Los indios eran hombres capaces de razón y doctrina, casi–humanos o bestias con apariencia humana Esta cuestión se presta a muchas y muy variadas consideraciones. Parece que cuanto más se quiere aclarar esta cuestión mayor es la maraña que se trenza. Hay especialistas que niegan de plano que existiera tal controversia y otros, sin embargo, que defienden que esta polémica constituyó el primer gran debate filosófico y teológico del Nuevo Mundo relacionado con sus pobladores. Traemos a dos autores que protagonizaron (...) hace unos años una intensa y cordial divergencia sobre este punto: Por una parte Lewis Hänke que hace girar la cuestión sobre la naturaleza o esencia de los indígenas: ¿son seres humanos o bestias irracionales? Y en el otro extremo Lino Gómez Canedo que deja a salvo la humanidad de los naturales como algo que no se había negado nunca y centra el debate en si éstos tenían derecho a su libertad individual, al dominio de sus cosas y tierras, si podían ser compelidos a trabajar para los españoles, etc. Tampoco podemos olvidar que una buena porción de esta confusión -aparte de los prejuicios y de la finalidad apologética o detractora que existe en algunos escritores- la compone la falta de claridad y confusión existente entre el significado y distinción de los términos ‘incapacidad’, ‘irracionalidad’, ‘bestialidad’ o ‘animalidad’. El artículo expone la evolución de las expectativas acerca del futuro y destino final del hombre tanto a nivel individual como colectivo. Hasta el siglo XVIII predominaban las preocupaciones referidas al destino personal de cada hombre y el significado de la muerte. Tras las revoluciones que acabaron con el antiguo régimen, empezó a dominar el interés por el futuro de la humanidad en su conjunto. Desde mediados del siglo XX hay una preocupación creciente ante el peligro de que la especie (...) humana desaparezca y sea suplantada por otro tipo de entidades, tal vez desarrolladas por el propio hombre. El transhumanismo se ha presentado como una respuesta, basada en la ciencia, a las ansias de supervivencia y mejora del hombre. No obstante, sus propuestas adolecen de varias debilidades, algunas de ellas posiblemente irreparables. (shrink)

Robert Openheimer fue un científico muy destacado, que intervino en el desarrollo de la mecánica cuántica y los inicios de la física nuclear. Se le nombró director científico del programa norteamericano para la creación de la bomba atómica, que gestionó con éxito. Intervino en el desarrollo posterior de la carrera armamentística, hasta que se le retiró la autorización para conocer los secretos atómicos de los Estados Unidos. Personalidad compleja, las implicaciones éticas del trabajo que realizó le suscitaron problemas de conciencia (...) durante la última parte de su vida. El artículo analiza esta problemática. Este artículo explora las consideraciones éticas que rodean el uso de la Inteligencia Artificial (IA) en la academia. Se establecen principios éticos generales para la IA en este ámbito, como la transparencia, la equidad, la responsabilidad, la privacidad y la integridad académica. En cuanto a la educación asistida por IA, se enfatiza la importancia de la accesibilidad, la no discriminación y la evaluación crítica de los resultados. Se recomienda que la IA se use para complementar y no para reemplazar la (...) enseñanza tradicional. En cuanto al ámbito de la investigación, se hace énfasis en la necesidad de garantizar la calidad y la veracidad de los datos utilizados, así como la transparencia en los métodos y resultados. Se deben considerar los posibles sesgos y riesgos de la IA en la investigación. El artículo concluye que la adopción responsable de la IA en la academia requiere una reflexión crítica sobre sus implicaciones éticas. Se recomienda la creación de marcos éticos específicos para cada contexto y la participación de diversos actores en la toma de decisiones. (shrink)

