The Problem of Authenticity of Constitutive Root Text al-Fıqh al-Akbar and the Contribution of Ottoman Intellectuals I.Mustafa Bilal ÖZTÜRK - 2022 - Kader 20 (1):281-304.
The foundations of almost all Islamic sciences were laid in the first and second centuries of hijra. With the expansion of the Islamic world since the first century of hijra, the existence of a collective effort to transfer oral information into writing is notable. With the invitation of the prophet Muḥammad to Islam, an unprecedented increase in the culture of writing has been observed. Since the emergence of Islam, the world history scene has witnessed feverish writing activity. Especially in the (...)

A Criticism Of the Definition of Knowledge: In The Context Of Jalāl al-Dīn Dav-vānī’s Risāla fī Taʻrīf ʻilm.Mustafa Bilal ÖZTÜRK - 2021 - Cumhuriyet İlahiyat Dergisi 25 (2):823-851.
This study discusses the treatise of Jalāl al-Dīn Davvānī (d. 908/1502) named Risāla fī taʻrīf ʻilm. This treatise criticizes a definition of knowledge adopted by some theologians in the late period (mutaʾakhkhirīn). The definition of knowledge at issue consists of three components: Attribution, discernment, no possibility of contradiction. Knowledge is an attribute as a category and with this attribution, a discernment is obtained. As a result of this process knowledge is acquired and there should be no possibility of this knowledge (...)

A Critical Edition of the “Ĥāshıya ‘alā Muqaddımāt al-Arba‘a” of Muśliĥu’d-Dīn al-Kastalī and an Analytical Interpretation of the Work.Mustafa Bilal ÖZTÜRK - 2020 - Kader 18 (2):666-724.
The text of “The Four Premises” (Muqaddimāt al-Arba‘a), which began with Sadr al-Sharī‘ah (d. 747/1346), centralizes on the actions of human beings by connecting it with the problem of good and evil in the field of kalām, Islamic philosophy and logic, and fıqh. It was also commented in with incisive and critical footness by Sa‘d al-Dīn al-Taftāzānī (d. 791/1390). In Ĥāshiya ‘alā Muqaddimāt al-Arba‘a, al-Kastalī (d. 901/1496) discusses the two main issues. One of them is good/husn-evil/qubh, the other is human (...)

There is no common working style followed in the preparation of the editorial critiques of the ĥāshiya. The overwhelming majority of the ĥāshiya works written on at least one text and commentary, were produced in the Ottoman science-culture basin and period. Ĥāshiya style of writing is an area neglected by the academic community until recently. A claimant is obliged to prove his claim by scientific, legal and moral principles. However, studies that prove or at least support the said judgment have (...)

Human Acts in Islamic Thought: Different Discourses Common Purposes.Bilal Taşkin - 2021 - Kader 19 (1):146-176.
The subject of human acts has been one of the controversial topics of kalām since the first centuries of Islam. A lot of concerning human acts –from divine attributes to divine decree and destiny, from the issue of good and evil (ḥusn and Qubḥ) to the boundaries of the reasoning, from the accountability with impossible things to the rational accountability, from the topics of substance and accident to causality- has been said and written in the history of Islamic tought. 13. The Negotiative Theory of Gender Identity and the Limits of First-Person Authority.Burkay Ozturk - 2022 - In Raja Halwani, Jacob M. Held, Natasha McKeever & Alan G. Soble (eds.), The Philosophy of Sex: Contemporary Readings, 8th edition. Lanham, MD: Rowman & Littlefield. pp. 261-281.
This paper assesses the first-person authority account (FPA) of gender, according to which X's self-identification of what X's gender is, is the final say on what X's gender is, such that if others disagree, they are mistaken. One main reason in support of FPA is respecting X's autonomy—that is, overriding X's self-identification amounts to denying X's autonomy. Ozturk criticizes this view using analogies of religious and patriotic self-identifications, such that there are cases in which someone can permissibly claim that another (...)

