The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

Despite increasing interest in studying arguments from deontic authority of the general form “(1) $$\delta$$ δ is a deontic authority in institution $$\varOmega$$ Ω ; (2) according to $$\delta$$ δ, I should do $$\alpha$$ α, C: therefore, (3) I should do $$\alpha$$ α ”, the state of the art models are not capable of grasping their complexity. The existing sets of critical questions assigned to this argumentation scheme seem to conflate two problems: whether a person is subject to an authority (...) of an institution in the first place and whether the command issued within the context of a particular institution is eventually binding. For this reason, we introduce (1) a set of Basic Critical Questions to scrutinize the former issue, and (2) a set of more detailed questions related to specific features, also referred to as “parameters”, of institutional environments (Intra-Institutional Critical Questions). We identify major elements of institutional environments in which authoritative utterances are made and the crucial parameters of arguments from deontic authority. The selected evidence from the decisions of the Polish Supreme Administrative Court helps us show how these parameters may be used to reconstruct subtypes of this argument scheme, with their associated sets of critical questions. In specific institutional contexts, such detailed schemes are capable of grasping the complexity of appeals to deontic authority and thus should be used rather than general schemes. The reconstruction of argumentation schemes with critical questions shows how particular arguments may successfully be attacked. (shrink)

This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. The book presents a broad set of perspectives, insights and results into the emerging field of research devoted to the logical analysis of the area of creation of law. How does logic inform lawmaking? Are legal systems consistent and complete? How can legal rules be represented by means of formal calculi and visualization techniques? Does the structure of statutes or of legal systems resemble the structure of deductive systems? What are the logical relations between the basic concepts of jurisprudence that constitute the system of law? How are theories of legal interpretation relevant to the process of legislation? How might the statutory text be analysed by means of contemporary computer programs? The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Eight papers are discussed: two concern the management and use of documents available on the World Wide Web, (...) and six apply machine learning techniques to a variety of legal applications. This is a report on the Doctoral Consortium co-located with the 17th International Conference on Artificial Intelligence and Law in Montreal.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. The thesis of the paper holds that some future developments of argumentation theory may be inspired by the rich logico-methodological legacy of the Lvov–Warsaw School (LWS), the Polish research movement that was most active from 1895 to 1939. As a selection of ideas of the LWS which exploit both formal and pragmatic aspects of the force of argument, we present: Ajdukiewicz’s account of reasoning and inference, Bocheński’s analyses of superstitions or dogmas, and Frydman’s constructive approach to legal interpretation. This paper (...) does not aim at exhaustive elaboration of any of these topics or their usefulness in current discussions within argumentation theory. Rather, we intend to indicate chosen directions of a potentially fruitful research program for the emerging Polish School of Argumentation which would consist in application of methods and conceptions elaborated by the LWS to selected open problems of contemporary research on argumentation. Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. In September 2018, the ArgDiaP association, along with colleagues from Germany and the UK, organised one of the longest and most interdisciplinary series of events ever dedicated to argumentation - Warsaw Argumentation Week, WAW 2018. The eleven-day ‘week’ featured a five day graduate school on computational and linguistic perspectives on argumentation (3rd SSA school); five workshops: on systems and algorithms for formal argumentation (2nd SAFA), argumentation in relation to society (1st ArgSoc), philosophical approaches to argumentation (1st ArgPhil), legal argumentation (2ndMET-ARG) (...) and argumentation in rhetoric (1st MET-RhET); and two conferences: on computational models of argumentation (7th COMMA conference) and on argumentation and corpus linguistics (16th ArgDiaP conference). WAW hosted twelve tutorials and eight invited talks as well as welcoming over 130 participants. All the conferences and workshops publish pre- or post-proceedings in the top journals and book series in the field. (shrink)

The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper provides commentaries on landmark papers from the first decade of that journal. The topics discussed include reasoning with cases, argumentation, normative reasoning, dialogue, representing legal knowledge and neural networks.

