The article analyses ethnonational conflicts in Belgium and Canada during the period 1960-1989. Using the most similar case design, it is argued that the different policy performances in Belgium and Canada can be accounted for by the institutional context in which the conflicts occurred. The institutional setup in Canada and Belgium created different modes of joint decision making. Through an analysis of three joint decision variables, namely, decision rules, preferences and default conditions, two empirical cases are scrutinized. The (...) Canadian Pension Plan in Canada and the institutional reform efforts in Belgium highlight the importance of institutional default conditions. On the basis of these empirical cases it is argued that the different conditions of joint decision making in the two states lead to a continuous production of compromises in Belgium and a genuine absence of mutual agreement in Canada. Since the emergence of Pakistan the history of Pak-Afghan relations can best be analyzed from conflict to cooperation. Some of the early problems are mainly responsible for conflict and cooperation in both countries relations. After the establishment of democratic setup in both states, different CBMs indicate positive sign in Pak-Afghan diplomatic relationship. The drawdown of US forces has created security concern for Pakistan and Afghanistan that the creation of power vacuum can push the country again into civil war like situation. (...) In such state of security Pakistan’s engagement to bring the Taliban to the negotiation table will smooth the way for a broad-based government in Afghanistan. Some of the Afghan domestic political issues also created mistrust i.e., the refugee’s problem, cross border militant’s infiltrations, drug problem and issue of the Taliban. However, the paper will highlight the measures to keep intact the reconciliation more effective and replace the mistrust by trust. How a hybrid Confucian-engendered form of governance might solve today’s political problems What might a viable political alternative to liberal democracy look like? In Against Political Equality, Tongdong Bai offers a possibility inspired by Confucian ideas. Bai argues that domestic governance influenced by Confucianism can embrace the liberal aspects of democracy along with the democratic ideas of equal opportunities and governmental accountability to the people. But Confucianism would give more political decision-making power to those with (...) the moral, practical, and intellectual capabilities of caring for the people. While most democratic thinkers still focus on strengthening equality to cure the ills of democracy, the proposed hybrid regime—made up of Confucian-inspired meritocratic characteristics combined with democratic elements and a quasi-liberal system of laws and rights—recognizes that egalitarian qualities sometimes conflict with good governance and the protection of liberties, and defends liberal aspects by restricting democratic ones. Bai applies his views to the international realm by supporting a hierarchical order based on how humane each state is toward its own and other peoples, and on the principle of international interventions whereby humane responsibilities override sovereignty. Exploring the deficiencies posed by many liberal democracies, Against Political Equality presents a novel Confucian-engendered alternative for solving today’s political problems. (shrink)

Carl Schmitt emphatically rejected intermediate formations between peace and war. Analysing Schmitt's oscillation between the domestic and the international, the article suggests that the notion of ?intermediate state? provides a vital route to the core of Schmitt's political theory. The concept emerges in Schmitt's analysis of the Rhineland crisis, recurs in his vehement critique of Weimar pluralism, and, finally, reappears in his theory of modern war from the Third Reich to the Cold War. ?Intermediate state? has both qualitative (...) and temporal aspects; it connotes not only categorical confusion and impurity but also instability and limited duration. Despite his criticism, Schmitt himself utilised the ambiguity, polysemy, and normative ambivalence of the intermediate state in his argumentation, finally giving it an open theological reinterpretation in his later work. Schmitt's theory of political conflict, consequently, is problematically bound to the vague intermediate state of perpetual conflict that he sought to avoid, and to the metaphorical aspects of the notion of battle that he explicitly rejected. There has been much recent debate about women's rights and their relation to human rights. Debates about domestic violence in Vanuatu are situated in this global frame but also in a regional and historical context dominated by the relation between kastom (tradition) and Christianity. This article depicts the dynamics of a conference on Violence and the Family in Vanuatu held in Port Vila in 1994, in terms of the competing claims of universal human rights and cultural relativism. The allegedly (...) western character of human rights which focus on the individual and civil and political rights is often contrasted with the non-western stress on collectivities and the rights to economic development and self-determination. These sorts of ideological oppositions in international politics reverberate in domestic politics as well, and especially in those which situate women and men as subjects in conflict, as they are in many domestic disputes. This paper analyses the international media coverage of the dispute surrounding the pardons the Polish President granted in 2015 