Eleven years after Kosovo’s unilateral declaration of independence, Spain’s position vis-à-vis Kosovo has not only not varied, but it has become stronger, turning Madrid into the leader of the Kosovo non recognizers club within the EU. This paper analyses Kosovo-Spain relations in the last eleven years. More specifically, the paper examines the reasons behind the non-recognition of Kosovo and the approach of the Spanish governments toward Kosovo’s statehood. This is followed by a thorough analysis (...) on how Kosovo’s path for self-determination played a major role in Catalonia’s quest for independence in 2017. The empirical research demonstrates that Spain’s main reason not to recognise Kosovo is based on the country’s internal dynamics; namely, Catalonia and the Basque country. Likewise, the paper argues that the Spanish governments throughout the last eleven years have created an analogy between Kosovo and Catalonia; not in their political statements, but in their political decisions, by worsening the almost inexistent diplomatic relations with Kosovo, when the Catalan path for independence was at its highest peak. By the same token, the paper reveals that this position was enhanced and driven by Catalan separatism, that continuously used Kosovo’s unilateral declaration of independence as a model to further their own path for self-determination. The data provided and analysed in this paper as well as the statements made are based on desk research and seven semi-structured interviews conducted in Prishtina, Brussels, Madrid and Barcelona in 2018. Imagine coming across the following description of recent events in a certain place. In this account, the revolt of an oppressed people against its overlords is called a “civil war.” The armed insurgents are “terrorists” and “pawns of foreign governments.” The government of this country may have acted brutally, but it is fighting guerillas who do not accept its rule, so what do you expect? State Department propaganda, justifying US support for a repressive regime? No, this is the language and (...) tone of the US left’s stance towards the Kosovar Albanians’ revolt against their Serbian rulers. With few exceptions, the left has failed to recognize the scale of Serbian oppression in Kosovo and the legitimacy of the Albanians’ struggle for independence. Instead, by referring to the crisis as a “civil war,” it has implicitly accepted Serbia’s claim that Kosovo belongs to Serbia. By characterizing the KLA’s attacks on Serb policemen and other representatives of the Serbian government as provocations, the left has accepted the Serbs’ justification for their barbaric attacks on Albanian villages. The emotions surrounding the question of Kosovo’s future owe their intensity to the long history of human rights abuses in the province. The years 1945–1966 and 1987–1999, in particular, saw harsh repression of local Albanians and a systematic favoring of local Serbs. Since June 1999, the province has been under international supervision, and, in this period, Serbs complain that they have been the victims of repeated acts of violence at the hands of Albanians. The North Atlantic Treaty Organization bombing of China's embassy in Yugoslavia on May 7, 1999, triggered a sharp reaction from the Chinese government, and for three consecutive days after May 8 there were violent anti-American demonstrations, with the emergence of a powerful wave of anti-American nationalism among the populace in mainland China. The May Eighth Incident was the most important political incident in China in the 1990s. Not only will this incident have a major impact on relations between China and (...) the United States, and among China and its peripheral countries and regions, but the nationalism it has triggered will be a constant and major political factor with far-reaching effects on the political culture and political options in the era of "post-omnipotentism". The paper aims to analyse the state of inter-ethnic relations in Kosovo between ethnic Albanians and ethnic Serbs, with special focus on the period after unilateral declaration of independence of Kosovo in 2008. Inter-ethnic conflict in Kosovo has exclusively been over its territory since both Serbs and Albanians have made claims about history and ethno-demography to justify their alleged exclusive right to this ethnically mixed region. Consequently, inter-ethnic relations between Albanians and Serbs in Kosovo have been (...) rather problematic throughout the most of the 20th century. During this period Albanians in Kosovo have been subjected to discrimination, intimidation and even mass expulsion by Yugoslav/Serb authorities. In late 1990s, these relations between Albanians and Serbs in Kosovo have progressively worsened and finally escalated in an armed warfare in 1999. Immediately after the war, Serbs in Kosovo were occasionally exposed to acts of inter-ethnic and retaliatory violence. Inter-ethnic relations between the two major ethnicities continued to be tense and fragile after independence of Kosovo in 2008. Dramatic changes of ethnic composition structure, atrocities and huge number of refugees due to the war, have left a legacy of deep mistrust and animosities between Albanians and Serbs in the newly created state. Consequently, Serbs in