Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. This paper is based on a semantic foundation of quantum logic which makes use of dialog-games. In the first part of the paper the dialogic method is introduced and under the conditions of quantum mechanical measurements the rules of a dialog-game about quantum mechanical propositions are established. In the second part of the paper the quantum mechanical dialog-game is replaced by a calculus of quantum logic. As the main part of the paper we show that the calculus of quantum logic (...) is complete and consistent with respect to the dialogic semantics. Since the dialoggame does not involve the 'excluded middle' the calculus represents a calculus of effective (intuitionistic) quantum logic. In a forthcoming paper it is shown that this calculus is equivalent to a calculus of sequents and more interestingly to a calculus of propositions. With the addition of the 'excluded middle' the latter calculus is a model for the lattice of subspaces of a Hilbert space. (shrink)

In a preceding paper [1] it was shown that quantum logic, given by the tableaux-calculus Teff, is complete and consistent with respect to the dialogic foundation of logics. Since in formal dialogs the special property of the 'value-definiteness' of propositions is not postulated, the calculus $T_{eff}$ represents a calculus of effective (intuitionistic) quantum logic. Beginning with the tableaux-calculus the equivalence of $T_{eff}$ to calculi which use more familiar figures such as sequents and implications can be investigated. In this paper we (...) present a sequents-calculus of Gentzen-type and a propositional calculus of Brouwer-type which are shown to be equivalent to $T_{eff}$ . The effective propositional calculus provides an interpretation for a lattice structure, called quasi-implicative lattice. If, in addition, the value-definiteness of quantum mechanical propositions is postulated, a propositional calculus is obtained which provides an interpretation for a quasi-modular orthocomplemented lattice which, as is well-known, has as a model the lattice of subspaces of a Hilbert space. Because modern societies are built on elaborate divisions of cognitive labor, individuals remain laypersons in most knowledge domains. Hence, they have to rely on others' expertise when deciding on many science-related issues in private and public life. Even children already locate and discern expertise in the minds of others. This study examines how far university students accurately judge experts' pertinence for science topics even when they lack proficient knowledge of the domain. Participants judged the pertinence of experts from diverse disciplines (...) based on the experts' assumed contributions to texts adapted from original articles from Science and Nature. Subjective pertinence judgments were calibrated by comparing them with bibliometrics of the original articles. Furthermore, participants' general science knowledge was controlled. Results showed that participants made well-calibrated pertinence judgments regardless of their level of general science knowledge. (shrink)

Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. Daniel Bell and Wang Pei’s recent monograph, Just Hierarchy, seeks to defend hierarchical relationships against more egalitarian alternatives. This paper addresses their argument, offered in one chapter of the book, in favour of a hierarchical relationship between human and nonhuman animals. This relationship, Bell and Pei argue, should conform to what they call “subordination without cruelty:” it is permissible to subordinate and exploit animals for human ends, provided that we do not treat them cruelly. We focus on three aspects of (...) their view: their argument for a hierarchical view; their understanding of cruelty; and their account of the heightened duties they claim we owe to nonhuman animals who are intelligent, domesticated, and/or “cute.” We argue that the reasons that Bell and Pei offer fail to support their conclusions, and that, even if one accepts a hierarchical view, the conclusions that Bell and Pei draw about the permissibility of practices such as killing animals for food do not follow. We conclude by emphasizing philosophers’ responsibility to thoroughly test their arguments and to engage with existing debates, especially when the practices they seek to justify involve harms of great magnitude. This paper is a historical, legal and philosophical analysis of the concept of human dignity in German and Kenyan constitutional law. We base our analysis on decisions of the Federal Constitutional Court of Germany, in particular its take on life imprisonment and its 2006 decision concerning the shooting of hijacked airplanes, and on a close reading of the Constitution of Kenya. We also present a dialogue between us in which we offer some critical remarks on the concept of human dignity (...) in the two constitutions, each one of us from his own philosophical perspective. English summary: Gilduin (1155) was, from 1113, the first abbot of the community of the Canons Regular of St Augustine, soon to become an abbey, under the auspices of St Victor of Marseille, on the left bank of the river Seine. After the death of his confrere Hugh, who was of German descent and the leading figure of the Victorines, on 11 February 1141, abbot Gilduin took care that the writings of Hugh were collected and compiled in a representative complete (...) edition. This 'Gilduin-edition' - as it is called in Medieval scholarship - comprises four volumes, the first of which is reconstructed herewith and presented in print. This volume follows the 2008 edition of Hugh's theological summa, De sacramentis christiane fidei. Then as now we are dealing with a critical albeit historical text. This new volume contains nine works, among which the first ever complete edition of Hugh's Cronica surely stands out. German description: Gilduin (+ 1155) war ab 1113 der erste Abt der einige Jahre zuvor gegrundeten und bald zur Abtei erhobenen Gemeinschaft von Augustinerchorherren unter dem Patronat des hl. We invoke the ideal of tolerance in response to conflict, but what does it mean to answer conflict with a call for tolerance? Is tolerance a way of resolving conflicts or a means of sustaining them? Does it transform conflicts into productive tensions, or does it perpetuate underlying power relations? To what extent does tolerance hide its involvement with power and act as a form of depoliticization? Wendy Brown and Rainer Forst debate the uses and misuses of tolerance, an (...) exchange that highlights the fundamental differences in their critical practice despite a number of political similarities. Both scholars address the normative premises, limits, and political implications of various conceptions of tolerance. Brown offers a genealogical critique of contemporary discourses on tolerance in Western liberal societies, focusing on their inherent ties to colonialism and imperialism, and Forst reconstructs an intellectual history of tolerance that attempts to redeem its political virtue in democratic societies. Brown and Forst work from different perspectives and traditions, yet they each remain wary of the subjection and abnegation embodied in toleration discourses, among other issues. The result is a dialogue rich in critical and conceptual reflections on power, justice, discourse, rationality, and identity. (shrink)