In the post-1945 world, constitutionalism has transcended the nation state, with an array of transnational arrangements now manifesting constitutional characteristics—so says a growing number of scholars. This article reveals an earlier but largely forgotten discourse of transnational constitutionalism: the constitutional theory of the British Empire in the late 19th and early 20th centuries. Focusing on the work of Albert Venn Dicey, the article shows that, when the Empire was at the height of its power and prestige, British constitutional scholars came (...) to see the Empire as a constitutional order and project. For Dicey, a committed constitutionalist and imperialist, the central dynamic of the imperial constitutional order was balancing British constitutional principles with imperial unity. This article focuses in particular on parliamentary sovereignty, a constitutional principle that, for Dicey, was both necessary for and dangerous to the Empire’s integrity. An exercise in intellectual history, the article rethinks Dicey’s work and the constitutional tradition in which Dicey has played such an integral part, seeking to reveal empire's forgotten significance. Além de buscar contribuir para robustecer tal linha de interpretaoção do famoso principío bohriano, neste paper tentaremos compreender dialecticamente a relaoção de Louis de Broglie e a de desigualdade de Werner Heisenberg. Industrial (“white”) biotechnology promises to contribute to a more sustainable future. Compared to current production processes, cases have been identified where industrial biotechnology can decrease the amount of energy and raw materials used to make products and also reduce the amount of emissions and waste produced during production. However, switching from products based on chemical production processes and fossil fuels towards “biobased” products is at present not necessarily economically viable. This is especially true for bulk products, for example ethanol production (...) from biomass. Therefore, scientists are also turning to genetic modification as a means to develop organisms that can produce at lower costs. These include not only micro-organisms, but also organisms used in agriculture for food and feed.The use of genetic modification for “deliberate release” purposes, in particular, has met great opposition in Europe. Many industrial biotechnology applications may, due to their scale, entail deliberate releases of GM organisms. Thus, the biobased economy brings back a familiar question; is it ethically justifiable, and acceptable to citizens, to expose the environment and society to the risks associated with GM, in order to protect that same environment and to sustain our affluent way of life? For a successful innovation towards a biobased economy, its proponents, especially producers, need to take into account (take responsibility for) such issues when developing new products and processes. These issues, and how scientists can interact with citizens about them in a timely way, are further explored in projects at Delft University and Leiden University, also in collaboration with Utrecht University. Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. El presente artículo describe un proyecto de innovación educativa de aprendizaje de competencias, realizado en el Curso Propio de Liderazgo de la Universidad San Pablo CEU, transversal a toda su oferta educativa. Se trata de nuevo proyecto basa- do en una docencia híbrida, donde las masterclass más teóricas se han complemen- tado con un aprendizaje basado en retos vinculados a materias de comunicación y sostenibilidad, aplicando la metodología Design Sprint. An undiscovered chapter in the history of architecture comes from the ex-Soviet Republic of Georgia. Poetics of Architecture is the name given to the studioworkshop at the Georgian Technical University set up by the Georgian architect Shota Bostanashvili (1948–2013). From 1990 until his death he delivered insightful, playful and rather provocative lectures on architecture at this university. He preferred to call his architectural philosophy, critical discourse on architecture. Themes ranged from poetics to metapoetics of architecture. His philosophy of architecture is (...) illustrated by some of his designs and executed projects which demonstrate a drift from existentialism to the philosophy of play. This study includes reference to his last building, a project whose demolition Bostanashvili witnessed before passing away. Based on the concept of the return of the sacred, this edifice was a sort of counter movement to technogenic architecture. (shrink)

Constitutional law in the United States is, for most practical purposes, the product of ‘judicial review’, the power of judges to disallow policy choices made by other officials or institutions of government, ostensibly because those choices are prohibited by the Constitution. This extraordinary and unprecedented power, America's dubious contribution to the science of government, has made American judges the most powerful in the world, not only legislators but super-legislators, legislators with virtually the last word. Because lawmaking power divorced from popular (...) will is tyranny, most states have attempted to reconcile the lawmaking power of judges with representative self-government by subjecting all or some judges to some form of popular election. In all but four such states, judges, encouraged and supported by their fellow lawyers in the organized bar—would-be judges and beneficiaries of judicial power—have responded by adopting codes of judicial ethics that limit what candidates for election to judicial office are permitted to say. The effect is to undermine elections as a control on judicial power by limiting criticism of judicial activism, the misuse of judicial power. (shrink)

