Le compte examiné, en dépit de ses nombreuses lacunes, assure que Janus, suivant l'exemple de Jacques Ier, renforce l'exploitation directe du domaine de la couronne, fiscalise les fiefs, développe les recettes extraordinaires (dîme royale, mète du sel). Ainsi, durant la seconde décennie du XVe s., le royaume franc conserve des (...) revenus importants, comparables à ceux d'autres États de l'Occident médiéval. Conceptual integration—“blending”—is a general cognitive operation on a par with analogy, recursion, mental modeling, conceptual categorization, and framing. It serves a variety of cognitive purposes. It is dynamic, supple, and active in the moment of thinking. It yields products that frequently become entrenched in conceptual structure and grammar, and it often performs new work on its previously entrenched products as inputs. Blending is easy to detect in spectacular cases but it is for the most part a routine, workaday process that (...) escapes detection except on technical analysis. It is not reserved for special purposes, and is not costly.In blending, structure from input mental spaces is projected to a separate, “blended” mental space. The projection is selective. Through completion and elaboration, the blend develops structure not provided by the inputs. Inferences, arguments, and ideas developed in the blend can have effect in cognition, leading us to modify the initial inputs and to change our view of the corresponding situations.Blending operates according to a set of uniform structural and dynamic principles. This article presents a formal ontology which accounts for the general nature of artefacts. The objective is to help structure application ontologies in areas where specific artefacts are present - in other words, virtually any area of activity. The conceptualization relies on recent philosophical and psychological research on artefacts, having resulted in a largely consensual theoretical basis. Furthermore, this ontology of artefacts extends the foundational DOLCE ontology and supplements its axiomatization. The conceptual primitives are as follows: artificial entity, intentional production (...) of entities, (state of) capacity, capacity to play a role in actions of a given type, function and functional object. These primitives enable artefacts in general to be characterized as intentionally and successfully produced entities, and isolate an important subclass of “technical” artefacts to which a function is ascribed. Lastly, we emphasize the novelty of this ontology by comparing it with other works with similar objectives. (shrink)

Une grande partie de l’activité est liée à des commandes faites par des donneurs d’ordre étrangers à des établissements manufacturiers. Les relations de sous-traitance ne se résument pourtant pas à des relations de subordination. En particulier en Chine rurale, ces relations peuvent être horizontales, fortement insérées dans des réseaux sociaux préexistants. Cet ouvrage est issu d’un colloque qui s’est déroulé à Paris (au Sénat) en janvier 2008. Il a été dirigé par les professeurs Gilles Darcy et Mathieu Doat, avec le soutien du Centre de Recherches Administratives de l’université de Brest et le Centre d’étude et de Recherches Administratives et Politiques de l’université de Paris 13 (Paris-Nord). Cet ouvrage cherche à mieux saisir les relations complexes entre le droit et l’imaginaire. En effet, le droit moderne est tout entier placé sous (...) le signe de la raison. L’imaginaire en semble exclu. Il est abandonné à l’art, aux poètes et aux peintres. L’image est suspecte. Elle est fiction ou rêverie. Aujourd’hui, le dépassement sinon la fin de l’ère moderne, par l’inflation des normes, la flexibilité des règles, la complexité des systèmes juridiques ont sous nos yeux des conséquences sur la manière dont on se représente le droit. Cette transformation du droit oblige à tâtonner parfois, à imaginer aussi, voire à rêver de nouvelles formes juridiques. Elle révèle en fait la part toujours présente de l’imaginaire dans le droit. C’est cette place et cette fonction de l’imaginaire en droit que cet ouvrage collectif interroge à travers quatre questions très générales qui constitueront les parties du livre. Quelle est l’importance de la manipulation des images en droit? La pensée juridique classique a pour constante tradition de dévaluer l’image. Pourtant, l’image est partout. Elle sert notre représentation de la justice ; elle permet de rêver un droit meilleur. Se faisant séductrice, elle infiltre la plupart des concepts juridiques, cachant parfois l’idéologie. L’importance de la manipulation n’inquiète pas toujours. Elle est cependant présente. Quelle part l’imagination et la rêverie prennent-elles dans la production du droit et du savoir juridique? L’imagination permet la création, l’invention des normes, des solutions juridiques et des théories. Elle déforme aussi les idées. Elle inspire le juge et transforme les textes. Comment l’imaginaire sert-il à fonder la puissance et la magie du droit? C’est la force et la puissance de l’image et de ses montages qu’il faut essayer ici de saisir. L’imaginaire fonde, bâtit, justifie, motive, légitime le système juridique. Qu’est-ce que connaître le droit quand il n’y a de connaissance que dans l’espace de la fiction? Le droit ne peut se passer de l’imaginaire. C’est une toile d’araignée qui met en rapport des mots. Les effets pervers sont multiples d’autant plus qu’on assiste à une explosion de la production juridique. (shrink)

