Language has a rich typology of inferential types. It was recently shown that subjects are able to divide the informational content of new visual stimuli among the various slots of the inferential typology: when gestures or visual animations are used in lieu of specific words in a sentence, they can trigger the very same inferential types as language alone (Tieu et al., 2019 ). How general are the relevant triggering algorithms? We show that they extend to the auditory modality and (...) to music cognition. We tested whether pro-speech musical gestures, i.e. musical excerpts that replace words in sentences, can give rise to the same inferences. We show that it is possible to replicate the same typology of inferences using pro-speech music. Minimal and complex musical excerpts can behave just like language, gestures, and visual animations with respect to the logical behavior of their content when embedded in sentences. Specifically, we found that pro-speech music can generate scalar implicatures, presuppositions, supplements, and homogeneity inferences. (shrink)

A key feature of unregulated mHealth research is the diversity of participants in this space. Applying an approach drawn from user experience design, we describe a set of archetypal unregulated mHealth researcher “personas,” which range from individuals who seek empowerment or have philanthropic objectives to those who are primarily motivated by financial gain or have misanthropic objectives. These descriptions are useful for evaluating policies applicable to mHealth to understand how they will impact various stakeholders.

In this work I argue that Descartes was not a trialist by showing that the main tenets of trialist interpretations of Descartes's theory of substance are either not supported by the text or are not sufficient for establishing the trialist interpretation.

The data science era is characterized by data-driven automated decision systems (ADS) enabling, through data analytics and machine learning, automated decisions in many contexts, deeply impacting our lives. As such, their downsides and potential risks are becoming more and more evident: technical solutions, alone, are not sufficient and an interdisciplinary approach is needed. Consequently, ADS should evolve into data-informed ADS, which take humans in the loop in all the data processing steps. Data-informed ADS should deal with data responsibly, guaranteeing nondiscrimination (...) with respect to protected groups of individuals. Nondiscrimination can be characterized in terms of different types of properties, like fairness and diversity. While fairness, i.e., absence of bias against minorities, has been widely investigated in machine learning, only more recently this issue has been tackled by considering all the steps of data processing pipelines at the basis of ADS, from data acquisition to analysis. Additionally, fairness is just one point of view of nondiscrimination to be considered for guaranteeing equity: other issues, like diversity, are raising interest from the scientific community due to their relevance in society. This paper aims at critically surveying how nondiscrimination has been investigated in the context of complex data science pipelines at the basis of data-informed ADS, by focusing on the specific data processing tasks for which nondiscrimination solutions have been proposed. Insurance coverage of abortion varies widely across the United States and is an extensively debated issue. Medicaid coverage of abortion is particularly relevant because the majority of abortion patients are poor or low‐income and are thus often covered by Medicaid. Since the Hyde Amendment was first passed in 1976, federal Medicaid funds have been banned from covering the costs of elective abortion. Although states are allowed to use their own funds to cover abortions for their Medicaid recipients, only 17 states (...) currently do so. Of these 17 states, only five cover abortion costs voluntarily; the others do so pursuant to court order. The medical literature includes few ethical analyses of the Hyde Amendment’s ban on Medicaid funding of elective abortions. To fill this gap, we perform an ethical analysis of federal policy to fund elective abortions using a consequentialist approach focused on consequences for pregnant women and their children. The speed and scale of the COVID‐19 pandemic has highlighted the limits of current health systems and the potential promise of non‐establishment research such as “DIY” research. We consider one example of how DIY research is responding to the pandemic, discuss the challenges faced by DIY research more generally, and suggest that a “trust architecture” should be developed now to contribute to successful future DIY efforts.

Norms conferring public or private powers, i.e., the competence to issue other norms, play a very important rôle in law. But there is no agreement among legal philosophers about the nature of such norms. There are two main groups of theories, those that regard them as a kind of norms of conduct (either commands or permissions) and those that regard them as non-reducible to other types of norms. I try to show that reductionist theories are not quite acceptable; neither the (...) command-variety (Kelsen, Alf Ross inOn Law and Justice), nor the permission-variety (von Wright, Kanger, Lindahl) provide a satisfactory account of competence norms.Among the authors who maintain that competence norms are different from (and hence not reducible to) norms of conduct are Hart, Ross inDirectives and Norms, and Searle. Ross and Searle distinguish between regulative and constitutive rules as two radically different kinds of rules and classify competence norms among constitutive rules. This distinction runs parallel to von Wright's distinction between rules that are prescriptions and determinative rules. While the first regulate actions (by commanding, prohibiting, or permitting them), determinative rules define certain concepts. To view competence norms as (partial) definitions of certain legal concepts (like those of legislator, judge, etc.) seems to open interesting perspectives and to shed light on at least one aspect of these elusive norms. This paper reports a psychological study of human categorization that looked at the procedures used by expert scientists when dealing with puzzling items. Five professional botanists were asked to specify a category from a set of positive and negative instances. The target category in the study was defined by a feature that was unusual, hence situations of uncertainty and puzzlement were generated. Subjects were asked to think aloud while solving the tasks, and their verbal reports were analyzed. A number of (...) problem solving strategies were identified, and subsequently integrated in a model of knowledge‐guided inductive categorization. Our model proposes that expert knowledge influences the subjects' reasoning in more complex ways than suggested by earlier investigations of scientific reasoning. As in previous studies, domain knowledge influenced our subjects' hypothesis generation and testing; but, additionally, it played a central role when subjects revised their hypotheses. (shrink)

