This volume addresses the intriguing issue of indirect reports from an interdisciplinary perspective. The contributors include philosophers, theoretical linguists, socio-pragmaticians, and cognitive scientists. The book is divided into four sections following the provenance of the authors. Combining the voices from leading and emerging authors in the field, it offers a detailed picture of indirect reports in the world’s languages and their significance for theoretical linguistics. Building on the previous book on indirect reports in this series, this volume adds an empirical (...) and cross-linguistic approach that covers an impressive range of languages, such as Cantonese, Japanese, Hebrew, Persian, Dutch, Spanish, Catalan, Armenian, Italian, English, Hungarian, German, Rumanian, and Basque. The recent debate on pragmatics and the law has found ways to circumvent an important distinction, originally drawn by Dascal and Wróblewski (1991), between the historical law-maker, the current law-maker, and the ideal/rational law-maker.1 By insisting on the relationship between the rational law-maker and contextualism and textualism (see Manning 2005, 2006), I want to redress this fault in current discussions. In this paper, I start with general considerations on pragmatics, intentionality in ordinary conversation, and intentionality in the context of judiciary (...) proceedings and legal texts. I then move on to considerations on rationality as a prerequisite for understanding the law and on the rational law-maker, an ideal construct proposed by Dascal and Wróblewski (1991). I argue that contextualism (of the moderate kind) is the best way to carry out the program by Dascal and Wróblewski on interpretation and the rational law-maker (also see considerations by Fish 2005); (on contextualism see Dascal and Weizman 1987). I argue that bearing in mind the rational law-maker postulated by Dascal and Wróblewski is a guidance to interpretation of statutes whose texts create interpretative difficulties. I conclude by saying that the considerations on the rational law-maker constitute a compromise between Scalia’s (1997) textualism and contextualism (see Manning 2005, 2006 on the divide between textualism and contextualism). This paper is an introduction to a virtual special issue of AI and Law exploring the legacy of the influential HYPO system of Rissland and Ashley. The papers included are: Arguments and cases: An inevitable intertwining, BankXX: Supporting legal arguments through heuristic retrieval, Modelling reasoning with precedents in a formal dialogue Game, A note on dimensions and factors, An empirical investigation of reasoning with legal cases through theory construction and application, Automatically classifying case texts and predicting outcomes, A factor-based definition (...) of precedential constraint and An improved factor based approach to precedential constraint. After describing HYPO, in this introduction to the special issue I look at various aspects of its influence on AI and Law: the developments led by Rissland at Amherst; the developments led by Ashley in Pittsburgh; the expression of these ideas in terms of rule based systems, and their subsequent formalisation; value based theories, which were inspired by a critique of HYPO; and contemporary approaches which revive the idea of dimensions. There is an increasing need for norms to be embedded in technology as the widespread deployment of applications such as autonomous driving, warfare and big data analysis for crime fighting and counter-terrorism becomes ever closer. Current approaches to norms in multi-agent systems tend either to simply make prohibited actions unavailable, or to provide a set of rules which the agent is obliged to follow, either as part of its design or to avoid sanctions and punishments. In this paper we argue (...) for the position that agents should be equipped with the ability to reason about a system’s norms, by reasoning about the social and moral values that norms are designed to serve; that is, perform the sort of moral reasoning we expect of humans. In particular we highlight the need for such reasoning when circumstances are such that the rules should arguably be broken, so that the reasoning can guide agents in deciding whether to comply with the norms and, if violation is desirable, how best to violate them. One approach to enabling this is to make use of an argumentation scheme based on values and designed for practical reasoning: arguments for and against actions are generated using this scheme and agents choose between actions based on their preferences over these values. Moral reasoning then requires that agents have an acceptable set of values and an acceptable ordering on their values. We first discuss how this approach can be used to think about and justify norms in general, and then discuss how this reasoning can be used to think about when norms should be violated, and the form this violation should take. We illustrate how value based reasoning can be used to decide when and how to violate a norm using a road traffic example. We also briefly consider what makes an ordering on values acceptable, and how such an ordering might be determined. (shrink)

Stories can be powerful argumentative vehicles, and they are often used to present arguments from analogy, most notably as parables, fables or allegories where the story invites the hearer to infer an important claim of the argument. Case Based Reasoning in Law has many similar features: the current case is compared to previously decided cases, and in case the similarity between the previous and current cases is deemed sufficient, a similar conclusion can be drawn for the current case. In this (...) article, we want to take a further step towards computationally modelling the connection between stories and argumentation in analogical reasoning. We show how story schemes can be used to investigate and determine story similarity, and how the point of a story – that is, the conclusion that the storyteller intends the hearer to draw – can be likened to the ratio decidendi in a legal case. Finally, we present some formal tools for modelling stories based on computational models of practical reasoning. (shrink)