The aim of the present article is to examine the paradox that while Bourdieu appears to be highly favorable to Marx, there is a radical disagreement between their two theoretical systems. In Bourdieu’s writing, comments favorable to Marx outweigh criticism by a ratio of 4,5 to 1. Marxists, in contrast, come in for ten times more criticism than support. Bourdieu’s approval of Marx in fact concerns only what are secondary aspects, while the few critiques he addresses delineate a structural opposition (...) between the two authors. Bourdieu rejects the theory of surplus value, the Marxist theory of exploitation, and the communist project. Among other things, he draws up a critique of Marx’s analyses of the State, legitimation, social classes. Explanation for the paradox is to be sought in the strategy deployed by Bourdieu in the field of the social sciences. (shrink)

Binding arbitration is generally less available in tort suits than in contract suits because most tort plaintiffs do not have a pre-dispute contract with the defendant, and are unlikely to consent to arbitration after the occurrence of an unforeseen injury. But the Federal Arbitration Act applies to all “contract[s] evincing a transaction involving commerce,” including contracts for healthcare and medical services. Given the broad trend towards arbitration in nearly every other business-to-consumer industry, coupled with some rollbacks in tort reform measures (...) that have traditionally favored medical professionals in the judicial system, it is very possible that we may witness in the near future more medical contracts containing arbitration provisions. But the race of incendiaries is as numerous as the waves of the sea. It is monotonous, it is indestructible, it is equal to that of the ants. It was born (...) at the same time as the first Babylonian tablets. In 1988, it continues its work. All over the world and in all times, the incendiaries were there with their torches. They burned parchments, wood or clay tablets, leather manuscripts, papyrus or folios. The same warriors who profaned temples set fire to incunabula. The same ones who slaughtered the Aztecs threw their firebrands into the collection of codices. What is it, this unleashed fury of prince and priest, judge and soldier against these small monuments of clay or paper, against these sepulchres in which the dead say that they have lived and loved, suffered and hoped? We show that the subset Z of N consisting of Fréchet-differentiable norms whose dual norm is not strictly convex reduces any difference of analytic sets. It follows that Z is exactly a difference of analytic sets when N is equipped with the standard (...) Effros–Borel structure. When we compare the genealogical strategies of the Ptolemies, Seleukids, and Hasmoneans, those of the Ptolemies and the Hasmoneans display striking parallels, while the Seleukids followed a different policy. This article explores one facet of the parallels, the combined use of funerary monuments, festivals, and narratives to create prestigious dynastic ancestors. We commence with Alexander the Great and Nectanebo II, the last native king to rule before the Persian conquest of Egypt, who became putative ancestors of the Ptolemies by way (...) of Alexander’s Sema in Alexandria, the Ptolemaic ruler cult, and four texts—the Demotic Chronicle, Nectanebo’s Dream and its “sequel”, and the Alexander Romance. The comparison between the Ptolemies and the Hasmoneans focuses on Alexander’s Sema and the Hasmonean funerary monument erected by Simon in Modi’in. Alongside their physical similarities, we show how the Modi’in monument was instrumental in turning the Hasmonean John Hyrkanos into the heir of all the tomb dwellers, particularly Judas Maccabee. La mécompréhension conceptuelle a resurgi, il y a peu, sous la forme d’une polémique sous-tendue d’arrière-pensées politiques : la laïcité elle-même serait devenue, dit-on, le masque de l’exclusion intolérante des confessions religieuses. Neste artigo, apresentamos o intuicionismo como uma atitude epistêmica geral, caracterizada pelo rigor de suas exigências de verificação não apenas na matemática e na lógica, mas em todo conhecimento cientifico.

