Resumo: Focamos neste trabalho algumas das tensões vivenciadas por professores pesquisadores vinculados ao sistema de Pós-graduação brasileiro, no contexto das transformações recentes da universidade. Os protagonistas da PG buscam alternativas éticas para o que consideram descaminhos na produção de conhecimentos no contexto científico. O trabalho decorre dos resultados de um conjunto de pesquisas sobre temas associados à produção em nível stricto sensu, desenvolvidas na última década por diversos pesquisadores em grupos ou projetos de investigação. Os resultados vêm mostrando cada vez (...) maior interferência de organismos nacionais de regulação, controle e avaliação do sistema de PG no funcionamento da universidade, ferindo a sua autonomia. Em consequência, os professores pesquisadores que atuam na PG veem-se compelidos a obedecer a dois ‘patrões’, ou ‘senhorios’, cujas exigências são distintas e não raro antagônicas. Diante dos frequentes conflitos entre as exigências, prevalece a subserviência ao órgão externo, já que as próprias IES estão sob avaliação destes órgãos. Neste contexto, emerge o debate sobre a excelência da produção acadêmico-científica, trazendo-se à tona os limites da produção/produtivismo. Como contribuição trazemos a noção de pertinência territorial para pensar outra possível modalidade de excelência. Por fim, enriquecemos a discussão da problemática, a partir da perspectiva do pensamento decolonial, que envolve a crítica ao eurocentrismo vigente em nossa academia e propõe o ‘penso onde sou’ como caminho para que a produção científica encontre alternativas, conectadas com as realidades e necessidades dos territórios em que estão instaladas as universidades e seus programas de PG. Introduction:Despite being considered as a contravention under some countries’ legislation, the therapeutic use of Cannabis sativa has been growing in Brazil, due to the promising results observed in many pathologies. Such a scenario has fostered the need to deepen discussions on the subject and possibly revise legislation governing the substance use and access.Objectives:Identify the types of stigma related to the therapeutic use of Cannabis and describe the strategies people use to overcome stigma.Methods:This integrative review was carried out in the databases (...) PubMed, Scopus, CINAHL, MEDLINE, PsycINFO, Web of Science, and Cochrane Library, with 565 articles being retrieved. Triads’ cross-check were done, first maintaining the “cannabis” and “therapeutic use” pair, added by “stigma,” “bioethics,” “ethics,” “social consequences,” and “legal consequences.” The final selection resulted in six articles.Ethical Consideration:However, the ethical issues that pervade and regulate decisions on this subject must be considered.Results:Different dimensions and types of stigma related to the therapeutic use of Cannabis have been identified. The bioethical principle of autonomy was an expression of citizenship and human rights, mitigating internal conflicts related to self-stigma and the effects of external stigma on the person’s life.Conclusion:It was possible to identify the types of stigma related to the therapeutic use of Cannabis is an internal dimension represented and an external dimension, represented and to identify strategies adopted to face this stigma: skills training group for users, elaboration of laws and specific programs to clarify the therapeutic use of Cannabis with a greater social scope, and support for family members. Thus, contributing to the building of people’s autonomy in a broader context of decision-making autonomy and executive autonomy will provide the development of people’s capacity to perform complex tasks of self-management and, consequently, to continue promoting and preserving their decision-making process and their capacity to plan and perform tasks associated with managing their lives and their treatments. Public decisions concerning large projects with detrimental environmental or heritage impacts involve value conflicts which stem from the diverse interests and variety of ways of evaluating the costs and benefits of such projects. They are also framed by institutionalised procedures and practices which favour certain concerns to the detriment of others. This paper aims to contribute towards a better understanding of how these procedures and practices, namely decision support tools such as the Environmental Impact Assessment (EIA), tend to shape public (...) decision-making processes in particular ways. It draws on a study of the public controversy surrounding the Foz Tua dam in Portugal, with a focus on the values upheld by the different parties in the controversy and their interplay in the production of justifications, specifically the actors’ positions on values and value conflicts and the restrictions posed by institutionalised public decision-making procedures on the expression and consideration of certain values. La première position est celle de Simon de Faversham, développée vers 1280 et probablement durant son séjour à la Faculté des arts de Paris. La seconde position est celle de Raoul le Breton, dernier des plus grands (...) maîtres ès arts parisien. The purpose of this article is to analyse how the background knowledge of travellers from the Old World have determined how they would experience American space. Such knowledge is more specifically directed in my study towards religion and politics, as my analysis intends to scrutinise how such realms made – and still make – subjects get to questionable conclusions since both Christianity and capitalism have had the normative tradition of disregarding the possibility of any meanings to deviate from their main (...) epistemes. My specific context, in this sense, concerns the travel book A Journey in Brazil and Maria Helena Machado’s compilation of William James’ diary – Brazil through the Eyes of William James – both written during the same trip to the Amazon. Main findings are: Louis Agassiz ambitious projects in America – more specifically the Amazon – prevented him from being as challenged by the journey as William James ends up being; there is enough literary evidence to assume that, in overall terms, his Christian bigotry made him immobile and unflappable when facing difference. Pensando nisso e preocupadas em oferecer ferramentas para o educador é que temos desenvolvido oficinas com dinâmicas, pois elas favorecem o filosofar, possibilitam ao profissional da educação infantil um espaço para ressignificar sua atuação e sua prática diante da reflexão e de vivências que o levem a experimentar o saber de si enquanto sujeito aberto ao diálogo e a novas aprendizagens.