Kosovo have from the beginning refused to recognize Kosovo’s independence and have rigorously refused any governance by Kosovo authorities. Serbian community, especially in the North, claims stronger territorial autonomy, even separatism and unification with Serbia. The paper claims that in Kosovo inter-ethnic and interstate relations are basically the components of the same equation. Therefore, paper concludes that only overall improvement of relations between Kosovo and Serbia could contribute to overall relaxation of inter-ethnic relations between Albanians and Serbs in Kosovo. That Kosovo exploded with genocidal violence in 1999 and ultimately prompted outside intervention surprised few—it was a long-festering hotspot but one that fell low on the world politics priority lists, despite the brutal “wars of Yugoslav” succession that engulfed Serbia, Bosnia, and Croatia. But for a relatively small scale conflict in a rather unknown corner of the world, Kosovo’s crisis of 1998–1999 brought with it a host of complex issues that challenge the international community to this day. As (...) with any issue or case in the area of genocide studies, attention and understanding must first go to the dramatic human suffering inflicted upon one group by another. The macro-level political, legal, and ethical discussion and debates swirling about Kosovo should not and must not obscure the powerful and provocative human element at play. First and foremost, the Kosovo issue revolves around how best to save lives following an explosion of genocidal violence. Simultaneously, however, Kosovo in 1999 exploded with ramifications for the future of state sovereignty, the United Nations, and understanding the causes of genocide, nation building, and humanitarianism in the twenty-first century. In Search of a New Institutional Structure for Chinese Civilization.

While declaring victory, Washington did not yet declare peace : the bombing continues until the victors determine that their interpretation of the Kosovo Accord has been imposed. From the outset, the bombing had been cast as a matter of cosmic significance, a test of a New Humanism, in which the "enlightened states" open a new era of human history guided by "a new internationalism where the brutal repression of whole ethnic groups will no longer be tolerated". Although there is much research on the contract cheating phenomenon, there is very little research on the legal solutions available to address such problems and almost zero research on the contract cheating phenomenon specifically in Kosovo in the Western Balkan region. This article presents the current situation with regard to contract cheating in Kosovo and compares it to western countries, with the aim of identifying the best international practices for combating contract cheating. We also present the results of (...) a study we conducted which suggest that the term “contract cheating” is not well defined in university legal documents, nor is there a consistent understanding of what constitutes contract cheating. Consequently, the perpetrators are not being punished. Results from our online survey also show that 5% to 20% of students use contract cheating services, and they are paying an estimated fee of between 100 and 200 euros and in some cases, more than 250 euros. On 17 February 2008, the province of Kosovo formally declared its independence from Serbia. The most important normative theories of secession*choice theories and just cause theories* appear to justify the creation of a second Albanian state on the Balkans. Kosovo’s independence reflects the will of the vast majority of its inhabitants and can be seen as a remedy for grave human rights violations in the era of Slobodan Milos?evic´. Two problems, however, need to be thoroughly discussed. Firstly, the (...) secession of Kosovo may establish a precedent for other separatist conflicts and contribute to the destabilization of south-east Europe and other world regions. Secondly, the new political authorities in Pristina may not be capable to protect the Serb minority against discrimination and repression. It is argued that both problems give no conclusive reasons to reject Kosovo’s claim for independence. The war in Kosovo is heartbreaking for everyone whose feelings are not limited by their convictions. Watching the daily television images of refugees and the NATO bombings, only dogmatists could be satisfied by their arguments for or against the war. Opponents and advocates of the invention alike should concede their mixed emotions, and there is no reason to deny similar scruples to the political leadership of the Western alliance. Was wissen Sie über Kosovo? Nicht genug. Nicht genug jedenfalls über objektive, wertfrei vorgegebene Fakten, mit deren Hilfe man verantwortungsethische Bewertungen des NATO-Angriffs begründen könnte. Trotzdem halte ich drei wertende Aussagen über den Kosovo-Konflikt für vernünftig. Sie lauten (in alphabetischer Reihenfolge): Der bewaffnete Kampf der Albaner im Kosovo war moralisch falsch. Die Militäreinsätze der Serben im Kosovo waren moralisch falsch (schon vor Beginn der NATO-Bombardements und erst recht danach). Und schliesslich: Die Luftschläge des Westens gegen Serbien (...) waren moralisch falsch. Insbesondere diese letzte