to two politicians, arrested almost a decade later. However political this case has become, it is underlain by a specific interpretive problem concerning the presidential pardon power under the Constitution, particularly whether it can be exercised before a final conviction (the so-called ‘individual abolition’). This question has long been controversial in scholarship and, in recent years, has been addressed by top (...) Polish courts, passing conflicting rulings. Attempting to probe into the intersection of journalism, politics, law and linguistics, this paper evaluates the issue’s portrayal in 37 articles published on major news websites around the time of the arrest. It is argued that when reporting local legal news, international media engage in a dual translation, rendering legal communications in one language into media communications in another. While ‘lossless’ transfer cannot be expected, this research shows that certain limits should not be crossed to maintain journalistic standards. In particular, most articles entirely omit the scholarship and rulings confirming the validity of the pardons. Consequently, readers are not given an opportunity to become aware of all relevant facts and perhaps seek further information. On the positive side, it has been found that simple and accessible language does not necessarily mean material distortions in the coverage of legal issues. The research thus suggests that reporting domestic legal news for international audiences requires understanding the source context, conscious language use and a reliable selection of information. Our century has witnessed violence on an unprecedented scale, in wars that have torn deep into the fabric of national and international life. And as we can see in the recent strife in Bosnia, genocide in Rwanda, and the ongoing struggle to control nuclear weaponry, ancient enmities continue to threaten the lives of masses of human beings. As never before, the question is urgent and practical: How can nations--or ethnic groups, or races--after long, bitter struggles, learn to live side by (...) side in peace? In An Ethic for Enemies, Donald W. Shriver, Jr., President Emeritus of Union Theological Seminary, argues that the solution lies in our capacity to forgive. Taking forgiveness out of its traditional exclusive association with personal religion and morality, Shriver urges us to recognize its importance in the secular political arena. The heart of the book examines three powerful and moving cases from recent American history--our postwar dealings with Germany, with Japan, and our continuing domestic problem with race relations--cases in which acts of forgiveness have had important political consequences. Shriver traces how postwar Germany, in its struggle to break with its political past, progressed from denial of a Nazi past, to a formal acknowledgement of the crimes of Nazi Germany, to providing material compensation for survivors of the Holocaust. He also examines the efforts of Japan and the United States, over time and across boundaries of race and culture, to forgive the wrongs committed by both peoples during the Pacific War. And finally he offers a fascinating discussion of the role of forgiveness in the American civil rights movement. He shows, for instance, that even Malcolm X recognized the need to move from contempt for the integrationist ideal to a more conciliatory, repentant stance toward Civil Rights leaders. Malcolm came to see that only through forgiveness could the separate voices of the African-American movement work together to achieve their goals. If mutual forgiveness was a radical thought in 1964, Shriver reminds us that it has yet to be realized in 1994. "We are a long way from ceasing to hold the sins of the ancestors against their living children," he writes. The menace of conflicts and natural disasters in different states of the world had spiralled into a global phenomenon of Internally Displaced Persons. These are groups of humans who had helplessly drifted away from their natural and ancestral home due to conflicts and disasters but had not crossed international boundaries into another country. They merely take solace by the protection offered by the spirit and letters of relevant international laws which have domesticated by member states. This paper seeks (...) to answer the question regarding the extent to which the IDPs have become a menace in Nigeria. The paper reveals that many governments’ actions are the primary and the root cause of the IDPs while others are recipient of the domino effect. The paper relies on a panel data elicited from thirteen out of the thirty six states in Nigeria. The paper reveals the need for urgent measures by government to douse the upsurge in the number of IDPs. The political settlement analysis was used to proffer a better way of culminating the crises. Recommendations are directed to the individuals, civil societies and the government at all levels. (shrink)

