The main purpose of this exploratory analysis is to understand whether, based on evidence gathered from international best practices selected among corporations which adopt the Global Reporting Initiative guidelines in sustainability reporting (SR), stakeholders are significantly consulted and involved—as international literature would indicate—by assurance providers, during assurance processes of SR. We aim at verifying if this practice—known as stakeholder assurance—is in fact widespread in SR assurance by carrying out empirical research, through content analysis, into a sample of 161 assurance statements (...) of international corporations, in order to test characteristics of any stakeholder assurance implemented. Popper a passé sa licence sous la direction de Bühler en 1928. Affirmer que Popper a été profondément influencé, non seulement par la théorie du langage de Bühler, mais aussi par sa psychologie, ne correspond pas à l’opinion courante. Le deuxième chapitre de Die beiden Grundprobleme der Erkenntis montre clairement que Karl Bühler a représenté l’un des points de départ les plus importants de la théorie de l’esprit de Popper. Selon Popper, dans l’épistémologie de Carnap, il y a un « (...) préjudice inductif » : afin de rétablir une opinion neutre et adopter une épistémologie qui soit indépendante de la psychologie, il est nécessaire de démontrer que, dans la psychologie aussi, le déductivisme est possible et concevable. Popper donne des exemples très clairs de psychologie déductive et cite la théorie de Kant, Johannes Mueller, l’École Wuerzburg et Ernst Mach. Le choix de tels exemples est significatif afin de comprendre la nature de la formation de Popper. En particulier, il est important de souligner l’absence de la « psychologie de la Gestalt » ou de ses penseurs, tels que Wertheimer, Koehler, Koffka, etc. En effet, Bühler s’opposait fortement à la psychologie de la Gestalt de l’École Wertheimer et, entre l’Institut Bühler de Vienne et les psychologues de la Gestalt à Berlin, il y avait une véritable rivalité. Popper — qui est normalement considéré, de façon simpliste, comme étant « un psychologue gestaltiste » — a tout à fait adopté l’idée de Bühler.Popper graduated under Bühler's direction in 1928. It's not part of the common view to say that Popper was strongly influenced, not only by Bühler's theory of language, but also by his psychology. The second chapter of Die beiden Grundprobleme der Erkenntnis shows clearly that one of the fundamental starting points for Popper's theory of mind was Karl Bühler. According to Popper, an “inductive prejudice” is contained in Carnap's epistemology : to restore a neutral point of view and to adopt an epistemology independent of psychology, it is necessary to show that, within the psychology, the deductivism is also possible, or thinkable. Popper provides some clear examples of deductive psychology and cites Kant's outlook, Johannes Mueller, the Wuerzburg's school and Ernst Mach. The choice of such examples is very important for the understanding of the nature of Popper's training. It is significant, in particular, the absence of the Gestaltpsychology or of its exponents, such as Wertheimer, Koehler, Koffka etc. In fact, Bühler was in sharp contrast with the Gestaltpsychology of Wertheimer's school and between the Bühler's Vienna Institute and the Berlin Gestalt -psychologists there was a real rivalry. Popper — who by the standard view is simplistically considered “a gestaltist psychologist” — adopted completely the Bühler's point of view. (shrink)

Norms conferring public or private powers, i.e., the competence to issue other norms, play a very important rôle in law. But there is no agreement among legal philosophers about the nature of such norms. There are two main groups of theories, those that regard them as a kind of norms of conduct (either commands or permissions) and those that regard them as non-reducible to other types of norms. I try to show that reductionist theories are not quite acceptable; neither the (...) command-variety (Kelsen, Alf Ross inOn Law and Justice), nor the permission-variety (von Wright, Kanger, Lindahl) provide a satisfactory account of competence norms.Among the authors who maintain that competence norms are different from (and hence not reducible to) norms of conduct are Hart, Ross inDirectives and Norms, and Searle. Ross and Searle distinguish between regulative and constitutive rules as two radically different kinds of rules and classify competence norms among constitutive rules. This distinction runs parallel to von Wright's distinction between rules that are prescriptions and determinative rules. While the first regulate actions (by commanding, prohibiting, or permitting them), determinative rules define certain concepts. To view competence norms as (partial) definitions of certain legal concepts (like those of legislator, judge, etc.) seems to open interesting perspectives and to shed light on at least one aspect of these elusive norms. In this work I argue that Descartes was not a trialist by showing that the main tenets of trialist interpretations of Descartes's theory of substance are either not supported by the text or are not sufficient for establishing the trialist interpretation.