Behauptung ist der Zielpunkt des Aufsatzes. Mein Plädoyer für diese Behauptung verläuft auf einem dritten Weg zwischen der gesinnungsethischen Position pazifistischer Rigoristen und der verantwortungsethischen Position ihrer Kontrahenten. Die grundlegende Richtlinie für meine Untersuchung besteht darin, keine Behauptungen als objektiv auszugeben, die in Wirklichkeit auf Wertungen beruhen. Schon beim Blick auf die Vorkriegs- und Kriegsgeschehnisse im Kosovo kommen wir nicht ohne die Hilfe von Werten aus; und ich plädiere dafür, diese Geschehnisse im Lichte einer verzweifelten Menschenliebe anzusehen: Daraus ergibt sich eine neue Form von Pazifismus. The author reflects on the implications of the Kosovo conflict for under-standing the post-Cold War changes in NATO's strategic concept. He develops a theoretical account of the move from war to police violence and the differences between the two concepts of violence.

This article presents the current legislative and educative measures in place for plagiarism prevention in Kosovo, especially in the case of student work, and provides an analysis of the effectiveness of such measures. Two public universities are used as case studies – the University of Haxhi Zeka and the University of Kadri Zeka – and the research is based on the legal and policy documents enacted by the two universities, as well as many reports, scientific articles on plagiarism and (...) HEI official websites. The issue of plagiarism has only recently become a priority in Kosovo, with many factors hindering advancement and development in this area. (shrink)

The main research question for this paper is: Are there radical left wing movements in Albania and Kosovo and what are their main traits? Through answering this question, we will explore the development of radical left wing movements. With radical left we intend movements that reject the underlying socio-economic structure of contemporary capitalism and its values and practices without opposing democracy. Through a thorough desk research and several interviews with experts and activists both in Albania and Kosovo, we (...) look at the two case Political Opportunity Structures to study the emergence, the strategies, success or failures of the radical left. In Albania the radical left has been in decline since 1992, with only a recent revival from 2009 on. In Kosovo, the Lëvizja Vetëvendojse!, a civil movement transformed in a party, has succeeded in imposing its left agenda. Both cases employ a new rhetoric unrelated to the past communist regimes thus changing the perspective of political debate in both countries. (shrink)

The experiences of many transitional justice mechanisms have led to a general consensus on the central importance of local legitimacy and local ownership; this indeed is repeatedly avowed by both the UN and the EU in their prescriptions on effective transitional justice mechanisms. Yet, I argue that the Kosovo Specialist Chambers was established in the absence of both. The court was not created in response to domestic pressure from within Kosovo; rather, it was the result of external pressure (...) which by definition compromised local ownership and legitimacy. Drawing on the findings from first-hand qualitative research, I demonstrate that the court’s local legitimacy has not improved since its establishment. This lack of legitimacy, I argue, has potentially negative implications as, without popular legitimacy, the court’s proceedings and judgements are unlikely to command sufficient public support to either catalyse the societal changes promised by the court’s external sponsors, or withstand opposition to the court from within the Kosovo Albanian population resulting from any perceived slight against the ‘heroic’ KLA. The Serbian Orthodox Church has been described in scholarship as having had a significant impact onto the social and political life of Serbia, especially since the wars of the nineties. With the coming of the age of the Internet and social science automation, however, more options have gradually become available to researchers in the recent years. For this reason, this article will tackle the official rhetoric of the Serbian Orthodox Church in relation to the sociopolitical with the assistance of social (...) science automation. Forming an examination via the methodological lens of Operational Code Analysis, this article delves into the Church’s discourse on Kosovo, via heavy vetting of all official statements given on the website of the Serbian Orthodox Church. It also expands upon the initial methodology – Operational Code Analysis – to an analysis of an institution with a uniform discourse, which has so far not seen light in scholarly production. Transformations in the biological, medical and legal processes of infertility, substantial modifications in family structure and the advancement of methods and techniques of reproductive technology will affect the next step in both legal and medical terms to address the regulation of bioethics and law in Kosovo. There is a need to establish perspectives in both ethical and professional terms, since the Republic of Kosovo is in the process of drafting a Civil Code. Many of these issues have been (...) raised and addressed during the review and evaluation of family