El derecho, como lenguaje, cumple diferentes funciones comunicacionales que logra, en buena medida, a través del uso de herramientas y dispositivos narrativos. Entre ellos se destacan las ficciones jurídicas, las cuales, lejos de retratar la realidad, buscan crear una verdad jurídica. En el caso de las ficciones constitucionales, éstas son, con frecuencia, malinterpretadas, lo que lleva a su degeneración. En este texto, más allá de ofrecer un acercamiento conceptual a la figura de las ficciones constitucionales, se ofrece un análisis introductorio (...) en cuanto a la forma en la que ha ocurrido esto en el contexto del nuevo constitucionalismo latinoamericano. We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

The first comprehensive survey of the criticisms of Leibniz's philosophical optimism in the first half of the eighteenth century, when what has been called the ‘debacle of the perfect world’ first began.

While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. While children’s experiences of online risks and harm is a growing area of research in New Zealand, public discussion on the matter has largely been informed by mainstream media’s fixation on the dangers of technology. At best, debate on risks online has relied on overseas evidence. However, insights reflecting the New Zealand context and based on representative data are still needed to guide policy discussion, create awareness, and inform the implementation of prevention and support programmes for children. This research report (...) presents findings from a quantitative study regarding different aspects related to risks and online safety. It looks at the online experiences that children find bothersome and upsetting and explores the hurtful behaviours they encounter or engage in, both online and in person. Evidence regarding exposure to different types of potentially harmful online content is also presented. Another relevant contribution is the insights related to excessive internet use.The findings presented in this report are based on data from 2,061 New Zealand children aged 9-17. We hope the findings will contribute to the development of policies, practices and services designed to support New Zealand children to safely take advantage of the opportunities available to them online. The prospective formalization of the Anthropocene as a chronostratigraphic unit by the International Commission on Stratigraphy has been intensely debated. This paper explores and assesses the stakes of this process from a philosophical perspective. I distinguish two senses of formalization—the descriptive and the evaluative—and argue that: 1) there are descriptive and evaluative formalizations of the Anthropocene beyond the confines of the ICS; 2) incoherencies between Anthropocene proposals and the ICS’s current tenets are not a decisive reason for deferring descriptive formalization; (...) and 3) the prospective evaluative formalization of the Anthropocene by the ICS would be impactful. During the second half of the nineteenth century, electronegativity has been one of the most relevant chemical concepts to explain the relationships between chemical substances and their possible reactions. Specifically, EN is a property of the substances that allows them to attract external electrons in bonding situations. The problem arises because EN cannot be measured directly. Indeed, the only way to measure it is through different properties that do can be directly measured, for instance enthalpy, ionization energies or electron affinities. (...) What is particularly troubling about this case in quantum chemistry is that the different models used to describe and quantify EN are incompatible but, in a certain sense, equivalent because the same EN scale results in all of them. By analyzing Linus Pauling’s and Robert Mulliken’s models of EN, it will be argued that, if we remain cling to a traditional representative conception of models, we cannot understand the meaning of the information provided by those models. Indeed, if we do not want to adopt an instrumentalist point of view concerning chemical knowledge, we should reconsider by virtue of what a model represents the system, or, in other words, which the factors that determine the representative power of a model are. I will propose a new perspective that incorporates the role of experimental techniques in the very notion of representation; this perspective allows us to understand how supposedly incompatible models of the same target system can be both simultaneously representative. Research and practice about self-determination in the context of disability has centred on teaching skills and providing support to help people with impairments to be independent. However, limited research exists about the impact of Information and Communication Technologies, in particular social media and mobile devices, on the development of self-determination skills among people with disabilities. This paper presents the findings of a qualitative study which collected data from observations, a researcher diary, focus groups, individual interviews and data from social media. (...) The focus of the study was on young people with vision impairments who were transitioning to university life. The study found that the participants developed self-determination skills by using and adapting collaborative and interactive online tools and mobile devices according to their transition needs. This finding expands the understanding of the implications of new technologies for young people with disabilities’ personal development and the enhancement of self-determination. (shrink)

This paper addresses a variant of the job shop scheduling problem with total tardiness minimization where task durations and due dates are uncertain. This uncertainty is modelled with intervals. Different ranking methods for intervals are considered and embedded into a genetic algorithm. A new robustness measure is proposed to compare the different ranking methods and assess their capacity to predict ‘expected delays’ of jobs. Experimental results show that dealing with uncertainty during the optimization process yields more robust solutions. A sensitivity (...) analysis also shows that the robustness of the solutions given by the solving method increases when the uncertainty grows. (shrink)

