Pedro Alvares Cabral's ships left Portugal on 9 March 1500 en route for the territory that he first named Terra de Vera Cruz and that later came to be known as Brazil. On the 22 March they called at the island of São Nicolau [Caminha, 1500], one of the northernmost islands of the Cape Verde group; this was about forty years after the discovery of the archipelago in 1460-62 [Albuquerque, 1991]. It is known that Vasco da Gama had stopped (...) at the island of Santiago in 1498 on his voyage to India, and also in 1499 on the return journey. Straight after the discovery of Brazil Cabral sailed for India and on the way back also dropped anchor at Santiago. Indeed, our archipelago, which is situated off Cape Verde in Senegal (the place from which it appears to take its name), was to become an important stopover point for maritime traffic between Europe, Asia and the Americas in the fifteenth and sixteenth centuries, both to allow crews to rest and to take on water, wood and some food supplies. It also became important as a holding point for slaves (a large number of whom came from around thirty Guinean ethnic groups and subgroups). They were dispatched from Santiago, known then as Cape Verde island, to territories such as Brazil from the early sixteenth century onwards, since these territories, which had only recently been discovered and were little known, needed people to work and populate them. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. There are important cases where properties not referred to by expressions from the languages of physics are enabled in certain times and circumstances to get causal control over some kinds of physical events. I will argue that in those cases we would have to transfer to those properties the causal sufficiency to bring about these events. This would offer a principle of causal inheritance in sharp contrast with the inheritance principle for the causal sufficiency of second order properties defended by (...) Jaegwon Kim in his recent discussion of the causal exclusion problem concerning mental properties. The two principles would be very different. Their domains of application would be distinct. Kim's principle would transfer causal sufficiency to the more "concrete" physical properties able to realize mental properties understood as second order properties. Our principle would transfer causal sufficiency to the more "general" properties able to cause the relevant physical effects in the times and circumstances in question. That way, it would be possible to give a quite simple answer to the problem of causal exclusion posed by Kim in relation to mental properties. Our approach also would have very important consequences in relation to ordinary macrophysical causation. (shrink)

In this work we provide a new topological representation for implication algebras in such a way that its one-point compactification is the topological space given in [1]. Some applications are given thereof.

Our democracies presently face a set of unique challenges. In this article we argue that the current crisis needs to be understood as resulting from the convergence of two historical transformations: the paradigm of boundlessness; and what we term “endividualismo”, a novel mutation of individualism in the context of the financial age. The result is a novel political reality where individual rights are ever-expanding and the opportunities for collective action have shrunk to the point of impossibility. The resulting powerlessness of (...) the polity demands new answers: we need to reconfigure the relationship between citizens and political power. (shrink)

En este trabajo se trata de contestar a la cuestión de cómo evaluar los argumentos judiciales de carácter justificativo. Se precisa para ello el sentido de la tesis de la única respuesta correcta; se identifican diversos criterios de corrección y se presta una atención particular a los criterios de universalidad, coherencia, adecuación de las consecuencias, moralidad social y crítica, y razonabilidad. This article deals with the question of how to evaluate justificatory judicial reasoning. To this end, the author clarifies the (...) meaning of the one-right-answer thesis, identifies a variety of criteria of correctness, and gives special attention to the ideas of universality, coherence, (good) consequences, social and critical morality, and reasonability. The Bayesian brain hypothesis, predictive processing, and variational free energy minimisation are typically used to describe perceptual processes based on accurate generative models of the world. However, generative models need not be veridical representations of the environment. We suggest that they can be used to describe sensorimotor relationships relevant for behaviour rather than precise accounts of the world.

This article examines Nietzsche’s analysis of the phenomenology of agent causation. Sense of agent causation, our sense of self-efficacy, is tenacious because it originates, according to Nietzsche’s hypothesis, in the embodied and situated experience of effort in overcoming resistances. It arises at the level of the organism and is sustained by higher-order cognitive functions. Based on this hypothesis, Nietzsche regards the sense of self as emerging from a homeostatic system of drives and affects that unify such as to maintain self-efficacy (...) levels. He relies on the same hypothesis to explain the emergence of an ascetic moral system and its specific, interpretive-affective ‘mechanism of willing’. The article aligns Nietzsche’s account of agent causation with Albert Bandura’s self-efficacy studies and Antonio Damasio’s recent account of self-systems as homeostatic systems. (shrink)