Some important ideas in Kelsen's Pure Theory of Law can be traced back to Kantian tradition, which has been very influential in Kelsen's thought, particularly in his early period. Among them we find the distinction between two radically different worlds (the world of facts and the world of norms), the normativity of legal science and the idea of validity as a binding force, based on the famous doctrine of the basic norm. These tenets and, especially, the use of a normative (...) concept of validity prove to be incompatible with Kelsen's positivistic programme of a value‐free legal science. The science of law cannot state that legal norms are obligatory or binding without trespassing the limits of Kelsen's ideal of a legal science; on the other hand, it is possible to define the concept of a legal system without resorting to the basic norm. So, if Kelsen is to be regarded as a consequent positivist, the Kantian ingredients of his theory must be rejected and the descriptive concept of validity as membership must be substituted for the normative notion of validity as a binding force. Massad al presunto orientalismo y etnocentrismo de ciertas corrientes reivindicativas de los (...) derechos LGTB desde el punto de la especificidad cultural del mundo árabe y analizaremos la polémica suscitada por dichas críticas entre distintos interlocutores. En este trabajo se discuten dos modelos opuestos de construcción de la identidad a partir de la contraposición que hace el filósofo Bernard Williams de las figuras de Rousseau y el sobrino de Rameau de Diderot. Frente a la concepción representacional de la identidad como copia o proyección de un ser interior, se propone una noción performativa de la personalidad basada en la espontaneidad y la multiplicidad como fuentes del sujeto contemporáneo. En el trasfondo de esta reflexión se encuentra la (...) hipótesis de que ambos métodos de producción ética de la identidad personal responden a concepciones estéticas profundamente enraizadas, una más próxima al modelo pictórico de copia de un original y la otra, teatral, basada en la importancia de la interpretación en los procesos de creación. Conventional quantitative methods for the measurement of organizational legitimacy consider mainly three sources that make judgments about organizations visible: news media, accreditation bodies, and surveys. Over the last decade, however, social media have enabled ordinary citizens to bypass the gatekeeping function of these institutional evaluators and autonomously make individual judgments public. This inclusion of voices beyond functional and formally organized stakeholder groups potentially pluralizes the ongoing discussions about organizations. The individual judgments in blogs, tweets, and Facebook posts give indication about (...) the broader fit between an organization’s perceived behavior and heterogeneous social norms and therefore constitute an indicator of organizational legitimacy that can be accessed and measured. We propose the use of social media data and sentiment analysis to study the affect-based responses to organizational actions by citizens. We critically discuss and compare the method with existing quantitative methods for legitimacy measurement and apply them to a recent case in the banking industry. We discuss the value of the method for studying the process of legitimacy construction as the expression and negotiation of normative judgments about organizations by various evaluators. (shrink)

This paper criticizes Alexy's argument on the necessary connection between law and morality. First of all, the author discusses some aspects of the notion of the claim to correctness. Basically, it is highly doubtful that all legal authorities share the same idea of moral correctness. Secondly, the author argues that the claim to correctness is not a defining characteristic of the concepts of “legal norm” and “legal system”. Hence, the thesis of a necessary connection between law and morality based on (...) such claim cannot be accepted. (shrink)

Ora, l'opera oratoria di Temistio, quale noi moderni leggiamo, comprende trentatrè orazioni, pubbliche e private, di cui due (o forse tre) incomplete. È molto probabile che gli altri tre (...) discorsi che Fozio ugualmente leggeva siano da identificare con orazioni perdute, di cui sopravvivono talune notizie: il discorso recitato nel 357 dinanzi al senato di Costantinopoli in occasione di un'ambasceria a Roma, il panegirico indirizzato nel 363 all'imperatore Giuliano per il suo quarto consolato e l'orazione sulla tolleranza religiosa indirizzata a Valente tra gli anni 375–376. Verrebbe, in questo modo, confermata la notizia della Bibliotheca circa l'esistenza di un corpus di complessivi trentasei discorsi ed in particolare rafforzata l'ipotesi, ventilata da taluni studiosi, secondo cui la silloge temistiana in nostro possesso corrisponderebbe in buona sostanza al ‘libro’ recensito da Fozio. The article fits in the new investigation trend about the classical models and sources of the Philagathos of Cerami’s Homilies, with particular focus on anonymous quotations and imitations of the Procopius of Gaza’s sophistic and rhetorical work. One of the most signifiant examples is the description of the Cappella Palatina in Palermo , for which Philagathos bore certainly in mind and adapted, besides other works, the Procopius’s Descriptio horologii. Garzya) di pubblicare un corpus di 166 lettere, basato su una recensio molto più ampia rispetto a quella dei suoi predecessori e soprattutto più completo per le nuove lettere, venute alla luce nel corso dei secoli.

