Abstrak: Tujuan dari artikel ini adalah menginterpretasi dan mengafirmasi bahwa Ada (das Sein) dalam “pertanyaan tentang Ada” (die Seinsfrage) dalam pemikiran Heidegger adalah univok sebagaimana konsep Ada itu univok dalam pemikiran Duns Scotus. Oleh karena itu, pertanyaan utama yang menuntun artikel ini adalah, bagaimana dapat ditunjukkan hubungan antara konsep Ada itu univok antara Dun Scotus dan Heidegger? Untuk memahami dengan baik tema ini, kita akan mengulasnya dalam empat bagian. Pertama, kita akan berkonsentrasi pada pengertian konsep ekuivok, analog, univok. Kedua, kita (...) fokus pada konsep analogi dan univok dalam pemahaman Abad Pertengahan. Bagaimana Duns Scotus memahami Ada itu univok akan dijelaskan pada bagian ketiga. Kemudian, kita akan mengelaborasi sebuah penafsiran Ada itu univok dalam pemi- kiran Heidegger pada bagian keempat. Pada akhirnya, konsep Ada itu univok dalam pemikian Heidegger terletak pada konsepnya tentang waktu. Abstract: The scope of this article is to interpret and affirm that Being (das Sein) in Heidegger’s “question of Being” (die Seinsfrage) is similarly univocal to Duns Scotus’ concept of the univocity of Being. Therefore, the central question which guides this article is, how can it point to the relationship between Duns Scotus and Heidegger in regards to the concept of the univocity of Being? To understand well this theme, we will explain it in four parts. First, we concentrate on the definitions of equivocity, analogy and univocity. Second, we focus on the concepts of analogy and univocity in the Middle Ages. How Duns Scotus understands the univocity of Being will be pointed out in third part. After that, we will elaborate an interpretation of the univocity of Being in Heidegger’s thought in fourth part. In the end, concept of the univocity of Being in Heidegger’s thought is put in his concept of time. This article examines the debate on whether to analyse ‘honour crimes’ as gender-based violence, or as cultural tradition, and the effects of either stance on protection from and prevention of these crimes. In particular, the article argues that the categorisation of honour-related violence as primarily cultural ignores its position within the wider spectrum of gender violence, and may result in a number of unfortunate side-effects, including lesser protection of the rights of women within minority communities, and the stigmatisation of those (...) communities. At the same time it is problematic to completely dismiss any cultural aspects of violence against women, and a nuanced approach is required which carefully balances the benefits and detriments of taking cultural factors into account. The article examines the issues within the context of the legal response to cases involving honour-related violence, arguing that although the judiciary has in a number of cases inclined towards viewing ‘honour’ as primarily cultural rather than patriarchal, in some cases they have begun to take a more gender-based or ‘mature multiculturalism’ approach. The common law system is a legal system that values precedent, or previous court decisions, in the resolution of current cases. As the availability of legal documents in digital form has increased, it has become more difficult for legal professionals to manually identify relevant past cases due to the vast amount of data. Researchers have developed automated systems for determining the similarity between legal documents to address this issue. Our research explores various representations of a legal document and discusses a (...) novel paragraph filtering process to identify key paragraphs using legal citation information to remove unnecessary text paragraphs without disturbing the concept of the legal document. State-of-the-art techniques like TF-IDF, BERT, Legal Bert, Doc2Vec, and Legal-longformer are used for the performance analysis of the proposed approach with document comparison. It has been shown that a model trained on the proposed filtered paragraphs can achieve better results than a model trained on the complete text and can also shorten the document by over 40%. The proposed filtering strategy could be helpful for models like BERT, where the maximum token length is fixed. (shrink)

Study on Rūpārūpavibhāga, Abhidhamma terminology by Buddhadatta.

