Working through a semiotic method, Condillac is able to radically revisit the theory of ideas developed by predecessors such as Malebranche and Locke. This critical edition allows readers to better understand Condillacs essential contributions to Enlightenment philosophy. Il l'est tout (...) d'abord du fait qu'on ne sait pas exactement dans quelles conditions il a ete compose, et que, faute de manuscrits, il reste impossible a ce jour d'en connaitre la redaction initiale. Il lui devient alors possible de bousculer de l'interieur la theorie des idees sous les formes qu'elle a prises chez ses predecesseurs, en particulier Malebranche et Locke, et de reconduire sans reste l'idee jusqu'a la sensation. Les comportements individuels et collectifs en présence d’incertitude peuvent paraître irrationnels ou se modifier au cours du temps à la suite de nouvelles informations ou d’événements plus ou moins en lien avec ces incertitudes. Ceci pose la question des moyens mis à disposition des autorités publiques pour prévenir et gérer ces situations. Dans cet article, nous nous intéressons aux comportements des individus face aux situations incertaines en mettant en avant la manière dont la population peut percevoir ces incertitudes et les (...) informations provenant de sources diverses. Nous reprenons la littérature économique des comportements et prises de décision dans un environnement incertain afin de mettre en évidence les difficultés de la mise en place de politiques notamment d’incitation à la prévention. Decision-making assisted by algorithms developed by machine learning is increasingly determining our lives. Unfortunately, full opacity about the process is the norm. Would transparency contribute to restoring accountability for such systems as is often maintained? Several objections to full transparency are examined: the loss of privacy when datasets become public, the perverse effects of disclosure of the very algorithms themselves, the potential loss of companies’ competitive edge, and the limited gains in answerability to be expected since sophisticated algorithms usually are (...) inherently opaque. It is concluded that, at least presently, full transparency for oversight bodies alone is the only feasible option; extending it to the public at large is normally not advisable. Moreover, it is argued that algorithmic decisions preferably should become more understandable; to that effect, the models of machine learning to be employed should either be interpreted ex post or be interpretable by design ex ante. Game theory is the mathematical study of strategy and conflict. It has wide applications in economics, political science, sociology, and, to some extent, in philosophy. Where rational choice theory or decision theory is concerned with individual agents facing games against nature, game theory deals with games in which all players have preference orderings over the possible outcomes of the game. This paper gives an informal introduction to the theory and a survey of applications in diverse branches of philosophy. No criticism (...) is reviewed. Game theory is shown at work in discussions about epistemological dependence, liberalism and efficiency, Hume’s concept of convention, morality and rationality, and distributive justice and egalitarianism. Dans cet article, je reviens sur un constat bien connu, mais jamais parfaitement élucidé : Rousseau n’emploie que très exceptionnellement l’expression « intérêt général », à laquelle il préfère celle d’« intérêt commun ». Je m’efforce d’y apporter une explication nouvelle, en partant d’un réexamen du concept même d’« intérêt » dans son œuvre, auquel il faut prêter un sens assez différent de celui auquel la philosophie politique nous a accoutumés : l’intérêt ne saurait être individuel, il ne saurait s’identifier (...) à l’« avantage », il ne saurait faire l’objet d’un « calcul ». À ce titre, il existe une véritable antinomie entre la notion d’intérêt commun chez Rousseau et celle d’intérêt général qui se formalise chez les physiocrates de façon quasi contemporaine. L’intérêt commun est la base de formation démocratique d’une volonté politiquement orientée, qui prend comme telle le nom de « volonté générale », là où l’intérêt général est le langage normatif dans lequel une décision politique non nécessairement démocratique cherche à fonder sa légitimité en raison. How management philosophy is conceived depends on if pragmatism is acknowledged or not! After having been under the main domination of management science both research and education has until recently widened its scope from a decision-making to an action-perspective. It seems to be a recent reconnection to pragmatism that makes the 2011 Carnegie report propose to rethink management in liberal arts terms, whilst the vastly influential 1959 Carnegie Pierson report distanced itself from American pragmatism thus focusing on decisions and forgetting (...) actions. Actions may contain decisions and choices but contain more than that. A decision-perspective explains by causal inference modelling choices as calculated or programmed. The action-perspectives strive at understanding intentions of agents by philosophical interpretations of action