Following the manuscript's discovery in 1864, scholars have widely assumed that De Jure Praedae (Commentary on the Law of Prize and Booty) was written by the Dutch lawyer Hugo Grotius (1583–1645) in the period 1604–1606. Yet the conventional dating fails to consider the materiality of Ms. BPL 917 in Leiden University Library. By analyzing paper supplies, this article throws new light on the date and manner of the manuscript's composition. The watermarks in the paper, the quire divisions and foliation are (...) considered in combination with relevant textual evidence, such as manuscript references to historical events and any allusions to Ms. BPL 917 in Grotius’ letters and other archival sources. This approach has yielded unforeseen results. Yes, Grotius wrote out the original text in 1604/05, as a fair copy of a previously existing work. Yet he did not stop there. Entire folio-pages were crossed out in Ms. BPL 917 and new ones inserted in the following sequence: - in, or shortly before, January 1607, Grotius deleted f. 63v and 67r and inserted f. 64–66 - between January 1607 and Nov–Dec. 1608, he deleted f. 7v, 19r, 38v, and 43r-v and inserted f. 8–9, 18, and 39–42 - in November–December 1608, he deleted f. 119r–122r and inserted f. 117–118. These revisions were a direct response to the challenges faced by the Dutch East India Company (VOC) in this period. Its growing empire in Southeast Asia was under threat from the peace and truce negotiations between the States General and Philip III of Spain and Portugal. Grotius’ revisions of Ms. BPL 917, along with chapter twelve's appearance as Mare Liberum in April 1609, justified the continuation of Dutch empire-building in the East Indies, the Twelve Years’ Truce (1609–1621) notwithstanding. Grotius’ rights and contract theories made it perfectly acceptable to conclude a peace or truce in (Western) Europe, yet persist in colonial warfare beyond the Line (i.e. the Tropic of Cancer). In this respect – the (implicit) differentiation between ‘the West and the rest’ in international relations – Grotius’ legacy is still with us today. (shrink)

American Academy of Pediatrics (AAP) and American College of Medical Genetics (ACMG) recently provided two recommendations about predictive genetic testing of children. The Clinical Sequencing Exploratory Research Consortium's Pediatrics Working Group compared these recommendations, focusing on operational and ethical issues specific to decision making for children. Content analysis of the statements addresses two issues: (1) how these recommendations characterize and analyze locus of decision making, as well as the risks and benefits of testing, and (2) whether the guidelines conflict or (...) come to different but compatible conclusions because they consider different testing scenarios. These statements differ in ethically significant ways. AAP/ACMG analyzes risks and benefits using best interests of the child and recommends that, absent ameliorative interventions available during childhood, clinicians should generally decline to order testing. Parents authorize focused tests. ACMG analyzes risks and benefits using the interests of the child and other family members and recommends that sequencing results be examined for additional variants that can lead to ameliorative interventions, regardless of age, which laboratories should report to clinicians who should contextualize the results. Parents must accept additional analysis. The ethical arguments in these statements appear to be in tension with each other. (shrink)

In this article we examine the role of vocative forms of address in shaping the political space in public/political discourse. We are particularly interested in strategic uses of forms of address by participants in political debates in order to gain legitimacy for their ideologies. Our data come from four formal television debates between Lech Wałęsa, the former Solidarity trade union leader and president of Poland, and two other Polish politicians, which were held between 1988 and 1995. Due to this historical (...) perspective, we are able to contextualize discursive patterns in the rapidly changing political and social situation in Poland, and show the diachronic development of the ideological underpinnings of discourse. This essay discusses some of the ways in which De iure praedae may be understood to constitute a republican text. It is my argument that the 'Commentary on the Law of Prize and Booty' should be firmly located within the over-arching republican discourse of the juvenilia, although the text's republican content is not immediately apparent. On close examination, a republican sub-text is detectible through the author's treatment of the discursive object of the text, the Dutch East India Company , a (...) corporate body. By attempting to legitimate the VOC's natural right to wage just war, Grotius invests a private entity with a public mark of sovereignty. This investiture of a non-state actor with public international legal personality forces a careful reappraisal of two central characteristics of seventeenth-century republican thought: the divisibility of sovereignty, and the fluid demarcation between the 'public' and the 'private' spheres. I conclude that the VOC may be accurately denoted a 'corporate sovereign', an entity whose legal personality is derived from the corporatist principles that underlined early republican and federalist theory. We investigate the relationship between weak square principles and simultaneous reflection of stationary sets.

