This manuscript presents a demonstration study of Quiet Time, a classroom-based Transcendental Meditation intervention. The aim of the study is to assess the feasibility of implementing and evaluating QT in two pilot settings in the United Kingdom and Ireland. This study contributes to the field by targeting middle childhood, testing efficiency in two settings operating under different educational systems, and including a large array of measures. First, teacher and pupil engagement with QT was assessed. Second, the feasibility of using a (...) quasi-experimental design and a wide range of instruments to measure changes in pupil outcomes before and after the intervention was assessed. This allows us to obtain information about which instruments might be feasible to administer and most sensitive to change. The first setting included 89 students from a primary school in the United Kingdom: those in sixth grade received the QT intervention, while those in fifth grade practiced meditation using the Headspace application. The second setting included 100 fifth- and sixth-grade students from two schools in Ireland: one received the QT intervention, the other served as a control. Recruitment and retention rates were high in both settings, and the intervention was feasible and accepted by students, parents and teachers. Implementation fidelity was lower in the United Kingdom setting where delivery started later in the school year and the practice was affected by preparation for the Standard Assessment Tests. These results show that QT may be feasibly delivered in school settings, and suggest the use of a compact battery of tests to measure impact. We find suggestive evidence that the intervention affected executive function as children who practiced QT showed improved working memory in both settings. In the Irish setting, pupils in the QT group had improved ability to control responses. These results have implications for future studies by a) demonstrating that implementation fidelity is highly context dependent and b) providing suggestive evidence of the malleability of children’s skills in middle childhood. COVID-19 created a transformational shift in the working environment for much of the labour force, yet its impact on workers is unclear. This study uses longitudinal data to examine the wellbeing of 621 full-time workers assessed before and during the first lockdown in the United Kingdom. We employ fixed effects analyses to investigate the impact of the restrictions and mandatory homeworking on cognitive, emotional, and psychological wellbeing. Within the sample, the rate of full-time homeworking increased from 2 to 74% between (...) waves. We identify significant changes in 9 of the 15 measures assessed, with a general pattern of improvements in wellbeing during lockdown. Overall levels of stress, self-rated mental health, positive emotions and life and job satisfaction are not adversely affected by the restrictions. There is a reduction in the burnout symptoms of disengagement and exhaustion and in the frequency with which negative emotions are experienced at work. Workers feel more autonomous, closer to their co-workers, and more attached to their organisations. However, homelife satisfaction declines. These findings highlight the possibility that the COVID-19 pandemic and large-scale transition to homeworking was associated with unchanged or improved worker wellbeing. This study has important implications for governments and employers regarding a global shift to homeworking. (shrink)

ABSTRACTOn 28 October 2012, Savita Halappanavar, an Indian woman living in Ireland, died in hospital while under medical care for a miscarrying pregnancy. According to her husband, her repeated requests for an abortion were ignored because of the presence of a foetal heartbeat. Ms Halappanavar’s death was a critical event in the process leading to a referendum on 25 May 2018, when the Irish electorate voted to repeal the Eighth Amendment of the Constitution, removing the constitutional ban on abortion. The (...) name Savita has become indelibly linked to the changing course of abortion politics, so it is timely to reassess the role of the media in shaping the parameters of the debate about the impact of her death on the issue. This study presents a frame analysis of Irish newspapers in the weeks following her death, mapping the political, medical, legal and socio-ethical discourses, as well as the related contemporaneous events that set the agenda for the type of debate that was to follow. It identifies four media frames: Public Tragedy, Political Opportunity, Abortion Legacy and Maternal Health. Our central argument is that the overall effect of media framing provided much face-saving for politicians in the way that the legislative issue was viewed through a conservative party-political lens, despite public outrage. The power exercised by technology companies is attracting the attention of policymakers, regulatory bodies and the general public. This power can be categorized in several ways, ranging from the “soft power” of technology companies to influence public policy agendas to the “market power” they may wield to exclude equally efficient competitors from the marketplace. This Article is concerned with the “data power” exercised by technology companies occupying strategic positions in the digital ecosystem. This data power is a multifaceted power that (...) may overlap with economic (market) power but primarily entails the power to profile and the power to