stories. It is less limited to finding the logics for constructing worlds, to paraphrase Herbert Simon’s favorite philosopher Rudolf Carnap, than embarking on plausible, although not certain, reconstructions of intentions giving meaning to action stories. This can be illustrated by turning to Elizabeth Anscombe’s Wittgensteinian investigation of intentions as Aristotelian syllogistic reasoning. Her constant analytical care to defend a philosophy of action against metaphysical assumptions and taken-for-granted “psychologisms” shows that an action-perspective is as analytic as ever one of decision-making. What differs is that the latter seems constantly attracted by programming inquiry by “scientific methodology” whilst the latter is charmed by philosophical approaches to action welcoming fascinating conundrums, enigmas and human goofs in the reality of managerial practice. Management science wants to reduce management to logics, programs and models for formal decision making whereas management philosophy is closer to spotting the artfully entrepreneurial in actions. The latter points in the direction of engineering tools, the former to appreciate the toys of management as artwork. Finally the argument of Georg Henrik von Wright helps us see that the two are philosophically compatible; for in a pragmatically inspired management philosophy actions may well contain decisions. There is a death by suicide in the world every 40 seconds, and suicide is the second leading cause of death for 15–29-year-olds. Experts say that one of the best ways to prevent suicide is for those in distress to hear from people who care about them. Facebook is in a unique position—through its support for networks and friendships on the site—to help connect a person in these difficult situations with people who can support them. Connecting people with the resources (...) they need is part of Facebook’s ongoing efforts to help build a safe community inside and outside of Facebook. This article provides a brief overview of how Facebook’s work to develop suicide prevention tools started and evolved, and the ethical considerations which surfaced during the process in the form of concrete product decisions around the implementation of these tools. This article is structured into three sections. Section 1 reviews what has been done in this space and lists and briefly describes other suicide prevention apps and tools. Section 2 describes Facebook’s overall approach to suicide prevention. Here, we’ll delve first into how that approach originated and how it was influenced by the external community’s proactive interactions with Facebook, highlighting our unique position to help address the problem. Afterwards, we’ll explain how that approach evolved, describing its various stages and iterations: understanding, reactive reporting, queue prioritization, and proactive reporting. This section describes the tools and resources Facebook has developed for people who may be at risk. Particular attention is devoted to the use of ArtificiaI Intelligence and Machine Learning to detect posts or live videos where someone might be expressing thoughts of suicide. Section 3 will elaborate on the ethical questions addressed when developing our approach and when making concrete product decisions to implement our suicide prevention tools. In this last section, we’ll expound the competing values and interests that were at stake during the product development process, and how we reached ethical balances between them. (shrink)

Key legislations in many countries emphasize the importance of involving children in decisions regarding their own health at a level commensurate with their age and capacities. Research is engaged in developing tools to assess capacity in children in order to facilitate their responsible involvement. These instruments, however, are usually based on the cognitive criteria for capacity assessment as defined by Appelbaum and Grisso and thus ill adapted to address the life-situation of children. The aim of this paper is to revisit (...) and critically reflect upon the current definitions of decision-making capacity. For this purpose, we propose to see capacity through the lens of essential contestability as it warns us against any reification of what it means to have capacity. Currently, capacity is often perceived of as a mental or cognitive ability which somehow resides within the person, obscuring the fact that capacity is not just an objective property which can be assessed, but always operates within a dominant cultural framework that “creates” that same capacity and defines the threshold between capable and incapable in a specific situation. Defining capacity as an essentially contested concept means using it in a questioning mode and giving space to alternative interpretations that might inform and advance the debate surrounding decision-making. Décrire la psychologie des philosophes, ce n'est pas fouiller dans leur vie pour exhiber leurs petits secrets. C'est plutôt constater qu'entre les deux extrêmes d'une métaphysique de la durée et d'une anthropologie de l'homme grec, une lignée de penseurs initialement formés à la philosophie a fourni une contribution décisive à l'histoire