The context in which the author places the concept of substantial morality (Sittlichkeit) is the history of Athens from about 490 to 430 B.C. This facilitates the understanding of a (political) way of life that is quite foreign to us in modern times. This also makes the concept of modern post-traditional morality, which plays a central role in the discussion of Hegel today, easier to understand. The concept of morality as a political category of social interaction thus becomes more (...) vivid. As knowledge in historical and classical philological research has advanced, not every statement of Hegel's remains as meaningful and usable. This article endeavors to draw out and explicate some of the normative tensions that animate the imaginary and practice of solidarity. It begins by examining the account of solidarity set forth in the writings of Jürgen Habermas. It then considers Axel Honneth’s recognition-theoretic conception of the solidaristic attitude. While remaining sympathetic to the left-Hegelian intersubjectivism of Habermas’ discourse-ethic, Honneth seeks to redress the “cognitive-centric” limitations of the latter thinker’s conception of solidarity. In this context, particular emphasis is placed on Honneth’s (...) engagement with the idea of Sittlichkeit, or shared form of ethical life, discussed in Hegel’s early “Jena period” work, as well as in his later Elements of the Philosophy of Right. To Honneth, while these writings can contribute significantly to a recognition-theoretic understanding of solidarity, they must be distinguished from the philosophy of consciousness that circumscribes the famous recognition struggle between master and slave in The Phenomenology of Spirit. In conclusion, the paper questions the capacity of Honneth’s approach to criticize ideological forms of solidaristic recognition, offering a qualified defense of Habermas’ contravening perspective. Sie verfolgt, wie Hegel das Verbrechen vom Standpunkt der Sittlichkeit aus einerseits als etwas davon Abweichendes beurteilt und andererseits die Strafe als die Realisation des Willens des Verbrechers deduzieren will. Dabei werden die logischen Abstraktionen, unter die Hegel das Verbrechen subsumiert, ebenso einer selbständigen Untersuchung unterzogen wie bei der Untersuchung der Sittlichkeit der Standpunkt der Sittlichkeit. Der Beitrag untersucht die geschichtliche Entwicklung in ehemaligen Kolonialstaaten nach dem Rückzug der Kolonialmächte. Er unternimmt diese Untersuchung im Ausgang von Hegels Begriff der Sittlichkeit. Mittels dieses Konzepts entwickelt der Autor ein Modell des historischen Prozesses, der durch den Widerstreit zwischen den Ansprüchen der einzelnen Gemeinschaften und denen des Nationalstaats bestimmt ist. Anschließend prüft er dieses Modell unter Rückgriff auf tatsächliche Entwicklungen, etwa in Südamerika.

Die Aufsätze des Bandes leisten einen Beitrag zur Debatte über die Relevanz des Hegelschen Sittlichkeitsbegriffs. The contribution starts with a concise account of Kant's moral philosophy. It is shown that a moral will is necessarily an autonomous will and that only the "formal" character of the moral law can establish its universal validity. Some widespread misunderstandings are discussed, especially with regard to the alleged emptiness of the moral law; the relationship between duty and inclination; the role of natural incentives in a moral will; and the necessary objects of such a will. This leads to the (...) idea of the highest good as the objective final end and duty of a finite rational being. Again, typical misunderstandings are dealt with: the reproach of eudaimonism, and heteronomy, and the role of the highest good as incentive; and an alleged inconsistency between Analytic and Dialectic of the Second Critique. In the then following discussion of Kant's doctrine of the postulates and his philosophy of religion, it is shown that religion is totally dependent on morality as philosophy of religion is on moral philosophy; that a belief in God is required neither for the validity of the moral law nor for the obedience to it; that the so-called moral proof is not a proof of God's existence, but only of the practical necessity of its assumption; and that the idea of the highest good refers throughout exclusively to another world. The last