While children’s interaction with digital technologies is a matter of interest around the world, evidence based on nationally representative data about how integrated these tools are in children’s everyday life is still limited in New Zealand. This research report presents findings from a study that explores children’s internet access, online skills, practices, and opportunities. This report is part of Netsafe’s research project Ngā taiohi matihiko o Aotearoa - New Zealand Kids Online, and our first publication as a member of Global (...) Kids Online. Generating insightful, reliable evidence about New Zealand children’s online experiences is vital to develop adequate support that reflects children’s experiences and needs. This, in turn, will help them to manage online risks and potential harm from behaviours such as cyberbullying, harassment, and other forms of abuse and intimidation. (shrink)

Research on transition to higher education and young people with disabilities has increased in recent years. However, there is still limited understanding of transition issues and how digital technologies, such as social media and mobile devices, are used by this group of students to manage these issues. This article presents the findings of an empirical study that addressed this matter based on young people’s views and experiences. The qualitative study was conducted in the context of a group of students with (...) vision impairments transitioning to a New Zealand university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The study shows that, like their non-disabled peers, the students actively engaged with interactive and collaborative digital technologies to make sense, individually and collectively, of different transition issues before, during and after the first academic trimester of their university journey. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. Over the last ten years the sharing of nude images or videos (sometimes known as “sexting”) by young people has emerged as a concern. Despite this, no research had been conducted on the prevalence of the sharing of nudes among young New Zealanders. This study addresses this and raises important questions for all those with a role in supporting young people’s healthy development. We believe this report makes an important contribution to the overall understanding of young people’s experience of these (...) behaviours. However, it only provides a snapshot, and more work is required to understand how best to support young people as they navigate the challenges and potential risks. En primer lugar, analizo ciertas ventajas epistémicas del criterio sustentado sobre los RS sólidos, evidenciando, consecuentemente, los límites del criterio estipulado por Contessa. En segundo lugar, muestro que los argumentos utilizados por Contessa para descartar el criterio instituido en los RS sólidos son deficientes, ya que, en el mejor de (...) los casos, no demuestran nada y, en el peor de los casos, o bien se comete una falacia por ambigüedad o bien se comete una petición de principio. El presente trabajo se ocupa de la teoría general de Carlos Nino sobre la legítima defensa y cómo ella se enmarca, de manera más general, en su concepción sobre el liberalismo en materia penal. Se muestran dos casos problemáticos para teorías así concebidas. Se propone una alternativa para salir de estos casos problemáticos apelando a consideraciones cercanas al ideal de no dominación. A pesar de que existe una vasta literatura sobre Naturalismo y Naturalismo ético no es fácil encontrar un libro que recopile lo que diferentes autores relevantes tiene para decir sobre tal tópico. El libro Ethical Naturalism. Current Debates (2012) ha venido a llenar tal (...) laguna. Este trabajo presenta el tema general del libro y analiza y critica algunas de las ideas allí desarrolladas. El propósito central es hacer algunas observaciones generales a la empresa del Naturalismo ético considerado globalmente y al mismo tiempo algunas observaciones que son relevantes sólo para algunas de las intervenciones que forman parte de la colección. This article introduces Transition 2.0, a paradigm shift designed to study and support students with disabilities' transition to higher education. Transition 2.0 is the result of a qualitative study about how a group of young people with vision impairments used digital technologies for their transition to university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The article discusses a conventional view of transition, referred to here as Transition 1.0, which has dominated (...) disability-related research and service provision in higher education. It counters this view by further developing the conceptual framework for Transition 2.0. The findings expand current conceptual approaches to transition by incorporating in the analysis the role played by digital tools such as social media and mobile devices. They also provide a new lens through which to study and understand student engagement in higher education. (shrink)

The incompatibility within the context of modeling cannot be established simpliciter. The fact that modeling is understood as an activity whose representational power can only be partially established, may minimize the supposed existence of incompatible models. Indeed, it is argued from perspectivism that incompatibility can be dissolved, meaning that it becomes trivial or simply false due to the inherently pragmatic and partial nature of the act of representation and modeling. From this perspective, incompatibility can only be a consequence of a (...) misunderstanding of the very nature of modeling and representation In this sense, in order to tackle this strategy at its root from perspectivism, we will first need to outline the maximal perspectivism thesis, attempting to identify the possible escape routes that perspectivism could find in order to explain incompatibility as an illusory incompatibility. Then, we will analyze Valence Bond Model and Molecular Model of covalent bonds, and we will conclude that the dissuasive strategies used to minimize and/or disregard incompatibility prove to be fruitless. El objetivo de nuestra investigación es determinar el impacto de hábitos alimenticios en el desempeño académico. Fue evaluada los hábitos alimenticios según instrumentos validados y establecido su normalidad con Shapiro-Wilk W=0.97 y significancia p-valor=0.34. Tenemos que el consumo alimenticio también tiene distribución normal e impacta en el desempeño académico con una correlación de Pearson de 0.24 y significancia p-valor=0.04. La regresión logística establece el punto de corte de consumo igual a 38 para tener la probabilidad de un 50% de buen (...) desempeño académico. Asimismo, la estimación puntual de desempeño académico correspondiente a este corte de consumo 38 es el puntaje de 14. (shrink)