En la conquista, colonización y evangelización de las Indias se dio una estrecha colaboración y alianza Iglesia-Estado, amalgama que reforzaba a ambas instituciones, aunque siempre bajo el control estatal, supervisada y coordinada por el Consejo de Indias. Las relaciones Iglesia-Estado en América pasaron por diversas modalidades: Patronato, Vicariato y Regalismo. En el siglo XVI rige el Patronato, basado en las concesiones Pontificias que ponía en manos de la Corona española el ‘cuidado’ sobre la Iglesia americana. Desde fines del XVI, religiosos (...) y juristas españoles elaboraron la teoría del Vicariato, según la cual los reyes, en virtud de la donación papal, eran Vicarios de la Santa Sede en las Indias y adquirían competencias en materia de disciplina eclesiástica. En el siglo XVIII el Regalismo asume ambas posiciones y las convierte en jurisdicción civil al considerar que los derechos esenciales del Patronato y el Vicariato no se basan en concesiones papales sino que son prerrogativas inherentes a la Corona, regalías o atributos del poder real. While Nietzsche's rejection of metaphysical free will and moral desert has been widely recognised, the sense in which Nietzsche continues to use the term freedom affirmatively remains largely unnoticed. The aim of this article is to show that freedom and agency are among Nietzsche’s central concerns, that his much-discussed interest in power in fact originates in a first-person account of freedom, and that his understanding of the phenomenology of freedom informs his theory of agency. He develops a non-reductive drive-psychological motivational (...) theory: reflective judgement and reasons can motivate by means of affective orientations agents have due to their drives. In particular, due to a standing desire or 'instinct for freedom' agents can generate, in mental simulations, the necessary motivational affects to unify their drives in view of certain long-term goals. Attention to the details of putatively obvious examples of philosophy-as-worldview within Latin America give us reasons to be skeptical about the taxonomy that gives us the category of philosophy-as-worldview. Among the examples that suggest difficulties for this way of thinking about the philosophical enterprise are 19th century Mexican ethnolinguistics, contemporary efforts to reconstruct historical and contemporary Indigenous thought, and 20th century efforts to articulate regional ontologies within Latin America. However, reflection on these cases also point to a different project worth (...) considering, namely, a taxonomy of wisdom- and knowledge-focused practices that might allow a different way of drawing distinctions between kinds of “philosophies”. Las visitas eclesiásticas eran un medio para contactar y conocer la realidad diocesana, sus problemas y sus éxitos. Sin embargo, a veces chocaban con delicados problemas provocados por los grandes periodos de sedes vacantes, durante los cuales los miembros del cabildo, los dueños del gobierno y la administración de la diócesis podían hacer y deshacer a su antojo. Priority arguments provide the most powerful theorem-proving technique in the field, but most of the applications of this technique are ad hoc, masking the unifying principles used in the proofs. Over the arc of his career, E. O. Wilson first embraced, then popularized, and finally rejected an extreme genetical hereditarian view of human nature. The controversy that ensued during the period of popularization (largely in the 1970s and 1980s) obscured the fact that empirical and theoretical research during this time undercut the assumptions necessary for this view. By the end of his career, Wilson accepted the fact that individual/kin selection models were insufficient to explain human behavior and society, and he (...) began conducting research based upon multilevel (group) selection, an idea he had previously scorned. Los indios eran hombres capaces de razón y doctrina, casi–humanos o bestias con apariencia humana Esta cuestión se presta a muchas y muy variadas consideraciones. Parece que cuanto más se quiere aclarar esta cuestión mayor es la maraña que se trenza. Hay especialistas que niegan de plano que existiera tal controversia y otros, sin embargo, que defienden que esta polémica constituyó el primer gran debate filosófico y teológico del Nuevo Mundo relacionado con sus pobladores. Traemos a dos autores que protagonizaron (...) hace unos años una intensa y cordial divergencia sobre este punto: Por una parte Lewis Hänke que hace girar la cuestión sobre la naturaleza o esencia de los indígenas: ¿son seres humanos o bestias irracionales? Y en el otro extremo Lino Gómez Canedo que deja a salvo la humanidad de los naturales como algo que no se había negado nunca y centra el debate en si éstos tenían derecho a su libertad individual, al dominio de sus cosas y tierras, si podían ser compelidos a trabajar para los españoles, etc. Tampoco podemos olvidar que una buena porción de esta confusión -aparte de los prejuicios y de la finalidad apologética o detractora que existe en algunos escritores- la compone la falta de claridad y confusión existente entre el significado y distinción de los términos ‘incapacidad’, ‘irracionalidad’, ‘bestialidad’ o ‘animalidad’. La expresión “arte cristiano” encierra en sí una contrariedad si se considera que Jesús de Nazaret no apuntó nada sobre la creación artística. Tampoco podemos rastrear en el anuncio de la Buena Noticia ningún hilo que nos conduzca hacia un culto que necesitara la contribución de las “artes plásticas”. Cristo predijo un culto al Padre “en espíritu y en verdad” (Jn 4,23). Los primeros cristianos fueron fieles a este espiritualismo trascendente judaico, pero al mismo tiempo, la fe en la Encarnación (...) del Verbo dio al testimonio de los sentidos un valor fundamental: “el que me ha visto a mí, ha visto al Padre” (Jn 14,9). Nace un conflicto entre la sensibilidad artística y la nueva fe que gira en torno a la necesidad de legitimar el valor estético sin que el espíritu sea traicionado. Plasmar en la figuración una auténtica y sincera confesión de fe. (shrink)

Acercándonos a los Santos Padres y dejándonos llevar por ellos queremos en estas páginas reflexionar sobre el ministerio eclesiástico, atendiendo de manera sencilla al pensamiento y a las palabras de los Padres en tanto que recogen el pensar y sobre todo el sentir de las comunidades cristianas de su tiempo. En estas primeras iglesias el ministerio se comprende desde el servicio como entrega confiada y generosa al Padre, y entienden que en Cristo y sólo en Él este servicio alcanza su (...) plenitud. The task of confronting Hegel with the conflicts of our present proves to be indispensable to keep alive the critical scope of dialectics. In a context marked by a new wave of movements that challenge the racist structures that inform our societies, the question of the contribution of Hegelianism to an anti-racist thought takes a significant relevance.The hypothesis of this article argues that it is possible to distinguish two different operations that shape an anti-racist critique with the resources of Hegelian (...) dialectical thought. The first one is constituted by the exegetical practice aiming to identify, within Hegel’s own discourse, a speculative core that allows the definitive overcoming of all ethno-racial particularisms through the postulation of a normative universal horizon. Such interpretative perspective, shared by numerous scholars, seeks the absorption of Hegel’s racist and Eurocentric assertions in the larger and global scope of his system. Once the limitation of this option is shown, we will examine an alternative operation, namely, the rewritings of the dialectical thought in certain philosophical reflections arising from the concreteness of anti-racist movements. To that extent, we will revisit the proposals of W.E.B Du Bois and Frantz Fanon as peripheral enunciations of the dialectic that enable a new understanding on the subjectivation processes and liberation horizons of racialized communities.
