ZusammenfassungEin Großteil der medizinisch und ethisch schwierigen Therapieentscheidungen betrifft kritisch kranke, einwilligungsunfähige Patienten und wird auf Basis des mutmaßlichen Patientenwillens getroffen. Das Gesetz kann hierzu nur allgemeine Vorgaben geben. Es ist für die behandelnden Ärzte essentiell, sich ein konkretes Vorgehen zu erarbeiten. Wie in der Praxis vorgegangen wird, ist bisher kaum untersucht. Ziel dieser Studie ist es, die Vielfalt der Herangehensweisen und Erfahrungen von Klinikern zum mutmaßlichen Patientenwillen zu erforschen. Wir führten semistrukturierte Interviews mit 18 Ärzten und elf Pflegekräften von (...) intensiv- und palliativmedizinischen Abteilungen eines Universitätsklinikums durch. Die Abschriften der Tonaufnahmen wurden mithilfe der Qualitativen Datenanalyse ausgewertet. Auf einer numerischen Ratingskala wurde erhoben, wie hilfreich die Kliniker das Konzept des mutmaßlichen Willens fanden. Die meisten Studienteilnehmer hielten das Konzept des mutmaßlichen Willens für sehr hilfreich. Zu ihrem Vorgehen berichteten sie, dass sie zumeist die nächsten Angehörigen befragen, zuweilen auch Professionelle und falls möglich die Patienten selbst. Gefragt werde nach früheren Äußerungen der Patienten, nach ihrer Lebenspraxis und -einstellung sowie ihrem aktuellen Verhalten. Benannt wurden auch zahlreiche Unsicherheiten und Schwierigkeiten psychologischer, sozialer, praktischer und konzeptioneller Natur. Der mutmaßliche Patientenwille wird, so unser Ergebnis, in der von uns untersuchten klinischen Praxis entsprechend den gesetzlichen Vorgaben ermittelt. Da jedoch zahlreiche Probleme berichtet werden, stellen wir konkrete Empfehlungen zur Ermittlung des mutmaßlichen Willens vor. (shrink)

Objectives Medical futility at the end of life is a growing challenge to medicine. The goals of the authors were to elucidate how clinicians define futility, when they perceive life-sustaining treatment (LST) to be futile, how they communicate this situation and why LST is sometimes continued despite being recognised as futile. Methods The authors reviewed ethics case consultation protocols and conducted semi-structured interviews with 18 physicians and 11 nurses from adult intensive and palliative care units at a tertiary hospital in (...) Germany. The transcripts were subjected to qualitative content analysis. Results Futility was identified in the majority of case consultations. Interviewees associated futility with the failure to achieve goals of care that offer a benefit to the patient's quality of life and are proportionate to the risks, harms and costs. Prototypic examples mentioned are situations of irreversible dependence on LST, advanced metastatic malignancies and extensive brain injury. Participants agreed that futility should be assessed by physicians after consultation with the care team. Intensivists favoured an indirect and stepwise disclosure of the prognosis. Palliative care clinicians focused on a candid and empathetic information strategy. The reasons for continuing futile LST are primarily emotional, such as guilt, grief, fear of legal consequences and concerns about the family's reaction. Other obstacles are organisational routines, insufficient legal and palliative knowledge and treatment requests by patients or families. Conclusion Managing futility could be improved by communication training, knowledge transfer, organisational improvements and emotional and ethical support systems. The authors propose an algorithm for end-of-life decision making focusing on goals of treatment. (shrink)

Protein aggregation has been studied for at least 3 decades, and many of the principles that regulate this event are relatively well understood. Here, however, we present a different perspective to explain why proteins aggregate: we argue that aggregation may occur as a side‐effect of the lack of one or more natural partners that, under physiologic conditions, would act as chaperones. This would explain why the same surfaces that have evolved for functional purposes are also those that favour aggregation. In (...) the course of reviewing this field, we substantiate our hypothesis with three paradigmatic examples that argue for the generality of our proposal. An obvious corollary of this hypothesis is, of course, that targeting the physiological partners of a protein could be the most direct and specific approach to designing anti‐aggregation molecules. Our analysis may thus inform a different strategy for combating diseases of protein aggregation and misfolding. (shrink)