Alan Turing is often portrayed as a materialist in secondary literature. In the present article, I suggest that Turing was instead an idealist, inspired by Cambridge scholars, Arthur Eddington, Ernest Hobson, James Jeans and John McTaggart. I outline Turing’s developing thoughts and his legacy in the USA to date. Specifically, I contrast Turing’s two notions of computability (both from 1936) and distinguish between Turing’s “machine intelligence” in the UK and the more well-known “artificial intelligence” in the USA. According to my (...) proposed historical interpretation, Turing did not view computations in the real world to be exhaustively and deterministically characterized by his automatic machines from 1936. In the popular imagination, the relevance of Turing's theoretical ideas to people producing actual machines was significant and appreciated by everybody involved in computing from the moment he published his 1936 paper ‘On Computable Numbers’. Careful historians are aware that this popular conception is deeply misleading. We know from previous work by Campbell-Kelly, Aspray, Akera, Olley, Priestley, Daylight, Mounier-Kuhn, Haigh, and others that several computing pioneers, including Aiken, Eckert, Mauchly, and Zuse, did not depend on Turing's 1936 universal-machine concept. Furthermore, (...) it is not clear whether any substance in von Neumann's celebrated 1945 ‘First Draft Report on the EDVAC’ is influenced in any identifiable way by Turing's work. This raises the questions: When does Turing enter the field? Why did the Association for Computing Machinery honor Turing by associating his name to ACM's most prestigious award, the Turing Award? I respond to Lennart Nordenfelt's analysis of dignity by questioning his attempt to establish an objective standard by which dignity can be determined. I approach this by considering the way in which claims to dignity may be contested and defended. This leads, in the cases of dignity of merit and dignity of moral status, to an apparent relativism. This relativism is checked by further consideration of dignity of identity, and in particular by consideration of the nature of the processes that (...) serve to humiliate people. It is suggested that acts of humiliation attack certain competences that human beings develop as embodied, social beings. Menschenwürde may then be articulated as an account of human nature, in terms of the human potential to develop a series of core competences. This account of human nature aspires to universality, and as such offers an objective ground to dignity. La biopolítica ha devenido, sin duda, una de las categorías centrales para la reflexión política contemporánea. Dada su importancia, resulta imperioso avanzar sobre algunas operaciones teóricas que no logran dar cuenta de su especificidad, en tanto que administración de la vida como forma de dominación. Al respecto, y con la intención de rehabilitar la conceptualización de la política, nos interesa demostrar cómo la aparente dicotomía entre zoé y bíos que pretende discutir Agamben no encuentra respaldo en los textos que él (...) mismo utiliza (fundamentalmente, Aristóteles y Foucault), ni tampoco en la cristalización de tales categorías en prácticas sociopolíticas (por ejemplo, la disciplina moderna con sus raíces en el monasterio cristiano). Precisamente, la identificación de la zoé ya como forma de vida es lo que nos permite comprender el interés biopolítico por gestionar la vida biológica. Así, solamente habiendo clarificado estas categorías, podrá rehabilitarse un pensamiento político sobre la política. (shrink)

