Sartre, na obra os _Cadernos para uma moral_ (1947-1948), apresenta apontamentos sobre a dimensão da história que começa a se desenvolver inicialmente no interior de sua reflexão moral. Sartre, entretanto, não tem uma versão finalizada de sua teoria da história, vinculando sua reflexão a uma comparação e crítica da filosofia da história hegeliana e do materialismo histórico marxiano. Objetivamos neste artigo analisar a crítica sartriana à Hegel nos Cadernos para uma moral sobre a história, mostrando um esboço das noções iniciais (...) de Sartre sobre a história. Sartre se utiliza amplamente de uma crítica à possibilidade de dialética hegeliana, questionando a dimensão desse movimento do real como verdadeiro. É analisada a idealização desse movimento na dialética do senhor e do escravo em obras como Fenomenologia do Espírito (1807) e se tematiza sobre a noção de totalidade da história. Sartre indicia a partir dessa crítica uma noção própria de história vinculada a uma totalidade destotalizada e um devir histórica centralizado na liberdade. (shrink)

Knowing who benefits financially from a securities trade is necessary for the detection, prosecution and deterrence of illegal securities trading. Foreign jurisdictions with banking or securities secrecy laws are frequently used as a platform for illegal activity to frustrate law enforcement. This paper considers the extent to which Canadian law gives effect to so-called foreign blocking legislation. We conclude that while Canadian law does not generally give effect to foreign blocking legislation, it imposes only limited requirements on market intermediaries to (...) collect beneficial ownership information. Requires signed TDF. ;It is the aim of this thesis to consider two accounts of 1st-person utterances that are often mistakenly conflated--viz. that involving the 'no-reference' view of 'I', and that of the non-assertoric thesis of avowals. The first account says that in a large range of 'psychological' uses, 'I' is not a referring expression; the second, that avowals of 1st-personal 'immediate' experience are primarily 'expressive' and not genuine assertions. ;The two (...) views are expressions of what I term 'Trojanism'. This viewpoint constitutes one side of a 'Homeric Opposition in the Metaphysics of Experience', and has been endorsed by Wittgenstein throughout his writings; it has received recent expression in Professor Anscombe's article 'The First Person'. I explore the ideas of these writers in some depth, and consider to what extent they stand up to criticism by such notable 'Greek' contenders as P. F. Strawson and Gareth Evans. ;I first give neutral accounts of the key-concepts on which subsequent arguments are based. These are the immunity to error through misidentification of certain 1st-person utterances, the guaranteed reference of 'I', avowal, and the Generality Constraint. I consider the close relation of Trojanism to solipsism and behaviourism, and then assess the effectiveness of two arguments for that viewpoint--Anscombe's Tank Argument and the argument from IEM. Though each is appealing, neither is decisive; to assess Trojanism properly we need to look at the non-assertoric thesis of avowals, which alone affords the prospect of a resolution of the really intractable problems of the self generated by Cartesianism. ;In the course of the latter assessment I consider the different varieties of avowal, broadening the discussion beyond the over-used example 'I am in pain'. I explore Wittgenstein's notion of 'expression', and discuss how this notion may help to explain the authority a subject possesses on his mental states as expressed in avowals. My conclusion is that an expressive account of avowals can provide a satisfactory counter to the Cartesian account of authority without our needing recourse to a non-assertoric or even to a non-cognitive thesis. ;Discussion of self-consciousness is implicit in discussion of the Homeric Opposition, but there is in addition a short chapter on the concept itself. Does history really matter? As a historian, and more importantly as a teacher of history, I have become convinced of the need to raise this question in my introductory classes. Too often this fundamental query is left for upper-division “theory” courses, or never broached at all. At a certain point historians, like most of us I imagine, stop asking why we do what we do and just get on with doing it. Suarez precursor de Descartes? A doutrina suazeriana sobre a causa final revista Resumo: Stephan Schmid busca mostrar que Francisco Suárez é um precursor da crítica que Descartes fez à causalidade final na explicação da natureza. Suárez teria reduzido a noção de causa à causa eficiente, teria eliminado a presença da causa final nas ações dos agentes naturais, isto é, daqueles entes que não possuem intelecto, e teria eliminado a presença da causa final nas ações divinas. Deste modo, ele seria um (...) precursor do pensamento mecanicista de Descartes e, sob certo aspecto, também