Unlike topics such as criminal responsibility, dangerousness has only recently begun to interest philosophically minded penologists. The most likely explanation is that until the middle of this century the periods for which people who had done serious harm to others were incarcerated in the UK so long that when they were released their age or condition or circumstances made them unlikely to repeat their crimes. It was only when pressure of resources—in plain terms overcrowded prisons and mental hospitals—forced the shortening (...) of these periods that it became politically necessary to worry about the possible dangerousness of really substantial numbers of prisoners and patients who became eligible for release. The problem was not entirely new. A few lifers, for example, had been set free each year, under licences which lasted for the rest of their lives; and the Special Hospitals which housed the violent insane had discharged carefully selected inmates, also under supervision. But by the late 1960s the introduction of parole, the Mental Health Act and the abolition of capital punishment had greatly increased the number of cases in which the problem of dangerousness had to be faced, and difficult decisions had to be taken. Sovereignty in premodern times evoked the dynastic figure of the 'sovereign' or territorial monarch. In modern times, it became a more abstract idea, referring to the power of the state, later of the people or 'the popular sovereign' as articulated and refined through constitutional arrangements. Today these inherited understandings of sovereignty confront various new challenges, including those of globalization, privatization of power, and the rise of sub-state nationalism. An examination of key historical writers and trends from the seventeenth century onwards, (...) including Hobbes, Bodin, Constant, Rousseau and Schmitt, brings out these developments and challenges. Sovereignty remains a malleable and 'active' feature of the global configuration of power. When I first came across Robert Nozick′s Philosophical Explanations I was struck by the purity of his justification of punishment. Most latter-day retributivists are crypto-utilitarians, claiming to find some sort of benefit in penalties, even if it is only symbolic. Nozick too sees punishment as symbolic, but not as having any necessary utility. Paradoxically, perhaps, he is one of the few retributivists who insists that it matters what the offender makes of his penalty. Even more interesting is the importance he (...) attaches to the analogy between retribution and revenge. Most retributivists are at pains to distance themselves from vengeance: but not Nozick. The volumes will provide critical perspectives on philosophers of great significance to the Anglo-American philosophical community, perspectives that have been largely ignored except by a handful of writers on German philosophy. The dissemination of this work will be of enormous value to Anglophone students and scholars of the history of German philosophy. By the start of the 1860s, architecture and the materials, processes, and cultures of emerging modernity were combining in Paris, above all other cities, with unprecedented consequences. Georges-Éugene Haussmann, Emperor Napoléon III’s Prefect of the Seine, had in 1853 been tasked with modernizing the city. His principle strategy was to demolish entire quarters of ramshackle medieval fabric for the creation of pristine, arrow-straight boulevards and sparkling squares, all of which were lined by luxurious standardized buildings, serviced by underground sewers, and (...) brilliantly lit by gas lamps.1 As the city heaved in every quarter, a group of Parisian authors stepped forward to respond to the literal. This article begins by assessing the ways in which the life and work of Neil MacCormick exemplified a dual commitment to the local and particular—especially through his advocacy of nationalism—and to the international and the universal. It then concentrates on one of the key tensions in his work which reflected that duality, namely the tension between his longstanding endorsement of constitutional pluralism—and so of the separate integrity of different “local” constitutional orders—and his belief in some kind of unity, and so (...) community, residing in the moral and rational properties of all law. The article continues by considering a number of ways in which this tension may be resolved. It concludes, with particular reference to MacCormick's late work on ethics, that the answer may be found through the idea of a general unity of practical reason which undergirds the various special orders of practical reason by which particular legal systems are distinguished. Ideas regarding the means of access to these transcendent abodes have been less consistent: Should Daoist adepts strive to be virtuous, or should they labor to “restore” themselves through esoteric, elite magic? A provocative answer to this question was given by the poet Tao Qian, who sided with Daoism's most (...) ancient authority by suggesting that Daoist harmony could not be achieved through mere individual study but, rather, could be found only in an uncorrupted social fabric, in his case defined as a humble lost village. This utopian vision, brought to life in the poem Peach Blossom Spring, not only rejected the esoteric values of the Daoist elite but also called into question imperial hegemonic structures in general. The fact that the poem's rustic utopian enclave was understood in these terms by generations of Chinese scholars and artists is revealed by the contrasting architectural forms used to represent these alternative concepts of the Daoist ideal: the palace and the village, the garden of leisure and the working farm. This volume explores some of the more important of Hans-Georg Gadamer's extensive writings on art and literature. The principal text included is 'The Relevance of the Beautiful', Gadamer's most sustained treatment of philosophical aesthetics. The eleven other essays focus particularly on the challenge issued by modern painting and literature to our customary ideas of art, and in turn revitalize our understanding of it. Gadamer demonstrates the continuing importance of such concepts as imitation, truth, symbol, and play for our appreciation of (...) contemporary art, and thereby establishes its continuity with the Western tradition. The essays here are not technical and are readily accessible to the beginning student and the general reader. The collection as a whole serves to illustrate the practice of hermeneutics and to introduce Gadamer's thought.