This contribution is concerned with a particular model theoretic semantics of the object language of quantum physics. The object language considered here comprises logically connected propositions, sequentially connected propositions and modal propositions. The model theoretic semantics arises from the already established dialogic semantics, if the pragmatic concept of the dialog-game is replaced by a "metaphysical" concept of the game. The game is determined by a game tree, the branches of which constitute a set, the set of "possible worlds" of an (...) individual quantum physical system. The semantic concepts like truth, falsity and valuation are defined with respect to this set. (shrink)

This contribution gives an outline of a game theoretic foundation of the logical structure inherent to the language of a science. Game theoretic approaches to a language were considered and developed by several authors. In this volume Saarinen examines the game theoretic semantics due to Hintikka and the dialog-game semantics due to Lorenzen. In the following I shall not re-examine the approaches by Hintikka and Lorenzen. However, some remarks about Lorenzen’s semantics are necessary since the game theoretic approach considered here (...) is essentially based on the idea of Lorenzen to use dialog-games for a foundation of logic.A systematic game theoretic presentation of the rules of a dialog game was given at first by Lorenz. Starting with certain structural rules which constitute the general scheme of a dialog, a further dialog rule is necessary in order to guarantee a finite game. (shrink)

An Objectivity Principle (O) and a Locality Principle (L) are considered with respect to two simple, but fundamental Gedanken experiments, namely a “Welcher-Weg” Gedanken experiment and an Einstein-Podolsky-Rosen (EPR) Gedanken experiment. It is shown that, if both principles (O) and (L) are assumed to be valid, a contradiction, in the EPR case Bell’s inequality, can be derived implying that at least one of the two principles (O) and (L) has to be denied. It is shown that, if (O) is denied, (...) (L) is preserved in the EPR-Gedanken experiment. For a more adequate discussion, in particular of (L), the two experiments are described in Minkowskian space-time of special relativity. (shrink)

Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously. Rule systems are used every day to share experience, pre-existing knowledge, beliefs and ethical rules, and to provide instructions for future action. This article expands and builds upon an approach pioneered by Julius M. Moravcsik to argue that ethics cannot be completely codified into a rigid set of rules, because any such set lacks a misapplication-correcting sensibility. Thus, an ethics that is transferred purely by means of a rule-set is incomplete and thus cannot be used reliably to guide future action. (...) The balancing sensibility is formed out of pre-existing expert knowledge and takes account of the limitations of rule-sets in specific contexts. Moravcsik’s approach is then expanded by incorporating it into a holistic framework for the analysis, guidance and development of actions to be taken to support the emergence, selection and implementation of solutions for a sustainable future. This approach has profound implications for managers and organisers in new or critical situations. (shrink)