In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations (...) as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. Abstrak: Mayoritas pembaca Platon menafsirkan filsafat Platon dalam perspektif dualisme, yaitu terdapat dunia idea (kosmos noetos) yang berlawanan dengan dunia indrawi (kosmos aisthetos). Cara tafsir ini menimbulkan banyak kontradiksi. Dalam estetika, E.H. Gombrich, sejarawan seni yang menelurkan teori Revolusi Seni Rupa Yunani, juga membaca Platon dalam tafsir dualisme. Gombrich menyimpulkan bahwa bagi Platon kontemplasi keindahan dapat membawa kita ke dunia idea yang transenden, sedangkan seni hanya menyenang-nyenangkan, mengelabui indra dan menggoda pikiran untuk terikat pada bayang-bayang. Padahal dalam teorinya sendiri, (...) Gombrich menjelaskan bahwa karya seni rupa Yunani terkemuka persis karena keindahannya yang dihidupkan dengan daya ilusif-persuasif. Tulisan ini hendak melempangkan kontradiksi tersebut dengan mengoreksi dunia idea - dunia indrawi menjadi alam visibel – alam inteligibel (horatos topos – noetos topos), istilah yang dipakai Platon dalam corpus-nya. Tulisan ini menyimpulkan bahwa Platon tidak menolak daya ilusif-persuasif yang terdapat dalam seni rupa melainkan menempatkannya sebagai instrumen untuk merealisasikan Agathon. Abstract: The majority of Plato’s reader interprets his philosophy in dualistic perspective, that there is the intelligible world (kosmos noetos) which opposed to the sensible world (kosmos aisthetos). This perspective caused many contradictions. In Aesthetics, E.H. Gombrich, an art historian who creates the Greek Revolution Theory, also read Plato under the perspective of dualism. For him, Plato thought that the contemplation of beauty can lead to the realm of transcendent ideas, while art can only flatter, deceive the senses and seduce the mind to feed on phantoms. Meanwhile, Gombrich also thought that Greek Art is beautiful precisely because of the power of illusion-persuasion. This article aims to reconcile the contradiction by replacing the intelligible world - sensible world to the intelligible realm - visible realm (topos noetos - horatos topos), the original term which Plato used in his corpus. 이 글은 초기불교의 무아설(無我說)에 근거하여 갈등 문제의 대처를 위한 소통 담론을 모색하는 데 목적을 둔다. 초기불교의 니까야(Nikāya) 문헌에는 다양한 유형의 무아설이 나타난다. 필자는 그들 중 ‘동일시의 부정(disidentification)’을 내용으로 하는 무아 유형 들이야말로 협력적 삶을 위한 소통의 지침이 될 수 있다고 본다. ‘동일시의 부정’ 방식으로 제시되는 무아란 스스로의 주장과 견해에 대한 반성적 태도를 본질로 한다. 이것은 자신의 경험을 구성하는 물질현상(色, rūpa)이나 느낌(受, vedanā) 따위에 대해 ‘나의 것 (mama)’이 아니며 ‘나의 자아(me attā)’가 아니라고 부정하는 방식으로 이루어진다. 이와 같은 부정은 스스로의 정체성을 이루는 (...) 요인들에 대한 거부로서, 자신의 신념이나 사고에 매몰되는 것을 막아줄 수 있다. 필자는 이와 같은 반성적 태도가 결여된 상태에서는 스스 로의 느낌이나 생각에 대한 과도한 확신과 함께 타인과의 소통 부재 상황이 초래될 수 있 다고 본다. 동일시 부정의 무아는 ‘나’ 혹은 자아에 대한 존재론적 부정으로 볼 수 없으며, 다만 자신을 구성하는 요인들과의 ‘거리두기’로 바꾸어 말할 수 있다. 이러한 ‘거리두기’는 자신에 대해 거리를 두는 정도만큼 타자를 위한 여유 공간의 확보를 가능하게 해줄 수 있 다. 이 점에서 무아란 ‘나’ 혹은 자아에 대한 전면적인 거부가 아니며 타자에 대한 맹목적 인 수용도 아니어야 한다. 무아의 실천에는 자신과 타자 모두에게 얽매이지 않는 유연성과 균형감이 요구된다고 할 수 있다. 이 글은 무아의 실천적 측면을 규명하기 위해 원효의 화 쟁(和諍) 사상과 현대의 체험주의(Experientialism) 담론을 활용한다. 자신의 신념이나 확 신조차도 다른 사람에 의한 검토와 비판에 개방되어야 한다는 화쟁 해석은 무아의 실천적 측면을 이해하는 데 참고가 될 수 있다. 한편 체험주의 담론은 절대주의적 사고방식의 폐해를 지적하는 동시에 몸으로 경험되는 ‘나쁜 것’에 대한 체험적 인식으로부터 공감과 소통 의 실마리를 찾아나갈 것을 제안한다. 체험주의의 시선은 무아설 및 사성제(四聖諦)가 사변 의 산물이 아니며 생생한 삶의 현실에 대처하기 위한 것임을 드러내는 데 유용하다. Through an examination of Bhāgavata Purāṇa X.43.17 and its interpretation by early commentators like Vopadeva, Hemādri, Śrīdhara, Sanātana, Rūpa, and Jīva, I argue that they created forms of hierarchical inclusivism by the application of rasa in the interpretation of the Bhāgavata Purāṇa. In doing so, I examine bhakti as a rasa, showing how rasa theory provided a vocabulary to include the characters of the Bhāgavata Purāṇa and their diverse experiences of the God Kṛṣṇa within hierarchical systems of bhakti. By hierarchical (...) inclusivism, I mean a theory, e.g., in the case of rasa, “the superiority of passionate love over fear,” and that this theory provided criteria to order items, e.g., in the case of rasa again, “the character of the cowherd women is superior to the character of the king.” In this case, hierarchical inclusivism is a theory for organizing and evaluating the mystical and aesthetic experiences of the ten characters mentioned in Bhāgavata Purāṇa X.43.17. I look at how commentators also used rasa for the basis for doctrines about God’s being and nature. (shrink)

