Murphy asks: 'what would law be like if we organized it around the value of Christian love, and if we thought about and criticized law in terms of that value?'. This book brings together leading scholars from a variety of disciplines to address that question. In the 1930s Warburg's spare prose and disciplined respect for the facts set the style for a new generation of biochemists who had not known the conceptual revolutions of earlier years. Led by Warburg, they rejected the excesses of the colloid school and the false starts of the teens and twenties. Talk of active structure virtually disappeared as chemists began to identify enzymes, coenzymes, vitamins, and hormones. In the gradual transformation of the Atmungsferment from an ironcolloid complex to a specific (...) haem-protein, the roots of Warburg's inspiration were readily forgotten-the richer and more varied intellectual currents of the early decades of biochemistry. Experimental cytology and pharmacology were important strands. Most of what Warburg was doing on narcosis from 1908 to 1912 was typical of this school. He was deeply influenced by Loeb and his theory of the fertilization membrane. In the period from 1900 to 1914 the ups and down of belief in Hofmeister's enzyme theory was an important trend which helped determine the style of biochemistry in later decades. Warburg's conception of the Atmungsferment was shaped by the general reaction c. 1910 against Buchner's optimistic view. Warburg's Heidelberg lecture was framed as an answer to Hofmeister's lecture of 1901 and turned out almost as an imitation or second edition of it. It was a style that was soon out of fashion. The affinity between the early concept of enzymes and the old concept idea of “living protein” should not be neglected in discussions of Warburg's distaste for “enzymology.” The colloid school is too easily dismissed as a mere impediment to the chemical triumphs of the 1930s. Warburg's Atmungsferment was obviously colored by the colloidal cast of biochemical thought in 1912. The Atmungsferment represented, in short, a hybrid transition from the romantic biochemistry of the period 1900–1925 to the mature, classical of the 1930s. It is fascinating precisely because it reflects, and refracts through a unique and powerful mind, the varied local traditions of the early history of modern biochemistry. (shrink)

In his seminal work, McTaggart :457–484, 1908; The nature of existence, Cambridge University Press, Cambridge, 1927) dismissed the possibility of understanding the B-Relations as irreducibly temporal relations, and with it dismissing the B-Theory of time, which assumes the reality of irreducible B-relations. Instead, he thought they were mere constructions from irreducible A-determinations and timeless ordering relations. However, since, philosophers have almost universally dismissed his dismissal of irreducible B-relations. This paper argues that McTaggart was correct to dismiss the possibility of B-relations, (...) and that would be B-theorists should be C-theorists and its concomitant commitment to the unreality of time. I do this by first elaborating C-Theory, noting that B-relations appear indiscernible from C-relations on close examination. This establishes an onus on B-theorists to distinguish B-relations from C-relations by elaborating the distinctively temporal character of the former. I then present a problem for the possibility of accommodating temporal character in B-relations. Following this, I question from whence derives our sense of the temporal character that purportedly resides in the irreducible B-relations. Finally, I extend the challenge against irreducible B-relations to a series of irreducible abstract temporal relations—so called Ersatz-B-Relations—modelled on them. (shrink)

This article is devoted, firstly, to providing a sympathetic reconstruction of the All Subjected Principle, identifying the most credible account of what it is to be subject to the law. This essay outlines an explanatory virtue of presentism: its unique ability amongst temporal metaphysics to deliver a partial explanation of the conservational character of natural laws. That explanation relies on presentism, uniquely amongst temporal metaphysics, being able to support an endurantist account of persistence. In particular, after reconsidering a former argument for endurantism entailing presentism by Merricks, a new argument for this entailment, is expounded. Before delivering the explanation of the conservational character of natural laws, a brief account of that (...) explanandum is given, followed by an elaboration of the wider significance of an explanation for the conservational character for natural laws, particularly for the dispositional essentialist project of nomic reductionism, and explaining the non-simultaneity of causation. We have no general duty to help others do their duty. But arguably we do, for a combination of agency-based and outcome-based reasons, have a general duty to let others do their duty. Our duty is derived from the other’s duty, but it is none the worse for being so. It is best seen as a duty, rather than as the upshot of some right or power of the other that would preclude us from insisting that the others do their (...) duty. Finally, our duty to let others do their duty is owed primarily to those toward to whom the others’ duty is owed, rather than to those whom we should allow to do their duty. (shrink)