de la psychologie. C'est exhumer des entreprises originales aussi méconnues que la psychologie historique, objective, comparée d'Ignace Meyerson, ou la psychologie sociale génétique de Philippe Malrieu, ressaisies dans leurs relations (...) concrètes. Mais c'est aussi prendre conscience que nombre de grandes figures de la philosophie française ont croisé la route de ces psychologues au point de retrouver, sans toujours le dire, leur méthode, leur objet ou leurs concepts, comme font fait Jean-Paul Sartre et Michel Foucault. C'est enfin se rendre compte que, par-delà l'opposition des structuralistes à la psychologie et en marge des développements des sciences cognitives, il y a place dans la pensée contemporaine pour ces hybridations "psycho-philosophiques". Diderot s’est passionné toute sa vie pour les questions musicales. C’est à travers elles que cet article traite du thème de la « perception des rapports » dans l’esthétique diderotienne. Le trait saillant des « Principes généraux d’acoustique » (1748) est le refus de distinguer un point de vue strictement scientifique et esthétiquement neutre, et un point de vue proprement esthétique. Dans les pas du Descartes de l’Abrégé de musique, et dans une discussion serrée avec le père André, Diderot soutient (...) une thèse que l’on pourrait qualifier d’empirico-malebranchienne. Si, sur le modèle de l’optique cartésienne, Diderot soutient que l’oreille perçoit les consonances et le beau musical selon une sorte de trigonométrie naturelle, il refuse de l’appuyer sur l’action directe d’une puissance supérieure à l’esprit, comme chez l’auteur de De la recherche de la vérité. La « perception des rapports » est au contraire fondée sur une conception empiriste du nombre : c’est dans l’expérience du dénombrement, et par le biais des sens, que nous connaissons le nombre. La conception des « corps harmoniques », développée dans la « Lettre à Mlle *** », permet d’associer la réalité des rapports des nombres, leur rationalité et le plaisir des corps – sans faire appel à une raison universelle sur le modèle malebranchien. Over the past three or four decades, the concept of medical ethics has changed from a limited set of standards to a broad field of debate and research. We define medical ethics as an arena of moral issues in medicine, rather than a specific discipline. This paper examines how the disciplines of health care ethics and health care law have developed and operated within this arena. Our framework highlights the aspects of jurisdiction and the assignment of responsibilities . This theoretical (...) framework prompted us to study definitions and changing responsibilities in order to describe the development and interaction of health care ethics and health law. We have opted for the context of the Dutch debate about end-of-life decisions as a relevant case study. We argue that the specific Dutch definition of euthanasia as ‘intentionally taking the life of another person by a physician, upon that person’s request’ can be seen as the result of the complex jurisdictional process. This illustrates the more general conclusion that the Dutch debate on end-of-life decisions and the development of the two disciplines must be understood in terms of mutual interaction. (shrink)

The ethics of autonomous vehicles has received a great amount of attention in recent years, specifically in regard to their decisional policies in accident situations in which human harm is a likely consequence. Starting from the assumption that human harm is unavoidable, many authors have developed differing accounts of what morality requires in these situations. In this article, a strategy for AV decision-making is proposed, the Ethical Valence Theory, which paints AV decision-making as a type of claim mitigation: different road (...) users hold different moral claims on the vehicle’s behavior, and the vehicle must mitigate these claims as it makes decisions about its environment. Using the context of autonomous vehicles, the harm produced by an action and the uncertainties connected to it are quantified and accounted for through deliberation, resulting in an ethical implementation coherent with reality. The goal of this approach is not to define how moral theory requires vehicles to behave, but rather to provide a computational approach that is flexible enough to accommodate a number of ‘moral positions’ concerning what morality demands and what road users may expect, offering an evaluation tool for the social acceptability of an autonomous vehicle’s ethical decision making. Créée par Éric Rochant, Le Bureau des légendes (Canal +, 2015-2020) explore le monde du renseignement en décrivant le travail du service des agents clandestins de la DGSE. Face aux incertitudes et aux complexités géopolitiques du monde contemporain, elle fait le choix d’une immersion au cœur du « renseignement humain ». Cet article envisage l’hypothèse selon laquelle une telle fiction permet de restaurer la confiance des spectateurs vis-à-vis de la capacité d’une démocratie à lutter contre ce qui la menace. En (...) plongeant son spectateur dans les coulisses du renseignement, en le familiarisant avec des personnages complexes, la série questionne la légitimité