Scientific pluralism has gained supporters in philosophy of science during the last decades, since it seems to accurately account for the plural and varied development of science. Arguments in defense of robust, non-merely epistemic pluralistic positions can be found in several contemporary philosophical works. According to these positions, to hold pluralism does not suppose to assume an epistemic position regarding truth and a non-realistic view on scientific theories. Monism can be thought as the “natural” opponent of scientific pluralism. In this (...) paper, we will evaluate the alleged rivalry between the two positions, paying special attention to those riskier, ontologically more robust, pluralistic proposals. We will argue that these strongest versions of pluralism fail to offer an alternative to monism: they either changes the topic or hold a weak skepticism that Hegel develops in the Phenomenology of the Spirit. Recent discussions about the microstructure of materials generally focus on the ontological aspects of the molecular structure. However, there are many types of substances that cannot be studied by means of the concept of molecule, for example, salts. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a "real" existence. In this context, the aim (...) of this paper will be to analyze the ontological status of phonons. For such purposes we will critically analyze the arguments that would account for the presumed nonexistence of phonons. Finally, having already demonstrated that there are not enough reasons to consider phonons as non-existing entities, we will explore some possibilities that allow us to elucidate their ontological status. Dicha utilidad se da en tanto que el experimento usado sea legítimo, esto es, que cumpla con ciertas exigencias teóricas. Sin embargo, la utilidad de tal método se ve afectada por la proliferación de experimentos mentales ilegítimos. Tomando como referencia un tipo específico de experimentos mentales ilegítimos, el texto se propone presentar una explicación al anterior fenómeno basada en la relación de (...) las nociones de conocimiento y necesidad lógica. Aunque fueron marginales a su pensamiento, la reunión de sus alusiones al respecto permite arrojar alguna luz sobre la reflexión de la Independencia y sobre los cambios que el Libertador experimentó en su percepción del naciente mundo que aparecía ante sus ojos. Se estudian algunas reacciones en América Latina y se describe el proceso por el cual Renan llegó posteriormente a ser aceptado por círculos conservadores. The French historian Ernest Renan published in 1863 a Life of Jesus that questioned his divinity. The book aroused scandal and attempts of rebuttal. Se adapta al título del libro de Andre Gunder Frank para proponer un esquema de conjunto de la historia americana desde una visión no eurocéntrica y desde la historia mundial. El acento no se coloca en la relación del continente con la Europa mediterránea o atlántica, ni en procesos endógenos, sino en los contactos que mantuvo con las otras civilizaciones del Viejo Mundo: África, la Europa oriental, Rusia, el Medio Oriente, India, China y el Pacífico. Se argumenta que antes de (...) la llegada europea hubo una etapa fuertemente influida por las relaciones con Asia. Éstas continuaron aún en época colonial, en términos comerciales, demográficos y artísticos, junto a una fuerte inmigración e influencia cultural africana. Si bien la independencia supuso una serie de ilusiones sobre el fomento de las relaciones con Asia, el siglo xix fue de creciente influencia europea (demográfica, militar, política, económica, cultural). El esquema propuesto puede servir para entender mejor los procesos por los cuales en nuestros días América, como el resto del mundo, está entrando nuevamente en la órbita asiática. (shrink)

Constructivist research in Science and Technology Studies is committed to revealing the heterogeneity of technological change and the fluid boundaries between the elements involved. Its major theories, the Social Construction of Technology and Actor Network Theory, have however both been criticized for limiting themselves to the micro-level of cases, impeding a structural analysis of technological systems. This article seeks to bridge any such divides. We research the recent changes in the viticulture of Mendoza, Argentina, which underwent radical changes over the (...) past decades: once governed by low-cost yield maximization, grape production now revolves around “quality.” To show how the particular quality definition developed, we depart from a social-constructivist framework, following the sociotechnical shaping of problem-solution relationships across the wine production system. To include relevant social groups from different settings around the world, we gradually incorporate the ANT concepts of obligatory passage points, enrollment, convergence, delegation, and codes into the analysis. Combined into the concept of “sociotechnical alliance,” our analysis follows the dual process of creating agreement while establishing heterogeneous practices across settings at different levels. It shows that functioning involves alliance building and highlights the hybridity and continuous dynamics of systems at large. (shrink)

Much recent discussion of love concerns ‘the reasons for love’: whether we love for reasons and, if so, what sorts of things those reasons are. This chapter seeks to call into question some of the assumptions that have shaped this debate, in particular the assumption that love might be ‘responsive’ to reasons in something like the way that actions, beliefs, intentions and ordinary emotions are. I begin by drawing out some tensions in the existing literature on reasons for love, suggesting (...) that these arise in part because different interests expressed in the language of ‘reasons’ – the interests of explanation, justification and interpersonal understanding – pull us towards different kinds of account of reasons for love. This seems to count in favor of treating these interests separately, with different conceptions of the reasons that answer to them. This suggestion, as I explain, runs up against a certain conception of ‘responsiveness to reasons’, which I argue is implicitly assumed in many discussions of reasons for love. However, I argue that we should be skeptical about the application of this conception to love in light of the ontological differences between love and paradigm ‘reasons-responsive’ phenomena, potentially making room for the suggested methodological separation. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a “real” existence. In this context, the aim (...) of this paper will be to analyze the ontological status of phonons. For such purposes we will critically analyze the arguments that would account for the presumed nonexistence of phonons. Finally, having already demonstrated that there are not enough reasons to consider phonons as non-existing entities, we will explore some possibilities that allow us to elucidate their ontological status. El objetivo de nuestra investigación es determinar el impacto de demanda de trabajo y recursos psicológicos en el desempeño profesional. Fue evaluada la calidad laboral según instrumentos validados y establecida su normalidad. Tenemos que los recursos psicológicos y demanda de trabajo impactan en el desempeño profesional con una correlación múltiple de Pearson de 0.91. La correlación de Pearson entre calidad laboral y desempeño profesional fue de 0.69 y p valor de 0.004. La correlación de Spearman entre recursos psicológicos y desempeño (...) profesional fue de 0.735 y p valor de 0.002. (shrink)