chapter first gives a concise account of Kant's teleological philosophy of history and then comes to the result of the whole inquiry: that there is a principle difference between philosophy of religion and philosophy of history which makes them not only independent of each other, but also keeps them in well distinguished fields. The philosophy of religion presupposes moral philosophy. Its main function is to determine what the idea of God morally means to man. Its achievement is to yield a reason of belief for the hope that the realization of the highest moral good is possible and that therefore the moral life of man is not necessarily pointless, as long as he fulfills his respective duty. It has meaning only for the one who is conscious of being subject to the moral law and ready to act accordingly. The philosophy of history on the other hand presupposes especially the doctrine of right. Its main function is to determine what the future of mankind on earth politically means to man. Its achievement is to yield empirical reasons for the hope that the realization of the highest political good is possible and that therefore the political life of man is not necessarily pointless, as long as he fulfills his respective duty. It has meaning only for the one who is conscious of being subject to the law of right and ready to act accordingly, although, it is true, the attainment of the historical aim itself is possible even by acting from purely prudential reasons. In den Sozialwissenschaften unserer Tage ist von Tugend kaum noch die Rede. Zu stark wirkt die Kritik an der moralischen Weltinterpretation nach, in deren Strudel die ehemals hochgeschätzten Tugenden geraten waren. So überrascht es kaum, daß auch die philosophische Ethik gegenwärtig eine eigene Tugendlehre nicht entwickelt. Doch die weit verbreitete Moralisierung der griechischen aretai und der lateinischen mores sowie deren Kritiker gehen zumeist von falschen Voraussetzungen aus, wenn sie von Tugendhaftigkeit, von Sittlichkeit oder von Moral sprechen. Die griechische arete (...) meinte ursprünglich ebenso wie die althochdeutsche tugund keine moralische Haltung oder Qualität, sondern eine besondere Tüchtigkeit oder Eignung, die einem Werkzeug ebenso zukam wie einem Körperteil oder einem Fachmann. So verstanden ist die Tugendlehre weiterhin ein wesentlicher Bestandteil einer praktischen Philosophie. (shrink)

Kant hat bewiesen, dass reine Vernunftnotwendigkeit der einzige nicht zufällige, also unbedingte Geltungsgrund von Ethos und Recht ist. Dazu bedarf Vernunftnotwendigkeit der Anwendung auf die menschliche Praxisdisposition und wird dadurch zum Sittengesetz. Es begründet das untergeordnete Verhältnis von Recht und Moral. Die menschliche Freiheit hat in der Notwendigkeit des Sittengesetzes ihren absoluten Grund und ihr Kriterium. Daher kann es nicht in unserem Belieben stehen, soziale, ethische und rechtliche Regeln aufzustellen, sondern es ist unabweisbare Menschenpflicht, sich nur Regeln zu geben, die (...) dem Sittengesetz gemäß sind. Auch die Geltung staatlicher Gesetze ist von dieser Übereinstimmung abhängig.Kant has shown that pure rational necessity is the single non-contingent and thus unconditional basis for the validity of law and ethics. In addition, rational necessity requires application to human practical disposition and thereby becomes moral law. The moral law provides the basis for the subordinate relationship of law and ethics. Human freedom finds its absolute foundation and its criterion in the necessity of the moral law. Accordingly, it cannot be within our discretion to establish social, ethical, and juridical rules, bur instead it is an imperative duty for human beings to adopt rules that accord with the moral law. O objetivo deste artigo é investigar o problema do formalismo dando ênfase à G. W. F. Hegel e sua Rechtphilosophie como proposta de objetivação dos conteúdos normativos do agir. A intenção é apresentar a versão de Hegel para o problema do formalismo em relação às determinações do agir na esfera ética, política e jurídica. Para a concretização de tal tarefa é necessário investigar as considerações acerca da Moralität e da Sittlichkeit, pressupostos básicos para edificar um projeto recheado por uma (...) Filosofia do Direito e pela figura do Estado político.
