The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

_Winner of the Fabian Dorsch ESA Essay Prize._ Julian Dodd defends the view that, in musical work-performance practice, interpretive authenticity is a more fundamental value than score compliance authenticity. According to him, compliance with a work’s score can be sacrificed in cases where it conflicts with interpretative authenticity. Stephen Davies and Andrew Kania reject this view, arguing that, if a performer intentionally departs from a work’s score, she is not properly instantiating that work and hence not producing an authentic performance (...) of it. I argue that this objection fails. A detailed analysis of work-performance practice reveals, first, that the normative scope of interpretive authenticity encompasses the practice of composing musical versions and that, second, when performers sacrifice score compliance to maximize interpretive authenticity, they are performing the target work by means of performing a version of it. By means of the nested types theory, I then show how performances produced in this way can be properly formed instances, and hence authentic performances, of their target work. (shrink)

In Religious Experience and the Knowledge of God, Harold Netland advances a critical-trust approach to religious experience. This approach raises important questions about what Michael Martin has called “negative religious experiences.” Netland responds by attacking Martin’s “negative principle of credulity,” but I argue that Netland’s response can be undermined if we take negative religious experiences not as experiences of God as absent, but as experiences of the world as godless. On this understanding, there is no need for a negative principle (...) of credulity; the ordinary principle still applies and puts pressure on Netland’s response. I then raise concerns with Netland’s “argument from fulfilled expectations,” even as part of a cumulative case argument. Ultimately, I propose that careful attention to the impact of Christ on our Western moral framework might help to resolve both concerns. (shrink)

As a candidate Donald Trump Sovereigntystyled himself uniquely equipped to enact the will of a thickly racialized national community. His campaign may thus be read alongside Carl Schmitt’s key concepts: the friend/enemy distinction fundamental to politics, a popular sovereignty founded in an organically united Volk. But what of Trump’s presidency? Here, too, Schmitt’s thought is helpful, particularly his work on commissarial dictatorship as a response to a state of emergency—we will read in this light the “Muslim Ban” and the pardon (...) of Sheriff Joe Arpaio. Rather than creating new executive powers, this chapter argues that Trump is exploiting existing ones. This is inevitable: Presidents will seek to exercise the powers available to them, and the US Constitutional tradition fails to provide effective tools for distinguishing between the executive’s legitimate and baseless emergency actions. Schmitt’s thought and career are marred by precisely the same failure. (shrink)

Eighteenth century river hydraulics used both theory and measurement to address problems of flood safety, navigation and defense related to the rivers. In the late eighteenth century the Dutch overseer of the rivers, Christiaan Brunings, integrated hydraulic theory and meteorological practices, which enabled him to design a unique instrument for measuring river flow. The question is whether the unprecedented detail of measurements fits the putative empirical stance in the eighteenth century. The interactions between theory, instrument, measurement, and other knowledge practices (...) are here assessed using experiences in similar measurement practices. I argue that Brunings had theoretical and embodied understanding of hydrodynamics, as he knew how to design an instrument for flow measurement of sufficient accuracy for his purpose in the sociopolitical context of river management. Ruth Macklin argued that dignity is nothing more than respect for persons or their autonomy. During the COVID-19 pandemic, difficult decisions are being made about the allocation of scarce resources. Respect for autonomy cannot justify rationing decisions. Justice can be invoked to justify rationing. However, this leaves an uncomfortable tension between the principles. Dignity is not a useless concept because it is able to account for why we respect autonomy and for why it can be legitimate to override autonomy in (...) times of critical care resource shortages. Dignity affirms the worth of the human individual as a meaning-making embodied subject, who is always in relationship to others, the world, time, and transcendence, and who realizes their dignity through their moral behaviour. Such an understanding means people should be helped to make morally right decisions about their own treatment, which may include forgoing potentially beneficial treatment for the good of others. Respect for dignity does not require fulfilling the morally wrong choices of one who insists on treatment at the expense of others. Dignity also protects the discretion of clinicians to make decisions appropriate to their competence by prohibiting the application of broad-based criteria such as age. (shrink)

This article is written by a descendant of enslaved Africans and explores the theological significance of Black bodies. Black bodies have been commodified, controlled and coerced by White hegemony, often lacking agency and self-determination. Using personal experience and contextual analysis, this article, drawing on Black theology inspired reflections, argues that we need to rethink how we conceive of Black bodies ethically, if Black lives are to really matter. The rehabilitation of Black bodies is achieved through a theological reappraisal of holiness (...) and sacraments, underpinned by an embodied pneumatology, in which Black bodies are shown to be sacramental and worthy of mattering in a world underpinned by White supremacy. Austin takes on the problem of other minds, of how to respond to the question ‘how do you know?’, if this question is raised with regard to the thoughts, feelings, sensations, minds of other creatures. This problem has traditionally been understood as the problem of justifying our belief in the existence of other minds. Austin argues that believing in other persons, in authority and testimony, is an essential part of the act of communicating, and as such is an irreducible part (...) of our experience. While we can state certain advantages of communicative performances, there is no justification for our doing them as such. (shrink)

