It has been recently argued that by Leifer and Pusey, and Price, that time-symmetric quantum mechanics must entail retrocausality. Adlam responds that such theories might also entail ‘spooky action at a distance’. This paper proposes a third alternative: time-symmetric quantum mechanics might entail temporal global correlations. Unlike the traditional analysis of time symmetries in quantum mechanics, which consider linear and unitary interpretations, this paper considers the time-symmetric collapse models advanced by Bedingham and Maroney. Trazamos las líneas generales para una epistemología experimentalista de las capacidades y esclarecemos la modalidad física e invariancia de las leyes fenomenológicas. Luego examinamos las generalizaciones físicas y extrapolaciones de las leyes fenomenológicas y exponemos el caso de la ley de Fresnel, que ilustra aspectos de (...) nuestro argumento. This study examined health professionals’ (HPs) experience, beliefs and attitudes towards brain death (BD) and two types of donation after circulatory death (DCD)—controlled and uncontrolled DCD. Five hundred and eighty-seven HPs likely to be involved in the process of organ procurement were interviewed in 14 hospitals with transplant programs in France, Spain and the US. Three potential donation scenarios—BD, uncontrolled DCD and controlled DCD—were presented to study subjects during individual face-to-face interviews. Our study has two main findings: (1) In the (...) context of organ procurement, HPs believe that BD is a more reliable standard for determining death than circulatory death, and (2) While the vast majority of HPs consider it morally acceptable to retrieve organs from brain-dead donors, retrieving organs from DCD patients is much more controversial. We offer the following possible explanations. DCD introduces new conditions that deviate from standard medical practice, allow procurement of organs when donors’ loss of circulatory function could be reversed, and raises questions about “death” as a unified concept. Our results suggest that, for many HPs, these concerns seem related in part to the fact that a rigorous brain examination is neither clinically performed nor legally required in DCD. Their discomfort could also come from a belief that irreversible loss of circulatory function has not been adequately demonstrated. If DCD protocols are to achieve their full potential for increasing organ supply, the sources of HPs’ discomfort must be further identified and addressed. (shrink)

This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. This article identifies power, subjectivity, and practices of freedom as neglected but significant elements for understanding the ethics of social entrepreneurship. While the ethics of social entrepreneurship is typically conceptualized in conjunction with innate properties or moral commitments of the individual, we problematize this view based on its presupposition of an essentialist conception of the authentic subject. We offer, based on Foucault’s ethical oeuvre, a practice-based alternative which sees ethics as being exercised through a critical and creative dealing with the (...) limits imposed by power, notably as they pertain to the conditioning of the neoliberal subject. To this end, we first draw on prior research which looks at how practitioners of social enterprises engage with government policies that demand that they should act and think more like prototypical entrepreneurs. Instead of simply endorsing the kind of entrepreneurial subjectivity implied in prevailing policies, our results indicate that practitioners are mostly reluctant to identify themselves with the invocation of governmental power, often rejecting the subjectivity offered to them by discourse. Conceiving these acts of resistance as emblematic of how social entrepreneurs practice ethics by retaining a skeptical attitude toward attempts that seek to determine who they should be and how they should live, we introduce three vignettes that illustrate how practices of freedom relate to critique, the care for others, and reflected choice. We conclude that a practice-based approach of ethics can advance our understanding of how social entrepreneurs actively produce conditions of freedom for themselves as well as for others without supposing a ‘true self’ or a utopian space of liberty beyond power. Monitoring systems have recently arisen to verify compliance with corporate codes of conduct for labor. This article places codes in the context of broader debates on global governance and argues for an empowered participatory approach to international labor standards focusing on enabling rights. Based on ethnographic research in Mexico and Guatemala on the implementation of codes in the apparel sector and their use in cross-border organizing campaigns, it explores the effect of monitoring on worker empowerment and working conditions in global (...) factories. The analysis highlights institutional designs and political strategies capable of contributing to the protection of international labor rights. (shrink)