This paper argues that most conceptualizations of citizenship limit the purview of the discourse to static categories. ‘Citizenship’ is commonly seen as an ideal type, presuming a largely legal relationship between an inidividual and a single nation-state – more precisely only one type of nation-state, the advanced capitalist post-war model. Alternatively, we suggest a re-conceptualization of citizenship as a negotiated relationship, one which is subject therefore to change, and acted upon collectively within social, political and economic relations of conflict. This dynamic process of negotiation takes place within a context which is shaped by gendered, racial and class structures and ideologies; it also involves international hierarchies among states. Citizenship is therefore negotiated on global as well as national levels. This conceptualization is demonstrated by way of identifying one particular set of experiences of negotiated citizenship, involving foreign domestic workers in Canada. As non-citizens originating from Third World conditions, this is a case involving women of colour workers, highly prone to abusive conditions, and under the direction of employers who are more affluent First World citizens and predominantly white women. Original survey data based on interviews with Caribbean and Filipino domestic workers in Canada are used to demonstrate the varied, creative and effective strategies of two distinctive groups of non-citizens as they attempt to negotiate citizenship rights in restrictive national and international conditions. Flagging labor governance in far-flung supply networks has prompted greater scrutiny of instrumental CSR and calls for models that are tethered more closely to accountability, constraint, and oversight. Political CSR is an apt response, but this paper seeks to buttress its deliberative moorings by arguing that the agonist notion of ‘domesticated conflict’ provides a necessary foundation for substantive deliberation. Because deliberation is more viable and effective when coupled with some means of coercion, a concept of CSR solely premised on (...) reciprocal corporate-stakeholder engagement is pre-mature; efforts should first be directed toward the antecedents of reciprocity and how it is to be achieved, and only then does deliberation become a reliably substantive exercise. The resulting account of agonistic CSR is generated through agonistic principles of realism, pro-action, contestation, and countervailence, and illustrated by the Bangladesh Accord. (shrink)

The people of Myanmar were struck by three major human rights disasters during the country's period of democratization from 2003 to 2012: the 2007 Saffron Revolution, the aftermath of Cyclone Nargis in 2008, and the 2012 Rakhine riots, which would evolve into the ongoing Rohingya crisis. These events saw Myanmar's government categorically labeled as an offender of human rights, and three powerful Southeast Asian member states-Indonesia, Thailand, and Malaysia-responded to the violations in very different ways. In each case, their responses (...) to the crises were explicitly shaped by norm conflict, which may be understood as a tension between international and domestic norms. Their reactions were compelled by a need to address conflicting domestic and international expectations for norm compliance regarding human rights protection and non-interference in internal affairs. In Norms in Conflict: Southeast Asia's Response to Human Rights Violations in Myanmar, Anchalee Rüland makes sense of state action that occurs when a governing body is faced with a circumstance that is at once in line with and contrary to its own governing policies. She defines five different types of response strategies to situations of norm conflict and examines the enabling factors that lead to each strategy. Domestic norms are known to evolve as a country's values change over time yet Rüland argues that the old and new norms may also coexist; knowledge of the underlying political context is crucial for those seeking a solid understanding of state behavior. Norms in Conflict challenges the conventional understanding of the logic of consequences in determining state behavior, advancing constructivist theory and establishing a provocative new conversation in international relations discourse. This paper examines the globalization process of German core export metalworking industries, to show how the globalization of national corporations has different effects on domestic economies. Contrary to the prevalent views on the globalization of production, this paper holds that the outcomes and patterns of globalization vary, due mainly to the politics of the main actors inside and outside corporations. This paper compares Germany’s negotiated globalization with U.S. employer unilateralism. In most U.S. corporations, employers decide how to globalize based (...) on the short-term perspective of shareholder value. By contrast, in Germany, main industrial actors—including employers, works councils, and trade unions—collectively negotiate how to globalize. In this conflict-laden process of collective negotiation, German actors have created a political compromise that combines the upgrading of domestic production with globalizing overseas, whereas Americans have failed to do so. Furthermore, this paper emphasizes that divergent patterns of globalization are not predetermined by national institutions. To the contrary, the successful outcomes in German globalization come mainly from actors’ proactive readjustments in their traditional model of industrial relations, creating new practices, such as active union involvement in company-level bargaining, and the democratic bottom-up process instead of the traditional top-down process of negotiation. The boundaries between medicine, religion, nursing and domestic service were fluid in mid‐nineteenth‐century England. The traditional religious understanding of illness conflicted with the newer understanding of anatomically based disease, the Anglican sisters were drawing a line between professional nursing and the traditional role of nurses as domestic servants who looked after sick people as one of their many duties, and doctors were looking for more knowledgeable nurses who could carry out their orders competently. This prosopographical study of the (...) over 200 women who served as government nurses during the Crimean War 1854–56 describes the status of nursing and provides a picture of the religious and social structure of Britain in the 1850s. It also illustrates how religious, political and social factors affected the development of the new nursing. The Crimean War nurses can be divided into four major groups: volunteer secular ladies, Roman Catholic nuns, Anglican sisters and working‐class hospital nurses. Of these four groups I conclude that it was the experienced working‐class nurses who had the greatest influence on the organization of the new nursing. (shrink)