We give a few results concerning the notions of causal completability and causal closedness of classical probability spaces . We prove that any classical probability space has a causally closed extension; any finite classical probability space with positive rational probabilities on the atoms of the event algebra can be extended to a causally up-to-three-closed finite space; and any classical probability space can be extended to a space in which all correlations between events that are logically independent modulo measure zero event (...) have a countably infinite common-cause system. In this article, we address the case of self-tracking as a practice in which two meaningful backgrounds play an important role as the spatial dimension of human practices. Using a phenomenological approach, we show how quantification multiplies backgrounds, while at the same time generating data about the user. As a result, we can no longer speak of a unified background of human activity, but of multiple dimensions of this background, which, additionally, is perceived as having no pivotal role in the (...) process, often being hidden, situated beyond human consciousness, or taken for granted. Consequently, the phenomenological experience of the background turns into a hermeneutic practice focused on the interpretation of representations and descriptions. By adopting a phenomenological approach, we show the problems and limitations of quantification of human activities occurring in self-tracking and the theoretical problems associated with the scheme of human-technology relations. Let ΩΩ be the semigroup of all mappings of a countably infinite set Ω. If U and V are subsemigroups of ΩΩ, then we write U≈V if there exists a finite subset F of ΩΩ such that the subsemigroup generated by U and F equals that generated by V and F. The relative rank of U in ΩΩ is the least cardinality of a subset A of ΩΩ such that the union of U and A generates ΩΩ. In this paper (...) we study the notions of relative rank and the equivalence ≈ for semigroups of endomorphisms of binary relations on Ω.The semigroups of endomorphisms of preorders, bipartite graphs, and tolerances on Ω are shown to lie in two equivalence classes under ≈. Moreover such semigroups have relative rank 0, 1, 2, or in ΩΩ where is the minimum cardinality of a dominating family for . We give examples of preorders, bipartite graphs, and tolerances on Ω where the relative ranks of their endomorphism semigroups in ΩΩ are 0, 1, 2, and .We show that the endomorphism semigroups of graphs, in general, fall into at least four classes under ≈ and that there exist graphs where the relative rank of the endomorphism semigroup is 20. Physical theories give us the best available information about what there exists. Although physics is not ontology, it can be ontologically interpreted. In the present study, I propose to interpret physical theories à la Quine, i.e. not to speculate about what really exists, but rather to identify what a given physical theory presupposes that exists. I briefly suggest how Quine’s program should by adapted to this goal. To put the idea to the test, I apply it to the famous Hartle–Hawking (...) model of the quantum creation of the universe from nothing, and try to discover what kind of nothingness the model presupposes. I also make some remarks concerning ontological commitments of the method of physics itself. (shrink)

We agree that the default numerical representation is best accessed by probing automatic processing. The locus of this representation is apparently at the horizontal intraparietal sulcus (HIPS), the convergence zone of magnitude information. The parietal lobes are the right place to look for non-abstract representation of magnitude, yet the proof for that is still to be found.

The text presents the results of a qualitative study focused on the issue of using nanomaterials in the extraordinary circumstances linked to the COVID-19 pandemic, particularly referring to the “Roušky s TULkou” initiative. Within several weeks, this initiative managed to launch the production of highly efficient nanofiber filters using the original AC Electrospinning technology on an industrial scale. The goal of the research was to analyse both the regional experience and the value-based challenges, conflicts and ethical dilemmas posed by an (...) emergency situation. The theoretical starting points of the research were the Turnerian understanding of liminality, communitas and antistructure and Stenner’s concept of liminal spaces. The results of the research show that the pandemic situation contributed to the emergence of an unexpected potential of the new technology and that the realisation of the activity was influenced not only by know-how and the university’s technical facilities, but particularly by social capital, thus uncovering the potential of the anti-structural character of the initiative and the temporary suspension of hierarchically established university structures. In the framework of Stewart Shapiro, computations are performed directly on strings of symbols (numerals) whose abstract numerical interpretation is determined by a notation. Shapiro showed that a total unary function (unary relation) on natural numbers is computable in every injective notation if and only if it is almost constant or almost identity function (finite or co-finite set). We obtain a syntactic generalization of this theorem, in terms of quantifier-free definability, for functions and relations relatively intrinsically computable on certain types (...) of equivalence structures. We also characterize the class of relations and partial functions of arbitrary finite arities which are computable in every notation (be it injective or not). We consider the same question for notations in which certain equivalence relations are assumed to be computable. Finally, we discuss connections with a theorem by Ash, Knight, Manasse and Slaman which allow us to deduce some (but not all) of our results, based on quantifier elimination. (shrink)

This article utilises feminist technoscience studies’ notions of bodily ‘materialisation’ and ‘ontological choreographies’, offering a cyborg feminist account of ‘bioavailability’ as embodied becomings, rather than a fixed ontological state of being. Drawn from 2 years’ ethnographic study in in vitro fertilisation clinics in Spain with migrant women who provided eggs to the cross-border in vitro fertilisation industry, this work explores how global understandings of race and inequalities, clinical practices and women’s own emotional and physical labours collectively produce bioavailability. Through examples (...) from observations and interviews in in vitro fertilisation clinics, we examined women’s embodied stories to understand the ways in which bioavailability becomes. The article demonstrates a novel way in which to think about ‘bioavailability’, a concept which has already been of enormous use to the social sciences since its introduction by Lawrence Cohen. We examine recent configurations of bodily extraction in the reproduction–migration nexus that help us rethink the concept of bioavailability. (shrink)
