Honor Solution. (shrink)

Paul Weiss is one of the two or three most original and creative philosophers and metaphysicians in America today. Creativity and Common Sense reveals why. It contains fourteen recent articles on the thought of Paul Weiss by authors who are most familiar with his writings, including an essay by Charles Hartshorne that provides a unique perspective on Weiss by one who has known him for his entire career. Weiss is shown to be one of the very few contemporary philosophers who (...) examines every area of concern to philosophy and does so on the basis of ontological insights regarding the ultimate elements of reality. He begins his philosophical consideration with the evidences offered by the world of common sense and seeks to provide an adequate and comprehensive account of what he finds there. The contributors to this collection present and examine many of Weiss’ strategic insights. They help clarify key elements in his thought and thereby contribute to an appreciation and understanding of his work. They also make evident the importance of Weiss’ insights for resolving vexing questions in such diverse areas as the philosophy of science, philosophical methodology, ethics, aesthetics, the philosophy of the human person, and the philosophy of language. This collection makes a significant contribution to the development of Weissian scholarship and to the growing appreciation of the significance of his thought for the discussions of contemporary philosophy. On January 11, 2024, the United Kingdom (U.K.) Supreme Court rendered its judgment in _Paul v Royal Wolverhampton NHS Trust_, restricting the circumstances in which “secondary victims” can successfully claim for damages in clinical negligence cases. This ruling has provided welcome clarity regarding the scope of negligently caused “pure” psychiatric illness claims, but the judgment may well prove controversial. In this article, I trace the facts and opinion from the majority and also discuss an important dissenting opinion. I then reflect (...) on what the ruling means for psychiatric illness claims by secondary victims, and more broadly on the implications for clinical negligence law. I suggest that while much-needed clarity has been injected in this area of the law, it is difficult, reading the majority of the Supreme Court’s emphasis on the restricted scope of a medical practitioner’s duty, to envision a scenario in which secondary victim could ever succeed in a clinical negligence context. Even though since 1965 the Great Cultural Revolution was basically an internal struggle in Mainland China, it coincided with a high tide of criticism toward Russian revisionism and therefore constituted a struggle for defining the ideological line of the Chinese Communist Party. As an internal struggle, the Great Cultural Revolution subjected all phases of cultural activity and personnel to a severe political grinding down so that a more uniform political consciousness of Maoism was generated as the guiding principle of the (...) nation; as an attempt to repudiate Russian revisionism and to assert the ideological identity of Maoism, the Great Cultural Revolution has helped in practice to provide a model of continuing revolution for a genuinely pursued Marxist society. In his long article, Chou Yang, who himself later became a target and victim of the Great Cultural Revolution, spelled out the latter message and hinted at the former possibility. What is even more significant is that he stressed repeatedly the importance of the role philosophy workers and social science workers must play in waging an ideological struggle against both Marxist revisionism and capitalism, on the one hand, and the importance of political leadership in the studies and works of philosophy and the social sciences, on the other. Law, Morality and Society Essays in Honour of H.L.A Hart.

A popular argument against direct duties for individuals to address climate change holds that only states and other powerful collective agents must act. It excuses individual actions as harmless since they are neither necessary nor sufficient to cause harm, arise through normal activity, and have no clear victims. Philosophers have challenged one or more of these assumptions; however, I show that this definition of harm also excuses states and other collective agents. I cite two examples of this in public discourse (...) and suggest we reconsider the notion of harmful action in our discussions about climate change. (shrink)

This collection of essays focuses on the concepts of tolerance and intolerance as it commemorates the life of James Parkes - the man who pioneered the study of antisemitism and Jewish-non-Jewish relations. The essays analyse many different examples of antisemitism, ambivalence and philosemitism.

ObjectivePeer victimization is a substantial early life stressor linked to psychiatric symptoms and poor academic performance. However, the sex-specific cognitive or behavioral outcomes of bullying have not been well-described in preadolescent children.MethodsUsing the baseline dataset of the Adolescent Brain Cognitive Development Study 2.0.1 data repository, we evaluated associations between parent-reported bullying victimization, suicidality, and non-suicidal self-injury, as well as internalizing and externalizing behavioral problems, cognition, and academic performance.ResultsOf the 11,015 9-10-year-old children included in the analyses, 15.3% experienced bullying victimization, as (...) reported by the primary caregiver. Of these, boys were more likely to be bullied than girls. Children who were bullied were more likely to display NSSI or passive suicidality and active suicidality. Bullied children also had lower cognitive scores, greater behavioral problems, and poorer grades. Across all participants, boys had poorer grades and greater behavioral problems than girls; however, bullied boys had greater behavioral problems than girls in several areas. Compared to their non-bullied peers, bullied children with greater non-suicidal self-injury or suicidality also had greater behavioral problems and poorer grades.ConclusionThese findings highlight the sex-specific effects of bullying, and the negative associations of bullying victimization with cognitive performance, behavioral problems, and academic performance. Future longitudinal studies will identify the natural history and neural correlates of these deficits during adolescence. (shrink)

A major challenge to the Doctrine of Double Effect is the concern that an agent’s intention can be identified in such a fine-grained way as to eliminate an intention to harm from a putative example of an intended harm, and yet, the resulting case appears to be a case of impermissibility. This is the so-called “closeness problem.” Many people believe that one can address the closeness problem by adopting Warren Quinn’s version of the DDE, call it DDE*, which distinguishes between (...) harmful direct agency and harmful indirect agency. In this paper, I first argue that Quinn’s DDE* is just as vulnerable to the closeness problem as the DDE is. Second, some might think that what we should therefore do is give up on intentions altogether and move towards some kind of non-state-of-mind, victim-based deontology. I shall argue against this move and explain why intentions are indispensable to an adequate nonconsequentialist theory. Finally, I shall propose a new way of answering the closeness problem. Recently, Gerhard Øverland and Alec Walen have developed novel and interesting theories of nonconsequentialism. Unlike other nonconsequentialist theories such as the Doctrine of Double Effect, each of their theories denies that an agent’s mental states are relevant for determining how stringent their moral reasons are against harming others. Instead, Øverland and Walen seek to distinguish morally between instances of harming in terms of the circumstances of the people who will be harmed, rather than in features of the agent doing the (...) harming. In this paper, we argue that these theories yield counterintuitive verdicts across a broad range of cases that other nonconsequentialist theories handle with relative ease. We also argue that Walen’s recent attempt to reformulate this type of theory so that it does not have such implications is unsuccessful. (shrink)