Over the years, there have been increasing intersections between religious claims and nationalism and their power to frame and govern world politics. When Politics Are Sacralized interdisciplinarily and comparatively examines the fusion between religious claims and nationalism and studies its political manifestations. State and world politics, when determined or framed by nationalism fused with religious claims, can provoke protracted conflict, infuse explicit religious beliefs into politics, and legitimize violence against racialized groups. A series of Enlightenment commentators (Montesquieu, Rousseau, Hume, Jefferson) and their progeny (...) have hailed Fénelon as a political subversive who boldly attacked the injustices of the reign of Louis XIV and who prepared the arrival of an egalitarian society with socialist and pacifist traits. Hanley, however, argues that Fénelon actually defended a more moderate and realistic model of political society than his Enlightenment exegetes have suggested. Like earlier commentators, Hanley attempts to prove his argument primarily through an analysis of Telemachus, the pedagogical novel Fénelon had composed for Louis, duc de Bourgogne, the "petit Dauphin" and grandson of Louis XIV, when Fénelon served as his tutor.Three strong chapters demonstrate Hanley's thesis concerning Fénelon's moderate politics and philosophy. Hanley argues that Fénelon's philosophy of education rests on a distinction between true and false glory. True glory resides in virtue and a humble recognition of divine glory, while false glory is the self-centered glorification of the human agent, which easily deteriorates into vanity. Rather than simply condemn self-interest, in his treatment of the education of the prince Fénelon argues that self-interest must be gradually transformed into a broader interest for the good of one's subjects and a deeper recognition of the glory of God. Earning the praise of his Enlightenment acolytes and later feminist commentators, Fénelon defends a solid education for women, but he clearly wants this education to prepare women for their domestic role as wives and mothers; his celebrated treatise and letters on the education of women are not an exercise in gender equality.The economic theory of Fénelon has often been interpreted as a type of utopian socialism. This is largely based on the central place taken by Bétique in the Telemachus. In this mythical land, the happy citizens practice a communist economics; private property is foreign to them. All their basic needs are provided for through communal cooperation. Luxury is also foreign to them; precious metals like gold and silver are used in practical construction as if they were pieces of iron. But Hanley argues that the prosocialist exegetes ignore the varied economies presented in the passages concerning Egypt, Crete, and Tyre. Bétique does not stand alone as an economic ideal. When Fénelon details how the economy of contemporary France should be reformed, it is far from simple socialism. The state has a strong initial role in the state's economic reform, but it works in tandem with private initiatives that will gradually become the stronger partner. "Fénelon differs from later socialists in insisting that the use of state power is not an end in itself, but necessary only to establish the conditions whereby a free economic system can emerge and flourish—at which point direct intervention of the state into economic affairs will diminish, and a free (though hardly unbridled) pursuit of self-interest will be encouraged" (81).Hanley also attacks the common argument that Fénelon is a pacifist who excoriates all recourse to war. Fénelon does indeed condemn war in the most graphic terms. The purpose of this contribution is to analyse climate change litigation in an innovative way, considering it as an example of “privatisation” of international law, and unravelling the “ecological” side of conflict-of-laws climate change litigation. The paper will first explain the concept of privatisation of law as applied to international law and what it means in the context of climate change litigation, before moving to a landmark case, whose appeal is still pending in front of a domestic court in (...) Europe: Milieudefensie et al. v. Royal Dutch Shell plc. The focus of the analysis of the cases will be limited to the use of the conflict-of-laws mechanism present in the Rome II Regulation, namely Article 7. The paper critically assesses the principle of ubiquity included in this provision, by looking at the concept of “event giving rise to the damage” as applied in CO2 reduction claims in the existing legal scholarship and using an underexplored ecofeminist perspective. Inspired by the work “A relational feminist approach to conflict of laws” by Roxana Banu (2017), the paper argues for a relational understanding of the concept of “event” and goes further to consider in an ecofeminist perspective the environment as composed of human, non-human beings and natural objects, and of their relations with each other. The article is meant to be a starting point for further research, which for the first time applies ecofeminist theories to private international law. (shrink)