de la confiance qu’il est possible d’accorder à un service de renseignement. La faillibilité des agents, mise en scène de façon détaillée, réfléchie par la série elle-même, rassure parce qu’elle permet de comprendre et de partager une forme de vie spécifique qui est celle de l’action secrète. L’espionnage, le contre-espionnage et le contre-terrorisme apparaissent alors comme des pratiques reposant en dernier ressort, non pas sur une maîtrise absolue, mais sur la décision de faire confiance ou au contraire de se méfier. Mobilisant les recherches de la sociologie contemporaine à propos de la confiance (Giddens, 1994 et Luhmann 2006), il s’agit de décrire Le Bureau des légendes comme une fiction projetant sur nos écrans, la possibilité d’une restauration de la confiance ou pour le dire à la manière de Stanley Cavell, une issue possible au scepticisme. Patient organizations increasingly play an important role in health care decision-making in Western countries. The Netherlands is one of the countries where this trend has gone furthest. In the literature some problems are identified, such as instrumental use of patient organizations by care providers, health insurers and the pharmaceutical industry. To strengthen the position of patient organizations government funding is often recommended as a solution. In this paper we analyze the ties between Dutch government and Dutch patient organizations to learn (...) more about the effects of such a relationship between government and this part of civil society. Our study is based on official government documents and existing empirical research on patient organizations. We found that government influence on patient organizations has become quite substantial with government influencing the organizational structure of patient organizations, the activities these organizations perform and even their ideology. Financing patient organizations offers the government an important means to hold them accountable. Although the ties between patient organizations and the government enable the former to play a role that can be valued as positive by both parties, we argue that they raise problems as well which warrant a discussion on how much government influence on civil society is acceptable. RESUMENEl artículo analiza el papel desempeñado por los argumentos de pendiente resbaladiza en los debates prácticos. Por un lado, estos argumentos suelen ejemplificar una forma d razonamiento imperfecto o paradójico. De hecho, la Filosofía clásica griega ya identificó las principales dificultades del sorites, el argumento del «montón». Por otro lado, la pendiente resbaladiza llama de nuevo la atención de la Filosofía contemporánea, ya que ocupa un lugar destacado en determinadas cuestiones morales, como pueden ser la eutanasia, los límites de la (...) investigación biomédica, o las posibles consecuencias de la intervención humana sobre el medio ambiente natural y sobe otras especies, no humanas. De esta forma, la Ética aplicada examina los riesgos y efecto son deseables de decisiones que, el comienzo, eran o parecían perfectamente aceptables, y lo hace así a pesar de que la metáfora de la pendiente resbaladiza no pueda aportar suficientes evidencias para frenar aquellas decisiones que comportan riesgos. Aun así, la pendiente sirve para expresar el peligro, la tragedia, los efectos negativos que amenazarían nuestra existencia, o la de las generaciones futuras. Por lo tanto, imágenes como la «caja de Pandora», la «ruptura de los diques», el «alud», no solo transmiten que algunas acciones pueden poner en riesgo la vida sino que, además, ilustran el uso práctico de los argumentos imperfectos.PALABRAS CLAVEpendiente resbaladiza, argumentación práctica, Ética aplicada.ABSTRACTThe article would analyze the role of the slippery-slope arguments in practical debates. On the one hand, they usually exemplify the imperfect, paradoxical reasoning; in fact, the ancient Greek Philosophy already identified the central flaws of the sorites, the «heap» argument. On the other hand, the metaphor of the slippery-slope draws again the attention of contemporary Philosophy, since it has a central part in some ethical issues, as happens with questions like euthanasia, the limits of biomedical research, and the possible consequences of the human action on the natural environment, and on non-humans. So, applied Ethics considers risks and undesirable effects of decisions that, at the very beginning, are, or seem acceptable, in spite of the fact that the slippery-slope could not allege enough evidences to prevent from this risky decision. However, it expresses how danger, tragedy, negative outcome would intrude in our existence, or in the existence of the next generations. In what is called the ‘geographic turn’ in contemporary philosophy, David Hume appears not only as a pioneer in using geographic metaphors to describe thinking but also his immanent empiricism had a decisive influence in Deleuze’s work. The aim of this paper is to advance in this double register and to present the geographic metaphors used by Hume to characterize his science of human nature or true philosophy, viz., the sceptic voyage, the conquest of the capital and mental geography.