law in the context of harmonisation and inclusion of this law in the Civil Code of the Republic of Kosovo. During the several meetings of official members with different interest groups regarding family law, the need has been raised to regulate family law to be included in the Civil Code for motherhood and fatherhood in the case of reproduction with biomedical assistance, as well as for the birth contract as a donation for another person (so-called surrogate motherhood). These bioethical and legal issues indicate the urgent need for legal harmonisation of a multidimensional platform specifically based on the principles of public health and universal human rights Conclusion. This text considers the results of the western powers’ recognition of Kososvo’s independence from three perspectives: firstly, the possible consequences (of which what is happening in Georgia already gives us some proof) of this independence proclaimed and recognised outside the provisions of international law, and which can be considered a precedent in other territories with similar problems; secondly, it proposes, following Hegel, a rational conception of the state, far removed from ideas of ethnicity based on race, language, and so on, (...) in which nationalism finds its inspiration. Finally, it analyses and criticises from the Hegelian perspective, as updated by the reasoning of authors such as Habermas, the foundations of nationalism, especially its mistaken defence of the pre-eminence of collective over individual rights. This New Humanism, timed fortuitously with a new millennium, will displace the crass and narrow interest politics of a mean spirited past. The main aim of this paper is to analyze the electronic banking services in Kosovo’s banking net profit during the period 2013 - 2017. The paper discusses the role that these services have played in the development of the banking industry, modernization of e-commerce, and economic growth. These services provide higher security, faster and easier access by reducing transaction costs, access to more distant markets, and access to many products and services. The main paper results have shown that E-banking (...) services have the highest positive impact in banking net profit, while automated teller machine services have shown a slight positive impact. The highest positive correlation results have been seen in point-of-sale services, whereas automated teller machine services showed a negative correlation in banking net profit in Kosovo during the research period. The constant increase of demand for these services has enabled banks to increase their profits in the banking market of Kosovo. Therefore, the paper finds that commercial banks in Kosovo should increase their focus on the advancement and development of electronic banking services (particularly, E-Banking services which are very practical and can be easily used anywhere and anytime). The Kosovo conflict -- The Israeli-Palestinian conflict -- The conflict in the Democratic Republic of Congo.

L’interprétation d’un acte de violence de masse est toujours délicate puisqu’elle confère un certain statut au groupe visé. Ce statut peut devenir un facteur important dans la décision de la communauté internationale de reconnaître ou non l’indépendance d’un groupe et de son territoire. Cet article examine le cas de la reconnaissance du Kosovo par la communauté internationale, en février 2008, et soutient que cette reconnaissance a été rendue possible par l’utilisation d’arguments basés sur le statut collectif de victime de (...) nettoyage ethnique détenu par la population albanaise du Kosovo. L’article comble le fossé entre, d’un côté, la théorie de la sécession comme réparation, et de l’autre, les travaux sur la violence de masse contre les groupes ethnonationaux. L’analyse montre que la pratique de la reconnaissance étatique a été réorientée vers un critère restrictif lié au type de violence subie par le groupe réclamant l’indépendance. Dans cette optique, le territoire devient une forme tangible de compensation pour les injustices subies, ce qui tranche par rapport à la pratique antérieure de la reconnaissance étatique dans l’ex-Yougoslavie et ailleurs.The interpretation of an act of mass violence is always a contentious issue since it confers a certain status to the targeted group. This status may become an important factor in the international community’s decision to recognize or not the independence of a group and its territory. This article examines the case of Kosovo’s February 2008 recognition by the international community and argues that this recognition was made possible by the summoning of arguments based on Kosovo Albanians’ collective status as victims of ethnic cleansing. The article bridges the gap between on the one hand the Remedial Right theory of secession, and on the other hand, works on mass violence against ethnonational groups. The article shows that the practice of state recognition was reoriented towards a restrictive criterion linked to the type of violence sustained by the group claiming independence. Under this interpretation, territory becomes a tangible form of compensation for suffered injustices, which contrasts with earlier practice of state recognition in the former Yugoslavia and elsewhere. Managing