Radical “Westernizing” transformations in extra-European countries, from Peter I’s Russia to Meiji Japan, are traditionally presented as a response to pressures from the more militarily and technologically advanced European powers. This corresponds to the general tendency to view war as the driving force behind early modern state-building. However, the question remains: how exactly did such transformations happen, and what explains their timing? Why did some countries, such as Russia, embark on radical institutional restructuring that threatened large sections of the traditional (...) military classes in the absence of any obvious existential threat, while in others even clear and immediate dangers failed to ignite a full-scale “Westernization”? This article seeks to complicate the “bellicist” narrative of “Westernizing” transformations and to generalize about the role of elite conflict in propelling “self-strengthening” reforms. It argues that “Westernizations” in extra-European polities were enabled by breakdown of domestic political balance and driven by “challengers” emerging in the course of these conflicts, as they strove to maximize their power. Factional struggles accompanying “Westernizations” are interpreted here not as a conservative reaction against reforms, but as a process that preceded and enabled institutional restructuring. This article revisits Dolf Sternberger’s 1960 theory, which, in explicit opposition to Carl Schmitt’s friend/enemy thesis, found the essence of politics and the political in peace. The essay contextualizes Sternberger’s propositions by relating them to his immediate post-1945 considerations – such as normalizing domestic politics, jettisoning authoritarianism, and laying the conceptual foundations for the nascent political science – and thereby reconstructs the questions his theory of the political sought to answer. The analysis shows in detail how (...) the key elements of Sternberger’s 1960 theory derived from the late-1940s: rather than reflecting an already normalized political situation or proposing naïve pacifism, Sternberger’s text took political conflicts seriously and provided an outline of a desired but only prospective political peace amidst a crisis. Despite substantial polarity, Sternberger’s view is largely compatible with Schmitt’s theory once we remove context-induced polemics and grave misinterpretations – and carries potential for systematic political theorizing. The article examines three dimensions of the interpretation of both historical and modern war events as they are perceived and undretstood at the level of official propaganda. First, it indicates that consequences of such propaganda are various manifestations of violence, and particular in many cases the emergence of repressive regimes and wars. Second, the article raises the issue of “politics of reconciliation”, the interpretive basis of which is a compromise reading of historical events by participants of conflicts or hostilities. (...) Since propaganda can affect not only interstate relations, but, above all, serve the need for domestic policy formation, the author of the article also pays attention to the interpretation of historical events within a country. In this context, the propagandists explore the idea of “positive reading of one’s own history”, i.e. they are focusing attention on those events that had a positive impact on the life of society. The other leading idea, which is used by propaganda to maintain unity in the state, is the idea of “policy of national unity.” The article concludes about the relevance of study of the phenomenon of propaganda, in particular due to new opportunities developed by modern social media. The author emphasizes the ability of propagandistic interpretations of events to disorient and engage citizens that will largely efect on which political forces a person will support in electoral races. Therefore, there is a need to develop a clear strategy for interpreting the events of history, filtering the mass media space from various manifestations of information distortion. And after all, the process of state formation involves, among other things, the implementation of a number of measures aimed at establishing national unity, i.e. «policy of national unity». (shrink)

Domestic politics is naturally important in ethnic policies. However, in spite of their potency, domestic political factors are not always the most decisive. International organizations have influenced the Latvian and Estonian governments, and at times the Slovak and Romanian governments. However, the ability of different organizational strategies to overcome domestic opposition and thus bring about their desired policy varies widely. In most cases, actors need to use conditionality and aim it at the appropriate decision makers. In (...) spite of their widespread use, efforts that rely solely on persuasion and diplomacy tend only to work when the domestic opposition is initially quite low or when ethnic minorities themselves have some bargaining power in the government.The key policy implication is that domestic factors do not make failure, or success for that matter, a foregone conclusion. For example, ethnic minority representation within the government coalition is not in itself a guarantee of passage of the policy preferences of the minorities. Conversely, the presence of authoritarian-style leadership does not automatically mean a rejection ethnic minority accommodation either, if organizations present their suggestions so that such leaders view it as being in their greater interests to maintain power. Conditionality that targets incentives to fit goals of the leadership can work. External actors are thus not justified in backing off from action based purely on a domestic analysis. (shrink)

