Inhabitants of low-lying islands flooded due to anthropogenic climate change will lose their territory and thereby their ability to exercise their right to political self-determination. This paper addresses the normative questions which arise when climate change threatens territorial rights. It explores whether the loss of statehood supports a claim to territorial compensation, and if so, how it can be satisfied. The paper concludes that such claims are well founded and that they should be met by providing compensatory territories. After introducing (...) a differentiation between land rights and territorial rights, previous theoretical responses to the problem of sinking islands are criticized. It is argued that states may be required to give up parts of their territory as compensation. The paper develops criteria of sufficiency for compensatory territories and proposes to base their selection process on a negative auction. Since it is unlikely that unsettled compensatory territories that meet the specified requirements are available, the rights of their original inhabitants are discussed. (shrink)

In the context of discovery-oriented hypothesis testing research, behavioral scientists widely accept a convention for false positive (α) and false negative error rates (β) proposed by Jacob Cohen, who deemed the general relative seriousness of the antecedently accepted α = 0.05 to be matched by β = 0.20. Cohen’s convention not only ignores contexts of hypothesis testing where the more serious error is the β-error. Cohen’s convention also implies for discovery-oriented hypothesis testing research that a statistically significant observed effect is (...) four times more probable to be a mistaken discovery than for a statistically significant true observed effect to be independently replicable. In the long run, Cohen’s convention thus is epistemically harmful to the development of a progressive science of human behavior, making its acceptance crucial in explaining the replication crisis in behavioral science. The balance between α- and β-errors generally ought to be struck using both epistemic and practical considerations. Yet epistemic considerations alone imply that making a genuine contribution to the body of knowledge in behavioral science requires error rates that are not only small but also symmetrical. (shrink)

Meaningful work is a key element of positive functioning of employees, but what makes work meaningful? Based on research on self-determination theory, basic psychological needs, and prosocial impact, we suggest that there are four psychological satisfactions that substantially influence work meaningfulness across cultures: autonomy (sense of volition), competence (sense of efficacy), relatedness (sense of caring relationships), and beneficence (sense of making a positive contribution). We test the relationships between these satisfactions and perceived meaningful work in Finland (n = 594, employees (...) of several organizations), India (n = 342, collected through Mturk), and the USA (n = 373, collected through Mturk). Regression analyses show that – except for competence in USA – all four satisfactions are significantly and independently associated with meaningful work. Moreover, structural equation modeling shows that they fully mediated the relationship between occupational position and work meaningfulness in India and in the USA. In sum, the results support the importance of these four satisfactions in explaining the psychological underpinnings of meaningful work. (shrink)