Some important ideas in Kelsen's Pure Theory of Law can be traced back to Kantian tradition, which has been very influential in Kelsen's thought, particularly in his early period. Among them we find the distinction between two radically different worlds (the world of facts and the world of norms), the normativity of legal science and the idea of validity as a binding force, based on the famous doctrine of the basic norm. These tenets and, especially, the use of a normative (...) concept of validity prove to be incompatible with Kelsen's positivistic programme of a value‐free legal science. The science of law cannot state that legal norms are obligatory or binding without trespassing the limits of Kelsen's ideal of a legal science; on the other hand, it is possible to define the concept of a legal system without resorting to the basic norm. So, if Kelsen is to be regarded as a consequent positivist, the Kantian ingredients of his theory must be rejected and the descriptive concept of validity as membership must be substituted for the normative notion of validity as a binding force. This paper criticizes Alexy's argument on the necessary connection between law and morality. First of all, the author discusses some aspects of the notion of the claim to correctness. Basically, it is highly doubtful that all legal authorities share the same idea of moral correctness. Secondly, the author argues that the claim to correctness is not a defining characteristic of the concepts of “legal norm” and “legal system”. Hence, the thesis of a necessary connection between law and morality based on (...) such claim cannot be accepted. (shrink)

This paper reports a psychological study of human categorization that looked at the procedures used by expert scientists when dealing with puzzling items. Five professional botanists were asked to specify a category from a set of positive and negative instances. The target category in the study was defined by a feature that was unusual, hence situations of uncertainty and puzzlement were generated. Subjects were asked to think aloud while solving the tasks, and their verbal reports were analyzed. A number of (...) problem solving strategies were identified, and subsequently integrated in a model of knowledge‐guided inductive categorization. Our model proposes that expert knowledge influences the subjects' reasoning in more complex ways than suggested by earlier investigations of scientific reasoning. As in previous studies, domain knowledge influenced our subjects' hypothesis generation and testing; but, additionally, it played a central role when subjects revised their hypotheses. (shrink)

In 1911 the Wilson cloud chamber opened new possibilities for physics pedagogy. The instrument, which visualized particles’ tracks as trails of condensed vapour, was adopted by physicists to pursue frontier research on the Compton effect, the positron and the transmutation of atomic nuclei. But as the present paper will show, Wilson's instrument did not just open up new research opportunities, but the possibility of developing a different kind of teaching. Equipped with a powerful visualization tool, some physicists–teachers employed Wilson's instrument (...) to introduce their students to a wide range of phenomena and concepts, ranging from the behaviour of clouds to Einstein's photon, the wave–particle duality and the understanding of the nucleus. This paper uses the notes, books and prototypes of these pioneering physicists–teachers to compose a pedagogical history of the Wilson cloud chamber, documenting an episode of immense ingenuity, creativity and scientific imagination. Conventional quantitative methods for the measurement of organizational legitimacy consider mainly three sources that make judgments about organizations visible: news media, accreditation bodies, and surveys. Over the last decade, however, social media have enabled ordinary citizens to bypass the gatekeeping function of these institutional evaluators and autonomously make individual judgments public. This inclusion of voices beyond functional and formally organized stakeholder groups potentially pluralizes the ongoing discussions about organizations. The individual judgments in blogs, tweets, and Facebook posts give indication about (...) the broader fit between an organization’s perceived behavior and heterogeneous social norms and therefore constitute an indicator of organizational legitimacy that can be accessed and measured. We propose the use of social media data and sentiment analysis to study the affect-based responses to organizational actions by citizens. We critically discuss and compare the method with existing quantitative methods for legitimacy measurement and apply them to a recent case in the banking industry. We discuss the value of the method for studying the process of legitimacy construction as the expression and negotiation of normative judgments about organizations by various evaluators. (shrink)

We present a general approach to quantified modal logics that can simulate most other approaches. The language is based on operators indexed by terms which allow to express de re modalities and to control the interaction of modalities with the first-order machinery and with non-rigid designators. The semantics is based on a primitive counterpart relation holding between n-tuples of objects inhabiting possible worlds. This allows an object to be represented by one, many, or no object in an accessible world. Moreover (...) by taking as primitive a relation between n-tuples we avoid some shortcoming of standard individual counterparts. Finally, we use cut-free labelled sequent calculi to give a proof-theoretic characterisation of the quantified extensions of each first-order definable propositional modal logic. In this way we show how to complete many axiomatically incomplete quantified modal logics. (shrink)

Ora, l'opera oratoria di Temistio, quale noi moderni leggiamo, comprende trentatrè orazioni, pubbliche e private, di cui due (o forse tre) incomplete. È molto probabile che gli altri tre (...) discorsi che Fozio ugualmente leggeva siano da identificare con orazioni perdute, di cui sopravvivono talune notizie: il discorso recitato nel 357 dinanzi al senato di Costantinopoli in occasione di un'ambasceria a Roma, il panegirico indirizzato nel 363 all'imperatore Giuliano per il suo quarto consolato e l'orazione sulla tolleranza religiosa indirizzata a Valente tra gli anni 375–376. Verrebbe, in questo modo, confermata la notizia della Bibliotheca circa l'esistenza di un corpus di complessivi trentasei discorsi ed in particolare rafforzata l'ipotesi, ventilata da taluni studiosi, secondo cui la silloge temistiana in nostro possesso corrisponderebbe in buona sostanza al ‘libro’ recensito da Fozio. The article fits in the new investigation trend about the classical models and sources of the Philagathos of Cerami’s Homilies, with particular focus on anonymous quotations and imitations of the Procopius of Gaza’s sophistic and rhetorical work. One of the most signifiant examples is the description of the Cappella Palatina in Palermo , for which Philagathos bore certainly in mind and adapted, besides other works, the Procopius’s Descriptio horologii. The conclusion is that Philagathos had at his disposal a whole now (...) lost manuscript with the Procopius’s work. (shrink)

Garzya) di pubblicare un corpus di 166 lettere, basato su una recensio molto più ampia rispetto a quella dei suoi predecessori e soprattutto più completo per le nuove lettere, venute alla luce nel corso dei secoli.