This dissertation offers a theoretical model to ground language rights, rooted in liberalism and the politics of difference. Many existing arguments for language rights apply what Raz has called an "interest theory of rights" to the issue of language rights, which implies that an interest important enough is grounds to hold others duty-bound. Different claims of interest regarding a particular language, such one's mother tongue, are assessed in light of liberal principles of justice and the politics of difference. A participation-based (...) conception of linguistic justice, which stems from an interest in participating with others in public life in a particular language, is offered. The dissertation also discusses why this approach is preferable to the major contending positions, such as the emerging theory of linguistic human rights, which are unable to respond to some of the most important forms of language conflict, and/or rest on controversial anthropological or metaphysical views. Finally, it discusses how this conception of linguistic rights can provide guidelines for various domestic issues, such as the redrawing of internal boundaries and the distribution of burdens and benefits regarding language in the areas of education, public services and government employment, and democratic processes. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering a (...) wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. She then suggests that the right question today may be breaking with the philosophy of human rights concerned with the defense of human beings against the hazards of arbitrary politics or the instrumental use of religion, in favour of a fair philosophy of humankind, a new humanism. This would consist in recognizing a common loyalty of all towards one interhuman, not only interstate community, to protect it from both the autonomy demanded by individuals and the instrumental use of minorities. -/- Considering the fact of diversity, so important today in terms of both politics and religion, Abdelhai Azarkan looks at the conditions under which tolerance could obtain the double status of right and duty. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. What are the consequences of globalization for the structure of political conflicts in Western Europe? How are political conflicts organized and articulated in the twenty-first century? And how does the transformation of territorial boundaries affect the scope and content of political conflicts? This book sets out to answer these questions by analyzing the results of a study of national and European electoral campaigns, protest events and public debates in six West European countries. In the First Action of the Verrines Cicero highlights the issue of judicial corruption, which appears to be leading to the passage of legislation ending the senatorial monopoly on composition of the juries in the quaestio de repetundis. The work might theoretically, therefore, furnish an important study of how Cicero publicly positioned himself on a key political issue at a crucial point in his career. Historians, however, often dismiss the political impact of the work, arguing that jury reform (...) was essentially a fait accompli before the trial began. Rhetoricians likewise tend to understate its political importance, both because of its status as a substitute for a longer and fully elaborated oration and because of a pronounced tendency in recent scholarship to subordinate political comment in the judicial speeches to the immediate practical goals of legal advocacy. Cicero's prosecution of Verres, however, involved an unprecedented move in the orator's career. Through the trial he injected himself forcefully, and for the first time, into a contemporary political debate and thereby created for himself a new space from which to operate within the political landscape. This work offers a timely philosophical analysis of interrelated normative questions concerning immigration and citizenship in relation to the global context of multiple nation states. In it, philosophers and scholars from the social sciences address both fundamental questions in moral and political philosophy as well as specific issues concerning policy. Topics covered in this volume include: the concept and the role of citizenship, the equal rights and representation of citizens, general moral frameworks for addressing immigration issues, the duty to (...) obey immigration law, the use of ethnic, cultural, or linguistic criteria for selective immigration, domestic violence as grounds for political asylum, and our duty to refugees in general. The urgency of the need to discuss these matters is clear. Several humanitarian crises involving human migration across national boundaries stemming from war, economic devastations, gang violence, and violence in ethnic or religious conflicts have unfolded. Political debates concerning immigration and immigrant communities are continuing in many countries, especially during election years. While there have always been migrating human beings, they raise distinctive issues in the modern era because of the political context under which the migrations take place, namely, that of a system of sovereign nation