This paper considers a problem for dynamic presentism that has received little attention: its apparent inability to accommodate the duration of events. After outlining the problem, I defend presentism from it. This defence proceeds in two stages. First, I argue the objection rests on a faulty assumption: that duration is temporal extension. The paper challenges that assumption on several different ways of conceiving of temporal extension. This is the negative case and forms the bulk of the paper. Second, after diagnosing (...) the error leading to the identification of duration with temporal extension, I outline a new presentist-friendly account of duration that avoids the problem. In particular, a non-reductive account of duration is offered that treats it as a primitive quality which bestows its possessor with a certain modal quality: that the possessor potentially does not change whilst there are changes in its environs. This is the positive case. Together the positive and negative cases provide presentism with an interesting and novel way of overcoming the problem of duration. (shrink)

In trust relationships, one person has a ‘beneficial interest’ in another’s performance. The former not only would but should benefit from the latter’s action, and the latter has a ‘fiduciary duty’ toward the former to so act. But where that act would otherwise be wrong, the first person’s beneficial interest would be providing a pro tanto reason for the second person to do something that is pro tanto wrong. That reason can – and should – be removed by the former (...) renouncing their beneficial interest in the latter’s pro tanto wrongful action. Doing so would cancel the fiduciary’s excuse for wrongdoing on the beneficiary’s behalf. (shrink)

This paper elaborates the problem of temporal unity for dynamic presentism and diagnoses the source of that problem in the dynamic presentist’s discarding the traditional C-series in its avoidance of McTaggart’s A-series paradox. This C-series provided the fixed structure of time which the transitory aspects of time then followed, and thereby unify those transitory aspects. It then considers ersatzer presentism as an ostensible solution to the problem of temporal unity by providing a new abstract C-series for dynamic presentism. However, after (...) a closer examination of the details of this proposal, it is found that the ersatz-B-series itself needs to be temporally variable to capture the transitory aspects of time that it is meant to track. Consequently, it cannot provide the fixed structure of time required to unify the transitory aspects of time into a temporal series. It is therefore suggested that dynamic presentists look for a more course-grained determiner of temporal progression to construct the presentist-friendly C-series required to unify their transitory aspects of time. Elsewhere I have defended utilitarianism as a philosophy peculiarly well suited to the conduct of public affairs, on grounds of the peculiar tasks and instruments confronting public officials. Here I add another plank to that defence of ‘utilitarianism as a public philosophy’, focusing on the peculiar role responsibilities of people serving in public capacities. Such ‘public service utilitarianism’ is incumbent not only upon public officials but also upon individuals in their capacities as citizens and voters. A new version of the ontological argument for the existence of God is outlined and examined. After giving a brief account of some traditional ontological arguments for the existence of God, where their defects are identified, it is explained how this new argument is built upon their foundations and surmounts their defects. In particular, this version uses the resources of impossible worlds to plug the common escape route from standard modal versions of the ontological argument. After outlining the nature of (...) impossible worlds, and motivating the need for positing them, the new argument is delineated and its premises justified. It is taken for granted that the argument cannot be sound, since it would prove too much. However, its premises are all plausible, and their denial promises to have significant ramifications. Several intuitive lines of objections are then explored in order to illuminate their shortcomings. The puzzle that the argument poses is therefore not whether the argument is sound, for it clearly cannot be. Rather, it is to place pressure on its plausible premises, so some plausible account of how the argument fails can be identified, and that the devising of such an account promises to be insightful. In the process, we should gain an improved understanding of how such ontological arguments work. (shrink)