This paper defends an internalist perspective of selection based on the hypothesis that considers living evolutionary units as Maxwell's demons (MD) or Zurek's Information Gathering and Using Systems (IGUS). Individuals are considered as IGUS that extract work by means of measuring and recording processes. Interactions or measurements convert uncertainty about the environment (Shannon's information, H) into internalized information in the form of a compressed record (Chaitin's algorithmic complexity, K). The requirements of the model and the limitations inherent to its formalization (...) are discussed. This approach offers an alternative view to the causes of evolutionary variations which goes beyond the classical Lamarckian-Darwinian controversy. I argue that random variations only apply near-to-equilibrium at the time organisms have attained structural closure, and that a speed up of mutation rates that facilitates the production of directed variations occurs far-from-equilibrium due to organisms' openness to the surrounding conditions. However, real organisms are located somewhere between the above two cases and thus, operate at an intermediate stage where there is a maximum efficiency of H/K conversion. In consequence, IGUS keep their autonomy and evolving capacity by compromising between external circumstances and inner constraints. This compromise is made possible by closure regulation. Likewise, this model explains why nature has favored the selection of agents capable of selectively recording a partial description of their environment. (shrink)

Consequently, as causes must be distinct from and superior to their effects, the Good is neither truth nor knowledge nor even being, but exceeds them all in beauty (509a), as well as in honour and power (509b). No other passage in Plato has had a more intoxicating effect on its readers. To take (...) just one example, James Adam was moved to quote St. Paul when he remarked about this passage that, 'it is highly characteristic of Plato's whole attitude that he finds the true keystone of the Universe — the ultimate fountain from which both Knowledge and Existence flow — in no cold and colourless ontological abstraction, like Being, but in that for which "all creation groans and labours". El presente artículo propone una aportación al debate suscitado en torno al problema que plantean la violencia y la sexualidad en la representación del otro, en este caso del árabe como Otro, partiendo en primer lugar de las consideración que hace Judith Butler sobre la noción de marco teórico y sus implicaciones políticas, éticas y estéticas. En un segundo momento confrontaremos este enfoque con las críticas planteadas por J. Massad al presunto orientalismo y etnocentrismo de ciertas corrientes reivindicativas de los (...) derechos LGTB desde el punto de la especificidad cultural del mundo árabe y analizaremos la polémica suscitada por dichas críticas entre distintos interlocutores. En este trabajo se discuten dos modelos opuestos de construcción de la identidad a partir de la contraposición que hace el filósofo Bernard Williams de las figuras de Rousseau y el sobrino de Rameau de Diderot. Frente a la concepción representacional de la identidad como copia o proyección de un ser interior, se propone una noción performativa de la personalidad basada en la espontaneidad y la multiplicidad como fuentes del sujeto contemporáneo. En el trasfondo de esta reflexión se encuentra la (...) hipótesis de que ambos métodos de producción ética de la identidad personal responden a concepciones estéticas profundamente enraizadas, una más próxima al modelo pictórico de copia de un original y la otra, teatral, basada en la importancia de la interpretación en los procesos de creación. En este texto, presento a Lamarck, como un autor que debe ser considerado, no solo como uno de fundadores de la biología, sino uno de los precursores del positivismo. Se examinarán nociones de “fuerza vital”, organización, “plan de la naturaleza”, “sentimiento interior” y hábito, pilares de su teoría de la transformación. Esta teoría fusiona el determinismo inherente al “plan de la naturaleza” (PN) con el papel más flexible del “sentimiento interior” (SI) y el hábito en la modificación. Es así como, (...) Lamarck defendió un holismo materialista que justifica la imagen de una naturaleza que, al organizar la materia, da lugar a la generación espontánea de seres vivos simples que a lo largo del tiempo se transforman incrementando los grados de organización, culminando con la aparición del hombre. Idea que Comte extrapoló para justificar un progreso social atado a la aparición de las ciencias positivas. Este trabajo también evalúa la crítica de Comte a Lamarck acerca del papel del medioambiente, cuyo potencial de cambio estaría limitado por “la existencia de “obstáculos interiores” a la modificación, superados en los humanos mediante la emergencia de la sociedad. Ambos autores estuvieron influenciados por François Quesnay, quien propugnaba una sociedad regida por una ética basada en una ley natural biológica. Pero, mientras Lamarck anticipaba el riesgo de la autoextinción humana, Comte consideraba que el verdadero progreso se lograría al convertir esa ley natural en fundamento de una nueva religión secular.
