This paper defends the Blockian Proviso against its critics, Kinsella in particular, and interprets it as a law of non-contradiction in the theory of just property rights. I demonstrate that one may not lawfully appropriate in such a way as to forestall others from appropriating an unowned land because such appropriation would result in conflict-generating norms, and conflict-generating norms are not rationally justifiable and just norms. The Blockian Proviso, which precludes forestalling, operates therefore at the level of original appropriation and (...) determines, according to the homestead principle of justice in first acquisition, what may and what may not be lawfully appropriated. Hence, the Blockian Proviso is not an add-on to the homestead principle but part and parcel thereof. (shrink)

Modern technology offers an increasing number of tools for teaching mathematics, but technology adoption in schools encounters many barriers. The Technology Acceptance Model explains that technology usage is dependent on intentions, which rest on perceived ease of use and perceived usefulness. Less is known about the relationship between intentions and actual behaviour. In the current study we show that the level of cognitive investment on the part of the teachers, captured by the construct of Need for Cognition (NC), is crucial (...) in the use of technology in mathematical instruction, while controlling for a variety of background factors. Furthermore NC moderates the relationship between intentions and technology use, such that high NC weakens the relationship between the perceived usefulness of technology in pedagogy and its actual use. Can ownership status influence probability judgements under condition of uncertainty? In three experiments, we presented our participants with a recording of a real horse race. We endowed half of our sample with a wager on a single horse to win the race, and the other half with money to spend to acquire the same wager. Across three large studies, we found the endowment effect – owners demanded significantly more for the wager than buyers were willing to pay to acquire it. (...) However, we also found that probability estimates of each horse winning the race did not differ between owners and non-owners of the betting slip. Our results demonstrate that distorted perception of probability is unlikely to be a mechanism explaining the endowment effect. (shrink)

In this commentary, I critically assess Rex Welshon’s position on the neural substrates of ownership unity. First, I comment on Welshon’s definition of ownership unity and underline some of the problems stemming from his phenomenological analysis. Second, I analyze Welshon’s proposal to establish a mechanistic relation between neural substrates and ownership unity. I show that it is insufficient and defend my own position on how neural mechanisms may give rise to whole subjects of experience, which I call the neuro-integrative account (...) of consciousness. Lastly, I comment on Welshon’s philosophical contribution and claim that it leaves the reader theoretically stranded. (shrink)

