The article describes the implementation of the diacritical principle in the philosophy of László Tengelyi. It is emphasized that not only the method is diacritical, but also the experience in itself, in the description of which Tengelyi sees the main task of phenomenological philosophy. In doing so, the author presents the main ideas of Tengelyi's last book, paying special attention to such structures of experience as I, the Other and the world. The analysis of the categories of experience and their (...) relation is carried out, for which the Kantian term «consonance» used. However, unlike Kant, Tengelyi shows that consonance permeates all experience. Further, the author, developing Tengelyi's approach, examines in detail the diacritical relation between the I and the Other and such types of diacritically structured experience as love, despair and the consciousness of one's own death. The paper examines the ethical standpoint of the Tractatus as it has been reconstructed by Cora Diamond (“the austere view”) and gives an account of some of the criticism this reconstruction has received in the work of P. M. S. Hacker and Meredith Williams (“the standard view”). The second half of the paper tries to argue that the austere and the standard views rather complement each other if we recognize “two I ’-s” in the Tractatus and if it is supposed (...) that there is a “3rd person” and “1st person” perspective which are both voiced on its pages. The paper, drawing on articles by J. M. E. McTaggart, G. E. Moore, D. Davidson, J. L. Austin, B. Russell, A. J. Ayer and G. E. M. Anscombe, argues that the philosophy of language in the analytic tradition has developed an “inchoative“ view of time, and history is a problem as regards the existence of events in the past and how these events can be known. An alternative view is hinted at through the work of L. Wittgenstein and S. Cavell.

The prevailing justification for constitutional institutions is that such institutions reflect and enable rational solutions to social problems. However, constitutions are constructed through emotionally driven processes that reflect both the public sentiments of the day and, at least to some extent, basic moral emotions. Historical examples from France and the United States demonstrate the role of such emotional processes in shaping the design of liberal constitutionalism. Further, constitutional law both sets and regulates emotional display rules; favors or disfavors certain emotional (...) commitments; and, particularly through the formulation of fundamental human rights, reflects and shapes emotional moral judgments. The emotional contributors to constitutional design and interpretation may be called “constitutional sentiments.”. (shrink)

Psychologists are paying increasing attention to a distinction between two ways of thinking. Cognitive psychologists discern between non-reflective “intuitive” and critical reflective “analytic” thinking. Cultural psychologists discern between context-focused “holistic” and object-focused “analytic” thinking. Both find the former strongly correlated with religious beliefs and Asian cultures, the latter with secular beliefs and Euro-American cultures. Yet, recent studies convincingly suggest: first, that analytic thinking does not just relate to secular beliefs but also to alternative beliefs that straddle the boundaries between secular (...) and religious worldviews; second, that critical reflective thinking includes both the holistic context-focus of Asian religions and the analytic object-focus of European philosophies and sciences. This article supports these recent studies in the psychology of religion based on recent studies from the history and sociology of religion and a discourse analysis of interviews with members of a small-scale twenty-first-century spiritual group, as an example. We show that people who identify as spiritual in a metamodern context use both holistic and analytic thinking in creating alternative worldviews, which dialectically reconcile beliefs that many within modern western cultures would consider contradictory. We conclude that this both/and logic challenges theories and stereotypes about “secular versus religious” and “eastern versus western” thinking. (shrink)

There is widespread agreement that democracy today faces unprecedented challenges. Populism has pushed governments in new and surprising constitutional directions. Analysing the constitutional system of illiberal democracies and illiberal phenomena in 'mature democracies' that are justified in the name of 'the will of the people', this book explains that this drift to mild despotism is not authoritarianism, but an abuse of constitutionalism. Illiberal governments claim that they are as democratic and constitutional as any other. They also claim that they are (...) more popular and therefore more genuine because their rule is based on conservative, plebeian and 'patriotic' constitutional and rule of law values rather than the values liberals espouse. However, this book shows that these claims are deeply deceptive - an abuse of constitutionalism and the rule of law, not a different conception of these ideas. (shrink)

This volume presents the long-awaited edition of the Cave 4 manuscripts of Serekh Ha-Yahad or The Rule of the Community, in which the Essenes detailed the guidelines for membership in their community. Also known as the Manual of Discipline, a complete scroll was found in Cave 1 at Qumran and this edition illuminates the textual and redactional history of Dead Sea literature. The document is extremely important for understanding the nature, practice, and ideology of the Qumran covenanters.

Research in the field of Empirical Ethics (EE) uses a broad variety of empirical methodologies, such as surveys, interviews and observation, developed in disciplines such as sociology, anthropology, and psychology. Whereas these empirical disciplines see themselves as purely descriptive, EE also aims at normative reflection. Currently there is literature about the quality of empirical research in ethics, but little or no reflection on specific methodological aspects that must be considered when conducting interdisciplinary empirical ethics. Furthermore, poor methodology in an EE (...) study results in misleading ethical analyses, evaluations or recommendations. This not only deprives the study of scientific and social value, but also risks ethical misjudgement. (shrink)
