In the past two decades academic and research literature on “corruption” has flourished. During the same period organizations and initiatives fighting against corruption have also significantly expanded, turning “anti-corruption” into a new research subject. However, despite a few exceptions there is a division of labor between scholars who study corruption itself and those who study the global anti-corruption industry. Juxtaposing corruption’s local discourses and anti-corruption international practices, this article is an attempt to bring together these two intertwined research dimensions and (...) explore how an ethnographic approach might contribute to framing them together. Firstly, it describes how corruption in Romania is often conceptualized and explained in terms of national heritage, something related to old and recent cultural history, including traditional folklore. Secondly, it explores how anti-corruption works in practice, focusing on international legal cooperation projects monitoring the progress and shortcomings both prior to and post Romania’s accession to the European Union. Finally, revealing the articulations of these two apparently unrelated research fields, the article argues that corruption’s local explanations and the circular logic of auditing observed within the anti-corruption industry share a common developmental ideology mirroring the crypto-colonialist structure of power relations and dependency among European nation-states emerging out of the Cold War. In this paper, we thoroughly investigate the various solutions proposed to solve the problems of transplantation system in Romania. Three types of solutions are especially envisaged: legislative ones, institutional ones and cultural/religious ones. We carefully analyze the main ethical and logistical arguments on presumed consent and its alternatives in Romania: family consent provided by the relatives and mandated choice. The volume Applied Ethics. Perspectives from Romania is the first contribution that aims at showing to the Japanese reader a sample of contemporary philosophy in Romania. At the same time a volume of contemporary Japanese philosophy is translated into Romanian and will be published by the University of Bucharest Press. -/- Applied Ethics. Perspectives from Romania includes several original articles in applied ethics and theoretical moral philosophy. It is representative of the variety of research and the growing (...) interest in applied ethics in the last few years in Romania. The philosophy practised here is at the same time an international activity, but also a kind of research deeply involved in Romanian realities. In the first decade post-1989 no gender policies with clear objectives and specific instruments existed in Romania. The gender mainstreaming was first stated in the two National Action Plans for Equal Opportunities between Women and Men (1996 and 2000). Still, the attention of the various Romanian Governments, concerning women's issues, was focused especially on labour relationships and on related domains, such as social security and health insurance. Other fields, such as education, political participation, family and civil rights, were under- (...) developed, as regards the consideration of women's needs and interests.The legislation and institutions that implement and monitor the observance of equality take no special interest in women's discrimination, as women are treated together with other discriminated categories (the disabled, Rroma, homosexuals). This study proposes a philosophical analysis of the public discourse that accompanies the cultural policy in Romania: justifications and finalities of State intervention in the cultural field, as well as representations of the roles that the public authorities attribute to culture/art. The objective is to bring into light the philosophical, political and aesthetical values that found and legitimise the cultural policies and shape the relationship between State and artists/art. It is basically about understanding the nature of representations on culture (...) and art that underlie the State intervention in the cultural field and, consequently, to determinate the ethos of the cultural policy in post-communist Romania and to expose the constraints that are still limiting its exercise. This article seeks to identify and analyse the most significant changes regarding parental leave provision in post-communist Romania, as well as the extent to which its legal adjustments that took place after 1990 reveal both old trends inherited from the former political regime as well as new tendencies influenced by EU norms and directives. Consequently, this article has a twofold structure. First, a brief overview of the main concepts and theoretical approaches to parental leave will allow us to proceed (...) to a proper understanding of the epistemological tools underpinning this research object. Second, this article tackles the numerous legislative changes concerning parental leave that occurred after the fall of the communist regime. Although limited to a single category of research sources, this inquiry is indispensable for analysing the extent to which childcare and the gendered division of parental responsibilities have become real political struggles within the post-communist public agenda in Romania. The young generation of the ’80s was born and entirely educated under communist ideology. And yet indoctrination failed for some of these young people, who saw the West as a symbol of a better society to aspire to. In order to escape from S.R. Romania, some of them risked their lives in the “adventure” of crossing the border illegally. The main opponents of the fugitives, the border guards, were part of the same age group. In many cases, they behaved (...) brutally toward the fugitives. Did they come to see them as traitors, or was it just the context in which this adversity manifested itself mixed with the soldiers’ fear of their superiors’ punishments? The study is part of a more extensive research regarding the phenomenon of illegal border crossing during Ceaușescu`s dictatorship. Through this study, I aim to analyse the two situations in which some of the young people of the ’80s could find themselves: opponents of the regime (when fleeing to the West was a form of protest) and involuntary “servants” of the system, such as border soldiers, respectively. Also, I focused on identifying the reasons for the conflict between the two categories of young people belonging to the same generation. (shrink)