According to contemporary understanding of the universal tree of life, the traditionally recognized kingdoms of eukaryotic organisms—Protista, Fungi, Animalia and Plantae—are irregularly interspersed in a vast phylogenetic tree. There are numerous groups that in any Linnaean classification advised by phylogenetic relationships would form sister groups to those kingdoms, therefore requiring us to admit them the same rank. In practice, this would lead to the creation of ca. 25-30 new kingdoms that would now be listed among animals and plants as “major (...) types of life”. This poses problems of an aesthetic and educational nature. There are, broadly speaking, two ways to deal with that issue: a) ignore the aesthetic and educational arguments and propose classification systems that are fully consistent with the Hennigian principles of phylogenetic classification, i.e. are only composed of monophyletic taxa; b) ignore Hennigian principles and bunch small, relatively uncharacteristic groups into paraphyletic taxa, creating systems that are more convenient. In the paper, I present the debate and analyze the pros and cons of both options, briefly commenting on the deeper, third resolution, which would be to abandon classification systems entirely. Recent advances in eukaryotic classification and phylogeny are commented in the light of the philosophical question of the purpose and design principles of biological classification systems. Recent findings demonstrate sex-related differences in the neurobiological mechanisms by which emotional arousal influences memory, and raise questions about the extent to which memory for emotional events may differ between males and females. Here we examine whether sex-related differences exist in the recall of central information and peripheral detail from an emotional story. Healthy subjects viewed a brief, narrated slide-show containing emotional elements in its middle section. One week later, they received an incidental multiple-choice recognition test for the story. Following (...) the test, each subject completed the BEM Sex-Role Inventory, an assessment of sex-related masculine and feminine traits. The results reveal no differences in recall of either central or peripheral story information when considering the performance of actual men and women, but a significant difference when considering male and females as determined by their BEM test scores. “BEM” males showed significantly enhanced recall of central emotional information. “BEM” females did not. Both groups showed significantly enhanced recall of peripheral emotional information, although this effect appeared larger in BEM females than in BEM males. The influences of “BEM” sex and type of information significantly interacted to influence emotional memory performance. These findings confirm the existence of sex-related influences in the recall of emotional information, and suggest that sex-related traits, rather than actual sex per se, may be a more sensitive indicator of these influences. This article relates to the CJEU’s understanding of the concept of the spouse in Case C-673/16 and its effect on the process of law application by Polish administrative courts. The authors considerations are based on the assumption that the CJEU’s interpretation of EU law in Coman and Others is of a dynamic-deliberative nature, based on functional rules, and that at the same it time takes into account a specific legal and socio-cultural context in which one of the fundamental freedoms guaranteed (...) by EU law is implemented. This judgment, as authors underline, confirms that a proper understanding of the current legal context of the concept of a spouse requires that the social and cultural context and the plurality of values arising from different lifestyles be taken into account in the application and interpretation of the law, all with a view to empowering the individual in his or her relationship with the State and raising the level of protection of human rights. Authors observe in the practice od Polish administrative courts that this CJEU’s judgment is important in the argumentative layer, but not decisive for the resolution of the case in specific situations where there is a need to address the effect of same-sex marriage in a case related to the implementation of the EU right to free movement. In this context authors consider whether the justification for rulings of administrative courts may be sought in John Gray’s concept of modus vivendi liberalism. (shrink)

The purpose of the paper is to discuss the phenomenon of life through the aspect of consciousness and in particular to analyze the role which consciousness plays in the living state (the L?state for short) as well as the consequences of the development of consciousness for the evolution of living beings. Consciousness is an epiphenomenon of knowledge. The discussion of the role of consciousness in life will have to involve an elucidation of the role of knowledge. This will be done (...) in light of and using the ideas of the theory of the Ecology of Knowledge developed by the author (Wojciechowski, 1975, 1986, 1989). Because of the special nature of consciousness, the paper will deal with the methodological problems of the study of consciousness, and, therefore of the study of the living state. (shrink)

C'est un fait que nous distinguons entre la connaissance quantitative et la connaissance qualitative. L'analyse de cette distinction remonte à l'Antiquité. Depuis Aristote, elle semble être acceptée comme définitive. L'épistémologie réaliste du Stagirite Justine la distinction par la différence objective entre les catégories de qualité et de quantité, irréductibles l'une à l'autre. Selon cette optique, les deux modes de connaissance nous offrent deux perspectives différentes sur le monde matériel. Ces deux perspectives se complètent l'une l'autre. Il faut tout de même (...) se demander si les deux sont jugées également nécessaires pour la connaissance sensible du monde perceptible. La question est d'autant plus importante qu'on considère la connaissance sensible comme point de départ du processus intellectuel qui mène, ou doit en principe mener, à la connaissance substantielle de la réalité matérielle. The analysis of the notion of need reveals two possible approaches to it — an objectivist and a subjectivist one, In the former, needs are regarded as conditions necessary for a subject’s normal functioning, existence in society, or, most broadly, for the preservation of the subject’s identity, A need is attributed to a given person on the ground of studying real links between the subject’s postulated character and external states of things, and so needs are independent of any inner condition (...) of the given person’s wants, preferences, desires etc. In the subjectivist approach, need is regarded as the subject’s inner condition marked by a sense of want along with the concomitant motive. The notion of value may be connected with both approaches to need; value can be defined as something which meets objective needs half way, or as something that satisfies a person’s own subjective needs. Every definition of value has important consequences for the exercise of normative research. Objectivism goes along, among other theories, with absolutism, paternalism or ascetism, whereas subjectivism fits relativism, phenomenalism or hedonism. Historical materialism supplies strong evidence in support of both of these axiological approaches, However, it is the validity of the subjectivist approach that seems to be propped by more arguments. But then, subjectivism has to cope with the problem of valuating needs. (shrink)