states with rights to control their borders and determine their memberships. In this paper the authors deal with the story of Saman Abbas, an 18-year-old girl of Pakistani origin, who disappeared in Italy and was killed by her family after she refused an arranged marriage. The case raised a public debate between right-wing parties, who accused the left-wing parties of being culpably blind to the danger of Islam and too tolerant towards illiberal cultures, and left-wing politicians who responded equating Saman’s murder with the domestic killing of Italian women. We argue (...) that neither position does justice to Saman’s story. We hold that Saman’s case is an example of intersectional oppression where gender oppression is intertwined with the immigrant’s oppression in a Western democracy. Thus, we counter the dilemma posed by Susan Okin, namely that there is an inherent conflict between the rights of minority cultures and the rights of women. In order to rebut Okin’s position, we rehearse multicultural positions concerning the protection of minority cultures, on the one side, and feminist positions regarding the promotion of autonomous choice, on the other. Our conclusion is that (a) multiculturalism cannot be identified with cultural rights, and (b) that what are autonomous choices and what are, instead, adaptive is difficult to ascertain and, especially, difficult to apply in politics. Structural oppression is instead the key normative notion for addressing equality among genders and among citizens at large. The intersectional oppression suffered by women like Saman cannot be addressed by a restriction of toleration for immigrant cultures or simply by security measures. To prevent more cases like Saman’s in the future, the immigrant oppression should be taken seriously as well. In the context of fairer terms of inclusion, conditions of reciprocal trust between minority and majority may develop and the deconstruction of the patriarchal view of family can start. (shrink)

In this article, I show that women are depicted in the early Confucian texts not primarily as undertaking household duties or nurturing children but rather as partaking in rituals of mourning and ancestor worship. To make the argument, I analyze, besides the more philosophical texts like the Analects and the Mencius, texts known as the “Five Classics,” which describe women in their social roles in much more detail than the former. What women’s participation in rituals reveals, I contend, is that (...) the domestic-political distinction does little to illuminate the philosophical vision offered by the early Confucian texts. Relatedly, while women’s involvement in communal religious rituals has also been noted about early Greece, the political import of such participation is even more pronounced in the Confucian case. Specifically, I show that, by embodying intergenerational continuity, the mourning and ancestor rituals that women partake in are foundational to the Confucian state. (shrink)

This article offers an institutional explanation for the conflicting trends in income inequality both across the Eurozone and within its member states. It argues that the euro’s introduction created different economic policy incentives for peripheral and core members. First, the euro’s design was a political choice skewed toward deflationary adjustment policies in hard times, leading to falling incomes and employment in the periphery. Second, the institutional incentives of the Eurozone are the opposite for export-driven coordinated market economies and demand-led (...) mixed market economies during booms and downturns, respectively. During the euro crisis, the Eurozone’s Northern countries gained at the expense of the Southern ones, while at the same time seeing lower domestic inequality compared to increased inequality in the periphery. This diverging pattern of European inequality was exacerbated by EU economic policy drift, the lack of any real national democratic choice in the periphery, and the growing importance of organized financial interests in Brussels. A conflict emerges when an actor is disposed to impose his/her views against the resistance of others. Conflicts are more problematic than moralists realize because they emerge unilaterally, are potentially violent, impermeable to content-based reason, and unavoidable. Order is then defined as an institutional framework that provides binding collective decisions. Order is deemed necessary because individuals need to cooperate to survive, (...) but groups cannot spontaneously secure collective decisions and are prone to conflicts. Particularly, the fact that potentially violent conflicts emerge unilaterally means that order requires coercion. I conclude that mischaracterizing conflict and order leads to undesirable normative principles, and that this criticism can be leveraged not only against Rawlsian liberals who moralize conflicts away, but also against some agonists who underestimate the need for order and some communitarians who underplay both circumstances. Political disputes over toleration are endemic, while toleration as a political value seems opposed to those of civic equality, neutrality and sometimes democracy. Toleration in Political Conflict sets out to understand toleration as both politically awkward and indispensable. The book exposes the incoherence of Rawlsian reasonable pluralist justifications of toleration, and shows that toleration cannot be fully reconciled with liberal political values. While raison d'état concerns very often overshadow debates over toleration, these debates – for example (...) about terrorism – need not be framed as a conflict between toleration and security. Framing them in this way tends to obscure objectionable behaviour by tolerators themselves, and their reliance on asymmetric power. Glen Newey concludes by sketching a picture of politics as dependent on free speech which, he argues, is entailed by the demands of free association. The September 2006 military coup against the Thaksin government in Thailand has had a profound impact on Thai politics. It has arrested the process of democratic consolidation that was set in motion in the country in the 1990s. Although many of Thaksin's policies lacked the spirit of democratic governance, he was democratically elected and was ousted from power unconstitutionally. The entire tenure of Thaksin has brought to the fore two deep cleavages in Thailand. The first of these is the deep (...) divide between the rural and urban electoral constituencies. The former provided a major vote bank with little bearing on the dispersion of power and resources that was effectively dominated by the latter. Thaksin and his populist policies effectively undermined the urban electorate and strengthened the rural constituency. The second and perhaps structurally more significant tension is that which has developed between the new business elite and the old establishment elite that comprise the monarchy, military, and the bureaucracy. This old elite has been at the forefront of displacing Thaksin through its fear of loss of control over the domestic political process. The drawn out confrontation that has spawned two social movements has significantly raised the country's political temperature and there is the real potential for the situation to deteriorate into violence. Despite these changes, a number of continuities unique to the Thai political situation continue to obtain as well. (shrink)

Indeed, Americans, and not a few non-Americans, have been greatly stirred--and divided--by the opinions of the Supreme Court, especially in the area of race relations, where the Court has tried to revolutionize American society. But these stirring decisions are aberrations, says Cass R. Sunstein, and perhaps thankfully so. In Legal Reasoning and Political (...) Conflict, Sunstein, one of America's best known commentators on our legal system, offers a bold, new thesis about how the law should work in America, arguing that the courts best enable people to live together, despite their diversity, by resolving particular cases without taking sides in broader, more abstract conflicts. In November 1989, the Berlin Wall, the symbol of the Cold War between the West and the East, came tumbling down. In December 1991, a superpower, the Soviet Union, ceased to exist. In the face of such dazzling and monumental change in the global situation, an American "Kremlinologist" acknowledged, bitterly: "We were wrong; we were all wrong." Indeed, it was perhaps the greatest irony of all.

The paper is focused on ideological and political conflicts about popular music in Serbia, as a good example of wrong and confused searching for identity. Basic conflict that author is analyzing is about oriental elements and the question if they are legitimate parts of Serbian musical heritage or not. Author is making an analysis of three periods in twentieth century, in which absolutely the same arguments were used, and he's paying special attention to contemporary conflicts, trying to (...) explain why all of the theories are ideologically based. Author is insisting on role market played in development and modernization of popular music in Serbia. The article is ending with some recommendations for better understanding of cultural identity in Serbia, and for recognizing popular music as specific field of interest and research. Zapravo, sukob o kome je rec, sve vreme se vodi oko toga da li su takozvani orijentalni elementi legitiman deo srpske muzike ili ne. Autor se fokusira na tri perioda dvadesetog veka kada su se potezali potpuno isti argumenti, a narocitu paznju posvecuje aktuelnim sukobima i izlaze zasto su sve tri prisutne pozicije na sceni ideoloski zasnovane. Posebna paznja posvecena je uticaju trzista na razvoj i modernizaciju popularne muzike. Clanak se zavrsava preporukama za jedno bolje postavljeno razumevanje sopstvenog kulturnog identiteta. What is the relation of politics to theory? Theories make political claims, theorists make political critiques, and academics use theory in the pursuit of institutional ends: theory is not only about politics but is itself a political practice.

In Toleranz im Konflikt and in other works the German philosopher Rainer Forst presents an intricate interpretation of tolerance as a moral-political virtue. His aim is to resolve many of the well-known paradoxes by distinguishing different components of tolerance and distinguishing the reasons that we may have for objecting, accepting or rejecting certain practices and views. Good ethical reasons for objecting to certain practices and views do not morally justify their suppression by legal means and state power. In this (...) way Forst connects his inclusive analysis of tolerance, with both his account of the contexts of justification and his defense of what he calls the moral right to justification. In his critical discussion Tim Heysse sounds the political implications of this analysis of tolerance. He criticizes its exclusive focus on political and legal power and its corresponding neglect of social power. However, he also calls attention to the fact that Forst’s analysis has the merit of revealing tolerance as a potential source of political conflict in society. (shrink)