Peut-on formuler des conditions non empiriques pour qu'un objet ou un fait soit reconnu comme ayant fonction de symbole ? Si oui, il conviendrait de les nommer conditions proto-logiques, car elles concernent des formes, comme la logique, mais sont plus primitives que les déterminations logiques mêmes. L'objet de cet article est de discuter cinq notions qui peuvent être présentées comme candidates à cette fonction d'universels proto- logiques pour les langues naturelles : la pluralité des niveaux d'« articu- lation», l'énoncé complet, (...) la notion d'« ancrage» de l'énoncé à renonciation, le nom propre, la corrélation rhème-thème. De tels universaux ne sont pas présentés comme des classes de symboles, mais des types de fonctions diversement réalisées dans des structures grammaticales. Les mettre en évidence - ou en découvrir d'autres - devrait être l'une des tâches de la philosophie du langage dans sa relation à la science linguistique.Is it possible to state non-empirical requisites for an object, fact or artefact, to obtain symbolical functioning ? If so, their status could be named proto-logical, in so far as they bear upon forms, like logic, but ought to be more primitive than logical determinations. The purpose of this paper is to discuss five notions which may be considered candidates for the functional role of proto-logical universals of natural languages : plurality of the levels of " articulations ", the concept of full-fledged sentence, " anchorage " of enunciated sentences to enunciation, proper names, the correlation rheme-theme. Such universals are not meant to correspond to classes of symbols, but to typical functions, diversely embodied in grammatical structures. To trace them - or others - should be one of the tasks of philosophy of language, in its relationship with linguistic investigations. (shrink)

Widespread preservation of fossilized biomolecules in many fossil animals has recently been reported in six studies, based on Raman microspectroscopy. Here, we show that the putative Raman signatures of organic compounds in these fossils are actually instrumental artefacts resulting from intense background luminescence. Raman spectroscopy is based on the detection of photons scattered inelastically by matter upon its interaction with a laser beam. For many natural materials, this interaction also generates a luminescence signal that is often orders of magnitude more (...) intense than the light produced by Raman scattering. Such luminescence, coupled with the transmission properties of the spectrometer, induced quasi‐periodic ripples in the measured spectra that have been incorrectly interpreted as Raman signatures of organic molecules. Although several analytical strategies have been developed to overcome this common issue, Raman microspectroscopy as used in the studies questioned here cannot be used to identify fossil biomolecules. A quoi nous conduisent inexorablement le relativisme et le pluralisme des valeurs ? A la guerre, l’actualité ne cesse de nous le confirmer. Elle peut être évitée, s’il est possible d’élever les valeurs à la vérité, seule en mesure d’apporter la concorde entre les êtres humains. C’est cette fondation rationnelle des valeurs, qui ne doit évidemment pas être métaphysique, qui est ici tentée. Mais vouloir fonder rationnellement des valeurs, n’est-ce pas œuvrer à l’établissement d’une dictature morale ? Non, dès lors (...) que ces valeurs se ramènent à la liberté. On peut craindre cependant que valoriser la liberté revienne à défendre l’égoïsme du système libéral. Ce n’est pas le cas si la liberté signifie le gouvernement responsable de soi-même. Reste à s’assurer de l’existence et de la valeur d’une telle liberté. L’enjeu est de taille : il s’agit de savoir s’il y a un sens à promouvoir le gouvernement responsable de soi-même ainsi que le respect d’autrui et de la nature, plutôt que l’intérêt et l’égoïsme. This book looks at why labour market institutions such as those evident in continental Europe - more specifically, employment protection, unemployment benefits, and relative wage rigidities - exist, what role they play in society, why they seem so persistent, where the pressure to reform them comes from, and whether reform can be politically viable or not. It studies the economic conditions under which we expect a given set of institutions to arise and remain stable, and provides theoretical guidelines about the (...) gainers and losers from given institutions.
