O presente artigo analisa as possibilidades e limites da discricionariedade administrativa no Estado Social e Democrático de Direito, propondo a releitura dos princípios da legalidade, da supremacia do interesse público e da igualdade perante a administração. Apresenta critérios distintivos entre ato administrativo vinculado e discricionário, além de discorrer sobre os parâmetros constitucionais e legais que devem nortear a decisão discricionária. Inspirando nas luzes pós-positivistas, a pesquisa conta com a revisão bibliográfica sobre o tema e, adotando o método dedutivo, busca aproximar (...) os preceitos constitucionais da atuação discricionária do administrador público. Este artigo tenta dar uma visão geral sobre a epoché fenomenológica, relacionando-a ao problema da constituição do saber fenomenológico,e também da fundamentação da Ciência. A epoché, formulada assim de forma universal é considerada como uma alteração radical da atitude natural.

This paper examines the associations among social desirability response bias, cultural constructs and gender. The study includes the responses of 1537 students from 12 countries including Australia, Canada, China, Colombia, Ecuador, Hong Kong, Ireland, Japan, Nepal, South Africa, Spain, and the United States. The results of the analysis indicate that, on average, social desirability response bias decreases (increases) as a country’s Individualism (Uncertainty Avoidance) increases. The analysis also indicates that women scored significantly higher on Paulhus’ Image Management Subscale on an (...) overall basis and for seven of the 12 country comparisons. This research serves as a caution when considering the research findings of prior international survey-based ethics research that do not include a direct measure of social desirability response bias. For example, the finding that women score higher on Paulhus’ measure of social desirability response bias calls into question prior research that does not control for social desirability response bias indicating women are more ethically sensitive than men. In this research, we use Rest's (1979a) Defining Issues Test, the Attitudes on Honesty Scale (Authors) and Academic Integrity Index (Authors); the last two are adaptations of the DIT. A total of 220 students from three universities participated in the study (66 psychology majors and 154 business majors). The data indicate that 66.4 percent of the students reported that they cheated in high school, college, or both high (...) school and college. Psychology majors scored higher than business majors on both the Defining Issues Test (Rest, 1979a) and the Attitudes on Honesty Scale (AHS, Authors). Using factor analysis, we found significant associations between students' ratings of the importance considerations present in the three cheating scenarios and their estimates of whether cheating would occur (i.e., the Academic Integrity Index). Finally, using logistic regression, we found that the scores on the Attitudes on Honesty Scale and Academic Integrity Index associate with the self-reported cheating behavior of college students. The paper explores the adoption and operationalization of the circular economy strategy within the ambit of cooperatives, anchoring this exploration in the embeddedness theory. In more detail, our study aims to discern whether territorial and network embeddedness act as catalysts for the adoption of a circular economy strategy and subsequently influence the operationalization of circular initiatives. Given that cooperatives intrinsically emphasize community bonds and mutualistic relationships, understanding the nuances of their embeddedness can elucidate the pathways in adopting and operationalizing circular (...) economy strategies. The study draws from a survey encompassing 1116 Italian cooperatives to fathom how these organizations integrate and operationalize the circular economy in their routine operations. Data were scrutinized using a structural equation model. Outcomes reveal that both territorial and network embeddedness emerge as strong influencers of circular economy strategies, which subsequently sway the operationalization of circular initiatives. Our investigation, assessing also the mediating role of circular economy strategy adoption in relation to both territorial and network embeddedness on the assimilation of circular endeavors, offers enriched theoretical and managerial perspectives on the embeddedness theory and its practical implications. Recognizing the growing interdependence of the European Union and the importance of codes of conduct in companies’ operations, this research examines the effect of a country’s culture on the implementation of a code of conduct in a European context. We examine whether the perceptions of an activity’s ethicality relates to elements found in company codes of conduct vary by country or according to Hofstede’s (1980, Culture’s Consequences (Sage Publications, Beverly Hills, CA)) cultural constructs of: Uncertainty Avoidance, Masculinity/Femininity, Individualism, and Power (...) Distance. The 294 individuals, who participated in our study, were from 8 Western European countries. Their responses to our 13 scenarios indicate that differences in the perceptions of ethicality associate primarily with the participants’ country as opposed to their employer (i.e., accounting firm), employment level, or gender. The evidence also indicates that these country differences associate with Hofstede constructs of Individualism and Masculinity. (shrink)

