This paper discusses the post-trial access to drugs for patients who participated in clinical trials in Brazil. The ethical guidance for clinical trials in Brazil is arguably one of the clearest in the world in attributing to research sponsors the responsibility for providing post-trial drugs to patients who participated in their experiments. The Federal Constitution recognizes health as a fundamental right to be fulfilled by the State. Based on the Brazilian constitution and on the National Health Council resolutions, courts have (...) been accepting patients' claims and ordering the State and the pharmaceutical companies to provide these patients with the tested treatment in the quantity and duration they need it. This generous interpretation of the duties of the pharmaceutical companies and the State makes the Brazilian model for post-trial access unique when compared to the experience of other countries and thus should be followed with attention by future research in order to assess its consequences for patients, research sponsors, and the public health system. This paper discusses so-called post-trial access to drugs for patients who participated in clinical trials in Brazil. Brazil is currently a relevant country for the pharmaceutical industry due to the dimensions of its actual and potential market. As a consequence, the number of pharmaceutical trials has been rising. It is the largest market for pharmaceutical companies in Latin America, the 8th biggest in the world and second only to China among the so-called BRICS’s emerging countries. The demand for pharmaceutical products (...) in the country has been increasing by double digits over the last few years, reaching 20% in 2008. Not surprisingly, we are also witnessing a steady increase in the number of applications by national and international pharmaceutical companies before ethical research authorities for authorization to perform clinical trials of drugs. As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

We argue that deliberative decision-making that is inclusive, transparent and accountable can contribute to more trustworthy and legitimate decisions on difficult ethical questions and political trade-offs during the pandemic and beyond.

El propósito de este texto es tematizar la precariedad con las herramientas de la filosofía política. Buscaremos equilibrar horizontes conceptuales con prácticas políticas para pensar la acción democrática en nuestro contexto. Nuestro argumento se compone de cuatro premisas. Primero, que elfalso dilema entre teoría y práctica nos permite explorar una relación de tensión creativa entre ambas para conceptualizar la precariedad. Segundo, que la construcción teórica de la precariedad responde tanto a ideas y conceptos como a instituciones y discursos que configuran (...) las vidas de quienes la experimentan. Tercero, que los distintos usos del concepto de precariedad permiten reconocer una fuente común de vulneración de derechos relacionada con la configuración del trabajo en el orden neoliberal. Cuarto, que relacionar la conceptualización de lo plebeyo con la de lo precario nos permite pensar prácticas democráticas renovadas. (shrink)

Introduction Context: In Portugal assisted death was approved in February 2020 by the Parliament, although the law is not yet in force. Objectives To find out what doctors think about those practices. Methods A link to a questionnaire was sent by email three times, at intervals of one week, to the doctors registered in the Northern Section of the Portuguese Medical Association, before the Parliamentary approval. Results The questionnaire was returned by 1148 physicians. A minority of doctors would practice a (...) form of assisted death under the present law or if it was legalized, but a higher percentage think that euthanasia should be legalized, and more would like to have that option if they themselves were in a terminal phase of a disease. Religion has a strong influence on the attitudes of doctors, so too does their contact with patients in a terminal phase, as doctors who deal with more patients with far advanced diseases are more likely to be unfavorable to assisted death. On the other hand, younger doctors are more in favor of these practices. Conclusion The small percentage of questionnaires sent back is a weakness in this study and casts doubts on the generalizability of the conclusions. However, this is, so far, the best approximation to the opinions of Portuguese doctors on assisted death. (shrink)

En este trabajo se hace un análisis aproximativo del estudio fenomenológico hermenéutico del dolor en la facticidad del vivir propio. Su objetivo es visualizar el dolor como determinante en la apertura a la existencia del ser, del ser-ahí, en perspectiva heideggeriana. Se expone la experiencia de la vida dolorosa como experiencia fáctica del vivir en sí mismo, y el conflicto ético que plantea la alteridad: la dificultad de comprender el dolor de los otros desde su propio experimentar dolor. Este conflicto (...) ético aparece en la conciencia del médico cuando éste asume el compromiso de ir más allá de la ayuda instrumental e intenta ver el sufrimiento del enfermo desde la realidad del otro como sí mismo. La hipótesis que subyace en este análisis es que el sufrimiento del dolor abre camino a la existencia propia; sin embargo, evidencia el obstáculo de comprensión del otro. Se concluye ratificando la idea de que el dolor tiene carácter de «existenciario» (término de Martin Heidegger, que significa un modo de ser-en-el-mundo). (shrink)