Por incorporar a esperança na pedagogia crítica para, um só tempo, humanizar radicalmente a educação e transformar a sociedade, ele faz aumentar nossas expectativas sobre o que são capazes de fazer uma teoria e uma pedagogia ao construir um caminho que demonstra a indissociabilidade de ordem teórica e prática.

Despite its potential implications for the objectivity of scientific knowledge, the claim that “scientific instruments are perspectival” has received little critical attention. I show that this claim is best understood as highlighting the dependence of instruments on different perspectives. When closely analyzed, instead of constituting a novel epistemic challenge, this dependence can be exploited to mount novel strategies for resolving two old epistemic problems: conceptual relativism and theory-ladeness. The novel content of this article consists in articulating and developing these strategies (...) by introducing two fine-grained notions of perspectives as the key units of analysis: “broad perspectives” and “narrow perspectives.”. Like other postmodern structures, post-industrial labour markets display more frequent and rapid changes and higher unpredictability. In these conditions, the world of work is less capable in providing individuals stable signals for the construction of their behaviours. This paper aims to examine both macro and micro factors that shape labour market participation and expectations related to employment outcomes. We explore statistical data from the World Values Survey Wave 7 collected from almost seventy thousands individuals around the world. Education can be seen as an investment that brings higher incomes to individuals. People with higher levels of education collect important earnings premium in the labour market. On the other hand, the expansion of education is a major trend that characterizes evolution of societies, with important positive effects at the level of social and economic development. This paper aims to explore the influence of educational attainment on subjective incomes of individuals, while taking into account other relevant personal factors, as well (...) as the phenomenon of education expansion at national level. We build our analysis on data from the World Values Survey Wave 7 collected from individuals around the world in various national settings. Our results are useful for better understand the influences of increasing participation to education on the earnings structure at both individual and national levels. (shrink)

We introduce the papers in this special issue by providing an overarching perspective on the variety in kinds of commons and the ethical issues stemming from their diversity. Despite a long history of local commons management, recent decades have witnessed a surge of scholarly interest in the concept of “the commons,” including a growing management literature. This swell was impelled especially by Garrett Hardin’s paper of 1968, and the body of work generated by Elinor Ostrom and her colleagues. However, the (...) term itself has come to be used in a variety of ways. To contextualize its ethical dimensions, we map a number of commons-related concepts such as common-pool resources, common property regime, excludability and subtractability, common-pool resource types and commons or “commoning” as a source of production. Following a brief summary of papers in this special issue, the essay concludes with an identification of implications for research, practice and policy. (shrink)