This article explores the theme of presence of the psychotherapist, a concept that has been of particular interest in humanistic and existential approaches. Presence was first associated with the humanistic attitudes of the practitioner and the way he or she embodies these attitudes in the here and now of the encounter. Since the publication in 2002 of Geller and Greenberg’s model of therapeutic presence, several quantitative studies have explored the relationship between the therapist’s perception of presence and other dimensions of (...) the therapeutic process. However, qualitative explorations still seem necessary to account for the complexity of the therapist’s presence and its role in the therapeutic process. Centered on the therapist’s perspective, we use an idiographic methodology and refer to lived clinical experience to highlight the dimension of sensory contact that, through the body, actualize a connection to a virtual space of the therapeutic relationship. We so describe how a therapist can achieve an embodied processing to clinical material from what we describe as “traces of presence” of the other. From this point of view, the patient’s presence incorporates itself into the therapist’s experience and the therapist can perceive aspects of this presence in a tangible, concrete, and useful way. The therapist’s presence thus takes on a meaning that is not reduced to what the patient will perceive and interpret of his or her attitude. It becomes the main material from which the therapist orients his or her clinical interventions. (shrink)

A number of attempts have been made to conceptualise legal reasoning along falsificationist lines. This paper criticises a recent one by Bernhard Schlink. After familiarising the reader with falsificationism, I argue that falsificationism is premised on an epistemological asymmetry between singular observation statements and universal hypotheses, and that absent such an asymmetry in the context of statutory interpretation, framing jurisprudence in falsificationist terms is unwarranted and misleading. To get off the ground, legal falsificationism would need to combine with some kind (...) of broadly intuitionist moral cognitivism, but even then, it would still misrepresent what is going on in legal reasoning. The arguments in this paper apply mutatis mutandis to all falsificationist theories of legal and ethical reasoning. I point to some by Albert, Canaris and Larenz. (shrink)

Leibniz was a philosopher of principles: the principles of Contradiction, of Sufficient Reason, of Identity of Indiscernibles, of Plenitude, of the Best, and of Continuity are among the most famous Leibnizian principles. In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. This article tries to elucidate the Deleuzian project of the reversal of Platonism in relation to that of Nietzsche. To this aim, I have made a predominantly historiographic sketch of the question in both authors. In the case of Nietzsche, I inquired about both the relationship that the reversal of Platonism presents in his philosophy with the problem of nihilism and the evolution that the topic undergoes throughout his vast intellectual production, until it reaches its final formulation. With regard to (...) Deleuze, I offer a broad overview of his work aimed at tracing the subject, from his interpretation of the Nietzschean formulation, as opposed to that of Heidegger, to the meticulous way in which it fits into his own philosophy as a shift of the essence in favour of the event as a source of singularities. I begin this paper with a puzzle: why is Plato’s Parmenides replete with references to Gorgias? While the Eleatic heritage and themes in the dialogue are clear, it is less clear what the point would be of alluding to a well-known sophist. I suggest that the answer has to do with the similarities in the underlying methods employed by both Plato and Gorgias. These similarities, as well as Plato’s recognition of them, suggest that he owes a more significant philosophical and (...) methodological debt to sophists like Gorgias than is often assumed. Further evidence from Plato and Xenophon suggest that Socrates used this very same method, which I call ‘exploring both sides’. I distinguish this Socratic method and its sophistic counterpart in terms of structure, internal aim, and external aim. Doing so allows for a more nuanced understanding of their similarities and differences. It also challenges the outsized role that popular caricatures of philosophical and sophistic method have had on our understanding of their relationship. (shrink)

Some feminists in the battered women's movement have been striving to develop egalitarian and participatory organizational structures for shelters. The Family Crisis Shelter offers a case study of a feminist shelter that is operating with a counterbureaucratic organizational structure. The shelter has a staff of nonprofessionals, makes all policy decisions through consensus, pays all staff the same wages, and imposes minimal regulations and restrictions on residents, who are encouraged to take initiative and make decisions. The article discusses the successes and (...) limitations of the nonbureaucratic structure for implementing the feminist goals of consensus and empowerment. (shrink)

Accordingto the mass media, a postfeminist era emerged in the 1990s. The first objective is to develop a definition of the postfeminist perspective. Based on an informal content analysis of popular articles, the authors identify four postfeminist claims: overall support for the women’s movement has dramatically eroded because some women are increasingly antifeminist, believe the movement is irrelevant, and have adopted a “no, but..”.version of feminism. The second objective is to determine the extent of empirical support for these claims. Usingexistingpublic (...) opinion data, the authors find little support for the four postfeminist claims. Implications of the unsubstantiated post-feminist argument are discussed. (shrink)

I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter.