Background Decision-making competence is a complex concept in the care for transgender and gender diverse adolescents, since this type of care concerns one’s developing gender identity and involves treatment options that often lack international consensus. Even despite competence assessments, moral challenges arise in the decision-making process. Here, traditional forms of clinical ethics support such as moral case deliberation might not fit as these do not provide thematic guidance. This study therefore aimed to develop a practice-oriented ethics support tool to assist (...) care providers when dealing with moral challenges around decision-making competence in transgender adolescent care. Methods The study followed a participatory design to develop a tool in close collaboration with care providers; they had a say in all phases of development and dissemination. Firstly, nine care providers were interviewed about experienced moral challenges and needs for ethics support. Based on this, the structure and content of the tool was constructed and discussed in two focus group meetings, after which four care providers tested the tool and additional feedback was collected from the team and an advisory board. The final tool was presented to all Dutch care providers in transgender adolescent care. Results Care providers expressed a need for guidance in defining and assessing decision-making competence. Main moral challenges concerned discussing fertility options with young clients, dealing with co-occurring mental health difficulties and the decision-making role of parents. The final tool, named the Competence Consultant, is an interactive pdf containing four parts: (1) Clarify information; (2) Identify doubts and moral questions; (3) Guidance for conversations and (4) Overview and Conclusions. Discussion Developing an ethics support tool in a controversial care setting is highly relevant as it aims to help individual care providers in defining, discussing and dealing with their moral challenges in actual practice. The ‘Competence Consultant’ for transgender care providers contributes to their moral sensitivity and moral competence. It is an example of the development of innovative and integrative forms of thematic ethics support. (shrink)

Pediatric oncology has a strong research culture. Most pediatric oncologists are investigators, involved in clinical care as well as research. As a result, a remarkable proportion of children with cancer enrolls in a trial during treatment. This paper discusses the ethical consequences of the unprecedented integration of research and care in pediatric oncology from the perspective of parents and physicians. An empirical ethical approach, combining (1) a narrative review of (primarily) qualitative studies on parents' and physicians' experiences of the pediatric (...) oncology research practice, and (2) comparison of these experiences with existing theoretical ethical concepts about (pediatric) research. The use of empirical evidence enriches these concepts by taking into account the peculiarities that ethical challenges pose in practice. Analysis of the 22 studies reviewed revealed that the integration of research and care has consequences for the informed consent process, the promotion of the child's best interests, and the role of the physician (doctor vs. scientist). True consent to research is difficult to achieve due to the complexity of research protocols, emotional stress and parents' dependency on their child's physician. Parents' role is to promote their child's best interests, also when they are asked to consider enrolling their child in a trial. Parents are almost never in equipoise on trial participation, which leaves them with the agonizing situation of wanting to do what is best for their child, while being fearful of making the wrong decision. Furthermore, a therapeutic misconception endangers correct assessment of participation, making parents inaccurately attribute therapeutic intent to research procedures. Physicians prefer the perspective of a therapist over a researcher. Consequently they may truly believe that in the research setting they promote the child's best interests, which maintains the existence of a therapeutic misconception between them and parents. Due to the integration of research and care, their different ethical perspectives become intertwined in the daily practice of pediatric oncology. Increasing awareness of what this means for the communication between parents and physicians is essential. Future research should focus on efforts that overcome the problems that the synchronicity of research and care evokes. (shrink)

Ce savoir ne se donne pas comme un préalable à l’enquête politique, il lui est inséparable et apparaît comme une anthropologie des différences.