This article explores the implicit theories of morality, or the conceptions regarding the patterns of stability, continuity and change in moral dispositions, both in lay and academic discourses. The controversies surrounding these conceptions and the fragmentation of the models and perspectives in metaethics and moral psychology endangers the pursuit of adequate operationalizations of morally relevant constructs. The current debate between situationists, who deny that character is an useful concept for understanding human behavior, which is better explained by contextual factors (Doris (...) 1998; Harman 1998) and dispositionists, who advocate the cross-situational stability of traits, is also present in the lay discourse, through the existence of competing commonsense ontological assumptions regarding the mutability or alterability of moral features, namely the implicit theories perspective (Chiu, Dweck, Tong, & Fu 1997). These personal theories are primary suspects in the affective and cognitive reactions to transgressions: the type of attended information in formulating evaluative judgments, the calibration of moral responsibility and blameworthiness, the assignment of retribution or reparatory recommendations to transgressors. In the second part of the study we attempt to advance toward a more fine-grained inspection of these lay beliefs, arguing that the construct of implicit theories of morality, as it is currently treated and measured, tends to be restrictive and oversimplifying. This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. Our paper reveals Professor Grigore T. Popaʼs view on medical ethics of anatomical teaching as he was bringing in Romania the experience of the Anglo-Saxon education from both England and the United States. We analysed his lecture: “What Anatomy is or is not?” where he introduced some ideas of medical ethics. Professor Popa considered that medical ethics and deontology are required whenever someone studies the anatomy of the human body. Anatomy teaches us the lesson of respect towards human body, and (...) so it can never be reduced to a useless science, since it expresses the spiritual nature of mankind. (shrink)

The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

Art opens itself to many different functions. In principle, one cannot exclude that a work of art acts as stimulant or relaxant, that it provides cognitive benefits or serves social aims. However, the fact that it fulfills a certain function does not transform a product into an artistic creation, nor does it prevents it from being art. Rather the capacity to open an unlimited functional and meaningful space is what comprises the autonomy and the artistic quality of a work.

El presente artículo parte del presupuesto de que el trabajo de la memoria tiene un efecto transformador y liberador, si es llevado a cabo de forma dinámica, creativa y participativa. Como se verá, las experiencias y producciones estéticas adquieren aquí una función destacada, especialmente cuando se comparten de manera abierta y solidaria en una comunidad. Se argumentará que el fomento del trabajo productivo de la memoria con medios estéticos es una labor que no puede ni debe terminar nunca, puesto que (...) tiene una importancia vital para los procesos emancipadores del ser humano. Cuando se activa el potencial productivo y transformador de la memoria, se trascienden historias cerradas, unívocas y homogéneas, como las que propaga una memoria meramente reproductiva, puesta al servicio de una ideología imperante. Esta tesis central será analizada en sus implicaciones filosóficas y discutida contraponiendo la «memoria comunitaria», esencialmente productiva y transformadora, a la «memoria oficial» que procede de manera reproductiva y manipulativa. Ejemplos de iniciativas comunitarias del contexto colombiano ilustrarán finalmente de qué manera medios estéticos pueden despertar y fomentar una memoria crítica y transformadora, capaz de convertir historias cerradas, ignoradas o reprimidas en posibilidades que se abren a la vida. Resumen: Espacio y tiempo son conceptos inseparables. La relación que los une es tan estrecha que el espacio puede considerarse la otra cara del tiempo, y viceversa. La unidad y a la vez alteridad espacio-temporal representa un problema fundamental tanto para la ciencia, especialmente la física, como para la filosofía y el arte. Aunque puede haber puntos de encuentro entre las concepciones de las diferentes áreas, se observan diferencias fundamentales en la manera de entender ambos conceptos y la relación entre (...) ellos. El espacio y tiempo de la física clásica y el espacio lógico de Wittgenstein, ligado al presupuesto de la simultaneidad, son presuposiciones teóricas necesarias para establecer leyes físicas o bien para lograr representaciones exactas. Frente a la noción científica y transcendental está la concepción ontológica de Heidegger y la artística de Chillida. Renunciando al ideal de la exactitud, de lo medible y comprobable, el filósofo y el escultor entienden la mutua pertenencia de espacio y tiempo como algo que tiene una importancia fundamental para la vida humana y que representa un reto que hay que buscar.: Space and time are inseparable concepts. The relationship that joins them is so close that one can understand space as the opposite side of time, and vice versa. Unity and otherness of space and time constitute a fundamental problem for science, especially physics, as well as for philosophy and art. Although there may be connecting lines between the conceptions those different fields hold on space and time, one observes fundamental differences in the way they understand these two concepts and the relation between them. The conception of space and time in classical physics, as well as in Wittgenstein’s notion of logical space connected with the principle of simultaneity, represent necessary theoretical premises in order to establish physical laws and precise representations. Opposite to the scientific and transcendental concepts, we find Heidegger’s ontological and Chillida’s artistic conceptions. Giving up the ideal of precision, of measurement and verification, the philosopher and the sculptor understand the mutual belonging of space and time as something that has a fundamental importance in human life, and that constitutes a challenge that one can only search for. Introduction: The teacher-student relationship in medicine determines the bond established with the patient. Objective: This study was designed to compare if first and third year medical students at a university perceived incidents perpetrated by teachers as morally wrong. Materials and methods: A semi-structured survey was used with open and closed items; specifically, participants were asked to relate a morally wrong incident, classified to six categories. Results: 80.7% in the third-year students and 30.4% of the first-year students perceived incidents that involved (...) mostly auxiliary personnel and evaluations. Verbal abuse and unfair assessment were the categories mentioned the most. Discussion: A morally wrong incident is a general concept, differing from other studies that specifically analyze abuse, also evident in this concept. Conclusion: A lack of respect and justice could indicate a lack of moral commitment. (shrink)

