ABSTRACT The ethical review process is an important component of contemporary health research worldwide. Sudan started an ethical review process rather late in comparison with other countries. In this study, we evaluate the structure and functions of existing ethics review committees. We also explore the knowledge and attitudes of Sudanese researchers toward the ethical review process and their experience with existing ethics review committees. There are four ethics review committees in the country; these committees have no institutional regulations to govern (...) their functions. Furthermore, Sudan also lacks national guidelines. Ethical reviews are carried out primarily for studies seeking international funding and are almost always governed by the funding agencies’ requirements. Nearly half of respondents (46.3%) knew about the existence of research ethics committees in Sudan. The current study investigated correlations among gifted students’ academic performance; emotional, social, analytical, creative, and practical intelligence; and their implicit theories of intelligence. Furthermore, it studied the effect of gender and grade on these variables. The participants included 174 gifted fifth and sixth grade students, comprising 53.4% male and 46.6% female. The following analytical, creative, and practical intelligence tests were administered: Aurora Battery, the emotional intelligence scale, the implicit theories of intelligence scale, and an assessment scale of students’ performances. The (...) results revealed significant correlations among academic performance, kinds of intelligence, and implicit theories of intelligence. There were no significant differences between the male and female students in these measures. There were, however, significant differences between the fifth and sixth grade students, with the sixth-grade students showing higher levels of all kinds of intelligence, except emotional intelligence. Moreover, the results indicated that the intelligence measures were non-significantly affected by either gender or gender–grade interaction. Overall, our results showed that most types of intelligence are related to giftedness, and that there were no gender differences among gifted students on measures of intelligence. (shrink)

Many practices available for use in health service psychology are ineffective or harmful. How we describe these practices is important to scientific discourse and science communication with policy-makers and the general public. The label “pseudoscience” is typically applied in these cases, though the meaning of pseudoscience varies widely creating a quagmire for transparent and accurate communication. To clarify this issue, we review several prominent definitions of pseudoscience as well as consider how the term is used amongst psychology scholars and science-communicators. (...) We define two additional terms adapted from the medical literature, contemporary and alternative psychotherapies and low-value practices, and discuss their strengths and limitations. Finally, we recommend the broader category of low-value practices for use due to its definitional clarity, lack of competing definitions, and potential for clarifying research programs. (shrink)

ObjectivesThe emergence of the COVID-19 pandemic worsened Lebanon’s economic situation and generated worries about living conditions. This study aimed to explain personal economic worries patterns among Lebanese young adults while accounting for demographics and mental health characteristics.MethodsA total sample of 988 Lebanese responses were collected, using an online survey. The analysis was conducted using regression-based methods.ResultsMen exhibited higher economic worries than women. Lower levels of economic worries among people with higher wages were more pronounced. Lebanese retirees experience the highest economic (...) worries compared to other employment status groups. Individuals with higher life satisfaction are less concerned about the economy. Mental wellbeing factors were positively associated with personal economic worries.ConclusionThe current study presents a seminal insight into the differences in economic worries caused by COVID-19 pandemic among individuals in a developing country context. The paper explores the important but neglected field of primary schoolchildren's attitudes towards the environment using a specifically designed scale in Arabic and English. It reports attitude differences towards the environment and three domains -- pollution, waste and animals and plants -- according to nationality and gender. Overall the findings show that environmental education programmes produce only slightly positive attitudes. Consideration is given to the further research required to enhance such programmes.