Este artigo investe na ideia de que a infância é um dispositivo histórico do poder. Tem-se como referência analítica Michel Foucault, que concebe a noção de dispositivo em suas discussões a respeito da sexualidade. A hipótese geradora é a de que, a partir do momento em que a criança se torna um dos grupos estratégicos do dispositivo da sexualidade, produz-se sobre ela um conjunto heterogêneo de regimes de verdades e práticas que configura uma maneira de ser e ter uma infância, (...) influindo significativamente nas perspectivas pedagógicas modernas. Dialogando com Deleuze, Agamben e Veyne, considera-se que todo dispositivo possui: linhas de visibilidade e de enunciação que são, respectivamente, máquinas de “fazer ver” e de “fazer falar” ; linhas de força, que sustentam os campos de visibilidade e os regimes de enunciabilidade; e linhas de subjetivação que são, segundo Deleuze a dimensão do “si próprio” e que configuram o sujeito infantil. Apresenta-se três grupos de práticas articuladas às estas características do dispositivo: as práticas pedagógicas, as práticas divisórias e identitárias de gênero e de sexualidade e as práticas médicas. Observa-se que, para Foucault, o dispositivo da sexualidade disciplina os corpos, regula e normatiza a população, regulamenta o prazer e os saberes sobre o sexo, e, além disso, ocupa-se, por meio desse regime sobre o sexo, da preservação da espécie humana. A infância como dispositivo, na perspectiva ora apresentada neste artigo, também regulamenta a criança, constituindo-a em “sujeito infantil”, estabelecendo uma pedagogia e uma ciência que compuseram o pensamento pedagógico moderno sobre e para infância, ocupando-se também da preservação e da manutenção dessa espécie outra, a criança. Il saggio evidenzia come il «diritto naturale» rappresenti il cuore nevralgico della «scienza» di Giambattista Vico. Questi, nell’opporsi allo scetticismo, da un lato, e al giusnaturalismo, dall’altro, fa del «diritto naturale» il punto di incontro di molteplici questioni, dalla politica alla giurisprudenza, dall’«equità» alla «Ragion di Stato».

This essay emphasizes how Vico was one of the modern philosophers to set himself the goal to reconstruct the history of the primitive world. Differently from several authors who preceded him and also other contemporary thinkers, the Neapolitan philosopher showed that the world of the origin wasn’t idyllic, but it was affected by fear, anguish and basic needs. What mainly characterizes Vico, however, is the fact that he represented the primitive world not as a unitary and fixed block, but as (...) a world made of different historical phases and of class and social conflicts. As there were no written documents, Vico elaborated a reconstruction of history, basing it on a new and revolutionary theory of myths which, being based on creativity induced by fantasy, are called “universali fantastici”. The design and analysis of norms is a somewhat neglected topic in AI and Law, but this is not so in other areas of Computer Science. In recent years powerful techniques to model and analyse norms have been developed in the Multi-Agent Systems community, driven both by the practical need to regulate electronic institutions and open agent systems, and by a theoretical interest in mechanism design and normative systems. Agent based techniques often rely heavily on enforcing norms using the software (...) to prevent violation, but I will also discuss the use of sanctions and rewards, and the conditions under which compliance by autonomous agents (including humans) can be expected or encouraged without sanctions or rewards. In the course of the paper a suggested framework for the exploration of these issues is developed. (shrink)

