It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

In order to show the validity of here proposed conception of social ontology and its advantages over descriptive theories of social reality, which in the analysis of the socio-ontological status of human rights find only legally understood normativity as present in social reality, we will first lay out Searle’s interpretation of human rights. In the second step, we will introduce the methodical approach and basic concepts of our socio-ontological position, and explain the structure of the relationship between justice, law, morality, (...) social institutions and collective intentionality. At the end we will show how our theory of social ontology is better than Searle’s legal positivism in examining the ontological status of human rights. At the end, we show in what ways such a theory of social ontology more intuitively and with wider arguments explains the ontological status of institution of human rights than Searle’s legal positivism. My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

Die vorliegende Arbeit berücksichtigt die Philosophie und Poetik der Geschichte und der Sprache a priori im poetischen und literarischen Werk von Peter Handke, in seinem poetologischen Essay Ich bin ein Bewohner des Elfenbeinturms und seinem Drama Die Fahrt im Einbaum oder das Stück zum Film vom Krieg, und zwar im Ausgang von der kantianischen Idee der Apriorität der Geschichte. Die Geschichte a priori ist, laut Kant, möglich, „wenn der Wahrsager die Begebenheiten selber macht und veranstaltet, die er zum voraus verkündigt“. (...) Die identische Idee vom Subjekt, das vor der Geschichte besteht, finden wir auch im poetischen Werk von Peter Handke, sowohl in seinen poetologischen Schriften, als auch in seinem dichterischen Werk. In this paper I follow Ted Nannicelli in the project of establishing boundaries of television works. I focus on serialized television works pertaining to a particular genre and I set out to provide an account of their identity. My claim is that external identity of such works is determined by their specific genre-affiliation, given the way in which generic norms determine the content of the series, namely, its characteristic storylines and regular set of characters. From the internal perspective, a series’ (...) identity is determined by the particular way in which it implements abstract generic norms. I describe the process of such implementation as creation of series-specific formulaic patterns, and I analyze different layers of works where such patterns are evident. My central claim is that series-specific formulaic patterns create a coherent set of norms which, through repeated instantiation in the series’ episodes, become associated with that particular series. The function of this set is to establish the series’ boundaries, and to maintain its identity when different modifications to the patterns are made. (shrink)

