Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. BackgroundThis study aimed to determine the elements and the extent of information that child participants and their parents would like to read in an informed assent form /informed consent form of a pediatric drug trial.MethodsA descriptive survey was conducted to determine the perceived importance of each element of the ICF content from child participants and their parents who underwent informed assent/consent of a multi-center pediatric drug trial. The respondents were asked to indicate the level of importance of each item in (...) a questionnaire, by giving a rating scale from 1 to 5.ResultsA total of 22 families, 17 child participants with the diagnosis of hematology or oncology diseases and 27 parents, were enrolled. Among 30 items, risk–benefit aspects were perceived to be of most concerning items from both child participants’ and parents’ viewpoint. None of the items were considered ‘slightly important’ or lower by more than 20% of the respondents.ConclusionsFor pediatric drug trials, risk–benefit information should be made a salient feature of an IAF/icf. This empirical data could help related stakeholders arrange essential information in order of importance and tailor an IAF/icf to better suit child participants’ and parents’ needs, particularly for pediatric drug trials involving children with the diagnosis of hematology or oncology diseases. Kit Fine and Gideon Rosen propose to define constitutive essence in terms of ground-theoretic notions and some form of consequential essence. But we think that the Fine–Rosen proposal is a mistake. On the Fine–Rosen proposal, constitutive essence ends up including properties that, on the central notion of essence, are necessary but not essential. This is because consequential essence is closed under logical consequence, and the ability of logical consequence to add properties to an object’s consequential essence outstrips the ability of (...) ground-theoretic notions, as used in the Fine–Rosen proposal, to take those properties out. The necessary-but-not-essential properties that, on the Fine–Rosen proposal, end up in constitutive essence include the sorts of necessary-but-not-essential properties that, others have noted, end up in consequential essence. Hartry Field’s epistemological challenge to the mathematical platonist is often cast as an improvement on Paul Benacerraf’s original epistemological challenge. I disagree. While Field’s challenge is more difficult for the platonist to address than Benacerraf’s, I argue that this is because Field’s version is a special case of what I call the ‘sociological challenge’. The sociological challenge applies equally to platonists and fictionalists, and addressing it requires a serious examination of mathematical practice. I argue that the non-sociological part of Field’s (...) challenge amounts to a minor reformulation of Benacerraf’s original challenge. So, I contend, Field’s challenge is not an improvement on Benacerraf’s. What is new to Field’s challenge is as much a problem for the fictionalist as it is for the platonist. (shrink)

Many legal disputes turn on scientific, especially statistical, evidence. Traditionally scientists have accepted only that statistical evidence which satisfies a 95 percent (or 99 percent) rule — that is, only evidence which has less than five percent (or one percent) probability of resulting from chance.The rationale for this rule is the reluctance of scientists to accept anything less than the best-supported new knowledge. The rule reflects the internal needs of scientific practice. However, when uncritically adopted as a rule for admitting (...) legal evidence, the seemingly innocuous 95 percent rule distorts the balance of interests historically protected by the legal system. In particular, plaintiffs in toxic tort and employment discrimination suits are effectively held to a heavier burden of proof in showing that their injuries were more probably than not caused by the defendant's actions. The result is that too many victims of toxic torts or employment discrimination cannot win legal redress for their injuries. (shrink)

In “Mathematical Truth,” Paul Benacerraf raises an epistemic challenge for mathematical platonists. In this paper, I examine the assumptions that motivate Benacerraf’s original challenge, and use them to construct a new causal challenge for the epistemology of mathematics. This new challenge, which I call ‘Gödel’s Gap’, appeals to intuitive insights into mathematical knowledge. Though it is a causal challenge, it does not rely on any obviously objectionable constraints on knowledge. As a result, it is more compelling than the original challenge. (...) It is also more general; the challenge applies equally to platonistic and non-platonistic accounts of mathematical truth. And it can be generalized beyond the case of mathematical knowledge to pose a challenge for, e.g., moral knowledge. (shrink)

The standard argument for the existence of distinctively mathematical objects like numbers has two main premises: some mathematical claims are true, and the truth of those claims requires the existence of distinctively mathematical objects. Most nominalists deny. Those who deny typically reject Quine’s criterion of ontological commitment. I target a different assumption in a standard type of semantic argument for. Benacerraf’s semantic argument, for example, relies on the claim that two sentences, one about numbers and the other about cities, have (...) the same grammatical form. He makes this claim on the grounds that the two sentences are superficially similar. I argue that these grounds are not sufficient. Other sentences with the same superficial form appear to have different grammatical forms. I offer two plausible interpretations of Benacerraf’s number sentence that make use of plural quantification. These interpretations appear not to incur ontological commitments to distinctively mathematical objects, even assuming Quine’s criterion. Such interpretations open a new, plural strategy for the mathematical nominalist. (shrink)