Many people move house at some point during their childhood and not rarely more than once. While relocations are not always harmful for under-aged children, they can, and frequently do, cause great disruption to their lives by severing their social ties as well as any attachments that they might have to their neighbourhood, town, or wider geographical region, with long-lasting psychological effects in some cases. Since it is increasingly recognised within normative philosophy as well as within Western societies that older (...) minors should have the final say over certain issues that significantly affect their lives (think, for instance, of custody disputes, decisions about whether to get specific vaccinations or use contraceptives), this raises the question: Can it be morally incumbent upon parents to give their minor children a veto over family relocation? This article argues that the answer is affirmative. Specifically, it suggests that such duties exist if and only if (i) parents are not morally required to either relocate their families or stay put, (ii) the stakes of the decision about a family relocation are fairly low, and (iii) the children have the competence to make these decisions, as many older minors do. Despite the unquestionable importance of technological progress in twenty-first-century society, the decision by many political leaders worldwide to treat natural sciences as an almost exclusive priority betrays a terrible misconception of the complexity of the contemporary world. As the Renaissance cannot be reduced to Copernicus’s or Galileo’s brilliant contributions, or Enlightenment to the works of such giants as Newton and Cavendish, contemporary society will hardly be remembered as just a series of amazing software and gadget updates. There are three categories (...) of questions today that only humanities are prone to answer. The first one, exploring the relations between subject and object mediated by the meaning of “property”, ultimately concerns the discussion between legality and legitimacy. Not long ago, teenagers were still being sued by the giants of the Entertainment Industry for downloading songs, and the practice of mash-ups or remixing even now arouses huge polemics. The second one, focused on the self-representations of the subject, concerns the changing meanings (and representations) of identity and cultural borders in a globalizing world. Finally, the inter-subjective interactions are the centre of the political tensions between democracy and demagogy, two opposed categories that have often been presented as hardly distinguishable from each other. BackgroundRespect for autonomy is a key concept in contemporary bioethics and end-of-life ethics in particular. Despite this status, an individualistic interpretation of autonomy is being challenged from the perspective of different theoretical traditions. Many authors claim that the principle of respect for autonomy needs to be reconceptualised starting from a relational viewpoint. Along these lines, the notion of relational autonomy is attracting increasing attention in medical ethics. Yet, others argue that relational autonomy needs further clarification in order to be adequately (...) operationalised for medical practice. To this end, we examined the meaning, foundations, and uses of relational autonomy in the specific literature of end-of-life care ethics.MethodsUsing PRESS and PRISMA procedures, we conducted a systematic review of argument-based ethics publications in 8 major databases of biomedical, philosophy, and theology literature that focused on relational autonomy in end-of-life care. Full articles were screened. All included articles were critically appraised, and a synthesis was produced.ResultsFifty publications met our inclusion criteria. Twenty-eight articles were published in the last 5 years; publications were originating from 18 different countries. Results are organized according to: (a) an individualistic interpretation of autonomy; (b) critiques of this individualistic interpretation of autonomy; (c) relational autonomy as theoretically conceptualised; (d) relational autonomy as applied to clinical practice and moral judgment in end-of-life situations.ConclusionsThree main conclusions were reached. First, literature on relational autonomy tends to be more a ‘reaction against’ an individualistic interpretation of autonomy rather than be a positive concept itself. Dichotomic thinking can be overcome by a deeper development of the philosophical foundations of autonomy. Second, relational autonomy is a rich and complex concept, formulated in complementary ways from different philosophical sources. New dialogue among traditionally divergent standpoints will clarify the meaning. Third, our analysis stresses the need for dialogical developments in decision making in end-of-life situations. Integration of these three elements will likely lead to a clearer conceptualisation of relational autonomy in end-of-life care ethics. In this paper, we will defend a particular version of the timeless solution to the problem of divine foreknowledge and human