This study characterizes a large sample of adults with attention-deficit/hyperactivity disorder and healthy controls regarding their task performance and neurophysiology; cross-sectionally and longitudinally. Self-reported symptoms, behavioral measures, and event-related potentials from a classical cued Go/NoGo task were used to outline the symptom burden, executive function deficits and neurophysiological features, and the associations between these domains. The study participants were assessed five or three times over two years. We describe cross-sectional and longitudinal group differences, and associations between symptom burden, and behavioral (...) and event-related potential components variables by latent growth curve models, including random slopes and intercepts. The ADHD group showed increased reaction time variability, increased commission and omission errors, and attenuated cueP3, CNV, N2d, and P3d amplitudes. We observed a decrease in self-reported symptoms in the ADHD group over the two years. The behavioral measures did not change over time, whereas the cueP3, P3d, and N2d amplitude attenuated in both groups. There was no evidence for a robust association between symptom burden and behavioral or ERP measures. The changes in the ERP components with stable task performance, potentially indicate more efficient neuronal processing over the two years. Whether the lack of association between symptom burden and behavioral or ERP measures might be due to the low reliability of the ADHD assessment criteria, or the inappropriateness of the objective measures cannot be inferred. The relationship between traumatic life events and increased suicide risk has been well reported in literature. However, the complex nature of suicidality phenomena still hinders our ability to comprehend the mediation mechanism underlying this association. In this study, we examined the mediating role of adult attachment and reflective functioning in the relationship between traumatic life events and suicidal ideation. Nine hundred and fifty Italian adults completed an online survey evaluating traumatic life events, adult attachment, reflective functioning and suicidal ideation. The (...) path analysis showed that the positive relationship between traumatic life events and suicidal ideation was partially mediated by attachment anxiety and reflective functioning. From a clinical point of view, these results support the relevance of evaluating and improving patients’ ability to mentalize as a part of psychotherapeutic intervention aimed at reducing suicidality in people with a history of traumatic experiences and attachment anxiety. The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. The collection of essays (...) is rather more philosophical and reflective as opposed to doctrinal. Each contribution focuses on the nature and operation of justice, the independence of the judiciary, and on judicial style primarily from the perspective of the judges themselves. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. Quine’s “New Foundations” (NF) was first presented in Quine [1937] and later on in Quine [1963]. Ernst Specker [1958, 1962], building upon a previous result of Ehrenfeucht and Mostowski [1956], showed that NF is consistent if and only if there is a model of the Theory of Negative (and positive) Types (TNT) with full extensionality that admits of a “shifting automorphism,” but the existence of a such a model remains an open problem.

An application of Narrative Knowledge Representation Language (NKRL) techniques on (declassified) ‘terrorism in Southern Philippines’ documents has been carried out in the context of the IST Parmenides project. This paper describes some aspects of this work: it is our belief, in fact, that the Knowledge Representation techniques and the Intelligent Information Retrieval tools used in this experiment can be of some interest also in an ‘Ontological Modelling of Legal Events and Legal Reasoning’ context.

Many people are worried about the harmful effects of climate change but nevertheless enjoy some activities that contribute to the emission of greenhouse gas (driving, flying, eating meat, etc.), the main cause of climate change. How should such people make choices between engaging in and refraining from enjoyable greenhouse-gas-emitting activities? In this chapter, we look at the answer provided by decision theory. Some scholars think that the right answer is given by interactive decision theory, or game theory; and moreover think (...) that since private climate decisions are instances of the prisoner’s dilemma, one rationally should engage in these activities provided that one enjoys them. Others think that the right answer is given by expected utility theory, the best-known version of individual decision theory under risk and uncertainty. In this chapter, we review these different answers, with a special focus on the latter answer and the debate it has generated. (shrink)

In the paper it is argued that bridging the digital divide may cause a new ethical and social dilemma. Using Hardin's Tragedy of the Commons, we show that an improper opening and enlargement of the digital environment (Infosphere) is likely to produce a Tragedy of the Digital Commons (TDC). In the course of the analysis, we explain why Adar and Huberman's previous use of Hardin's Tragedy to interpret certain recent phenomena in the Infosphere (especially peer-to-peer communication) may not be entirely (...) satisfactory. We then seek to provide an improved version of the TDC that avoids the possible shortcomings of their model. Next, we analyse some problems encountered by the application of classical ethics in the resolution of the TDC. In the conclusion, we outline the kind of work that will be required to develop an ethical approach that may bridge the digital divide but avoid the TDC. (shrink)

In this paper we introduce three methods to approach philosophical problems informationally: Minimalism, the Method of Abstraction and Constructionism. Minimalism considers the specifications of the starting problems and systems that are tractable for a philosophical analysis. The Method of Abstraction describes the process of making explicit the level of abstraction at which a system is observed and investigated. Constructionism provides a series of principles that the investigation of the problem must fulfil once it has been fully characterised by the previous (...) two methods. It has been observed that whereas painters and musicians are likely to be embarrassed by references to the beauty in their work, mathematicians instead like to engage in discussions of the beauty of mathematics. Professional artists are more likely to stress the technical rather than the aesthetic aspects of their work. Mathematicians, instead, are fond of passing judgment on the beauty of their favored pieces of mathematics. Even a cursory observation shows that the characteristics of mathematical beauty are at variance (...) with those of artistic beauty. For example, courses in art appreciation are fairly common; it is however unthinkable to find any mathematical beauty appreciation courses taught anywhere. The purpose of the present paper is to try to uncover the sense of the term beauty as it is currently used by mathematicians. (shrink)