In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

Humeanism about laws has been famously accused of the explanatory circularity by David Armstrong and Tim Maudlin, since the Humean laws hold in virtue of their instances and, at the same time, scientifically explain those very instances. Barry Loewer argued that the circularity challenge rests on an equivocation: in his view, once the metaphysical explanation is properly distinguished from the scientific explanation, the circularity vanishes. However, Marc Lange restored the circularity by appealing to his transitivity principle, which connects the two (...) types of explanation. Lange’s transitivity principle has been widely discussed and criticised in the literature. In view of counterexamples, Lange refi ned both the principle, by taking into account the contrastive nature of explanation, and the requirement of prohibition on self-explanation. Recently, Michael Hicks has developed a new strategy for defending Humeanism about laws from the refined circularity challenge, critically appealing to the contrastive nature of both explanations and meta-explanations. We contrast two positions concerning the initial domain of actions that infants interpret as goal-directed. The 'narrow scope' view holds that goal-attribution in 6- and 9-month-olds is restricted to highly familiar actions (such as grasping) (). The cue-based approach of the infant's 'teleological stance' (), however, predicts that if the cues of equifinal variation of action and a salient action effect are present, young infants can attribute goals to a 'wide scope' of entities including unfamiliar human actions and actions of (...) novel objects lacking human features. It is argued that previous failures to show goal-attribution to unfamiliar actions were due to the absence of these cues. We report a modified replication of showing that when a salient action-effect is presented, even young infants can attribute a goal to an unfamiliar manual action. This study together with other recent experiments reviewed support the 'wide scope' approach indicating that if the cues of goal-directedness are present even 6-month-olds attribute goals to unfamiliar actions. In this paper, I address the question of engaged philosophy with an emphasis on aesthetics and the philosophy of art. Referring to some specific problems discussed in these areas – in particular climate change, ecological crisis and immoral art – I demonstrate that philosophy can be engaged in two ways: (i) in its aspiration to question social reality, culture, human experience and the strategies for making sense of and finding value in that experience; (ii) in the aspiration to contribute to (...) the well-being of individuals and society through its contribution to understanding that reality and experience. First, I point to the connection between the philosophical questions and the fundamental intellectual aspirations of human beings as social and cultural beings, but also as autonomous knowers and valuers. Second, I respond to two objections that can be directed against engaged philosophy: (i) one that points to a lack of consensus among philosophical responses (the problem of disagreement), and (ii) one that highlights the irrelevance of philosophical debates to our social practice. With his thesis on the genius who does not know from where their ideas come from and how they create, Kant left an indelible mark on thought concerning art and artistic creation. He insisted that it represents a unique act by natural gift, and thus specific for the domain of art, and specifically not belonging to the domain of science. Although today we know that such a disposition is wrong, many of Kant’s claims are supported in contemporary theories in cognitive (...) science, but also by the artistic practice. In this paper, I will analyse Kant’s theory of beautiful art and artistic creation in the context of contemporary research on creativity and talent and show how much is Kant’s theory on beautiful art and artistic creation rich explanatory, especially for understanding and thinking the artistic creation, artistic reception and artistic practice. Following the recent wave of globalization, the possession of different types of knowledge became even more important for economic development than the possession of physical resources. The ability of a society to adopt existing and create new knowledge thus gained fundamental importance for its wellbeing. In this paper, we identify important aspects of the relationship between education, creation of knowledge, economic growth, as well as both material and immate?rial wellbeing of a society. We describe potential problems that prevent societies from (...) maximizing the benefit from the effort its members invest in acquiring knowledge. The problems of failure of the national markets for education as well as the global migrations which lead to drain of knowledge towards economically highly developed countries are especially analyzed. In the long run, they lead to a decline in both national competitiveness and different aspects of the immate?rial wellbeing. As the basis for solving these problems we propose a combination of economic theory and the concept of solidarity between more and less devel?oped countries, individuals and societies of their origin, respecting the free will of individuals. nema. Frisch’s 1933 macroeconomic model for business cycles has been extensively studied. The present study is the first comprehensive mathematical analysis of Frisch’s model. It provides a detailed reconstruction of how the model was built. We demonstrate the workability of Frisch’s PPIP model without adding hypotheses or changing the value of Frisch’s parameters. We prove that (1) the propagation model oscillates; (2) the PPIP model is mathematically incomplete; (3) the latter could have been calibrated by Frisch; (4) Frisch’s analysis and demonstration (...) are based on Poincaré’s methodology. Since the latest political changes, the FRY faces a choice of a transition strategy and privatization model whithin it. After ten years of transition in East Europen countries, well established patterns in marked oriented reforms and subsequent results are observed and could serve as policy lessons for the FRY. Regarding the significant impact that initial conditions have on efforts and results of transition macroeconomic policy and structural reform implementation, the paper presents the prevailing institutional setting of the Yugoslav economy inherited (...) from the communist regime. Also, the ten years of Yugoslav privatization experience is reported to have weak results due to the poor concept. Debates on privatization, as well on structural reforms and macroeconomic policy, have again become lively in the FRY.Depuis les derniers changements politiques, la République Fédérale de Yougoslavie fait face à un choix de stratégies de transition et de modèles de privatisation. Après dix années de transition dans les pays de l’Europe de l’Est, des schémas bien établis de réformes menant à l’économie de marché et les résultats qui en découlent sont observés et pourraient servir de leçon pour la République Fédérale de Yougoslavie sur le plan politique. Eu égard à l’impact significatif qu’ont les conditions initiales sur les efforts et les résultats de la politique macroéconomique de transition et d’instauration de la réforme structurelle, l’article souligne que l’environnement institutionnel de l’économie yougoslave est un héritage du régime communiste. Aussi, les dix années de privatisation en Yougoslavie ont donné lieu à des résultats peu significatifs, précisément à cause de l’héritage évoqué. Les débats autour de la privatisation, des réformes structurelles et de la politique macroéconomique sont à nouveau d’actualité en République Fédérale de Yougoslavie. (shrink)