Some say that consent is essentially just a state of mind. Others say it is essentially just a communication. Many say it is both. I say it is neither. Instead it is an act, or rather a pair of acts—an internal mental act in the first instance, an external performative act in the second. Each of those acts is an act of commitment, intrapersonally in the first case and interpersonally in the second. The content of the commitment is, familiarly enough, (...) to give permission to someone else to do something that it would be wrong for them to do without your permission. The novelty lies in seeing consent as an act of commitment in those two dimensions and in seeing those as commitments that persist until and unless undone by an act of a similar sort. (shrink)

ABSTRACT This article aims to analyze some contours of the existential practice of attempting to “locate one's life” through self-reflection. I will focus primarily, but not exclusively, on two exemplifications of self-reflection that are not “philosophical” in any technical or academic sense: Cory Taylor's Dying: A Memoir and Yi-Fu Tuan's Who Am I? An Autobiography of Emotion, Mind, and Spirit. Taylor, a novelist, is writing hurriedly facing imminent death, while Tuan, a distinguished cultural geographer, writes facing not death but the (...) prospect of continuing to live without any real will to do so. Their reflections are carried out in two different rhetorical registers, with quite different motivational contexts and expectations. They throw clear light, with rich philosophical import, on the complex relations between memory and mood, such as regret and nostalgia, the languages of self-description, and the permanent tensions between hope and action in coming to terms with what or who one is, or has become, or with what, if anything, lies ahead. Maximizing want-satisfactionper seis a relatively unattractive aspiration, for it seems to assume that wants are somehow disembodied entities with independent moral claims all of their own. Actually, of course, they are possessed by particular people. What preference-utilitarians should be concerned with is how people's lives go—the fulfilment of their projects and the satisfaction of their desires. In an old-fashioned way of talking, it ishappy peoplerather thanhappiness per sethat utilitarians should be striving to produce.

Among moralists and social critics of several stripes, it is not enough that the right thing be done: they also insist that it be done, and be seen to be done, for the right reasons. They are anxious to know whether we are sending food to starving Africans out of genuinely altruistic concern, or merely to clear domestic commodity markets, for one particularly topical example. Or, for another example, critics of the Brandt Commission’s plea for increased foreign aid more generally (...) say, in stinging rebuke: ‘Many of those who support the proposal... do so out of genuine humanitarian concern about... poverty. But it is doubtful whether this is the main concern of its authors, and it certainly is not their only concern.... They are, instead, primarily concerned with the preservation of the existing world economic order.’What is common to all such cases is an attempt at motive differentiation. Any particular piece of behavior might have sprung from any of a number of different underlying motives; commentators want to know which was the real motive. Here I shall show that this characteristic quest for motive differentiation is misguided. In most of the standard social situations, it makes no material difference to agents’ actions whether they act from one sort of motive or another. And in such circumstances, pressing the motivational issue will usually lead only to mischief, of both a pragmatic and a moral sort. (shrink)

Sustainable practices are commended to us both out of prudential regard for our own future and out of principled concern for the ‘right to life’ of endangered species, ecosystems and ways of life and for intergenerational justice among our own kind. The larger point of the ‘sustainability ethic’ might be more political, however. Insisting that any practice we adopt now must be sustainable into the indefinite future constitutes an institutional check preventing us from taking unfair advantage of our privileged temporal (...) position vis‐a‐vis our successors. This paper argues for a pragmatic motivation for believing Presentism—the thesis that everything is present. After outlining a pragmatic source of justification for beliefs, in terms of their action-guiding aims, a pragmatic motivation for believing presentism is detailed and proffered. More specifically, the paper outlines two kinds of bases for our desires: a negative and a positive basis. The former concerns some dissatisfaction with a certain aspect of our present state, whilst the latter focuses instead on our potential future gratification (...) or contentment. An account of desire satisfaction needs to, in some sense, “answers” to either of these kinds of bases. However, it is argued that only presentism can support an adequate conception of desire satisfaction. And although non-presentists can support a form of desire prevention, this severely lessens the effectiveness of beliefs to fulfil their aims. Accordingly, presentism is best able to support beliefs in achieving their action-guiding aims. It is claimed that this provides some pragmatic justification for believing presentism. (shrink)