Remembering the year of 1989 does not always seem to produce a coherent narrative about the recent history of Romania. Most likely, when asked about their own experiences or what truly happened back then, Romanians would refer to it as “the events” because there still is a certain veil of ambiguity over their shared collective memory. The author’s personal encounters with such story tellers confirm that Romanians are still torn apart between various interpretations concerning what happened during December 1989.

In the context of the Union of Greater Romania, a problem specific to the development of the Romanian society and of the re-united national state was the regulation of the status or the varied religious cults. It is well known that under the Older Romanian Kingdom, the Orthodoxy was a state religion. The other cults – Lutheran, Catholic, Mosaic, and Moslem – represented small numbers of believers and had not been regulated under the law; they were tolerated. Following the (...) Union of 1918, the Romanian State came to accommodate not just one, but several denominations. Consequently, it had to clarify its relations with the cults in the Romanian provinces of Bucovina, Basarabia, Banat, and Transylvania. These cults which had not existed in the Older Kingdom functioned according to the legislative systems they had belonged to before 1918. Thus came the necessity of establishing the unitary status for the minority cults, which, given the diversity of their religious doctrines, rituals and interests, posed new problems to be settled for the government policy. This also should be the focus of the debates surrounding the forthcoming law of the cults in Romania. (shrink)

In this paper inter-denominational cooperation is treated as part of the church-state relation because the propensity for inter-denominational cooperation is influenced by the legislative framework that regulates church-state relations. Although inter-denominational cooperation is hard to achieve, the author argues that some policy solutions are accessible to the government to encourage churches to cooperate at the level of church-based NGOs. The model is similar in some aspects to the faith-based and community initiatives developed in the United States. ABSTRACTFreethought was a transnational movement that developed particularly in the second half of the nineteenth century, spreading across Europe and other world regions and promoting new models for society. The present article proposes an investigation of the contours and developments of the freethought movement in Romania before World War I. This is an important area of research given that most analyses performed to date have considered only the Western world and not the Eastern European context.Our intention is to elucidate (...) to what extent the European models influenced this movement and to uncover their impact on the Romanian society of the time. The paper highlights the criticisms of the clerics upon freethought, showing that the development of this current in Romania as a national movement represented not simply imitation of the European models, but an adaptation of those models to Romanian realities. The Romanian freethinkers can be seen trying to develop some of the most radical ideas of those times, in connection with the European trends. (shrink)

The study uncovers the drama of Stei Baita (Romania), a former uranium mine, which experienced during the communism period, an intensive industrialization. This shaped the territorial pattern, cultural, economic and social relationships, with a tremendous impact on the quality of the environment which was sacrificed against a rapid of a so-called economic growth. Stei Baita is a classic example of legacy mine land and the authors aim is to capture and assess all important aspects of sustainable development within this (...) study-case of disadvantaged community living in a radon prone area. More specifically, authors introduce their responses to several questions: (1) What do we know about social, economic and environmental capital of the selected settlement?; (2) Is the legacy of a uranium mine the platform of debate for negotiating for sustainable development?; and (3) What is the role of ethics in the current context of Stei Baita? Within the framework of analysis, equity, seen as part of ethics, is valued both as the premise of the debate and mandatory requirement for human development that should target sustainability. Authors have not discussed truths, but positions on identified problems by investigating community members’ perceptions. Thus, peculiarities of this community are dealt within a thematic context (e.g., resources and environment, individual development, social system). Finally, ethics is valued as social construct built by negotiating interpretations of morally desirable situations and behaviors accepted in a particular society at a certain historical moment. This view is consistent with ethical relativism which denies the existence of a unique moral truth and which sets the understanding of Stei Baita context on the path of the “new ethics”. The “new ethics” depicts the world in nuances, allowing society to surpass obstacles to the progress of understanding. (shrink)