Legal argumentation, like argumentation generally, occurs against a background of shared understanding and competence. This view, inspired by Kuhn's understanding of scientific reasoning, is in stark contrast to more traditional ‘rule-following’ accounts of legal argumentation. Below I consider reasons to reject the more traditional view of legal reasoning in favor of a roughly Kuhnian account of legal reasoning and conclude by raising skeptical questions about the cogency of legal reasoning when the tacitly accepted background conditions that make it possible are (...) not critically examined. Wright claims that his and Hale’s abstractionist neologicist project is primarily epistemological in aim. Its epistemological aims include establishing the possibility of a priori mathematical knowledge, and establishing the possibility of reference to abstract mathematical objects. But, as Wright acknowledges, there is a question of how neologicist epistemology applies to actual, ordinary mathematical beliefs. I take up this question, focusing on arithmetic. Following a suggestion of Hale and Wright, I consider the possibility that the neologicist account provides an idealised reconstruction (...) of how people acquire cognition of numbers or arithmetical knowledge. I conclude that it is unlikely that this account can be used to reconstruct even idealised answers to pressing questions about our actual epistemology. (shrink)

Cicero rejoins that they would be of exactly the same mind, even though they had a life ten times as long to look back upon.

Sentences of the form si sit … esset crop out at rare intervals in the literature of classical Latin, deviating so sharply from what might be called the standard forms of conditional speaking that they have commonly been regarded with more or less suspicion.

The discussion of the construction with usus est is conventionally bound up with that of opus est, and comparatively little attention has been given to the problem presented by the use of the ablative case with the former phrase. The tendency to pass lightly over this matter is due doubtless to the manifest etymological connexion between usus and utor, which leads to the assumption that the verbal noun would naturally follow the syntax of the verb.

In a note on this passage as far back as 1868, E. Wölmin 1 advanced the theory that the plural anulis is used here in a technical and stereotyped way as symbolic of equestrian rank. He is not sure whether such illogical use of the plural is to be found earlier than Tacitus or not.

This book investigates the architecture of the language faculty by considering what the properties of language reveal about the mental abilities and processes involved in language acquisition. The language faculty, the author argues, must be able not only to accommodate what is general, exceptionless, and universal in language, but must also be capable of dealing with what is irregular, exceptional, and idiosyncratic. In Syntactic Nuts Peter Culicover shows that this is true not only of the lexicon, but for syntax. Marginal (...) and exceptional cases, where there is no straightforward form-meaning correspondence, are dealt with by the language faculty easily and precisely as the general cases. In considering how and why this should be the author argues against the prevailing trend in generative grammar, which takes the learner as either incorporating maximally global generalisations as part of its innate capacity for language, or projecting global generalisations from a very limited input on the basis of innate mechanisms. He suggests that the learning mechanism does not generalize significantly beyond the evidence presented to it, and further that it seeks to form generalizations based on all and only the evidence presented to it. Syntactic Nuts makes a fundamental contribution to generative grammar and syntactic theory. It situates syntactic theory within cognitive science in a novel way. This article provides a conceptual and empirical assessment of UN brokered partnerships that seek to deepen or create inclusive and sustainable agricultural supply chains in sub-Saharan Africa. More specifically it appraises the decision-making mechanisms, processes of partnership brokerage and project implementation within the UNDP Growing Sustainable Business Initiative (GSB) in Kenya. The paper argues that the lack of bottom-up participation in decision-making mechanisms and the predominantly economic imperatives driving the GSB partnership projects have failed to reach out to the partnerships’ (...) intended beneficiaries—Kenyan small producers of nuts and mangoes. In conclusion it is suggested that opening up the GSB platform might hold the promise of reconciling sustainable business models with (some) poverty reduction. (shrink)

The ethics of betel nut use in Taiwan are examined in this article. It first presents scientific facts about the betel quid, its consumption and negative health consequences and then analyses the cultural background and economic factors contributing to its popularity in Asia. Governmental and institutional attempts to curb betel nut cultivation, distribution and sales are also described. Finally, the bioethical implications of this often ignored subject are considered.