Metodologinya adalah induktif dan interdisipliner. Kosmologi dan antropologi amat membantu memberikan data ilmiah. Data-data tersebut merupakan titik awal untuk melakukan teologi ekologi, selain sumber-sumber yang diperoleh dari Wahyu, seperti Kitab Suci, Tradisi dan Magisterium. Artikel ini merupakan suatu upaya mengembangkan teologi ekologi berdasarkan tradisi teologi Kristiani yang menggaris bawahi sejumlah titik pandang teologis, seperti penciptaan sebagai suatu proses melalui itu (...) Allah menciptakan dunia; peran khas manusia sebagai partner Allah Pencipta, selaku gambar dan rupa Allah, merawat dan memelihara ciptaan atas nama Allah; antroposentrisme tidak memiliki akar dalam teologi ekologi Kristiani. The given data could be the starting points in doing a theology of ecology, besides the resources from Revelation, such as Scriptures, Tradition and Magisterium. This article is an effort to elaborate a theology of ecology based on Christian Tradition of Theology which underlines several theological points of view such as: creation as a process through which God creates the world; a special role as co-partner of the Creator for human being as “imago Dei” has to conserve and to take care of creation as God’s representative; anthropocentrism has no root on Christian theology of ecology. The Cosmic mysticism of St. Francis, promoted by Pope Francis in his encyclical letter Laudato Si’, occupies the second part of this article in order to understand ecological spirituality which emerges throughout the encyclical letter. For Christians, taking care of creation is also an imperative rooted in their Christian faith. In her article on ‘translating ngaka’ (diviner-healer), Musa Dube argues that in the writings of Robert Moffat and subsequently in his translation of the Bible into Setswana, the person of the ngaka, rather than being portrayed as occupying a central and positive role in Setswana culture, is relegated to a marginal position and is even depicted as evil and an imposter. The article seeks to argue that firstly, there is a fundamental connection between ngaka and bogwera in Setswana tradition. This (...) is because ngaka performed the rite of initiation and was a central figure in the circumcision (rupa) of those undergoing the rite of imitation. Secondly, in his 1857 English–Setswana Bible Moffat alters the word bogwera in Luke 2:21. In representing and translating bogwera as circumcision in Luke 2:21 Moffat rewrites and reorders the political, economic and religious beliefs of Batswana. It is in the transmogrification of bogwera in Luke 2:21 that an act of hybridisation and creolisation takes place through the ordering of the Batswana cosmology and culture. I would further argue that not only did this marginalisation colour the perceptions of the Batswana regarding bogwera, but also that the translated text was used as a tool to disrupt, marginalise, replace, subvert and colonise the spiritual spaces of the Batswana. Furthermore, the article attempts to critically engage with the translated text from an ideological criticism within postcolonial theory, engaging with the fundamental question: why did Moffat translate and alter bogwera as circumcision rather than using the proper word which is rupa (circumcision)? Selected letters published in the newspaper Mahoko a Becwana (Words of Batswana) are quoted and discussed, as it is in these letters that we are