influence opinion formation. While the current legal framework for data protection and privacy in the EU imposes constraints on personal data processing by technology companies, it ostensibly does so without regard to whether or not they have “data power.” This Article probes this assumption. It argues that although this legal framework does not explicitly impose additional legal responsibilities on entities with “data power,” it provides a clear normative indication to do so. The volume and variety of data and the reach of data-processing operations seem to be relevant when assessing both the extent of obligations on technology companies and the impact of data processing on individual rights. The Article suggests that this finding provides the normative foundation for the imposition of a “special responsibility” on such firms, analogous to the “special responsibility” imposed by competition law on dominant companies with market power. What such a “special responsibility” might entail in practice will be briefly outlined and relevant questions for future research will be identified. (shrink)

How can absence make presence become? The question turns a usual notion of form inside out; it subverts normative habits in drawing distinctions. If we adapt the models of time by which we might consider such things (and not-things), the relational terms of form can shift. Two lines of inquiry are pursued in this article. The first is an investigation of form and its relation to time. The second is an exploration of paradox in describing forms of art. Both are (...) cybernetic in their framework and approach. The ‘Hastig’ (‘Hastily’) movement of Robert Schumann’s 1839 piano work Humoreske is the form that serves as site for the two inquiries to intertwine. Its construction presents a paradox through which form and time may be called into question. In considering Schumann’s composition as a re-conceiving of form and time, an idea emerges; art can make us aware of the constraints and possibilities of our models and our experiences of paradox in living with them. Of continuing interest to Doyle has been the thought of Francisco Suárez, S.J. On this topic Doyle has published over a dozen articles and four English translations of portions of Suárez's key works. Background: Moral distress is an important and well-studied phenomenon among nurses and other healthcare providers, yet the conceptualization of parental moral distress remains unclear. Objective: The objective of this dimensional analysis was to describe the nature of family moral distress in serious pediatric illness. Design and methods: A dimensional analysis of articles retrieved from a librarian-assisted systematic review of Scopus, CINAHL, and PsychInfo was conducted, focusing on how children, parents, other family members, and healthcare providers describe parental moral distress, both (...) explicitly through writings on parental moral experience and implicitly through writings on parental involvement in distressing aspects of the child’s serious illness. Ethical considerations: To promote child and family best interest and minimize harm, a nuanced understanding of the moral, existential, emotional, and spiritual impact of serious pediatric illness is needed. The cases used in this dimensional analysis come from the first author’s IRB approved study at the Children’s Hospital of Philadelphia and subsequent published studies; or have been adapted from the literature and the authors’ clinical experiences. Findings: Three dimensions emerged from the literature surrounding parent moral distress: an intrapersonal dimension, an interpersonal dimension, and a spiritual/existential dimension. The overarching theme is that parents experience relational solace and distress because of the impact of their child’s illness on relationships with themselves, their children, family, healthcare providers, their surrounding communities, and society. Discussion: Elucidating this concept can help nurses and other professionals understand, mitigate, or eliminate antecedents to parental moral distress. We discuss how this model can facilitate future empirical and conceptual bioethics research, as well as inform the manner in which healthcare providers engage, collaborate with, and care for families during serious pediatric illness. Conclusion: Parent moral distress is an important and complex phenomenon that requires further theoretical and empirical investigation. Decisions about whether or not to become a parent are significant parts of normative human development. Many studies have shown that married different-sex couples are expected to become parents, and that many social pressures enforce this norm. For same-sex couples, however, much less is known about social norms surrounding parenthood within marriage. This study examined injunctive norms and descriptive norms for the pursuit of parenthood as a function of age, gender, and sexual orientation. Participants in an internet survey included 1020 (...) cisgender people from across the United States Findings showed that norms, especially descriptive norms, for the pursuit of parenthood for heterosexual people were much stronger than those for lesbian women and gay men, and that norms for lesbian women were stronger than those for gay men. These differences were more pronounced for older, heterosexual, and male participants. However, lesbian and gay participants, especially gay men, reported that lesbian and gay people ought to become parents to the same extent