In this study, it is tried to put forth some explanations on the definition of vitality referring to the historical definition of biology that can be considered as thestudy of life. In accordance with the explanations, the necessity of revision and distinction of some terms in the contemporary biology is also mentioned. The first among which is the updating of the term known as homeostasis into homeokinesis. For this reason, a number of propositions are emphasized in order to clarify the (...)

This study investigates whether female Audit Committee Financial Experts (ACFEs) at Chinese listed companies reduce earnings management by examining their influence under different ownership structures and cross-listing scenarios. Our findings reveal that female ACFEs negatively affect earnings management, with their impact varying by ownership type. Specifically, female ACFEs in privately owned enterprises (non-SOEs) are more effective at reducing earnings management than those in state-owned enterprises (SOEs). Furthermore, our analysis indicates that female ACFEs in cross-listed firms are better at mitigating earnings (...)

Corporeality: Emergent consciousness within its spatial dimensions develops our understanding of what we can experience through our bodies in relation to the space around us. Rather than considering architecture as being about manifestation and mediation of fixed meanings, the book focuses instead on architectural space as a field that envelopes us incessantly, intimately, and affectively. We are in immediate contact with that space, and the way we relate to it determines how we are able to grasp the realities of the (...)

Dignity Embodies Duty”: Islamic Perspective on Combating “Hate Speech.Bilal Ahmad Malik - 2023 - Muslim World Journal of Human Rights 20 (1):19-45.
Hate speech (‘al-jahr bi’-sūʾ min al-qawlin the Qur’anic description) continues to be the subject of contentious debate. Arguably, the notion of “unregulated speech” in the liberal discourse encourages hate speech on the pretext of “defending” the right to freedom of speech. Islam recogniseshuman dignityas the underlying basis of all human rights and freedoms, including the right to freedom of speech. Here arise two core questions. First, is freedom of speech and expression an absolute right or has Islam imposed certainconditionson the (...)

Al-Bassam’s The Al Hamlet Summit (2006), an adaptation of Shakespeare’s Hamlet (1603), presents a cynical comment on the political corruption in the Arab World and it constitutes from a presentist perspective, we argue, an anachronistic critique of some Arab leaders’ lapse into normalisation with the long-standing Other, the Israeli occupation. Al-Bassam captures the political corruption and Arab leaders’ liaison with Israel through the figure of Claudius, who, like Arab leaders, normalises relations with the enemies of his nation, Fortinbras and the (...)

Witness and martyrdom: Palestinian female martyrs’ video-testimonies.Bilal Tawfiq Hamamra - 2018 - Journal for Cultural Research 22 (3):224-238.
ABSTRACTDuring the second Intifada which started in 2000 and ended sometime in mid 2000s, Palestinian male and female martyrs used video testimonies, records and documents of death, using the first person pronoun so as to articulate their missions and justifications for carrying out their acts of martyrdom. This study, which focuses on Palestinian female martyrs’ video-testimonies, investigates the elusive relationship between martyrdom and witness. I contend that the female martyr is a witness to the Israeli occupation of Palestine and to (...)

  26. The evolution of the rule of law : the origins and function of legal theory.Bilal Ibrahim - unknown
The thesis examines the origins and function of legal theory within the context of the development of early Islamic law. I argue against the depiction of the development of law as a series of compromises between traditionalism and rationalism. Rather, by evading the demands of traditionalism, law evolved into a complex doctrinal entity rooted in the social structures of third-century Abbasid society. This revision of the development of law provides a context to evaluate early works of legal theory. Moreover, in (...)