confronted with an act of hybridisation and creolisation. The letters also point to the effects of such a translation and transmogrification as a discursive tool to reorder and to pervert the Batswana cosmology and culture. In translating and altering circumcision as bogwera Moffat performs an act of mutation of meaning. It is in this morphing of bogwera into something that is charged with negativity in order to reorder and rewrite through an exercise of transmutation that Moffat attempts to subvert and to indoctrinate, resulting in the subversion of the spiritual spaces of Batswana. Just as the different parts of the chariot when they are brought, together form a chariot, so when the constitutive elements of existence are brought together in a body, they form a living being”.Later the king asked, “What becomes reborn, Nāgasena?”“The name and the form (nāmarūpa) are reborn”.“Is it this (...) name and this form that are reborn?”“No, but through this name and this form, deeds, whether good or bad, are performed, and by these deeds, the karma, another name-and-form is reborn”.This dialogue from the first century B.C. explains, with a slightly different meaning, a cardinal notion for Hinduism, the principle of individuation. InPart I of my article I have tried to show how the problem of negation has led the Jains to accept Non-existence and Existence as constituents ordharmas of every real object and to formulate their first dialectical principle:sad-asad-rŪpa $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{m} $$ vastu or ‘Every real object possesses a mode as an existent and as a non-existent’. Their interpretation of negation seems to be based on the ‘primitive’ realistic standpoint that every word in a true proposition, including the word ‘not(-)’, must have (...) some sort of objective reference. The most precise and intricate model of mind from the tradition, the Theravāda, is developed in the Abhidhamma. Much of the first book of the canonical Abhidhamma, the Dhammasangani breaks down conscious awareness into its constitutive mental factors. The Dhammasangani goes on to supply a list of 56 mental factors (cetasika). The 56 factors that can occur in this moment of good conscious awareness are listed in the chapter, along with additional factors added by the commentary; in separate columns are (...) lists of representative bad and neutral thoughts. First in each column are five factors present in every moment of conscious awareness, understood as a distinct grouping by the commentary: contact, feeling, perception, intention, and consciousness itself. An aim of the Abhidhamma method is to teach the distinctions between mind and matter, which are often paired in a single formulation: nāma‐rūpa. (shrink)

Gauḍīya Vaiṣṇava thinkers adapted rasa theory to a context of devotion to the god Kṛṣṇa. In doing so, bhayānaka-rasa, the aestheticized experience of horror, presents interesting complexities. This paper examines the conceptualizations of bhayānaka-rasa by four Gauḍīya Vaiṣṇava authors: Rūpa Gosvāmin, Jīva Gosvāmin, Kavi Karṇapūra, and Baladeva Vidyābhūṣaṇa. Between them, they discuss three distinct modes of bhayānaka-rasa in a devotional context: a devotee’s fear after committing an offense against Kṛṣṇa, fear of some dreadful being who the devotee thinks might hurt (...) Kṛṣṇa, and fear of Kṛṣṇa’s display of his cosmic form. This paper also briefly examines the Rūpa’s explicit rejection of the fear felt by Kaṃsa as a case of devotional bhayānaka-rasa. A central concern for the Gauḍīya Vaiṣṇava authors is whether fear, a typically unpleasant emotion, can attain the status of a rasa and how it is subordinated to more direct forms of devotion. This paper argues that these thinkers make an important contribution to reconceptualizing bhayānaka-rasa, particularly highlighting Jīva’s Gosvāmin’s argument that the real object of bhayānaka-rasa is not the person