This paper provides a discussion of Jacques Rancière’s former teacher at École Normale Supérieure, then famous for fashioning Marxism with the philosophical gauge of structuralism, Louis Althusser. Perhaps a brief discussion on the relation between the two would render context to the origins of Rancière's philosophico-political praxis, specifically the humble beginnings of conceptualizing an egalitarian method out of his philosophical rupture with Althusserianism. Meanwhile, to reduce the philosophical enterprise of Althusser into its practical shortcomings and silence during the revolutionary events (...) of May 1968 in France would do an injustice to the magnitude of his contribution to contemporary French political theory and his major revisions in the theoretical direction of the Parti communiste français. Thus, the following discussions focus on sketching Althusser's theoretical foundations, which possibly clarifies the political decision he has made during May '68: a demand for organization over spontaneous revolutionary activity based on the authority of theoretical practice over the ideological activities—a decision that became the point of departure for Rancière's subversion of both mastery and the structural inequality Althusserianism entail. The whole piece is guided by the following two-fold question—a question, perhaps, akin to Badiou's inquiry: What were the philosophico-political interventions of Louis Althusser, and why did Rancière move away from his direction? International law lacks many of the standard features of domestic law. There are few legislative or judicial bodies with exclusive authority over particular jurisdictions or subject matters, the subjects regulated by international law typically must affirmatively consent to be bound by it, and supranational authorities with the power to coerce states to comply with international obligations are rare. How can a legal system with these features generate changes in state behavior? For many theories, the ability of international law to inform (...) and change individual preferences provides the answer. When voters care that treaty commitments be kept, or that international norms be honored, the theory goes, leaders are more likely to be able to make choices consistent with international obligations. Over the last decade, a literature has emerged testing these theories using surveys and experiments embedded in surveys. Multiple U.S. studies find that international law and international norm arguments shift public opinion in the direction of greater compliance by 4 to 20 percentage points. However, studies in foreign contexts are more mixed, with some backlash reported in countries in which international law is highly politicized. This Article describes the state of current knowledge about whether international law actually does change preferences, explains the limitations with existing research, and proposes avenues for future study. Karl Popper held an opposition to determinism, based mainly in his political and ethical convictions. Nevertheless, most of his reflections upon it belong to epistemology. This paper studies Popper's refutation of determinism and his three main arguments of a priori nature against it. Some attention is paid also to the Popperian interpretation of quantic mechanical indeterminism.

Este artículo presenta el enfoque docente de la asignatura ‘Estructura Global de los Medios’, perteneciente al plan de estudios del Grado en Comunicación Audiovisual de la Universidad de Castilla-La Mancha. A partir de la descripción y el análisis de la experiencia docente implementada durante el curso 2021-2022, basada en la simulación y la participación de los estudiantes en el desarrollo curricular, se destacan las innovaciones docentes aplicadas y los resultados de aprendizaje identificados. Estos resultados, fundamentados en el fomento del trabajo (...) en equipo y la competencia analítico-crítica del alumnado, indican que la metodología docente propuesta favorece la adquisición de competencias y dinamiza el proceso de aprendizaje a pesar de la dificultad intrínseca de la asignatura. This paper examines from a historical perspective Tarski's 1936 essay, "On the concept of logical consequence." I focus on two main aims. The primary aim is to show how Tarski's definition of logical consequence satisfies two desiderata he himself sets forth for it: (1) it must declare logically correct certain formalizations of the -rule and (2) it must allow for variation of the individual domain in the test for logical consequence. My arguments provide a refutation of some interpreters of Tarski, (...) and notably John Etchemendy, who have claimed that his definition does not satisfy those desiderata. A secondary aim of the paper is to offer some basic elements for an understanding of Tarski's definition in the historical logico-philosophical context in which it was proposed. Such historical understanding provides useful insights on Tarski's informal ideas on logical consequence and their internal cohesion. (shrink)

Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)