Reasoning with cases has been a primary focus of those working in AI and law who have attempted to model legal reasoning. In this paper we put forward a formal model of reasoning with cases which captures many of the insights from that previous work. We begin by stating our view of reasoning with cases as a process of constructing, evaluating and applying a theory. Central to our model is a view of the relationship between cases, rules based on cases, (...) and the social values which justify those rules. Having given our view of these relationships, we present our formal model of them, and explain how theories can be constructed, compared and evaluated. We then show how previous work can be described in terms of our model, and discuss extensions to the basic model to accommodate particular features of previous work. The 1830s and 1840s are the formative years of modern public health in Britain, when the poor law bureaucrat Edwin Chadwick conceived his vision of public health through public works and began the campaign for the construction of the kinds of water and sewerage works that ultimately became the standard components of urban infrastructure throughout the developed world. This book first explores that vision and campaign against the backdrop of the great "condition-of-England" questions of the period, of what rights and (...) expectations working people could justifiably have in regard to political participation, food, shelter and conditions of work. It examines the ways Chadwick's sanitarianism fit the political needs of the much-hated Poor Law Commission and of Whig and Tory governments, each seeking some antidote to revolutionary Charitism. It then reviews the Chadwickians' efforts to solve the host of problems they met in trying to implement the sanitary idea: of what responsibilities central and local units of government, and private contractors, were to have; of how townspeople could be persuaded to embark on untried public technologies; of where the new public health experts were to come from; and of how elegant technical designs were to be fitted to the unique social, political and geographic circumstances of individual towns. Rejecting the view that Chadwick's program was a simple response to an obvious urban problem Professor Hamlin argues that at the time a "public health" focusing narrowly on sanitary public works represented a retreat of public medicine from involvement with the great social issues of the Industrial Revolution. In exploring the views of medical men who were critical of Chadwick, Hamlin suggests the parameters of a public health that might have been, in which concern for health and well-being becomes the foundation of a public medicine that is a principal guarantor of social justice. This book offers modern public heatlh professionals elements of a forgotten professional heritage that might be useful in responding to the bewildering range of health problems we now confront. Todavía hoy, a doscientos cincuenta años de su muerte, son de gran actualidad algunas de sus fundamentales teorías y formulaciones, como el principio de la división de poderes dentro de un Estado, la concepción de la existencia de un "espíritu" característico de cada pueblo, el rechazo de la tortura y la necesidad de conmensurar las penas a los (...) delitos. La relevancia, la complejidad y la riqueza de los temas afrontados por el filósofo francés hacen comprender claramente el motivo por el que autores ilustres se han visto influidos por su pensamiento, y esto sería motivo suficiente para recopilar todos sus escritos. No Tratado político, Espinosa, ao primeiro movimento do texto, faz dura crítica àqueles que criaram utopias ao tratarem da política. Tais filósofos, afirma, por tomarem os homens não pelo que são, mas pelo que gostariam que fossem, conceberam uma forma de política que nunca pôde ser posta em aplicação. Tese muito próxima à de Maquiavel, presente em O Príncipe, segundo a qual, para escrever coisa útil neste campo, deve-se ir direto alla verità effettuale della cosa che alla immaginazione di essa. (...) Não casualmente, portanto, no Capítulo V do Tratado político, último parágrafo, Espinosa usa os termos ‘agudíssimo’ e ‘prudentíssimo’ ao se referir ao florentino. Há mais Maquiavel em Espinosa para além das citações elogiosas? O artigo procurará tratar desta questão ao mostrar alguns traços comuns às respectivas filosofias políticas. Ao que indicam as fontes primárias e alguns comentadores, Espinosa teria se apropriado, e reconceitualizado, à sua maneira, teses-chave do florentino para escrever suas obras, em particular o Tratado político. No primeiro movimento o artigo analisa, em panorama, a ontologia espinosana. Após, mostra como, do interior dos conceitos presentes na ontologia, derivam os de homem, desejo, alegria e tristeza, esperança e medo, segurança e desespero, ação e paixão. Da relação entre ontologia, homens e desejo – bem como dos demais afetos –, são extraídas, em breves considerações, algumas teses políticas de Espinosa. Levanta-se, neste movimento argumentativo, a hipótese de que as teses políticas espinosanas derivam de sua ontologia e de sua (...) concepção de homem como desejo e variação de potência. O conceito de desejo é analisado à luz da variação de potência e do tema do direito natural, o qual, em Espinosa, se identifica a potência. Quando das breves derivações à política, algumas teses hobbesianas – relacionadas aos temas da multidão, povo, representação, direito natural, estado civil, etc. – são trazidas à argumentação para que se mostre, por contraste, o peso das inovações espinosanas. This paper provides a synthesis and translation of Le strutture speculative della dottrina della scienza; Il pensiero di J.G. Fichte negli anni 1801–1807 (Genova: Pantograf, 1995) by Gaetano Rametta. The 1807 Wissenschaftslehre offers important insight into Fichte’s mittlere Phase (1801–1807). Fichte’s text and Rametta’s work on it remain untranslated into English; this translation, the notes to which offer a running commentary and defi nitions of key terms, intends to make the former known through the latter. Rametta focuses on Fichte’s (...) analysis of vision, and the vision of vision. In his middle-period and later work, Fichte developed this theme far past the early Jena-period doctrine thereof, as treated by Dieter Henrich. Within this thematic context, Rametta also discusses the proof-structure of the 1807 WL, the distinction between Wahrheitslehre and Phänomenologie, and the concept of Weisheit or “wisdom.” The article concludes with a treatment of the significance of Fichte’s later philosophy for the philosophy of religion. In this introduction I give an overview of Carole Hafner’s work and discuss the papers in this volume. The final section offers some more personal reminiscences of Carole and her contribution to the AI and Law community, from myself and other colleagues.

In this paper, we take up an old issue that of pragmemes, broached by Mey and further explored by Capone. It is not easy to define pragmemes and distinguish them sufficiently from speech acts (units of language use broached by Austin and Searle) or from Wittgensteinian language games or from macro speech acts (see van Dijk on macrostructures) or from Goffman’s scripts. The best idea we could develop about pragmemes is that they instantiate the triple articulation of language, proposed (...) by Jock Wong; being essentially composed of phonological-syntactic units, that have a certain content relative to a social situation and to a certain culture, pragmemes express a certain function (or illocutionary force), like, e.g., modifying society or some aspect of it. They are part of a chapter that can be called either “societal pragmatics” or “emancipatory pragmatics,” to use the words by Mey. In fact, knowledge of how language is used to diminish the rights of people and to propagate the “status quo” may be instrumental to give rights and power to ordinary human beings who are oppressed by political and economical structures. -/- . This paper studies the use of hypothetical and value-based reasoning in US Supreme-Court cases concerning the United States Fourth Amendment. Drawing upon formal AI & Law models of legal argument a semi-formal reconstruction is given of parts of the Carney case, which has been studied previously in AI & law research on case-based reasoning. As part of the reconstruction, a semi-formal proposal is made for extending the formal AI & Law models with forms of metalevel reasoning in several argument schemes. (...)