who serves as the source of fear, but is Kṛṣṇa, out of love for whom such fear is felt. To explain the khandhas as the Buddhist analysis of man, as has been the tendency of contemporary scholars, may not be incorrect as far as it goes, yet it is to fix upon one facet of the treatment of the khandhas at the expense of others. Thus A. B. Keith could write, “By a division which ... has certainly no merit, logical or psychological, the individual is divided into five aggregates or groups.” However, the five khandhas, as treated in the (...) nikāyas and early abhidhamma, do not exactly take on the character of a formal theory of the nature of man. The concern is not so much the presentation of an analysis of man as object, but rather the understanding of the nature of conditioned existence from the point of view of the experiencing subject. Thus at the most general level rūpa, vedanā, sañña, and are presented as five aspects of an individual being's experience of the world; each khandha is seen as representing a complex class of phenomena that is continuously arising and falling away in response to processes of consciousness based on the six spheres of sense. They thus become the five upādānakkhandhas, encompassing both grasping and all that is grasped. As the upādānakkhandhas these five classes of states acquire a momentum, and continue to manifest and come together at the level of individual being from one existence to the next. For any given individual there are, then, only these five upādānakkhandhas — they define the limits of his world, they are his world. This subjective orientation of the khandhas seems to arise out of the simple fact that, for the nikāyas, this is how the world is experienced; that is to say, it is not seen primarily as having metaphysical significance.Accounts of experience and the phenomena of existence are complex in the early Buddhist texts; the subject is one that is tackled from different angles and perspectives. The treatment of rūpa, vedanā, saññā, and represents one perspective, the treatment of the six spheres of sense is another. As we have seen, in the nikāya formulae the two merge, complementing each other in the task of exposing the complex network of conditions that is, for the nikāyas, existence. In the early abhidhamma texts khandha, āyatana and dhātu equally become complementary methods of analysing, in detail, the nature of conditioned existence.The approach adopted above has been to consider the treatment of the five khandhas in the nikāyas and early abhidhamma texts as a more or less coherent whole. This has incidentally revealed something of the underlying structure and dynamic of early Buddhist teaching — an aspect of the texts that has not, it seems, either been clearly appreciated or properly understood, and one that warrants further consideration. O presente estudo pretende salientar o trânsito das grandes formulações da concepção da temporalidade na tradição hindu: do tempo (kāla) à sua compreensão como instantâneo (kṣaṇa). Num ponto preliminar, salientam-se as condições linguísticas do pensar indo-europeu e a "gramática" sanscrítica a propósito do tempo. Sublinham-se de seguida os enquadramentos rituais e míticos, tanto ligados com a ciclicidade (saṃsāra), como com o imutável e eterno (ānantya). Depois percorrem-se, de forma sintética, os vários "sistemas" filosóficos salientando respectivamente: a concepção metafísica (no Vedānta (...) e Mīmānsā), a recorrência e irrealidade já num plano gnosiológico (no Sāṃkhya e no Yoga), e a formulação psicológica (tanto no Vaiśeṣika, como no Nyāya, além disso presente no Jainismo). Enfim, na última parte, faz-se menção aos principais traços característicos da doutrina budista da instantaneidade (muito característica sobretudo das escolas "subitistas"). Valoriza-se conclusivamente esta instância de um "agora" também como lição da espiritualidade hindu em geral. (shrink)