Com base na crítica que Hume faz ao argumento do desígnio, especialmente nas partes 10 e 11 dos Diálogos sobre a Religião Natural, meu objetivo neste artigo é, a partir de uma análise da relação entre a existência do mal no mundo e a suposta existência de uma divindade possuidora dos atributos tradicionais do teísmo, defender a tese segundo a qual o tratamento que Hume dá ao problema do mal corresponde, digamos assim, à cartada final – o último e decisivo (...) recurso que Philo personagem que articula essa crítica) aciona para mostrar que o argumento do desígnio não fornece bases suficientemente sólidas e consistentes para dar suporte à crença na existência de um Deus maximamente poderoso, justo e benevolente; e que, portanto, a existência do mal no mundo tem uma força argumentativa tal que a improbabilidade da existência de Deus é maior do que com base nos argumentos apresentados nas partes 2 a 8 dos Diálogos. Isso significa que eu tomo aqui o problema do mal como o maior problema para o teísta experimental – cuja argumentação pretende provar a existência de Deus a partir da observação dos fenômenos do mundo. Over the turn of the 21st century, the use of data from large electronic corpora has changed research on Spanish historical syntax, spurring interest in long-range evolutions and the shape of the correspondent diachronic curves. However, general reflections on diffusion and the factors that drive and influence it are still pretty much lacking. In this paper, I reflect on the research possibilities laid open by the availability of such large masses of data, focusing particularly on new knowledge on syntactic change (...) brought about by the study of low-frequency phenomena and of recessive changes, as well as on the exploration of changes conditioned by dialect contact and textual traditions. I conclude with some remarks on the general typology of diffusion in syntactic change. (shrink)

Many different arguments have been put forward in order to assign the best place for a given element within Mendeleev's Table: its spectroscopy, its chemical activity, the crystalline structure of its solid state, etc. We here propose another criterion; the nature of the few body corrections to the pairwise additive energy. This argument is used here to address a question often brought forward by Eric Scerri in Foundations of Chemistry, namely the rightful place of helium; either above the column of (...) the alkaline earths (beryllium, etc.) or rather above the noble gas elements. We access most of our most cherished beliefs via testimony. Philosophy is no exception. We treat spoken and written philosophical testimony as evidence for philosophical claims. Nonetheless, this paper argues that philosophical testimony is unable to justify philosophical beliefs. If testimony is the only evidence we have to justify philosophical beliefs, this entails skepticism about philosophy. Call this the testimony challenge. First, the paper argues that philosophical testimony does not meet the conditions under which evidence can justify our beliefs. Second, (...) it shows that philosophical testimony cannot provide preemptive epistemic reasons as science and mathematics do. Finally, it answers the self‐defeat objection and a set of objections aiming to block the thesis that philosophical testimony does not justify philosophical beliefs. The paper aims to rethink the role of philosophical testimony in philosophy and reinforce the skeptical worries raised by methodological and disagreement challenges. (shrink)

Violence has long been assumed to be an intrinsic trait of female prostitution. However, it has been mostly associated with the locale in which the activity is exercised, i.e. with working time and space. In this article, based on data gathered by direct observations, in-depth interviews and the compilation of so-called time-budgets, the authors demonstrate that violence is as pervasive and omnipresent a feature of prostitutes’ ostensibly private ‘off-duty’ time and space, though it takes on varied and distinct forms and (...) configurations, compared to violence in the workplace. O objetivo deste artigo é fornecer novos dados historiográficos sobre a assistência concedida às crianças da cidade de Braga, na ocasião do seu falecimento, no século XVIII. No trabalho que realizamos, foi possível analisar alguns dados sobre o anúncio da morte das crianças de Braga, os seus velórios, sepultamentos e a assistência às suas almas, através de fontes documentais das confrarias da cidade e das Constituições Sinodais do arcebispado. A análise testamental forneceu menos dados, mas revelou a provável preocupação de (...) alguns indivíduos, com a salvação das almas dos filhos falecidos com mais de sete anos de idade. (shrink)