freedom. Our strategy is grounded on a particular temporal framework, which models the flow of time and a libertarian understanding of freedom. The propositions describing a certain act by an agent have an indeterminate truth value until the agent makes her choice; therefore, they become true or false when a decision is made. In order to account for this change (...) of truth value, a multiple frame structure is introduced in which every frame presents a privileged time, with its past and the possible alternative futures, which are still open. God atemporally knows all the frames and the truth values of propositions with respect to each one. Since divine knowledge of what an agent decides in a certain temporal frame depends on the agent’s act itself, divine knowledge does not conflict with the agent’s free will. (shrink)

In spite of the important discoveries made by Adam Smith and later by the economists of the Austrian School, Friedrich Hayek remained intellectually challenged by the miracle of the price mechanism. As it turned out there was still some pioneering to do in describing the price mechanism. This became clear when Hayek identified the dispersal of information relevant to exchange transactions as the central issue of economic study. In the context of his distinction between competition as a state of things (...) and as a process the price mechanism manifests itself as a powerful integrator of information which is at first sight hopelessly dispersed in modern society. In 1945 he pointed out another intellectual challenge which the miracle of the price mechanism poses: How could such a marvelous functionality come into existence? “I am convinced that if it [the price mechanism] were the result of deliberate human design, and if the people guided by the price changes understood that their decisions have significance far beyond their immediate aim, this mechanism would have been acclaimed as one of the greatest triumphs of the human mind”. It is precisely because the free determination of prices is obviously not an invention, and because actors on the market in general do not realize that their decisions are at once also signals for the information-processing system that the market is, that in general this market order is not highly estimated. The market order is nevertheless the best illustration of the dual principle that the most beautiful forms of complex functionality are not deliberately created and are not deliberately maintained. In 1920 Bignone published an Italian translation of the writings and fragments of Epicurus in Laterza's library of Ancient and Mediaeval Philosophers which in many respects added to and improved upon Usener's classic collection, of Epicurea. He has since then zealously prosecuted these studies, and arrived at some very interesting conclusions which he has given out in two volumes published lately.1 His starting-point is the observation that the writings of Epicurus often have a polemical tone, and not only rebut the (...) accusations of adversaries who misinterpret the new doctrine, but are often directed also against those preceding philosophers who denied to pleasure a stable and certain nature on which a system of ethics could be based. Bignone has set himself the task of particularizing these anonymous predecessors, and thereby bringing the Epicurean polemic into more striking relief. I t was easy and safe to start from the standpoint that Epicurus in his rehabilitation of pleasure had to oppose Plato and the Platonists, but at what Platonists in particular did he take aim? In answering this question Bignone has been able to make use of recent Aristotelian studies, especially those of Jaeger, which have thrown much light on the first phase of the Stagirite's philosophy, of a purely Platonic inspiration. As is well known, some exoteric dialogues belong to this phase, such as the Eudemos, the Protrepticon, and On Philosophy, which have to a large extent disappeared, though it has been found possible to reconstruct a few scattered fragments of them. The great scholastic works which reveal the full independence and maturity of Aristotle's genius have eclipsed them in the memory of posterity. But originally there were only these dialogues, the only ones published, to make Aristotle's thought known to the public outside the peripatetic school. The scholastic writings on the other hand remained unknown until the time of Sulla. What wonder, then, if Epicurus, in combating Platonism, had in mind these dialogues, which give out the fundamental conceptions of Platonism in a more decisive and dogmatic form than that of the Platonic dialogues? Ex aequo et bono compensations refer to tribunal’s compensations that cannot be determined exactly according to the rule of law, in which case the judge relies on an estimate that seems fair for the case at hand. Such cases are prone to legal uncertainty, given the subjectivity that is inherent to the concept of fairness. We show how basic principles from statistics and machine learning may be used to reduce legal uncertainty in ex aequo et bono judicial decisions. For a (...) given type of ex aequo et bono dispute, we consider two general stages in estimating the compensation. First, the stage where there is significant disagreement among judges as to which compensation is fair. In that case, we let judges rule on such disputes, while a machine tracks a certain measure of the relative differences of the granted compensations. In the second stage that measure, which expresses the degree of legal uncertainty, has dropped below a predefined threshold. From then on legal decisions on the quantity of the ex aequo et bono compensation for the considered type of dispute may be replaced by the average of previous compensations. The main consequence is that this type of dispute is, from this stage on, free of legal uncertainty. (shrink)