Aristotle wrote in History of Animals about a division of labor among workers within the hive that is based on age. He observed that the field bees foraging for nectar and pollen have less “hair” on their bodies than the hive bees that care for young larvae and tend the nest. He concluded that the more pubescent hive bees must be older. We now know that, in (...) fact, the field bees are older and have less hair because the hairs break off as the bees age. The phenomenon of age related changes in behavior, age-polyethism, is now well documented for many social insects (Oster and Wilson 1978).Evidence of the ecological success of social insects is inescapable. InnisIvo Assad Ibri Semiotics and Pragmatism: Theoretical Interfaces Springer, 2022, xxvii + 341 pp., incl. indexIn the chapter on 'The Heuristic Power of Agapism in Peirce's Philosophy' in his recent book, Semiotics and Pragmatism: Theoretical Interfaces, Ivo Ibri points out that access to Peirce's work requires something on the part of the reader that is "not readily available (...) in everyone's spirit: a sense of poetry, an aesthetic sensitivity that will, ultimately, become the sharpest and strongest tool to penetrate the deepest meaning of his philosophy" (116). Such a sensitivity is manifested in Ibri's own responsiveness to Peirce's accounts of the permeating qualities of things in a dynamic universe of emerging novel orders and patterns. Ibri's book presents the record, indeed the culmination, of a well-known and wide-ranging long-term engagement with the work of Peirce. It makes available in English translation the contents of the two-volume [End Page 257] collection of his papers in Portuguese published in 2020 and 2021, although a number of them were originally published in English. The title of the book indicates the dynamic triadic nature of Ibri's central Peircean themes: semiotics and pragmatism and their theoretical as well as historical 'interfaces.'Paradoxically, taken alone, the book's main title, 'Semiotics and Pragmatism,' gives no indication that it is principally about Peirce. The reason, I think, is that there is an interwoven duality of, or tension between, the tasks that Ibri has taken upon himself to accomplish in the intellectual journey manifested in the book's contents: (a) Thinking about Peirce, on the one hand, and (b) Thinking with and through Peirce, on the other. This duality of tasks accounts both for the expository and argumentative richness of Peircean themes and the accompanying sense of intellectual engagement and exploration as they are taken up in the various parts of the book: art as an articulated realm of 'nameless things,' the presence of a poetic ground and its links to Schelling in Peirce's philosophy, the nature of abduction and of agapism as heuristic principles, the scope of Peirce's theory of signs and interpretants, the theory of beliefs and the intellectual dangers and poverty of dogmatism, the nature of habits and rational conduct, the centrality of the categories for Peircean pragmatism and objective idealism, the relations between pragmatism, pragmaticism, and neopragmatism, and other technical and subsidiary topics of current social and political importance. The discussion of these themes involves wide-ranging and generous linkages to other parallel discussions that support or expand Ibri's own positions and existential commitments.Ibri frames in a variety of ways the inextricably intertwined strands of semiotics and pragmatism (or pragmaticism) in Peirce's work and argues forcefully in other chapters for Peirce's metaphysical vision of an emergent creative universe marked by the "infinite faces of chance" (122), a vision rooted in Schelling's objective idealism and in scientific discoveries of the 19th century. The organization of the book is thematic and does not develop in linear fashion as a treatise. It can be seen as sequence of engagements or as a series of analytical spirals in which the topics and issues of the book, focused on Peirce's heuristic fertility, are taken up in a kind of dialectical dance of 'retrievals and continuations,' leading inevitably, as Ibri points out, to a high number of repetitions and recapitulations. This is partially due to each chapter in the book, while free standing, functioning as a heuristic device for exploring and arguing for the nature and power of Peirce's interlocking main positions and their shared conceptual underpinnings.In a stimulating chapter on 'The Poetics of Nameless things,' Ibri writes that the Peircean claim of a "correspondence between external and internal worlds" is the "deepest root of pragmatism" (60).