a company or organization in today’s market is a challenge that each leader has to face. Companies have to adapt and embrace challenges, or they will be left behind by the competitors in the market. The leadership of a company has to be creative in order to fulfill the needs of the customers, the market, and its employees. The same rules apply for language teaching organizations, which have to follow the rapid changes in the field of education, technology and (...) marketing all the same. Therefore, the purpose of this paper is to acquire knowledge of key aspects of instructional leadership in private and public schools, to find the parameters that make an organization successful, and to compare key management decisions taken by organizations over the years. In focus of this paper is a case study with two primary schools in Kosovo, one public and one private, how they operate, how are they managed and the possible ways of further development. Interviews with the leaders of the schools have been conducted, and the findings have been compared and supported with contemporary literature review. The paper starts provides an introduction, the literature review, the framework used, an interpretation and critical discussion of the data collected, and it ends with the conclusion on instructional leadership. This paper aims to assess selected municipalities’ performance of citizen-centric investment planning, governance and transparency, financial management, and support for youth programming in Kosovo. In completing this assessment, the Municipal Performance Management System of the Ministry of Local Government Administration in Kosovo was utilized. Selected municipalities are based on the Municipal Performance Report of 2019. Eight from Albanian majority municipalities in the top ranking, and two municipalities with higher scores from minority municipalities. The paper aims to highlight three (...) critical local government issues in ten selected municipalities: 1) The way of governing municipalities assessed according to the applicable legislation and 2) The provision of services in terms of quantity and quality, when possible and 3) Youth-oriented capacity building for municipal staff for better youth services. The paper will produce findings on capacity building needs and support needed on youth and citizen-centric investment and capacity building needs. A non-exhaustive list of needed capacities is produced, while the findings from the evaluation will be used to develop a capacity-building manual for municipal staff on youth-oriented municipal services. This book represents a unique endeavor to elucidate the story of Kosovo's unilateral quest for statehood. It is an inquiry into the international legal aspects and processes that shaped and surrounded the creation of the state of Kosovo. Being created outside the post-colonial context, Kosovo offers a unique yet controversial example of state emergence both in the theory and practice of creation of states. Accordingly, the book investigates the legal pathways, strategies, developments and policy positions of international (...) agencies/actors and regional players (in particular the EU) that helped Kosovo to establish its independence and gradually acquire statehood. Although contested, Kosovo, and its quest for statehood, represents a unique example of successful unilateral secession. The book therefore explores and analyses patterns of state formation and nation-building in Kosovo, and its transition to democracy. It presents a three-level assessment. First, seen from a historical perspective, the book examines the validity of the right of Kosovar-Albanians to self-determination and remedial secession. Second, from a legal positivist perspective, it scrutinizes all of the legalist arguments that support Kosovo's right to statehood, and claims that both traditional and legality-based criteria for statehood remain insufficient to determine whether Kosovo has achieved statehood. Third, from a post-factum perspective, the book analyzes the scope and extent to which the internationally blended element was decisive in Kosovo's state-formation and state-building processes. It explains how the EU's involvement as an 'internationally blended element' in Kosovo's efforts to achieve statehood was instrumental and played a crucial role in shaping the emerging state. In particular, the book elaborates on how the EU was able to streamline its mode of intervention in the context of state-building and reform. (shrink)