Insbesondere dadurch was der Autor als "souveranes Vergehen" und "idealistische Casur" beschreibt. Die Grundlinien dieser Arbeit kehren zuruck zu den grundlegenden Figuren der Philosophie Hegels und ziehen sich auf den Problemkreis des Verhaltnisses zwischen des Rechts und der Geschichte, in Rucksicht auf die konstitutive Rolle der Gewalt bei jeder Institutionalisierung des Rechts und der Begrundung neuer Lebensgestalten, zusammen. Das Hauptthese konzentriert sich auf das Bestehen der dialektischen Kluft innerhalb der Hegelschen Differenzierung zwischen der Freiheitsvollendung im Staate und dem philosophischen Wissen, das fur die Weltgeschichte grundlegend ist: der Begriff der absoluten Freiheit, der in seiner Abstraktheit in der Weltgeschichte seine Kraft der Zerstorung zeigt, ist gerade dasselbe, was am Begriff der Philosophie selbst tief geschichtlich ist, worin er aber seine konkrete Macht bei der Entstehung neuer normativer Ordnungen mit sich bringt. In a departure from the mainstream methodology of a positivist-oriented jurisprudence, Collective Rights provides the first legal-theoretical treatment of this area. It advances a normative-moral standpoint of 'value collectivism' which goes against the traditional political philosophy of liberalism and the dominant ideas of liberal multiculturalism. Moreover, it places a theoretical account of collective rights within the larger debate between proponents of different rights theories. By exploring why 'collective rights' should be differentiated from similar legal concepts, the relationship between collective and (...) individual rights and why groups should be recognised as the third distinctive type of right-holders, it presents the topic as connected to the larger philosophical debate about international law of human rights, most notably to the problem of universality of rights. We found, however, an unexpected, positive feature of decoupling in the study of a local government; namely, when organizational members engage in discussions that turn away from the letter of an ethics code they often do so to address higher ethical principles embedded in the spirit of the code. (...) The decoupled understanding of the code in these cases becomes a symbolic, legitimating gesture grounded not in strict provisions but in creative and complex interactions. This counterintuitive explanation of decoupling capitalizes on discourse that evolves from a legalistic interpretation to rich discussions that value the multiplicity of voices within organizational life. What follows is that ethical decision making emerges as creative, dynamic, and responsive to its constituents. (shrink)

Our engagements with poetry often leave us with a sense of having been not only aesthetically pleased and emotionally aroused but intellectually stimulated and cognitively rewarded.1 However, explicating the nature of such intellectual stimulus and accounting for poetry’s cognitive values are not easy tasks, given that poetry does not stand in the same relation to truth and knowledge as do science and philosophy. Decisions in democracy are binding not in virtue of being true or good, but on account of being an outcome of the majority voting procedure. For some, this is a proof of an intricate connection between democracy and moral relativism. The ‘militant democracy’ model, on the other hand, is premised on the idea that certain political actors and choices have to be banned for being fatally bad for democracy. This gives rise to the claim that protected democratic fundamental values of (...) freedom and equality enjoy the status of absolute moral standards. This article dismisses the intuition that justification of ‘militant democracy’ depends on unpacking the relation between democracy and meta-ethics. Instead, following Bernard Suits’ analytical exposition of the important features of games, it demonstrates, first, how democracy is like a game and, then, it argues that a plausible justification of ‘militant democracy’ stems from its game-like character. The first part of the paper focuses on the current debate over the universality of human rights. After conceptually distinguishing between different types of universality, it employs Sen’s definition that the claim of a universal value is the one that people anywhere may have reason to see as valuable. When applied to human rights, this standard implies “thin” (relative, contingent) universality, which might be operationally worked-out as in Donnelly’s three-tiered scheme of concepts–conceptions–implementations. The second part is devoted to collective rights, (...) which have recently become a new topic of the human rights debate. This part provides the basis of political–philosophical justification and legal–theoretical conceptualization of collective rights, as rights directly vested in collective entities. The third part dwells on the problem of universality of collective rights. It differentiates between the three main collective entities in international law—peoples, minorities, and indigenous peoples—and investigates whether certain rights vested in these collectives might, according to Sen’s standard, acquire the status of the universal ones. After determining that some rights are, in principle, plausible candidates for such a status in international law, this paper concludes by taking notice of a number of the open issues that still need to be settled, primarily by the cooperative endeavor of international legal scholars and legal theorists. Abstract:My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art’s impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art’s impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