Zusammenfassung Die im Dezember 2022 in Kraft getretene Erweiterung des Infektionsschutzgesetzes sieht vor, im Fall einer Pandemie knappe intensivmedizinische Ressourcen nach dem Kriterium der Überlebenswahrscheinlichkeit zu priorisieren. Der Aufsatz geht der Frage nach, ob der Vorwurf, diese Regelung setze Menschen mit Behinderung einer erheblichen Diskriminierungsgefahr aus, berechtigt ist. Nach einer kurzen Darstellung des im Infektionsschutzgesetz festgelegten Zuteilungsverfahrens wird zunächst das vielschichtige Konzept der Diskriminierung erörtert. Im Kontext der Allokation knapper intensivmedizinischer Ressourcen besteht vornehmlich das Risiko einer nichtintendierten Diskriminierung, die in (...) direkter wie auch indirekter Form erfolgen kann. Die Regelungen, die das Infektionsschutzgesetz trifft, bieten Menschen mit Behinderung einen vergleichsweise hohen Schutz vor direkter Diskriminierung. Dennoch müssen Menschen mit bestimmten Behinderungen gravierende Nachteile hinnehmen, weil sie im Fall einer COVID-19-Infektion absehbar eine geringere Überlebenswahrscheinlichkeit als gesunde Menschen haben. Eine indirekte Diskriminierung liegt aber nur dann vor, wenn für die Auferlegung disproportionaler Nachteile keine hinreichende Rechtfertigung angeführt werden kann. In modernen pluralistischen Gesellschaften, die durch tiefgreifende Wertkonflikte gekennzeichnet sind, sollten unterschiedliche ethische Theorien – darunter auch konsequentialistische Positionen – als mögliche Grundlage einer Rechtfertigung anerkannt werden. Im Ergebnis erweist sich der Vorwurf, eine am Kriterium der Überlebenswahrscheinlichkeit orientierte Zuteilung knapper intensivmedizinischer Ressourcen bewirke eine Diskriminierung von Menschen mit Behinderung, als nicht stichhaltig. The political agreements concluded in the summer of 1981 between the main majority and opposition parties constitute a turning point in the development of Spanish regionalism. Whereas previously autonomy statutes were awarded to historic regions with strong social and cultural identities, we have now a situation where a considerable degree of self-government is also made possible for all other regions. This decision shifted the focus more to socio-economic development, thereby stimulating expectations of improvement based on regional political efforts as well (...) as on national solidarity and state assistance. The recently adopted statute of Andalucia illustrates excellently this new orientation. In this contribution an analysis is made of the institutional instruments available for regional self-government. The conclusions are quite positive with regard to the devolution of powers provided in the constitution and the different statutes. Nevertheless Spain is not evolving into a federal state system. As a more appropriate description we prefer Perez Moreno's characterisation of the existing intergovernmental relations as «autonomias integradas». (shrink)

The restructuration of municipalities which has been decided by the Belgian government, is not only a purely technical operatzon but rather, and in the first place, a social problem. The shape and duty-profile of a local authority should not, indeed, be attuned only to fast changing expectations as far as services are concerned, but to consultation and participation as well.Public administration research cannot keep aloof from this debate, but is considerably hampered by the institutional confusion and the insufficient explicitation of (...) the aims of the present reform. A starting-pointcan, however, be found in the mergers of municipalities that were realized in 1964 and in 1970/1971. In 67 of these municipalities an inquiry was held concerning the consequences of the merger, and moreover, in twotest-cases this inquiry grew to a full-scale systematic policy analysis.This research shows that, as a rule, the former municipalities are reasonably represented in the new entity's council, but it also reveals that few efforts are made to give this representation a broader impact along formal or informal participation-channels. Integration of employees has not caused insurmountable problems. However, in large sized municipalities, resulting from mergers, one could notice a drastic increase in municipal personnel, not only with regard to new duties and objectives but to traditional administrative and police duties as well. Such a phenomenon points to the far-reaching changes which a substantial scale-increase provokes in a municipality's structure and policy profile. A large municipality resulting from mergers is no langer a simple sum of component parts, but a completely new entity, wishing to catch up as fast as possible with comparable municipalities that passed through a progressive growth process. Therefore, scale-increase is not only a means of economizing or an intra-administrative matter, but rather a way of creating chances for further development or wealth and well-being. (shrink)

Separatism has become an important issue in international politics, as events like the fall of the Soviet Union and Yugoslavia have demonstrated. This book investigates whether the secession of democratic states can be justified. Beginning with a critical analysis of current philosophical and people’s rights debates, the author develops his own legitimation theory. Drawing on the fundamental values of modern democracies, the author argues that a right of secession should be recognized.