In this paper I explore the metaphilosophical consequences of deep disagree-ments in philosophy. I argue that deep philosophical disagreements imply a challenge for philosophy since deep philosophical disagreements hinder ratio-nal decision between philosophical theories. That makes demanding or offe-ring reasons for philosophical theory useless. To overcome this, I argue that philosophical argument is an end in itself and not a means to rational reso-lution of deep philosophical disagreements. I describe two theories that at-tempt to explain deep disagreements in general. Next, (...) I distinguish between intraphilosophical and interphilosophical disagreement. Thus, interphilosophical disagreements are those that are deep philosophical disagreements, while in-traphilosophical disagreements are disagreements between epistemic peers. Subsequently, I explore the consequences of deep philosophical disagreements and conclude that epistemic and practical reasons fail to provide a rational res-ponse to deep philosophical disagreements. Finally, I respond to two objections about argumentative language in philosophical debates and the impossibility of philosophical progress. (shrink)

The Periodic Table has the column of the noble gas atoms (He, Ne, Ar, Kr, Xe, Rn) as one of its main pillars. Indeed the inert chemical nature of their closed shell structure is so striking that it is sometimes extended to all such structures. Is it true however that any closed shell, say a closed d-subshell will denote a lack of chemical activity? Take the noble metals for instance, so renowned for their catalytic capacity. Platinum has 10 electrons in (...) its valence shell which makes one of its excited states to be a closed 5d10–6s0 state. Surely this state would not be expected to be crucial to the catalytic activity of platinum, or would it? Or take palladium whose ground state is precisely the 4d10–5s0 state, should we expect that an isolated Pd atom at near zero-point temperature would attack a closed-shell hydrogen molecule efficiently? We shall here show that this is precisely the case; the closed-shell excited states of nickel and platinum are indeed crucial, through symmetry avoided crossings, for their reactivity. Other valuable catalysts as ruthenium depend on their excited states with maximal d-shell occupancy for their activity. The most notable confirmation of this new finding; that closed d-shells are vital to the catalytic activity of noble metals however, is the case of palladium whose closed-shell ground state is indeed capable of attacking hydrogen and hydrocarbon molecules even at temperatures well below 10 K as was predicted theoretically and immediately confirmed experimentally. El artículo tiene como objetivo mostrar que el estilo como problema político es una de las condiciones de posibilidad para comprender el ethos reaccionario de la modernidad latinoamericana. La conjetura de fondo es que la modernidad latinoamericana es un tiempo diacrónico que mantiene un tiempo liberal en tensión con un tiempo reaccionario, razón suficiente para sugerir que el estilo de los “antimodernos” permite comprender algunos los problemas de la formación estético-política latinoamericana. Por consiguiente, el artículo está dividido en tres partes. (...) La primera discute el estilo como un problema ético, antes que estético o retórico. La segunda postula la noción de estilo y sus rasgos gnósticos en el colombiano Nicolás Gómez Dávila. Por último, el artículo cierra con una discusión del concepto de estilo de Octavio Paz para mostrar cómo un intelectual que se define a sí mismo como liberal puede compartir el estilo de un reaccionario como síntoma de un ethos epocal. Anthropology as Counter-Science. A Merleau-Pontyan approachThe author tries to show that the conception of the anthropology as counter-science, presented by Foucault (inspired by Lévi-Strauss), is limited to dissolve some naïve representations of subjectivity, and that the critical potential of this notion could be extended to the current theoretical conceptions (section 1). The author holds that the limited notion of contra-science can be found in the very Lévi-Strauss’ works, and this is made clear by comparison with Edmund Husserl’s works (sections 2-3). (...) After that, the author tries to develop a larger notion of counter-science, based on Merleau-Ponty’s criticisms to Lévi-Strauss (section 4). The author uses the subject of acupuncture’s efficacy as an example of this larger notion of counter-science.L’antropologia come contro-scienza. Sosteniamo che questa nozione limitata di contro-scienza può essere trovata nell’opera di Lévi-Strauss stesso, cosa che emerge con chiarezza nel confronto con alcuni testi di Edmund Husserl (sezioni 2-3). Cerchiamo quindi di sviluppare una più ampia nozione di controscienza antropologica, che si basa sulle posizioni critiche di Merleau-Ponty riguardo a Lévi-Strauss (sezione 4). This article explores the ways in which suspects attempt to make putative victims/complainants at least partially responsible for the incidents for which they are investigated, transforming themselves into the victim and the other into the perpetrator. Drawing upon conversation analysis, I examine audio-recorded police interviews for low-level crimes in England and in which suspects have constructed what I refer as counter-denunciations. I argue that suspects accomplish these counter-denunciations through discursive practices that involve, for example (a) contrasting the complainant’s actions with (...) their own innocent conduct; (b) historicizing the event being investigated; and (c) discrediting the complainant’s character—stigmatizing. These practices have in common the suspects’ reliance on the relational and contextual character of the categories ‘offender’ and ‘victim’. (shrink)