de Espinosa. Contra esta interpretação, procuro mostrar que Suárez não reduz a noção de causa à causa eficiente, não elimina a presença da causa final nem nos agentes naturais, nem na ação divina e que, portanto, ele não pode ser considerado, neste assunto, um precursor de Descartes nem de Espinosa. In this way he would be a forerunner of the mechanistic thought of Descartes and, from a certain aspect, of Spinoza. Resumen: El presente texto trata de la teoría de Charles Larmore, más precisamente, de las relaciones entre las concepciones de desacuerdo razonable, de pluralismo y de liberalismo. Tal teoría tiene como características el intuicionismo racional, contextualismo y defiende una posición realista de la moralidad. O pensamento de Heidegger, através da analítica existencial e da proposta de destruição da metafísica, elabora um novo horizonte a partir do qual o conhecimento pode ser compreendido. Não mais da objetificação, dos dualismos sujeito e objeto, mente e mundo, mas a partir do lugar originário, do ser-aí em sua facticidade, do seu ser-no-mundo. O texto pretende mostrar e caracterizar esse horizonte originário e prévio, além de indicar algumas possibilidades que com ele se abrem. Daremos ênfase à questão do horizonte (...) compreensivo prévio, que acompanha cada conhecimento e cada conhecer, mas que tende a se manter oculto e esquecido em função da primazia do ente na Metafísica tradicional. Inicial e normalmente vivemos e pensamos a partir da disponibilidade e da presença dos entes, do que se chama de realidade. Há que retomar a historicidade e a temporalidade do ser humano como condições básicas que acompanham o fenômeno do conhecimento e, por isso, da noção de possibilidade e de abertura. Uma volta para as condições pré-teóricas e pré-lógicas do conhecimento, onde o fundamento é segundo o modo de ser do ser-aí, a facticidade, um abismo, o ser-no-mundo a partir donde se constituem as relações cognoscitivas e práticas. O conhecimento humano é finito, assim como o é o próprio ser humano e, por isso, não possui lugar fora do tempo onde possa ser ancorado e fixado. Há uma circularidade interpretativa e uma diferença ontológica já sempre em operação e que não podem ser superadas por teorias do conhecimento, mas devem ser autenticamente assumidas para que o conhecimento seja compreendido no seu ser. As questões religiosas permeiam o conjunto da obra rawlsiana. O problema é saber como pessoas com diferentes doutrinas compreensivas religiosas podem chegar a um consenso sobreposto. A solução para o problema de como a legitimidade política pode ser alcançada, apesar do conflito religioso, e de como, entre cidadãos de diferentes crenças, a justificação política pode prosseguir sem referência à convicção religiosa é relacionada com a ideia de razão pública.

Suárez e a fundamentação da metafísica Resumo: Contra a interpretação de François Courtine, Rolf Darge afirma que para Francisco Suárez a metafísica é uma ciência que trata do ente entendido não como aquilo que pode ser objeto para a mente humana, mas como aquilo que é apto a existir de fato. A metafísica seria uma ciência real, entre outras razões, porque ela é uma ciência a posteriori. Este artigo pretende verificar (...) melhor a afirmação de que a metafísica de Suárez é uma ciência a posteriori. O artigo acompanha a reflexão de alguns autores do século XX no que se refere à questão do conhecimento, sobretudo nas discussões em torno da dicotomia mente e mundo. Esses autores são McDowell, Putnam e Rorty. A ênfase é colocada na importância e na necessidade de que aquele que contemporaneamente investiga algum aspecto da realidade, se ocupe também em refletir sobre os pressupostos e fundamentos que operam na sua teoria e na sua prática. Os autores em questão indicam algumas dificuldades (...) e movimentos que acontecem no âmbito das teorias do conhecimento, de modo a ajudar o pesquisador atual a compreender as aporias que percorrem os substratos fundamentadores do seu pensar e fazer investigativo. La infracción al deber objetivo de cuidado (IDOC) es una figura introducida en Ecuador en el 2014 con el COIP, con 4 requisitos concurrentes. Para las actuaciones de los Anestesiólogos es necesario evaluar conjuntamente: la ley y reglamento de la especialidad, las normas mínimas de seguridad de la CLASA y los documentos sobre “cirugía segura” de la OMS. Investigamos en este artículo si existe relación entre estas últimas normas y los requisitos mencionados. El objetivo es encontrar la antes mencionada relación (...) y revisar su realidad procesal. Para ello realizamos análisis documental mediante lógica jurídica. Como resultado obtuvimos una correspondencia entre estas normas y los elementos de la IDOC, así como una ausencia de su consideración dentro de las sentencias evaluadas. Se concluye que, si bien son legalmente exigibles, estas normas no son siempre analizadas cuando se juzga una supuesta IDOC, por lo que es necesaria su incorporación al ámbito judicial. (shrink)