In an interesting essay published in this journal Jonathan Floyd has recently argued (Citation2009) that, contrary to widespread opinion, political philosophy is not too a‐historical, for historical facts cannot ground timeless political principles. In the following I would like to reply to his theses showing that the authors he criticises aim in fact to show that our historical situation gives us a decisive clue as to the tasks that philosophical theory has to address; that philosophical argumentation rests on normative beliefs (...) that we expect our audience to take for granted, and that these beliefs are historically embedded. Finally, although the historicity of normative beliefs has been often used to reject universalism, current scholarship includes important attempts to combine historicity and universalism. (shrink)

While applying general ethical principles and reasoning to the dilemmas presented by the development of nanotechnology is often useful and always legitimate, we also need to find a way to bridge the gap between general principles and the specific issues that arise from the development of individual nanotechnologies. Drawing inspiration from pragmatist thinking, a useful strategy is to focus on the links between the epistemological, political and social representations of a particular case. There is growing interest for a communitarian approach to the governance of genomics, and for such governance to be grounded in principles of justice, equity and solidarity. However, there is a near absence of conceptual studies on how communitarian-based principles, or values, may inform, support or guide the governance of genomics research. Given that solidarity is a key principle in Ubuntu, an African communitarian ethic and theory of justice, there is emerging interest about the extent to which Ubuntu could offer (...) guidance for the governance of genomics research in Africa. To this effect, we undertook a conceptual analysis of Ubuntu with the goal of identifying principles that could inform equity-oriented governance of genomics research. Solidarity, reciprocity, open sharing, accountability, mutual trust, deliberative decision-making and inclusivity were identified as core principles that speak directly to the different macro-level ethical issues in genomics research in Africa such as: the exploitation of study populations and African researchers, equitable access and use of genomics data, benefit sharing, the possibility of genomics to widen global health inequities and the fair distribution of resources such as intellectual property and patents. We use the identified the principles to develop ethical guidance for genomics governance in Africa. (shrink)

BackgroundIn the Netherlands, patients have the legal right to make a request for euthanasia to their physician. However, it is not clear what it means in a moral sense for a physician to receive a request for euthanasia. The aim of this study is to explore the moral values of physicians regarding requests for euthanasia. MethodsSemi-structured interviews were conducted with nine primary healthcare physicians involved in decision-making about euthanasia. The data were inductively analyzed which lead to the emergence of themes, (...) one of which was about values regarding end-of-life decisions.ResultsFour clusters of values related to euthanasia requests are described: values related to 1) the patient; 2) the family; 3) the physician; and 4) life and death. The data show that the participants value patient autonomy as a necessary but not sufficient condition for meeting a euthanasia request. A good relationship with the patient and the family are important. For the physician, the values physician autonomy, responsibility, understanding the patient and relief of suffering play a role. Life as an intrinsic good and a peaceful death are also important values.ConclusionThis study shows that next to patient autonomy and the relationship with the patient and the family, it is important for the participants to act in accordance with their professional values and to do justice to values related to life and death. The awareness of going against the intrinsic value of life is crucial, even if performing euthanasia may result in a feeling of relief or gratitude afterwards. (shrink)

IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals.