This volume analyses, from a computational point of view, how culture may arise, develop and evolve through time. The four sections in this book examine and analyse the modelling of culture, group and organisation culture, culture simulation, and culture-sensitive technology design. Different research disciplines have different perspectives on culture, making it difficult to compare and integrate different concepts and models of culture. By taking a computational perspective this book nevertheless enables the integration of concepts that play a role in culture, (...) even though they might originate from different disciplines. Culture is usually regarded as something vague and qualitative and thus difficult to deal with in a computational and formal setting. Taking a computational approach to culture thus encompasses a twofold risk: taking a too simplistic approach to cultural influence on behaviour; or trying to capture too much, hence not leading to useful computational tools. However, the approaches and insights in this collection show how different perspectives by leading researchers described in thirteen chapters still can form a coherent picture. The book thus illustrates the potential of using computing systems to better understand culture. By describing methods, theories and concrete application results about the integration of cultural aspects into computer systems, this book provides inspiration to researchers of all disciplines alike and presents the start of an interdisciplinary dialogue on culture. Algorithmic decision-making increasingly shapes people's daily lives. Given that such autonomous systems can cause severe harm to individuals and social groups, fairness concerns have arisen. A human-centric approach demanded by scholars and policymakers requires considering people's fairness perceptions when designing and implementing algorithmic decision-making. We provide a comprehensive, systematic literature review synthesizing the existing empirical insights on perceptions of algorithmic fairness from 58 empirical studies spanning multiple domains and scientific disciplines. Through thorough coding, we systemize the current empirical literature along (...) four dimensions: (1) algorithmic predictors, (2) human predictors, (3) comparative effects (human decision-making vs. algorithmic decision-making), and (4) consequences of algorithmic decision-making. While we identify much heterogeneity around the theoretical concepts and empirical measurements of algorithmic fairness, the insights come almost exclusively from Western-democratic contexts. By advocating for more interdisciplinary research adopting a society-in-the-loop framework, we hope our work will contribute to fairer and more responsible algorithmic decision-making. (shrink)

The meshed control theory assumes that cognitive control and automatic processes work together in the natural attention of experts for superior performance. However, the methods adopted by previous studies limit their capacity to provide in-depth information on the neuromotor processes. This experiment tested the theory with an alternative approach. Twelve skilled golfers were recruited to perform a putting task under three conditions: (1) normal condition, with no focus instruction (NC), (2) external focus of attention condition (EC), and (3) internal focus (...) of attention condition (IC). Four blocks of 10 putts each were performed under each condition. The putting success rate and accuracy were measured and electroencephalographies (EEGs) were recorded. The behavioral results showed that the NC produced a higher putting success rate and accuracy than the EC and IC. The EEG data showed that the skilled golfers’ attentional processes in the NC initially resembled those in the EC and then moved toward those in the IC just before putting. This indicates a switch from more automatic processes to cognitive control processes while preparing to putt. The findings offer support for the meshed control theory and indicate the dynamic nature of neuromotor processes for the superior performance of athletes in challenging situations. (shrink)

It is "the hour of terror at the world's vast meaningless grinding" that William James (Will to Believe 173) examines, described by Todd May (...) (xi) as "the confrontation of our need for meaning with the unwillingness of the Universe to yield it to us." This confrontation with the existential void and the potential absurdity of human existence is often not just an intellectual dilemma, but felt as a deep personal crisis accompanied by melancholia, angst, nausea, or even suicidal thoughts. Young William James confessed in a letter to a friend that "all last winter" he "was on the continual verge of suicide" (quoted in Gunnarsson), writing later that "too much questioning" leads "to the edge of the slope" wherein lies "nightmare or suicidal view of life" (James, "Is Life Worth Living?" 6). Similarly, Leo Tolstoy (54) reports how his inability to identify a lasting meaning of life drove him to a "state of lunacy" where "the best I could do was to hang myself."Despite a few earlier allusions—most famously the Book of Ecclesiastes proclaiming that "all is vanity and a striving after wind," and Shakespeare's Macbeth lamenting that life is "a tale told by an idiot … signifying nothing"—the existential confrontation is predominantly a modern phenomenon (Martela, A Wonderful Life). Addressing the slippery slope argument (SSA) in legal contexts from the perspective of pragma-dialectics, this paper elaborates the conditions under which an SSA-scheme instance is used reasonably (rather than fallaciously). We review SSA-instances in past legal decisions and analyze the basic legal SSA-scheme. By illustrating the institutional preconditions influencing the reasoning by which an SSA moves forward, we identify three sub-schemes (causal SSA, analogical SSA, and Sorites SSA). For each sub-scheme we propose critical questions, as well as four rules that (...) clarify when the SSA scheme is used reasonably. The institutional preconditions make the analogical SSA expectable in common law contexts; the Sorites SSA is expectable in civil law contexts; whereas the causal SSA is common to both contexts. This result should inform future work on the identification of typical argumentative patterns for the SSA in legal contexts. (shrink)

