This article discusses passive and active aspects of consciousness as two equally justified roots of life experiencing the world. The passive domain involves the synthesis of internal time, association, habituality, bodily aspects, etc. The active domain includes strictly cognitive competences of consciousness: thinking, judging, etc. What has been actively constituted becomes passive as the basic level for higher form of understanding. The two domains interweave, influence each other, complement each other, and also remain in a certain tension and discrepancy. In (...) the broader perspective of the system of consciousness and its various layers, the passive-active differentiation must be treated functionally, and not as hierarchically arranged or constituted by separable concepts. The article is an overview of the main philosophical ideas of Gottlob Frege. The author stresses that Frege has built important tools for the analysis of language: the logic of sentences and the logic of predicates. He stresses also the importance of Frege’s work on the foundations of mathematics. He argues that his greatest achievement is the fact that thanks to Frege language has become main object of investigations in contemporary philosophy, and that theory of meaning has replaced the traditional (...) theory of knowledge. Frege’s ideas, taken together, constitute a well-defined method, a particular style of approach to philosophical problems and of their resolution. The effectiveness and enduring pertinence of Frege’s method is demonstrated by means of an analysis of several typical category mistakes, frequent in philosophical argumentation. Consciousness, according to one of Husserl’s characteristics, is also a system of potential moments outlined in advance. How does consciousness gain this competence? Answering the question, subsequent conditioning aspects are taken into account: (1.) the inner time consciousness that determinates the temporal structure of the word-experience (Welterfahrung) and the world consciousness (Weltbewusstsein), (2.) the network of types. The two aspects of consciousness make possible and determinate cognitive styles of present and future course of experience. The closing remarks (3.) concern the (...) nature of types and their role as cognitive structures that integrate common knowledge with scientific knowledge. Types combined into wider structures types define the further course of experience. Ultimately, they define the scope of practical possibilities, purposes and interests of the subject, an open horizon of possible closer specification. (shrink)

In his response to the question about the conditions of the possibility of dependable cognition Kant first points to the faculties of the cognitive powers and subsequently lists the criteria and normative foundations of knowledge—a system of forms, concepts and principles. Kant primarily seeks the possibilities of experience-independent cognition, the logical criteria governing the possibility of cognition as such. The paper outlines the creation of the systemic union of the primal concepts and principles of pure reason, which is necessary for (...) the creation of knowledge. In other words, it follows the constitution phases of the cognition system: apperception, experience, self-consciousness and the principles of reason. The principles of reason ultimately give systemic unity to humancognitive powers—and, in effect, the human world of experience and cognition. It is this systemic unity which makes cognition science—or, in other words, pure reason—as it constitutes a specific system and is able to create science understood as the systemic unity of specific fields. The paper deals with the concept of the model of the word. It concerns a pre-linguistic stage of language acquisition, descriptive content of proper names and interpretation by means of a conceptual system. The model of the world comprises all aspects of being conscious. It is a system, a unity, a background of our conscious life; perception, language, notions, concepts, are its aspects. The more we know about cognitive processes, functions and structure of the mind, the be$er we understand the (...) nature of language; the more we know about language, the better we understand the nature of the mind. Linguistic meaning as it was shown by the studies of language and categories acquisition, has its origin in the aforementioned model. That is why linguistic meanings are not ready-made contents, ideas, semantic entities, etc. but rather systems of procedures that constitute sense of speech acts. The approach to linguistic meaning as a part of an individual conceptual system, a system of information that mirrors cognitive, linguistic and non-verbal experience of an individual, is much of help in understanding efficacy of language, forming of beliefs, convictions, and also introducing new meanings. In an era of fiscal austerity and dualization of social protection, has organized labor become increasingly split along skill and industry lines? Against recent political science accounts of trade union involvement in social policymaking, this paper argues that, in the specific area of pensions, unions representing high-skilled workers and the core industrial sectors of the economy have paradoxically been led to increase their cooperation with unions representing the less privileged segments of labor, in order to improve coverage of private pensions (...) across the board. These unions’ motivations for doing so and the strategies they have employed have nonetheless differed according to the preexisting institutional design of domestic pension systems. The argument is supported with case studies of British, French, German, and Belgian unions’ involvement in contemporary pension reform. (shrink)