This paper defends an internalist perspective of selection based on the hypothesis that considers living evolutionary units as Maxwell's demons (MD) or Zurek's Information Gathering and Using Systems (IGUS). Individuals are considered as IGUS that extract work by means of measuring and recording processes. Interactions or measurements convert uncertainty about the environment (Shannon's information, H) into internalized information in the form of a compressed record (Chaitin's algorithmic complexity, K). The requirements of the model and the limitations inherent to its formalization (...) are discussed. This approach offers an alternative view to the causes of evolutionary variations which goes beyond the classical Lamarckian-Darwinian controversy. I argue that random variations only apply near-to-equilibrium at the time organisms have attained structural closure, and that a speed up of mutation rates that facilitates the production of directed variations occurs far-from-equilibrium due to organisms' openness to the surrounding conditions. However, real organisms are located somewhere between the above two cases and thus, operate at an intermediate stage where there is a maximum efficiency of H/K conversion. In consequence, IGUS keep their autonomy and evolving capacity by compromising between external circumstances and inner constraints. This compromise is made possible by closure regulation. Likewise, this model explains why nature has favored the selection of agents capable of selectively recording a partial description of their environment. (shrink)

In 1911 the Wilson cloud chamber opened new possibilities for physics pedagogy. The instrument, which visualized particles’ tracks as trails of condensed vapour, was adopted by physicists to pursue frontier research on the Compton effect, the positron and the transmutation of atomic nuclei. But as the present paper will show, Wilson's instrument did not just open up new research opportunities, but the possibility of developing a different kind of teaching. Equipped with a powerful visualization tool, some physicists–teachers employed Wilson's instrument (...) to introduce their students to a wide range of phenomena and concepts, ranging from the behaviour of clouds to Einstein's photon, the wave–particle duality and the understanding of the nucleus. This paper uses the notes, books and prototypes of these pioneering physicists–teachers to compose a pedagogical history of the Wilson cloud chamber, documenting an episode of immense ingenuity, creativity and scientific imagination. No other passage in Plato has had a more intoxicating effect on its readers. To take (...) just one example, James Adam was moved to quote St. Paul when he remarked about this passage that, 'it is highly characteristic of Plato's whole attitude that he finds the true keystone of the Universe — the ultimate fountain from which both Knowledge and Existence flow — in no cold and colourless ontological abstraction, like Being, but in that for which "all creation groans and labours". En este texto, presento a Lamarck, como un autor que debe ser considerado, no solo como uno de fundadores de la biología, sino uno de los precursores del positivismo. Se examinarán nociones de “fuerza vital”, organización, “plan de la naturaleza”, “sentimiento interior” y hábito, pilares de su teoría de la transformación. Esta teoría fusiona el determinismo inherente al “plan de la naturaleza” (PN) con el papel más flexible del “sentimiento interior” (SI) y el hábito en la modificación. Es así como, (...) Lamarck defendió un holismo materialista que justifica la imagen de una naturaleza que, al organizar la materia, da lugar a la generación espontánea de seres vivos simples que a lo largo del tiempo se transforman incrementando los grados de organización, culminando con la aparición del hombre. Idea que Comte extrapoló para justificar un progreso social atado a la aparición de las ciencias positivas. Este trabajo también evalúa la crítica de Comte a Lamarck acerca del papel del medioambiente, cuyo potencial de cambio estaría limitado por “la existencia de “obstáculos interiores” a la modificación, superados en los humanos mediante la emergencia de la sociedad. Ambos autores estuvieron influenciados por François Quesnay, quien propugnaba una sociedad regida por una ética basada en una ley natural biológica. Pero, mientras Lamarck anticipaba el riesgo de la autoextinción humana, Comte consideraba que el verdadero progreso se lograría al convertir esa ley natural en fundamento de una nueva religión secular. In the context of bounded arithmetic we consider some general replacement schemes and construct models for them. A new proof of a conservation result between and is derived.

We use the model theoretic notion of coheir to give short proofs of old and new theorems in Ramsey Theory. As an illustration we start from Ramsey's theorem itself. Then we prove Hindman's theorem and the Hales-Jewett theorem. Finally, we prove the two Ramsey theoretic principles that have among their consequences partition theorems due to Carlson and to Gowers.