L(ow) tone in Mandarin Chinese causes both downstep and post-low-bouncing. Downstep refers to the lowering of a H(igh) tone after a L tone, which is usually measured by comparing the H tones in a “H…HLH…H” sentence with a “H…HHH…H” sentence (cross-comparison), investigating whether downstep sets a new pitch register for the scaling of subsequent tones. Post-low-bouncing refers to the raising of a H tone after a focused L tone. The current study investigates how downstep and post-low-bouncing interact with focus and (...) phrasing in Mandarin Chinese. In the experiment, we systematically manipulated (a) the tonal environment by embedding two syllables with either LH or HH tone (syllable X and Y) sentence-medially in the same carrier sentences containing only H tones; (b) boundary strength between X and Y by introducing either a syllable boundary or a phonological phrase boundary; and (c) information structure by either placing a contrastive focus in the HL/HH word (XF), syllable Y (YF), or the sentence-final word (ZF). A wide-focus condition served as the baseline. With systematic control of focus and boundary strength around the L tone, the current study shows that the downstep effect in Mandarin is quite robust, lasting for 3–5 H tones after the L tone, but eventually levelling back again to the register reference line of a H tone. The way how focus and phrasing interact with the downstep effect is unexpected. Firstly, sentence-final focus has no anticipatory effect on shortening the downstep effect; instead, it makes the downstep effect lasts longer as compared to the wide focus condition. Secondly, the downstep effect still shows when the H tone after the L tone is on-focus (YF), in a weaker manner than the wide focus condition, and is overridden by the post-focus-compression. Thirdly, the downstep effect gets greater when the boundary after the L tone is stronger, because the L tone is longer and more likely to be creaky. We further analyzed downstep by measuring the F0 drop between the two H tones surrounding the L tone (sequential-comparison). Comparing it with F0 drop in all-H sentences (i.e., declination), it showed that the downstep effect was much greater and more robust than declination. However, creaky voice in the L tone was not the direct cause of downstep. At last, when the L tone was under focus (XF), it caused a post-low-bouncing effect, which is weakened by a phonological phrase boundary. Altogether, the results showed that although intonation is largely controlled by informative functions, the physical-articulatory controls are relatively persistent, varying within the pitch range of 2.5 semitones. Downstep and post-low-bouncing in Mandarin Chinese thus seem to be mainly due to physical-articulatory movement on varying pitch, with the gradual tonal F0 change meeting the requirement of smooth transition across syllables, and avoiding confusion in informative F0 control. Then, he finds in Cicero the idea of a befitting mutuality among four distinctively human capacities: a faculty for inquiry into and love for truth manifest in words and actions (reason); a disposition for the recognition of and attraction to things of worth beyond self-interest (the honorable); an acute sense (...) of one own spheres of responsibility along with facility for speaking and acting appropriately within them (appropriate action), and fostering and extending the bonds of mutual personal relations grounded in justice and benevolence (society). This article moves between Aristotle, Maimonides, and the Stoics. Aristotle’s moral taxonomy, outlined in NE 7.1, appears problematic, given his view that, in the sphere of moral virtue, the intermediate (temperance, courage) is the extreme, and there is no excess of temperance or courage. This is hard to square with the moral agent whom he describes as possessed of “hyperbolic” (hyperbole, excessive) virtue. As Aristotle has very little to say about the latter, I turn to Maimonides and the Stoics for (...) clarification and enlightenment. (shrink)

Newspaper stories that rely on reconstruction of events from police reports, court records, and recollections of witnesses often sacrifice attribution for the sake of immediacy. Such stories make compelling reading, but they mislead readers by erasing the line between information obtained via observation and information obtained from human or documentary sources. This article argues that the lack of attribution is more distracting than it presence--because readers wonder how the reporters know what they know--and calls on reporters to make clear when (...) they have left the realm of observation and entered that of reconstruction.