Ovaj rad se bavi metodološkim aspektima obnovljenih pravno-filozofskih nastojanja da se preispita pojam međunarodnog prava. Posle kratkog osvrta na istoriju pravne filozofije i ključne tačke Hartovog i Kelzenovog pozitivističkog stanovišta, u radu se dalje ispituje na koji način se savremene pravne teorije, kako u pozitivističkoj, tako i u ne-pozitivističkoj tradiciji, bave međunarodnim pravom. Poslednji deo rada predstavlja pokušaj da se skiciraju određene smernice za novi početak u filozofskoj obradi međunarodnog prava. Prvo, istorija rasprava u ovoj oblasti svedoči o tome da (...) su metodološki pravni teoretičari u pravu kada tvrde da nam utvrđivanje odgovarajućeg metoda pomaže u odgovoru na pitanje šta je pravo. Drugo, imajući na umu stalno promenjivu prirodu međunarodnog prava, odgovarajući metodološki pristup zahteva „evolucionarnu epistemologiju“ (D’Amato), koja teško da se može nazvati obeležjem analitičke jurisprudencije. Najzad, takva epistemologija je na kompleksan način povezana sa našim istraživanjem šta međunarodna pravda ili, bar, šta međunarodna „unutrašnja moralnost“ zahteva. (shrink)

ABSTRACT:Evidence abounds that when ethics initiatives are decoupled from the actual work of organizations, ethics policies may become little more than “window dressing” (Weaver, Trevino, and Cochran 1999; Collen and Gonella 2002). We found, however, an unexpected, positive feature of decoupling in the study of a local government; namely, when organizational members engage in discussions that turn away from the letter of an ethics code they often do so to address higher ethical principles embedded in the spirit of the code. (...) The decoupled understanding of the code in these cases becomes a symbolic, legitimating gesture grounded not in strict provisions but in creative and complex interactions. This counterintuitive explanation of decoupling capitalizes on discourse that evolves from a legalistic interpretation to rich discussions that value the multiplicity of voices within organizational life. What follows is that ethical decision making emerges as creative, dynamic, and responsive to its constituents. (shrink)

In diesem Aufsatz wird das Verhältnis zwischen den Begriffen Gelassenheit und πόλεμοσ, von Heidegger als „Auseinanderset- zung“ übersetzt und aufgefasst, untersucht. Der Betrachtung liegt dabei die Frage zu Grunde, ob der späte Heidegger sich mit den Begriffen Gestell und Gelassenheit überhaupt noch im Sinne grundlegender Gestalten der mensch- lichen Lebensweise auseinandersetzt, so wie er es in den 30er Jahren tat und behauptete. Weitergehend wird die Beziehung des Begriffs der Gleichförmig- keit, verstanden als eine Folge der technischen Herrschaft über die Erde, (...) zu C. Schmitts Begriff der Neutralisierung als eine der Konsequenzen der zu- nehmenden Technisierung hergestellt und diskutiert. (shrink)

The aim of this article is to explore the ways and forms in which history is present, represented and used in Vygotsky’s theorizing. Given the fact that Vygotsky’s theory is usually described as a cultural-historical theory, the issue of history is necessarily implicated in the theory itself. However, there is still a gap between history as implicated in the theory and an explicit theorizing of history – both in Vygotsky’s writings and in Vygotskian scholarship. Therefore it is expected that it (...) would be fruitful to shed light on some possible pathways that can bridge this gap. The prevailing theoretical role of history in Vygotsky’s theory is to serve as a general framework which provides tools for the development of higher psychic functions. Thus, history is recognized as a formative context of psychic life. Further, history appears in Vygotsky’s writings also as a projected better future. All these uses of history presuppose an idea of history as linear progress. But Vygotsky also argues for a stronger epistemological claim – that history is the most powerful explanatory principle. After conceptual and theoretical reflection on history, some limitations of Vygotsky’s historicizing of the history of psychic development will be pointed out and related to general epistemological problems of historicizing. Finally, Vygotsky’s cultural-historical theory, an edifice built up in the 1930s but relying on the rich philosophical and psychological legacy available up to that time, will be positioned against the pluralistic, postmodern and hermeneutic turn in contemporary social and human sciences.