The results of our research, obtained from a survey of 50 Western managers working in Romania, show that differences exist between Western managers' ethics and those of their Romanian counterparts, especially with regard to bribery. Different backgrounds are at the basis of such divergence. Beyond the communist era and its heritage, the cultural aspect of bribery has been analyzed. Nevertheless, the results of our research suggest that culture may play a double role and the influence could come from both (...) the home environment of Western managers and their new environment. Some Western managers who adapt to the Romanian environment appear to have been already conditioned to bribery from their home environment. (shrink)

Du Bois-Reymond’s Ignorabimus could have been a game changer in the last decades of 19th century, but it wasn’t. The sound argument of the German physiologist concerning the limits of natural science, although it was indeed taken seriously and confronted by all means, was in fact so severely distorted by opponents that one could hardly recognize it in the straw men generated in the process. By scrutinizing three less known approaches dug up from 19th century Romanian literature, the present paper (...) focuses on the theoretical commitments that prevented the consciousness issue to be properly addressed. Existing scholarly work on corporate social responsibility frequently emphasizes either normative/ethical claims about social progress or instrumental/strategic claims about corporate effectiveness, yet less often acknowledges the moral conditions of those undertaking CSR within a specific cultural context. In this paper, we draw attention to the social conditions in which CSR takes place and the related ethics of the subjects that must enact it. Our approach is to document the lived experiences of practitioners in Romania, a post-communist society. Drawing from (...) fifty-three depth interviews with both corporate responsibility practitioners, and managers in non-profit organizations who together work on CSR projects, we describe their experiences of the social and organizational environment, the CSR practices that are undertaken in this context, and the intended and unintended consequences of such work. Using Bauman’s theorization of ethics, including adiaphora and moral distancing, and Borţun’s interpretation of Romanianness, we then theorize liquid CSR as an ambivalence between adiaphoric practice and the moral impulse to do good, resulting in both intended and unintended consequences. Communication about diagnosis and medical treatment for children suffering from life-threatening illnesses is complex. It is a primary step in involving underage patients and families in care and lays the foundation for obtaining parental permission and patient assent for treatment. In practice child participation in care is often difficult to obtain due to patients' different and sometimes fluctuating preferences, but also parents' protective strategies. Physicians may be susceptible to parental wishes to limit information and feel uncomfortable discussing issues related to (...) uncertainty of cure with patients. A qualitative study in Romanian paediatric oncology units was conducted to explore children's involvement from the perspectives of parents and oncologists. Interviews with participants discussed 18 patient cases. Data were transcribed and thematic analysis was used to interpret and mine patients' involvement during treatment. Different facets of patient participation were identified: restricting, widening and enhancing involvement. A fourth category, unintentional involvement, occurred for all patients due to children's observations during long-term hospitalisations and access to Internet. Uncertainty overarched parental attitudes regarding the extent to which children should be included. Physicians usually complied with parental wishes to limit involvement, but together with parents involved patients at least in a practical way. Adults' protective attitude may backfire, as adolescents' online searches often expose patients to worse-case scenarios. Further research should acknowledge the hazards of restricted diagnosis disclosure and develop clinician tools to support families in communicating with patients. This should be paralleled by physician efforts to elicit patients' needs regarding participation. (shrink)

Some of the post-socialist countries of Europe experienced after the fall of communism what some called a religious revival. Anthropologists and sociologists alike were sure that they discovered serious evidence against the case of secularization theory. What unfortunately most of them failed to observe was the particular shape and form of this religious growth and the structural changes of the religious mentalities occurred in the process of transition from a closed, ideologically monopolized society, to a pluralistic one. After more than (...) half of a century of atheistic ideologization of the public sphere, Romania remains one of the most religious countries of both Eastern and Western Europe. The thesis of this article is that this fact is due to the lack of modernization of the Romanian social system both before and during the post-socialist period. (shrink)

Relationships to time through memory or projection form a particular axis along which the post-communist space reshapes, constructs and understands its identity. Caught between a public rejection of the communist past and a need for roots in the recent past, if only for narrative reasons, and cornered by the near future in the name of transition, the postcommunist societies face a dilemma in their search for identity. The weight of this dilemma can be directly measured by the level of consensus (...) around the passing of certain ‘reparation’ laws, such as the restitution of nationalised property or ‘lustration’, however it can also be seen in other public debates. This sheds light on the difficulties that a society may experience in adopting a collectively-accepted narrative, which then forms the basis on which it constructs its identity. (shrink)