Esse texto é um resultado parcial e provisório de uma pesquisa de Pós-doutorado em andamento na Scuola Normale Superiore de Pisa/Italia sobre a supervisão do filósofo Roberto Esposito. Observa-se que nessas primeiras décadas do século XXI o pensamento filosófico Italiano, por algumas das razões que tentaremos expor abaixo, tem sido objeto de um grande interesse mundial, tornando-se objeto de inúmeros seminários, livros e artigos. O texto tenta avaliar se existiria algo como uma “filosofia Italiana” para além da pertença nacional daqueles (...) que contribuíram para a sua construção. Pode-se falar em uma Italian Theory? Na defesa que Maurice Blanchot faz da consistência ontológica da experiência poéticoliterária, surge uma relação filosófica ambígua com bergsonismo. Compreender como o pensamento deHenri Bergson incide em sua teoria é imprescindível para podermos estabelecer a importância deMallarmé na constituição de uma teoria do espeço literário e encontrarmos o devido lugar do devir e daduração nesta teoria da literatura. Em Blanchot podemos verificar algumas linhas de ruptura econtinuidade com o bergsonismo, procedendo sobretudo uma reversão do fluxo temporal no espaçodiferencial da escrita (...) e da própria experiência subjetiva. Não deixamos de notar que Blanchot, ao seguiruma tendência interna de divergência do bergsonismo com ele próprio, recupera um outro lado daexperiência das “ilusões idealistas das representações simbólicas”. Tais ilusões, combatidas porBergson em sua crítica ao conceito e apelo empírico à intuição, formam para Blanchot um substratopositivo-ontológico da linguagem e sobretudo da literatura. (shrink)

Nunca tal vez como ahora el hombre ha estado tan amenazado de una quiebra de los valores que sustentan su vida espiritual, su cultura y aun su misma coexistencia y subsistencia sobre la tierra. En el orden social internacional y nacional, en el mejor de los casos, pareciera que sólo existe un equilibrio de fuerzas, continuamente amenazado por quebrarse con el predominio de una de las partes, pero en modo alguno una paz interna lograda por un auténtico orden jurídico-moral. De (...) hecho tal equilibrio está roto en muchos casos; y en el plano internacional son muchos los pueblos sojuzgados por guerras o imposiciones injustas de otros Estados más fuertes, impedidos en el libre ejercicio de su soberanía —Hungría es un ejemplo—; y en el plano nacional son muchos los dictadores que con violencia imponen su régimen sobre los individuos, privados de sus derechos personales y sometidos a vejaciones y humillaciones de toda índole; y las clases sociales más fuertes que imponen una verdadera esclavitud sobre las más débiles —la explotación humana de los trabajadores o, lo que es peor, de pobres mujeres indefensas sometidas a las garras de un comercio infame—. Ha desaparecido el orden humano-moral, el orden intrínseco y jerárquico, que desde la conciencia y de un modo absoluto imponía a cada uno —al Estado, familia e individuos— sus obligaciones, con lo cual y correlativamente aseguraba también a cada uno sus derechos frente a los demás, organizando a los individuos en la familia e instituciones, a éstas en el Estado y a éste en la Comunidad internacional. Y este orden se ha perdido, porque los valores correlativos de justicia y de derecho con las consiguientes normas moral-jurídicas o son desconocidas o han perdido su carácter de vigencia absoluta y han sido substituidas por la fuerza, la austucia y los intereses y pasiones en general.