Spin is a fundamental and distinctive property of the electron, having far-reaching implications. Yet its purely formal treatment often blurs the physical content and meaning of the spin operator and associated observables. In this work we propose to advance in disclosing the meaning behind the formalism, by first recalling some basic facts about the one-particle spin operator. Consistently informed by and in line with the quantum formalism, we then proceed to analyse in detail the spin projection operator correlation function \=\left\langle (...) \left \left \right\rangle \) for the bipartite singlet state, and show it to be amenable to an unequivocal probabilistic reading. In particular, the calculation of \\) entails a partitioning of the probability space, which is dependent on the directions \.\) The derivation of the CHSH- or other Bell-type inequalities, on the other hand, does not consider such partitioning. This observation puts into question the applicability of Bell-type inequalities to the bipartite singlet spin state. (shrink)

Aquí, presentamos un recuento de las reflexiones de estos teóricos y las ponemos en diálogo con la obra literaria del (...) Elicura Chihuailaf titulada Recado confidencial a los chilenos. El objetivo de este artículo es evidenciar el carácter poscolonial y posoccidental de una obra literaria que es en sí misma un forma de resistencia y de oposición a esa homogenización discursiva de la identidad latinoamericana que, desde la occidentalización y la permanencia del pensamiento colonial, ha imperado por largo tiempo en los estudios latinoamericanistas. Cette étude vise à comprendre les spécificités sémantiques des lexèmes _manipuler_ et _modifier_ afin d’éclairer l’usage qui en est fait en bioéthique lorsque les actions désignées ont comme objet l’embryon, le cerveau, l’ADN, l’Homme, le vivant ou la procréation. En s’appuyant sur les définitions des dictionnaires et sur les réponses à un questionnaire soumis aux locuteurs, et en se servant de concepts de la sémantique combinatoire, de la sémantique argumentative, de la sémantique des cadres et de l’aspect sémantique, l’étude identifie (...) les éléments de signification propres à chacun des deux lexèmes. Ces éléments sont étroitement liés au potentiel de signification des lexèmes et aux traits aspectuels des procès qu’ils désignent. À l’issue de cette étude, un ensemble de traits sémantiques caractéristiques de chaque lexème est proposé, dans une perspective contrastive. (shrink)

Classifications are useful and efficient. We group things into kinds to facilitate the acquisition and transmission of important, often tacit, information about a particular entity qua member of some kind. Whilst it is universally acknowledged that classifications are useful, some scientific classifications (e.g. chemical elements) are held to higher epistemic standards than folk classifications (e.g. bugs). Scientific classifications in terms of ‘natural kinds’ are considered to be more reliable and successful because they are highly projectible and support law-like and inductive (...) generalisations. What counts as a natural kind is, however, controversial: according to essentialists (e.g. Putnam, Kripke, Ellis) natural kinds are mind-independent and possess essential characteristics; according to promiscuous realists (e.g. Dupre ) there are ‘countless legitimate, objectively grounded ways of classifying objects in the world’; and according to scientific realists (e.g. Boyd, Psillos) natural kinds are grounded in the ‘causal structure of the world’. More specifically, realism about kinds can be understood as a commitment to the existence of natural divisions (kinds) in the world that we come to know as a result of mature scientific investigation into the nature of such kinds. Realism about natural kinds is supported and articulated in terms of three main arguments, metaphysical, semantical, and epistemological. In the first part of my thesis I offer a sustained and systematic investigation of these three main arguments, with their respective promises and prospects for the viability of realism about kinds and I find them wanting, whilst in the second part of the thesis I pursue an unexplored line of inquiry regarding natural kinds and propose a mild realism about natural kinds via the ontology of real patterns.