La notion de cause fait corps avec le cadre noétique du système dans lequel elle apparaît. Elle ne peut pas être plus large ou plus profonde que le système lui-même. Qui veut comprendre le sens qu'on donne au concept de cause, doit faire une étude épistémologique du contexte dont il fait partie. Une telle analyse doit éviter de s'enfermer dans le cercle vicieux auquel l'expose le rôle tout à fait fondamental que joue la notion de cause dans la formation du (...) système. En effet l'idée qu'on se fait de la causalité exerce une influence déterminante sur l'ensemble des affirmations de base sur lesquelles repose le complexe d'explications philosophiques ou scientifiques. John Venn w Formal Logic zbudował pewien system sylogistyki, będący jedną z realizacji idei kwantyfikacji orzeczników. Interesującą rekonstrukcję tego systemu zaproponował V.I. Markin. Markin posługuje się pięcioma funktorami pierwotnymi {aa,ai,ia,ii,e}. Wyrażenia elementarne SaaP,SaiP,SiaP,SiiP oraz SeP są czytane odpowiednio: wszelkie S są wszelkimi P, wszelkie S są pewnymi P, pewne S są wszelkimi P, pewne S są pewnymi P oraz żadne S nie są P.Markin podaje aksjomatykę dla tego systemu. Proponuje też reguły translacji jego formuł na język sylogistyki klasycznej, o aksjomatyce (...) Łukasiewicza {SaS, SiS, MaP/\SaM ε SaP, MaP/\MiS ε SiP} oraz reguły translacji odwrotnej.To sformułowanie sylogistyki Venna można uprościć przez przyjęcie konwencji notacyjnej:SφΨP / SφP/\PΨS SφP/\PΨS / SφΨP dla φ,Ψε{a,ι}.Proponowana jest nowa aksjomatyka dla sylogistyki Venna z mocnym rozumieniem zdań szczegółowo-twierdzących. Badane są związki logiczne między sylogistyką Venna i systemem Łulasiewicza. Zostaje sformułowany system z mocnym rozumieniem zdań szczegółowo-twierdzących. Zusammenfassung Im Rahmen dieses Beitrages soll hinterfragt werden, inwieweit sich die Konzepte der Amerikanisierung und der Globalisierung eignen, um aktuelle Sportentwicklungen zu beschreiben. Nach der Präzisierung des Begriffs der Sportentwicklung vor dem Hintergrund aktueller entwicklungstheoretischer Diskussionen und der Theorie sozialen Wandels werden die Konzepte der Amerikanisierung und der Globalisierung auf der Basis des dargestellten begrifflichen Instrumentariums analysiert, und es werden zentrale Tendenzen der aktuellen Sportentwicklung beschrieben. Abschließend erfolgt die Diskussion der Reichweite der beiden Konzepte im Rahmen der Forschung zur Sportentwicklung, (...) und es werden Perspektiven der zukünftigen Forschung aufgezeigt. (shrink)

The decision should be based on the directives of interpretation, which indicate the need for such a determination of the meaning of the applicable norms so that it remains in harmony with commonly accepted moral rules of the society. The equity has one more purpose; namely, it allows for the process of decision-making—and not just (...) for the process of unifying the decisions—since the mere rule does not specify the algorithm of undertaking them. This rule thus assumes that it will be further specified by phronesis judge who in a given situation will determine—for the purposes of a particular decision—a hierarchy between the criteria of substantive justice “embedded” in this rule. The reference to equity stands for the concretization of an unspecified general rule. We deal here with an indefinite general rule, the application of which is facilitated by a reference to rightness. (shrink)