Domestic violence is one of the most serious forms of violation of basic human freedoms and rights regardless of ethnicity, gender, religion, and status. A reflection on many international statistics shows that women are the most frequent victims of domestic violence. Based on the definition of the phenomenon of domestic violence, the forms of abuse, the manner how violence is treated, the possibility of children, men, extramarital spouses, brothers, sisters, and old people living in an extended domestic community, of also (...) being victims is not excluded. Since domestic violence is not only a national problem but a worldwide problem, international organizations have worked towards the eradication of this phenomenon by sanctioning it in various international conventions. Also, the legal systems of many countries prohibit and sanction domestic violence by special laws obliging the state authorities to act in all situations when there are indications that there are direct or indirect violent acts in a family. In this paper, the authors present only the domestic violence against children as an evident problem in families, but which is often unreported. The legal frameworks of the Republic of North Macedonia and Republic of Kosovo are presented in this paper with the aim to describe the material-legal and procedural-legal treatment of domestic violence by pointing out the failure of the state authorities in implementing the laws on protection and prevention of this phenomenon. The authors take the approach of only treating the legal consequences of child abuse by parents that in both legislations is deprivation of parental rights for the violent parent. They conclude that the state authorities should intensify their work in taking control measures towards all the families where there are suspicions that the parental rights are neglected, and the child is abused. Because many cases of abuse have not been detected or reported, and in both countries a special study especially on domestic violence against children does not exist, the possibility that the number for this type of child abuse is great. The objective of this paper is to provide a comparative analysis of local community protection mechanisms in Kosovo and North Macedonia. The intention is to comparatively analyze the community protection mechanism’s differences and similarities and their establishment in both countries. Requirements on community protection mechanisms as tools for ensuring community rights will be elaborated with two institutional settings and succinct legal infrastructure. The establishment of the community-led mechanisms debate has been increasingly conductive to Kosovo and North Macedonia since (...) the inter-ethnic conflicts that these two states were involved in. For that particular reason, Kosovo and North Macedonia have initiated the design of community protection mechanisms to foster inter-community communication, tension easing, and serving as a means and tool for communities’ inclusiveness in local and central institutional affairs. In doing this analysis, two primary legal documents in Kosovo and North Macedonia, the proposed plan settlement of the former United Nations special envoy Martii Ahtisaari in Kosovo and the Ohrid Framework Agreement in North Macedonia, will lead to conclusive comparative findings. Further, the comparative analysis will extend to elaborating Kosovo’s and North Macedonia’s legislative framework, such as their constitutions, community protection laws, and local governance legislation. The importance of the paper also extends to comparing the community protection mechanisms between two countries in finding potential differences and parities between the community protection mechanisms in Kosovo and North Macedonia. Finally, the analysis will provide a theoretical understanding of the local community protection mechanisms framework, focusing on establishing community protection mechanisms, legal requirements, and successes these mechanisms have brought to both countries’ institutional settings. In reconstructing and commenting upon the Kosovo conflict, the cognitive interest of practical philosophy does not evade a political judgment but is primarily led by the interest in answering the question of what normative yardsticks are available (to politicians and to the public) for coping with a situation where the international order of law fails to provide a legal solution to the problem of preserving peace and, at the same time, protecting human rights that are severely violated by a (...) sovereign state. The paper proposes an answer from the point of view of an ethics of history-related responsibility, which takes into account three normative levels based on ethical, legal and political considerations. Justice is not only about punishing the perpetrators but also protecting the rights of their victims. Corruption is not a victimless crime! Therefore, the main intention of this paper is to enlighten that protecting the rights of the victims of corruption is one of the crucial battles in the war against corruption. Wining this battle during the pandemic Covid-19 is grinding but of vital importance at the same time! Corruption has already been a remaining concern in the Republic of (...) class='Hi'>Kosovo. Notwithstanding, the situation with the pandemic Covid-19 has made the justice system, and not only, more fragile. Consequently, we are currently living in a perfect environment for corruption acts where the victims of corruption are not acknowledged and sometimes even “garbled” with the victims of Covid-19! It is important more than ever to ensure effective remedies for persons who have suffered from corruption acts including the possibility of compensation for their damage. Indeed, the Republic of Kosovo is not a state party of the Civil Law Convention on Corruption. Yet this convention shall be the guide for establishing such legal avenues while the good practices of the United Kingdom and the French Republic shall be the aim and motivation for this. (shrink)