This article explores the critical realist conceptualization of authenticity through its development in tourism, especially in relation to indigenous Sámi culture. Authenticity is discussed through the often relativistic perspectives surrounding it. This paper proposes a middle ground between objective and existential views; it considers authenticity to be a compromise, and it focuses on both universal components (present in all Sámi people in the tourism context) as well as mediated components (such as characteristics differently influenced by geo-history). The role of cultural (...) tourism labels is also discussed. The overlying objective is to conceptualize authenticity so that it produces a positive effect on the tourism operations of Sámi people. Specifically, it argues that the use of certain labels or certifications, based on the concrete universal aspects of Sámi, can be beneficial. If the Sámi themselves are involved in the creation of such labels, they need not betray the objective of respecting Sámi culture. (shrink)

ABSTRACTIn this paper, I discuss my personal experience of the issues that can arise when adopting critical realism in academic contexts dominated by irrealist methodological approaches. I draw inspiration for my analysis from the concept of Gramscian hegemony and the concept of ‘authenticity’. These concepts are related because hegemonic processes prevent individuals from freely expressing themselves. In my case, academic hegemony has resulted in social pressure to sacrifice my authentic critical realist self in order to achieve academic success. I also (...) discuss groupthink dynamics, suggesting that they are a mechanism by which hegemony – and denial of individual authenticity – can be achieved. This paper is meant to be a theoretical and reflexive discussion, which could be the starting point for empirical studies investigating the situation of a critical realist in a hegemonic academic context. O objetivo deste trabalho é duplo: primeiramente, tecer alguns comentários sobre o uso feito pelo filósofo da ocorrência de fenômenos da natureza como fatores explicativos para mudanças profundas ocorridas no comportamento humano, um recurso argumentativo presente nas duas narrativas hipotéticas; em seguida, abordar as razões que Rousseau fornece para que esses acontecimentos deixem de ser simples fatos naturais e se tornem verdadeiras catástrofes para o ser humano, as quais podem ser encontradas, por exemplo, na Carta a Voltaire sobre a Providência.

Uma concepção de cosmopolitismo, de base eurocêntrica, é questionada por pensadores como K. A. Appiah, Walter Mignolo, Silviano Santiago entre outros, para buscar possíveis ressemantizações do termo no contexto contemporâneo, marcado pela globalização, pelo multiculturalismo e pela expansão das novas tecnologias de comunicação. Considerando esse confronto de noções de cosmopolitismo, indaga-se como se deu a interpretação do Brasil no início do século XX, quando recrudesceram as tensões entre cosmopolitismo e nacionalismo. Busca-se, por outro lado, confrontar tais interpretações com as que (...) surgem no início do século XXI, quando a nação vai deixando de ser o centro de um sistema de significação, em tempo heterogêneo e de globalização, em que se pode falar em “cosmopolitismo do pobre” (cosmopolitismo do subalterno), como formulou Silviano Santiago. The purpose of this study is to analyse the structure of written argumentative texts produced by pupils in grades 3, 5, 7 and 11 in relation to three different tasks: Group A — subjects are assigned a topic question consisting of a single statement ; Group B — subjects are given a topic question consisting of both a statement and its opposite ; Group C — subjects are given an initial and a final sentence of a text, which they have (...) to complete, and which refers to opposite opinions . Six different types of text organization were evidenced on the basis of the argumentative moves presented in the texts, the linguistic indexes used to express the relationships between the moves, the presence or absence of counter-arguments and the type of argumentation or reasoning used. The organization of the texts range from a simple affirmation of a position to a use of data or reasons to support a position, to others still in which two positions are presented in the body of a unitary structure, developed ‘in parallel’ and interconnected regularly. Our analysis found a well-defined tendency corresponding to the age levels in the types of texts produced by the subjects. The texts produced by the younger group, the pupils in elementary school, contained a fairly simple structural organization, characterized by very few argumentations or a lack of explicitness of the essential moves and a juxtaposing of arguments. The older subjects, in particular those attending secondary school, were able to produce texts which were more complex with regard to the presence and the organization of the argumentative moves, and more coherent and cohesive with respect to their articulation of opinions and use of adequate linguistic indices to analyze t topic. As regards the different types of tasks, when the subjects were presented explicitly with two opposite opinions , they developed both positions in their responses, contrary to the situation in which they produced one position when only one of two opinions was presented. The article examines Kant's notion of conceptual extension in order to determine a conception of predication that could integrate, in a coherent fashion, basic theoretical commitments of general logic as he conceived it and the central tenets of his transcendental logic. After a brief overview of the several characterizations of thatnotion in the Kantian corpus, I distinguish three interpretative models concerning it in the literature. Such models are criticized and their prospects of integrating Kant's commitments in a fully satisfactory way (...) are rejected. Finally, I sketch an alternative account of Kant's notion of conceptual extension, which respects the criteria of adequacy that guided the examination of the former models. It points, on its turn, to a revaluation of Kant's notion of conceptual content. (shrink)