as heterosexual people. Overall, the results indicated that, regardless of sexual orientation, adults report that lesbian and gay married people ought to become parents, but that they expect only a minority of these couples will pursue parenthood. All non-nuclear-weapon states are morally and legally obliged by the Nuclear Nonproliferation Treaty (NPT) to refrain from acquiring nuclear weapons. These obligations cannot be overridden for reasons of mere prudence. Only (i) material breaches of the treaty and/or a corresponding; (ii) ‘fundamental change in circumstances’ (rebus sic stantibus) that undermines the integrity of the NPT may override states parties’ legal nonproliferation duties. More than the violations of the NPT by ‘rogue’ states like North Korea or Iran, I argue that the (...) failure of the de jure nuclear-weapon powers since 2001 to uphold their informal and some formal NPT commitments suggests the possibility of material breach and/or institutional subversion. If NPT subversion were to occur, the non-nuclear-weapon states’ collective responsibility to avoid complicity in that subversion leads them to choose between (a) individually seeking nuclear weapons capability for state security; or, more preferably, (b) a publicly announced and collective withdrawal from the NPT that simultaneously refuses to pursue the nuclear weapons option. In a widely cited and controversial speech, UN Secretary-General Kofi Annan highlighted the moral character of the boundaries of political sovereignty when he questioned whether respecting national sovereignty everywhere and always precluded the international protection of human rights. He argued that it did not and highlighted the importance of multilateral authorization. In this article, I explore the difference that multilateral authority, as opposed to unilateral national decision, should make in justifying armed intervention. Should the more salient role of the United (...) Nations lead us to a more expansive tolerance of international intervention? And, if multilateralism does make a difference—and many think its impartiality is key—are good intentions enough? Had the international community also discovered how to intervene more effectively, with a better prospect of self-sustaining self-determination, at an acceptable humanitarian cost? I will conclude that multilateralism should widen our acceptance of intervention, even though the intentions at play are not reliably superior to unilateral intentions. (shrink)

T he Question of punishment and its justification has been a major preoccupation in recent philosophy of law. The reasons for this growing concern are not difficult to discover. Both philosophers and jurists have become increasingly sceptical of traditional theories of legal punishment. Each of these inherited theories was designed to establish criteria for the recognition and appraisal of punishment as a legal institution. However, alternative theories emphasised different and often conflicting criteria. Some theories emphasised moral desert and retribution, while (...) others appealed to the social utilities of punishment. Failure to reconcile these diverse philosophical viewpoints, through sustained debate over two centuries, has been a major source of intellectual dissatisfaction. (shrink)

Howard S. Cohen and Michael Feldberg, Power and Restraint: The Moral Dimension of Police Work, New York Praeger, 1991; xvii + 166 pp.

Recent estimates indicate that over 40,000 children die annually in the United States and a majority have life-limiting conditions. Children at end of life require extensive healthcare resources, including multiple hospital readmissions and emergency room visits. Yet, many children still suffer from symptoms at end of life—including fatigue, pain, dyspnea, and anxiety—with less than 10% of these children utilizing hospice care services. A critical barrier to pediatric hospice use was the original federal regulations associated with the hospice care that required (...) a diagnosis of 6 months to live and the discontinuation of all curative treatments. The Concurrent Care Provision of the United States’ Affordable Care Act eliminated the need to forgo curative therapies in order to enroll in hospice for children in Medicaid or Children’s Health Insurance Program. Concurrent care for children can help mitigate the tension families experience in choosing between essential forms of care, as well as contribute to improved end-of-life outcomes for the child and possibly bereavement outcomes for the family. Understanding concurrent care for children from a social justice perspective has important advocacy and research implications for hospice and palliative care clinicians providing care for children and their families. We apply Powers and Faden’s theory of social justice “as the moral foundation of public health and health policy” to the provision of concurrent care to children near end of life and families in the United States. The goals of applying this theory are to explore additional insights and perspectives into concurrent care policy may provide and to assess the usefulness of this theory when applied to end-of-life health policy. We argue that concurrent care policy is socially just since it has potential to promote well-being in vulnerable children and families and can limit the inequity children at end-of-life experience in access to high-quality hospice care. Furthermore, the Humean want-belief model of motivation---the view that beliefs alone are incapable