The Cratylus’ main concern is to outline and evaluate the competing views of language held by two characters, Hermogenes and Cratylus, who disagree about whether convention or nature (respectively) are the source of onomastic correctness. Hermogenes has been thought to hold two radically different views by different scholars, one extreme conventionalism whereby all names are correct relative to their speakers, and another modest conventionalism according to which distinct naming actions – establishment and employment – explain why some names are correct (...) and others are not, depending on the speaker. In this paper I argue that, though Hermogenes ultimately endorses a conventionalism of the latter kind, it is a mistake to assign him this position from the outset. Rather, to understand the structure of the conversation about conventionalism, we must view Hermogenes’ position, and Socrates’ understanding of it, as developing instead of settled. For it is only by discussing the matter that Hermogenes comes to express a moderate conventionalist view and Socrates comes to appreciate the position Hermogenes actually holds. (shrink)

The Jewish leftist lawyer Ernst Fraenkel was one of twentieth-century Germany's great intellectuals. During the Weimar Republic he was a shrewd constitutional theorist for the Social Democrats and in post-World War II Germany a respected political scientist who worked to secure West Germany's new democracy. This book homes in on the most dramatic years of Fraenkel's life, when he worked within Nazi Germany actively resisting the regime, both publicly and secretly. As a lawyer, he represented political defendants in court. As (...) a dissident, he worked in the underground. As an intellectual, he wrote his most famous work, The Dual State – a classic account of Nazi law and politics. This first detailed account of Fraenkel's career in Nazi Germany opens up a new view on anti-Nazi resistance – its nature, possibilities, and limits. Rooting, defined as a spectator’s demonstrative encouragement of a contestant’s effort, ideally has the morally positive aspects of benevolent concern and helpfulness but in practice strains against reasonable standards of conduct by being rude, excessively biased, exploitative, fanatical, and superstitious. Rooting may activate an atavistic, morally cogent sense of fighting for one’s group that is at odds with the universalism of civilized morality. The ‘merely play’ excuse can cut both ways, deflecting moral objections but also removing moral credit from rooting. (...) Although rooting is often not humane, humane rooting can occur and is supported by humane commentary by sports participants, broadcasters, and journalists. Humane rooting supports the premise of benevolence theories (Mengzi, Hutcheson) that morally ideal benevolence has a foothold in an innate general benevolence – seen in this area especially in benevolence toward efforts. Being partisan, excited, and demonstrative, rooters cannot perfectly embody ‘universal calm benevolence’, but they can consciously minimize the inhumane aspects of rooting and achieve a more fully prosocial satisfaction. The role of mathematics in scientific practice is too readily relegated to that of formulating equations that model or describe what is being investigated, and then finding solutions to those equations. I survey the role of mathematics in: 1. Exact solutions of differential equations, especially conformal mapping; and 2. Simulations of solutions to differential equations via numerical methods and via agent-based models; and 3. The use of experimental models to solve equations (a) via physical analogies based on similarity of the (...) form of the equations, such as Prandtl’s soap-film method, and (b) the method of physically similar systems. Two major themes emerge: First, the role of mathematics in science is not well described by deduction from axioms, although it generally involves deductive reasoning. Creative leaps, the integration of experimental or observational evidence, synthesis of ideas from different areas of mathematics, and insight regarding analogous forms are required to find solutions to equations. Second, methods that involve mappings or transformations are in use in disparate contexts, from the purely mathematical context of conformal mapping where it is mathematical objects that are mapped, to the use of concrete physical experimental models, where one concrete thing is shown to correspond to another. Cet article retrace les changements intervenus au sein du militantisme féministe chinois dans un climat de détérioration politique deux décennies après la Quatrième Conférence mondiale sur les femmes (QCMF) en 1995. Il met en lumière les actions novatrices menées par les jeunes féministes, de même que l’intense surveillance qu’exerce, sur le militantisme organisé, un État totalitaire qui craint de perdre son pouvoir. Bien que la sphère publique et le cyber espace ne laissent guère beaucoup de place à l’activisme, les féministes (...) chinoises se sont mobilisées pour continuer d’expérimenter de nouvelles façons d’exiger l’égalité de genre et de poursuivre des transformations sociales et culturelles. Se analizan tres elucidaciones posibles de la idea de EN: fundadas en expectativas fácticas, fundadas en expectativas evaluativas y fundadas en la percepción de ausencias reales; luego se examina la pertinencia de cada una de esas versiones para el proyecto pesimista radical, y se propone una visión restrictiva sobre el papel que las EN puedan tener en (...) dichas justificaciones, en cualquiera de las tres versiones, señalando que la versión que puede aportar a dicho rol justificador es la versión de las expectativas evaluativas, pero con limitaciones. This paper aims to interpret the role of the soul as ontological, intellectual or cognitive and as the moral principle within the frame of the holistic conception of human psychosomatic health that emerges from the context of Zalmoxian medicine in the proemium of Plato’s Charmides. It examines what the ontological status of the soul is in relation to the body and the body–soul complex of man considered as a psychosomatic whole. By comparing the presentation of the soul as principle in (...) the Charmides and the Phaedrus, the paper defends the thesis that in the former dialogue, Plato develops his own anthropological ontology, which paves the way for the salvation of human existence and health. The soul is bestowed with an ontological primacy that determines the philosophical and medical presuppositions for treating human illness under a holistic view. The interpretation of the ontological relation of the soul to the body and the entire human being in the context of Zalmoxian holistic medicine is based on Hermias Alexandrinus’ exegesis of the conception of the soul as principle in the Phaedrus. This paper demonstrates that, from both the medical holistic viewpoint and the anthropological philosophical perspective, the soul is the principle and πρῶτον with regard to the body and the body–soul complex without being the whole that the corresponding medical epistemology must apprehend. Discusses Frege's formal definitions and characterizations of infinite and finite sets. Speculates that Frege might have discovered the "oddity" in Dedekind's famous proof that all infinite sets are Dedekind infinite and, in doing so, stumbled across an axiom of countable choice.