In this paper, I defend that the historiographical category of eclecticism is a correct way to describe the epistemology and the exegetical activity of the Anonymous commentator on Plato’s Theaetetus. In addition, I show that the interpretation of the platonic philosophy presented in this text not only presupposes an eclectic philosophical attitude, but also offers a conscious defense of a positive and philosophically relevant form of eclecticism. By eclecticism, I understand a method of inquiry based on the deliberate use of (...) hypotheses and arguments from different philosophical traditions. My claim is that Anon. intends to lay ground of his way of doing philosophy by attributing it to Plato and the platonic tradition. In doing so, Anon. provides us with a positive understanding of eclecticism as a legitimate methodology of philosophical investigation. (shrink)

This article is a belated contribution to a Common Knowledge symposium on the “unanticipated conceptual practice” of “anthropological philosophy.” The basic argument is that the groundwork for this emerging approach, associated foremost with Eduardo Viveiros de Castro's book Métaphysiques cannibales of 2009, was laid in the 1970s by the controversial French anthropologists Pierre and Hélène Clastres. It is argued that the Clastres took the intellectual practices of Guarani shamans and prophets as analogous to the those of ancient Greek philosophers but (...) also as sharply critical of the principles that underlay early Western metaphysics. In this study the influence of irrational beliefs and perfectionism on the emergence of competitive anxiety was investigated. While previous studies indicate that higher irrational beliefs predict greater competitive anxiety, in the present study it is hypothesized that this relationship is mediated by perfectionism. A serial atemporal multiple mediation analysis revealed that both adaptive and maladaptive perfectionism were significant partial mediators between irrational beliefs and competitive anxiety. The total score and all four subscale scores on irrational beliefs had both direct (...) and indirect effects on cognitive competitive anxiety, the latter effects mediated by both forms of perfectionism. Depreciation beliefs had a direct effect, and demandingness and awfulizing had indirect effects, on somatic competitive anxiety when both forms of perfectionism were entered as mediators. These findings suggest that both irrational beliefs and perfectionism influence the emergence of competitive anxiety, therefore rational emotive behavioral therapy with a focus upon perfectionism may be an effective means of reducing competitive anxiety in athletes. In The Science of Culture and the Phenomenology of Styles, Renato Barilli examines the history of artistic style in relation to scientific discovery. Applying an innovative analysis, he illustrates the subtle, yet intrinsic, connection between paradigm shifts in the sciences and in the arts. Barilli argues that there are "homologies," or equivalences, between specific discoveries or inventions and revolutionary advances in artistic techniques. He draws upon the pioneering work of Lucien Goldman, who provides the fundamental definition of "homology," as (...) well as the theories of Luciano Anceschi and Marshall McLuhan in order to reassess conventional modes of dividing art history into such periods as modern, contemporary, and postmodern. By correlating moments like the invention of the printing press and the internal combustion engine with canonical periods in the evolution of art, Barilli unearths conceptual links across domains and disciplines. An insightful reflection on the historic perspectives of cultural production, The Science of Culture and the Phenomenology of Styles sheds new light on the relationship between visual culture, art, and language.