Este artículo estudia la revisión que hace Antonio Pérez de la identidad intencional de Pedro Auréolo entre el ser aparente de una cosa como conocida y su ser real extramental. La teoría de la cognición de Pérez es claramente deudora de la teoría de la intencionalidad de Auréolo. Al igual que este, Pérez se apoya en el instrumento lógico de la connotación y en la identidad entre la especie inteligible y el acto de conocimiento. Pérez está de acuerdo con la (...) teoría de Auréolo, afirmando una identidad de indistinción entre el ser aparente de la cosa como conocida y el ser real de la cosa extramental. Sin embargo, Pérez parece no estar plenamente satisfecho con la teoría de la cognición de Auréolo, e introduce algunos cambios relevantes. En primer lugar, emplea la doctrina suareziana de que todo acto intencional, aunque apunta directamente a un objeto, reflexiona virtual o indirectamente sobre sí mismo. Como consecuencia, apoya una identidad entre el lado formal –es decir, el acto de cognición– y el lado objetivo –es decir, la cosa reconocida–. En segundo lugar, ofrece una definición de la identidad de indistinción que difiere de la de Auréolo. Al hacerlo, Pérez equipara el ser aparente con una forma universal, es decir, el acto de cognición como tal, caracterizando todo acto particular de cognición como propio de todo ser inteligente. Esta forma indeterminada, entonces, puede ser determinada por todo objeto posible. (shrink)

Attraverso l'utilizzo di un metodo di tipo fenomenologico, vengono messe in luce le tappe che conducono l'individuo a un processo di realizzazione etica di sé. Particolare risalto viene dato al dramma che il soggetto vive nella scelta razionale dei valori. Dramma che induce il filosofo americano a trovare nell'etica lo sviluppo finale della logica. Questa svolta (...) muove l'intero processo della soggettivitÀ sul piano della responsabilitÀ. Una responsabilitÀ drammatica e rischiosa, che costituisce l'unica via che il soggetto puň percorrere se aspira a qualificare la realtÀ in cui si trova inscindibilmente incarnato in modo intelligente, personale e creativo. Este artículo pretende estudiar la crítica de Antonio Pérez a la teoría de la identidad intencional de Pedro Auréolo. La teoría de la cognición de Pérez es claramente deudora de la doctrina de la intencionalidad de Auréolo. El jesuita español utiliza a menudo las mismas expresiones lingüísticas que Auréolo (como "ser aparente") y coincide con él en la identidad intencional entre el conocedor -que coincide en acto con el acto de conocer- y el objeto conocido, que es lo mismo que (...) existe fuera del intelecto. Tanto Pérez como Auréolo basan su teoría de la identidad intencional en el De anima de Aristóteles, pero el jesuita español señala una incoherencia en la doctrina de Auréolo, que contradice la concisa afirmación de Aristóteles sobre la identidad entre el conocedor y lo conocido durante el acto de conocimiento. Al examinar a fondo la teoría de la identidad intencional de Auréolo, concebida como una especie de identidad de indistinción, Pérez señala una incoherencia entre la descripción que hace Auréolo del acto de cognición y su concepción de la identidad de indistinción. Además, Pérez parece considerar insuficiente la identidad de indistinción de Auréolo utilizada para describir la identidad intencional que caracteriza el acto de cognición. En consecuencia, ofrece una nueva definición de identidad indistinta para presentar el ser aparente como una realidad indeterminada que puede ser determinada por cualquier contenido inteligible. Esta revisión péreziana de la teoría del ser aparente de Auréolo, por un lado, puede verse como un caso de revisionismo escolástico temprano moderno aplicado a un pensador medieval y, por otro, encuentra una aplicación más amplia en la metafísica y la antropología filosófica de Pérez. In this paper we show that the Gupta-Belnap systems S# and S* are П12. Since Kremer has independently established that they are П12-hard, this completely settles the problem of their complexity. The above-mentioned upper bound is established through a reduction to countable revision sequences that is inspired by, and makes use of a construction of McGee.

Husserl’s Third Logical Investigation, ostensibly dealing with the phenomenology of whole and parts, is actually meant to introduce the notion of Fundierung. This term is frequently used in the phenomenological literature, although little has been written about Fundierung itself since Husserl introduced it. Husserl himself, although he used it extensively, never again felt the need to reopen the discussion.

The author returns to a much debated topic, the so-called “Episode of Helen”, which has come to us only through indirect transmission, and endeavors to dismantle the prejudice against Virgilian authorship. G. P. Goold’s pugnacious intervention, dating back to more than half a century ago, contributed decisively – in fact, more than it should have – to the thesis that the text is spurious. A critical analysis of the text will demonstrate this claim to be groundless while offering arguments that (...) support the authenticity of the episode. (shrink)