Austin attacks the view that language is referential, based on the simplistic division of utterances into the ‘descriptive’ and ‘evaluative’, using his notion of performative utterances. Such utterances, in the appropriate circumstances, are neither descriptive nor evaluative, but count as actions, i.e., create the situation rather than describing or reporting on it. In saying ‘I promise to go’ one is making a promise, not stating that one is making it. A performative promise is not, and does not involve, the statement (...) that one is promising. It is an act of a distinctive sort, the very sort named by the performative verb. And, according to Austin, making explicit what one is doing is not describing what one is doing or stating that one is doing it. (shrink)

This book makes an important contribution to ongoing efforts in the fields of medical law and bioethics to answer the challenges posed by the limitations of the principle of respect for autonomy, especially as these pertain to human research ethics. The principle of respect for autonomy seems to have become firmly embedded in human research ethics since its inclusion in the 1947 Nuremberg Code, which was a response to atrocities committed by Nazi doctors. Nonetheless, there is an increasing awareness of (...) the limitations of the principle of respect for autonomy and the underlying conceptualisations of human autonomy. (shrink)

This article is devoted to examining the ontological foundations of computer-generated music scores. Specifically, we focus on the categorial question, i.e., the inquiry that aims to determine the kind of ontological category that musical works belong to. This task involves considerations concerning the existence and persistence conditions for musical works, and it has consequences for the determination of what it is to compose a musical work. Our contention is that not all the possible answers to the categorial question in the (...) ontology of music are equally compatible with the hypothesis that creative music systems compose musical works. The thesis defended here is that musical Platonism is the proposal that best accommodates this hypothesis. We claim that musical Platonism is the answer to the categorial question that offers the most straightforward explanation for the possibility of considering creative music systems as genuinely composing musical works. Moreover, we uphold that the notion of creative-evaluative discovery as the characterization of what it is to compose a musical work entailed by Platonism is the simplest explanation of the process developed by a computer in producing musical works. For this purpose, we will take as empirical data the features of the Iamus computer, a system that produces musical works autonomously using evolutionary algorithms and following an evo-devo strategy. The works generated by this computer have been recorded by the London Symphony Orchestra and other renowned international soloists, and its impact has been notable in the literature (Ball, 2012; Coghlan, 2012; Berger, 2013). Wittgenstein's principal works, the Tractatus Logico‐Philosophicus and Philosophical Investigations, are each written in such strikingly unconventional ways that it takes considerable effort to translate them into conventional philosophical writing. The most important aspect of Wittgenstein's style for an understanding of his philosophy is his use of multiple voices, and the way he forces his reader to engage with those voices in order to understand him. This chapter provides an outline of the leading macro‐level answers to the question which of Wittgenstein's (...) writings set out his philosophy, and which set out views he rejected. Wittgenstein's method of composition, revision, and rearrangement, leads from the remarks written down in his wartime notebooks, to a manuscript containing several stages of construction of the Prototractatus, and from there to the polished typescript of the Tractatus. The chapter illustrates how to interpret Wittgenstein's remarks without taking a position on questions about texts and style, voice and authorship. (shrink)