of motivating---seems to provide a good explanation for the impossibility (...) of egoist-conversion. I argue that the moral rationalist is not in fact committed to the possibility of egoist-conversion, and that an explanation of its impossibility can be given which is compatible with rationalism; so this impossibility counts neither against rationalism nor for the want-belief model. The applicability of Nagel's concept of theory reduction, and related concepts of reduction, to the reduction of genetics to molecular biology is examined using the lactose operon in Escherichia coli as an example. Geneticists have produced the complete nucleotide sequence of two of the genes which compose this operon. If any example of reduction in genetics should fit Nagel's analysis, the lactose operon should. Nevertheless, Nagel's formal conditions of theory reduction are inapplicable in this case. Drawing on an analysis of complaint files that we conducted for the Irish Medical Council, this paper offers three possible explanations for the gap between the ubiquity of official commitments to taking patients’ complaints seriously and medical professional regulators’ dismissal—as not warranting an inquiry—of the vast majority of complaints submitted by members of the public. One explanation points to the “regulatory illiteracy” of many complainants, where the remit and threshold of seriousness of regulators is poorly understood by the general public. (...) Another points to possible processes of “institutional epistemic injustice” that unjustly undermine the credibility of certain complainants, such as those with low levels of formal education. A third explanation highlights the marginalization of the general public from “symbolic power” to define what matters in medical professional regulation. In this article, I use a nineteenth-century anatomical collection of wax moulages, currently off-staged in the storage facilities in the university where I work, to think about the matter of human remains. Rather than seeing the gross pathology moulages as inert teaching resources, I propose they are agential assemblages, entangled in which are human remains, and that they can be included amongst the dead. I consider their capacity to perform pastpresence work, a particular kind of work of the dead that (...) foregrounds erasures, such as the erasure of the many confined women suffering from syphilis whose bodies were used to cast moulages. This article considers how such pastpresence work might help us be response-able for uncared-for remains, such as the remains of “disappeared” women and infants who died in so-called Mother and Baby Homes, which have reappeared at the center of contemporary Irish public life. At a time when moulages are being reexhibited in museums internationally, I speculate about whether and how the collection might be restaged to perform subversive and utopian pastpresence work, destabilizing the erasures of conventional narratives of medicine and contributing to the crafting of a new and more careful order of things. This paper describes the establishment of a research ethics committee in a business school within a university in Ireland. Many of the procedural issues encountered by the Kemmy Business School REC with respect to its modus operandi are outlined. The difficulties faced by business school RECs arising from the need to simultaneously accommodate both academic and corporate stakeholders are discussed in the context of the ethicality of research carried out in the business domain. The experiences of the authors, both of (...) whom have served as respective chairpersons of the Kemmy Business School REC since its inception, inform the discussion. Given the dearth in the literature on research ethics in a business school context, the objective of this paper is to outline the experiences of one business school REC with respect to how it operates in order to assist other committees through the establishment phase and beyond. If I choose two words in the book that I think have been most influential, I would choose "mutually exclusive." Sacks was scarcely the first critic to observe that the kinds of fiction are usually actions, apologues, or satires. But no other theoretician has insisted so cogently as he did that, as principles governing the interaction of parts in a coherent work, these principles are mutually exclusive, "mutually incompatible." The reason Sacks became a great journal editor was that the firmness (...) of his own principles never blinded him to the value of other and very different theoretical questions which might be addressed to a work of fiction. And his tone of voice was never brazen but always that of the eighteenth-century gentleman: Come, let us reason together. Yet he never blinked his adherence to the truths he saw: he stated them directly, and he taught us to strive equally to face the consequences of holistic recognition of forms: "One cannot create an action which is also a satire any more than he can write an active sentence which is also a passive sentence in English. To carry the analogy a step farther, the observation that the types are mutually incompatible is no more an attempt to dictate to writers what they may or may not do than is the observation that active sentences are not passive sentences" . Mary Doyle Springer, associate professor of English at Saint Mary's College of California, is the author of Forms of the Modern Novella and A Rhetoric of Literary Character: Some Women of Henry James.