The Elements of Avicenna's Physics: Greek Sources and Arabic Innovations by Andreas Lammer.Bilal Ibrahim - 2020 - Journal of the History of Philosophy 58 (1):168-170.
In this timely and outstanding contribution, Andreas Lammer tackles central concepts and problems in Avicenna's Physics of the Healing. The analysis provides a wide-ranging but cohesive study of Avicenna's approach and ideas. The philological and philosophical analysis of the historical context of Avicenna's arguments pays dividends. Avicenna's—often radical—reworking of Aristotle's approach in the Physics critically engages a long tradition of Peripatetic and Neoplatonic philosophy in Greek and Arabic. Lammer's contribution, based on his doctoral dissertation, lays fertile ground for future work. (...)

Most of the medical faculties have included topics related to medical research ethics and developed ethical committees; yet, in some cases, unethical behaviors are still observed, and many obstacles are still conferring to applying these guidelines. The first-person authority view (FPA) is the current dominant view about what someone’s gender is. According to FPA the person has authority over her own gender identity; her sincere self-identification trumps the opinions of others. There are two versions of FPA: epistemic and ethical. Both versions try to explain why a person has authority over her own gender identity. But both have problems. Epistemic FPA attributes to the self-identifier an unrealistic degree of doxastic reliability. Ethical FPA implies the existence of (...)

The Einstellung effect occurs when the first idea that comes to mind, triggered by familiar features of a problem, prevents a better solution being found. It has been shown to affect both people facing novel problems and experts within their field of expertise. We show that it works by influencing mechanisms that determine what information is attended to. Having found one solution, expert chess players reported that they were looking for a better one. But their eye movements showed that they (...)

A Critical Survey of Adams’ Divine Command Meta-ethics.Mustafa Polat - 2023 - Tabula Rasa: Felsefe Ve Teoloji 40:53-68.
The divine command meta-ethics (hereafter, DCM) promote non-naturalist realism about the ontological status of moral properties while depending on this ontological status on a such-and-such divine being’s moral roles derived from some relevant divine characteristics. As DCM typically contends, our moral discourse depends on God’s commands and prohibitions to the effect that an action A is morally right if and only if God commands A. Robert M. Adams (1979, 1987a) offers a modification that explicates the dependency relation between a loving (...)

Universities regulate speech in various ways. How should we assess when such restrictions are justified, if they ever are? Here, we propose an answer to this question. In short, we argue that we should think about speech restrictions as being like acts of war, and so should approach their justification using just war theory. We also make some suggestions about its implications. For instance, one of the jus ad bellum requirements for a just war is that you have a reasonable (...)

On Adams’ Moral Argument for God’s Existence.Mustafa Polat - 2022 - Tabula Rasa: Felsefe Ve Teoloji 39:19-29.
Robert M. Adams (1979, 1987a, 1987b) defends a modified variant of the divine command theory (hereafter MDCT) to the effect that he proposes a moral argument for God’s existence driven in the form of practical reasoning with respect to rational moral agents’ beliefs in the adequacy of MDCT. For Adams, one’s commitment to MDCT as the most adequate theory legitimately provides her a practical reason for why she ought to believe in God’s existence which MDCT implies. In this paper, I (...)

Drawing on Levinasian concepts of sleep, insomnia, and the il y a, this paper examines the liminal states of insomnia and sleep within the Palestinian-Israeli conflict. Sleep and insomnia, being proximates of death as well as displacement and anonymous existence successively, are topics that have not, to the best of our knowledge, received any critical commentary within (post)colonial studies. This paper argues that the Israeli military occupation deprives Palestinians from sleep, casting them into the horror and anonymous existence of insomnia (...)

When the Solution Is on the Doorstep: Better Solving Performance, but Diminished Aha! Experience for Chess Experts on the Mutilated Checkerboard Problem.Merim Bilalić, Mario Graf, Nemanja Vaci & Amory H. Danek - 2019 - Cognitive Science 43 (8):e12771.

The crucial information needed for a solution is often so far removed that gaining access to it through restructuring leads to the subjective experience of “Aha!”. Although this assumption is shared by most insight theories, there is little empirical evidence for the connection between the necessity of restructuring an incorrect problem representation and the Aha! experience.