The aim of this paper is to show that it’s not a good idea to have a theory of truth that is consistent but ω-inconsistent. In order to bring out this point, it is useful to consider a particular case: Yablo’s Paradox. In theories of truth without standard models, the introduction of the truth-predicate to a first order theory does not maintain the standard ontology. Firstly, I exhibit some conceptual problems that follow from so introducing it. Secondly, I show that (...) in second order theories with standard semantics the same procedure yields a theory that doesn’t have models. So, while having an ω- inconsistent theory is a bad thing, having an unsatisfiable theory of truth is actually worse. This casts doubts on whether the predicate in question is, after all, a truthpredicate for that language. Finally, I present some alternatives to prove an inconsistency adding plausible principles to certain theories of truth. (shrink)

Meetings are complex institutional events at which participants recurrently negotiate institutional roles, which are oriented to, renegotiated, and sometimes challenged. With a view to gaining further understanding of the ongoing negotiation of roles at meetings, this article examines one specific recurring feature of meetings: the act of proposing future action. Based on microanalysis of video recordings of two-party strategy meetings, the study shows that participants orient to at least two aspects when making proposals: 1) the acceptance or rejection of the (...) proposal; and 2) questions of entitlement: who is entitled to launch a proposal, and who is entitled to accept or reject it? The study argues that there is a close interrelation between questions of entitlement, aligning and affiliating moves, and the negotiation of institutional roles. The multimodal analysis also reveals the use of various embodied practices by participants for the local negotiation of entitlement and institutional roles. (shrink)

Although this issue has been extensively explored through studies of implicit learning, there is currently no agreement about the extent to which knowledge can be acquired and projected onto performance in an unconscious way. The controversy, like that surrounding implicit memory, seems to be at least in part attributable to unquestioned acceptance of the unrealistic assumption that tasks are process-pure, that is, that a given task exclusively involves either implicit (...) or explicit knowledge. We set up a general context in which one can prove Sauer-Shelah type lemmas. We apply our general results to answer a question of Bhaskar [1] and give a slight improvement to a result of Malliaris and Terry [7]. We also prove a new Sauer-Shelah type lemma in the context of op-rank, a notion of Guingona and Hill [4].

The aim of this paper is to highlight an interdependence between procedural and agential norms that undermines their neat separation when appraising argumentation. Drawing on the munāẓara tradition, we carve a space for sequencing in argumentation scholarship. Focusing on the antagonist’s sequencing of critical moves, we identify each sequence’s corresponding values of argumentation: coalescence, reliability, and efficacy. These values arise through the mediation of virtues and simultaneously underpin procedural as well as agential norms. Consequently, an ambiguity between procedure and agent (...) becomes apparent. This ambiguity hints at the potential for a virtue theory of argumentation that draws on procedural norms. (shrink)

The question of whether it has an exact pair in the c.e. degrees was first raised in [22, Question 4.2] and later in [25, Problem 5.5.8].We give a negative answer to this question. In fact, we show the following stronger statement in the c.e. degrees. This article argues that empirical social scientists can be freed from having to account for “micro-to-macro transitions.” The article shows, in opposition to the (still) dominant perspective based on Coleman’s macro-micro-macro model, that no micro-macro transitions or mechanisms connect the individual level to the macro level in empirical social science. Rather, when considering that social macro entities and properties are micro manifest rather than macro manifest, it becomes clear that the micro-macro move in empirical social science is purely conceptual or (...) analytical. This chapter is concerned with the Cambrian explosion. It considers only one particular kind of explanation for the Cambrian radiation: that major innovations in animal body plan were produced from relatively few genetic changes of large phenotypic effect. It investigates the developmental genetic hypothesis of the origin and maintenance of body plans. This chapter suggests that the genetic architecture underlying body plans was not set during the Cambrian and has been immutable since. It shows that the link between body plan (...) and phylum can become blurry when the minor phyla are considered. (shrink)

We propose that rapid eye movement (REM) and slow-wave sleep contribute differently to the formation of episodic memories. REM sleep is important for building up invariant object representations that eventually recur to gamma-band oscillations in the neocortex. In contrast, slow-wave sleep is more directly involved in the consolidation of episodic memories through replay of sequential neural activity in hippocampal place cells.