People should be at the centre of attention within knowledge-based economics. The leaders of each enterprise ought to focus on providing the best conditions for their employees’ professional and individual development and treat them with respect in terms of their dignity and needs. In contemporary literature two notions in perceiving people in organisations are noticeable. The first one treats employees as ‘resources’ which have to be properly used or as ‘capital’ that should bring a decent return on investment. The second (...) notion derives a lot from Christian philosophy and sees the human as a person who treats work as a way to realize his calling and thus is able to take responsibility for the decisions made and actions taken. Acting in a constantly changing environment, people have to be flexible and able to take advantage of emerging opportunities and avoid threats. Within this process it is not a matter of being a human ‘being’ but rather becoming, which means that they are incessantly developing their potential. Although it is hard to predict human behaviour, the main task for managers is to lead in a way that will help employees use their full potential for both their own and the company’s benefit. A number of nonmonotonic reasoning formalisms have been introduced to model the set of beliefs of an agent. These include the extensions of a default logic, the stable models of a general logic program, and the extensions of a truth maintenance system among others. In [13] and [16], the authors introduced nonmonotomic rule systems as a nonlogical generalization of all essential features of such formulisms so that theorems applying to all could be proven once and for all. In this paper, (...) we extend Rieter's normal default theories, which have a number of the nice properties which make them a desirable context for belief revision, to the setting of nonmonotonic rule systems. Reiter defined a default theory to be normal if all the rules of the default theory satisfied a simple syntatic condition. However, this simple syntatic condition has no obvious analogue in the setting of nonmonotonic rule systems. Nevertheless, an analysis of the proofs of the main results on normal default theories reveals that the proofs do not rely on the particular syntactic form of the rules but rather on the fact that all rules have a certain consistency property. This led us to extend the notion of normal default theories with respect to a general consistency property. This extended notion of normal default theories, which we call Forward Chaining normal , is easily lifted to nonmonotomic rule systems and hence applies to general logic programs and truth maintenance. Experiences are interpreted as conscious mental occurrences that are of phenomenal character. There is already a kind of (weak) intentionality involved with this phenomenal interpretation. A stricter conception of experiences distinguishes between purely phenomenal experiences and intentional experiences in a narrow sense. Wittgenstein’s account of psychological (experiential) verbs is taken over: Usually, expressing mental states verbally is not describing them. According to this, I believe can be seen as an expression of one’s own belief, but not as an expression of (...) a belief about one’s belief. Hence, the utterance I believe it is raining shows that I believe that it is raining, although it is not said by these words that I believe that it is raining. Thinking thoughts such as I believe it is raining, but it is not raining (a variant of Moore’s paradox) is an absurdity between what is already said by silently uttering It is not raining and what is shown by silently uttering I believe it is raining. The paper agrees with a main result of Wittgenstein’s considerations of Moore’s paradox, namely the view that logical structure, deducibility, and consistency cannot be reduced solely to propositions—besides a logic of propositions, there is, for example, a logic of assertions and of imperatives, respectively. The author examines the arguments for applicability of the limitation clause which specifies the requirements for limitation of constitutional freedoms and rights (Article 31 para. 3 of the Constitution) to the right to protection of life (Article 38). Even if there is almost a general acceptance of such applicability, this approach does not hold up to criticism based on the rule existing in the Polish legal order that treaty commitments concerning human rights have supremacy over national statutory regulations. Due to (...) an international pattern which does not provide application of the limitation clause to the right to life protection, despite the recognition — at the level of a constitutional standard — of applicability of the clause of Article 31 para. 3 to Article 38, and to protection of life in general, this will be made impossible at any attempt to formulate a statutory standard. He also points out the defectiveness of the reasoning leading to acceptance of certain limitations of a particular value (e.g. life) on the basis of the ex definitione exemptions existing in the international standard to the assumption of applicability of the limitation clause when shaping statutory standards in the Polish legal system. The discussed issues are related to the question of interpretation of the inviolability of human rights. This term takes different meaning in the context of: 1) inviolability of all human rights understood in abstracto as normative structures of a general and abstract nature; 2) right protecting certain values with no exception; 3) rights to which an application of the limitation clause is forbidden; 4) rights not subject to derogation; 5) inviolability of understood in concreto, as that is (here and now) due to the subject of dignity; 6) inviolable essence of freedoms and rights. One should also clearly distinguish between (7) the descriptive and (8) the normative meaning of inviolability. -/- Punktem wyjścia jest analiza argumentacji na rzecz tezy o stosowalności do prawa do ochrony życia (art. 38 Konstytucji RP), klauzuli limitacyjnej określającej warunki ograniczania konstytucyjnych wolności i praw (art. 31 ust. 3). Mimo niemal powszechnej akceptacji tej tezy, nie wytrzymuje ona krytyki opartej na pierwszeństwie, które w polskim porządku prawnym mają zobowiązania traktowe dotyczące praw człowieka, wobec regulacji ustawowych. Ze względu na wzorzec międzynarodowy, który nie przewiduje stosowania klasycznej klauzuli limitacyjnej do prawa do życia, mimo uznania - na poziomie standardu konstytucyjnego - stosowalności klauzuli z art. 31 ust. 3 do art. 38 i ochrony życia w ogóle, stosowalność tej klauzuli będzie uniemożliwiona przy każdej próbie formułowania standardu ustawowego. Autor zwraca uwagę na wadliwość wnioskowania prowadzącego od uznania dopuszczalności pewnych ograniczeń ochrony jakiejś wartości (np. życia) na podstawie wyjątków ex definitione obecnych w standardzie międzynarodowym, do tezy o stosowalności klauzuli limitacyjnej przy kształtowaniu standardu ustawowego w polskim systemie prawnym. Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności.