In 2011, the people of Tunisia, Egypt, Libya, Yemen, Bahrain and later Syria struggled to overthrow their despotic regimes and bring about radical political change. However, to date, little discussion has revolved around the role of long-standing assumptions about political change and human rights in the Arab world in prolonging the lifespan of these collapsing regimes. The first of these assumptions claimed that authoritarian rulers were the guarantors of stability in nations throughout the region. Second was the assumption that Islamists (...) were the sole alternative to authoritarian regimes in the region. These uprisings also proved false the theory that democracy and civil and political rights were not priorities for peoples of the Arab world. Finally, the fourth assumption to be debunked is the claim that the people of the region are not ready for a democratic system that respects human rights because the religion of the majority—Islam—is incompatible with democratic values and human rights. ABSTRACT At the beginning of the twentieth century, health research in the Sudan developed primarily as a function of the colonial British administration. Ethical issues in the medical profession in the Sudan are governed by the Sudan Medical Council. To address these issues, the Sudan Medical Council issued Medico‐legal and Ethical Guidelines in 1967. This important document has focused principally on ethical issues arising in clinical medicine. Throughout the history of health research in Sudan it is very difficult to find (...) any reference to research ethics. Nevertheless, there have been a few attempts to articulate ethics in health research. In 1979, Sudan witnessed the establishment of the first ethical review committee, which was established by the initiative of a group of doctors and scientists from the national health research laboratory. This committee got neither political nor institutional recognition. Therefore, it was not developed and came to an end shortly after its inception. Yet, in 2000 the FMOH established an ethical review committee (ERC). The functions of this committee were to review proposals of health research to be carried out in the country for ethical issues irrespective to the funding agents. Unfortunately, the committee devoted all the jobs in reviewing only externally‐sponsored health research and research carried out by expatriate researchers or international organisations. (shrink)

Objectives: to assess physicians’ and patients’ views in Saudi Arabia towards involving the patient versus the family in the process of diagnosis disclosure and decision-making, and to compare them with views from the USA and Japan.Design: A self-completion questionnaire was translated to Arabic and validated.Participants: Physicians from different specialties and ranks and patients in a hospital or attending outpatient clinics from 6 different regions in KSA.Results: In the case of a patient with incurable cancer, 67% of doctors and 51% of (...) patients indicated that they would inform the patient in preference to the family of the diagnosis . Assuming the family already knew, 56% of doctors and 49% of patients would tell the patient even if family objected . However, in the case of HIV infection, 59% of physicians and 81% of patients would inform the family about HIV status without the patient’s consent . With regards to withholding ventilatory support, about 50% of doctors and over 60% of patients supported the use of mechanical ventilation in a patient with advanced cancer, regardless of the wishes of the patient or the family. Finally, the majority of doctors and patients were against assisted suicide.Conclusions: Although there was more recognition for a patient’s autonomy amongst physicians, most patients preferred a family centred model of care. Views towards information disclosure were midway between those of the USA and Japan. Distinctively, however, decisions regarding life prolonging therapy and assisted suicide were not influenced to a great extent by wishes of the patient or family, but more likely by religious beliefs. Clark1880, WGS1984, and ITRF08 are the reference systems used in Iraq. The ITRF08 and WGS84 represent the global reference frames. In the majority of instances, the transformation from one coordinate system to another is required. The ability of the artificial neural network to identify the connection between two coordinate systems without the need for a mathematical model is one of its most significant benefits. In this study, an ANN was employed for two-dimensional coordinate transformation from local Clark1880 to the global (...) reference system ITRF08. To accomplish so, 68 stations with known coordinates in both systems were utilized in this research and were split into two groups: the first set of data was used as the training data and the second set of data was used as the validation data. A root-mean-square error was used to examine the performance of each transformation. The results showed that the RMSE using the ANN was 0.08 m in the east and 0.17 m in the north. The results indicated that the ANN can be used for 2D coordinate transformation with the results that are better than those of the authorized techniques such as 2D conformal transformation and 2D conformal least square. Economic burden of private supplementary tutoring is increasing around the world. Demand for private supplementary tutoring, contributing factors, and their effects are investigated in the study. For this purpose, data were collected through questionnaire, and multistage non-probability technique was used. Hurder model was used to find the factors affecting demand for private supplementary tutoring at the higher secondary level. Linear regression model was used to find the economic burden of family and factors affecting the demand for private tutoring. The findings (...) showed that several factors have a significant effect on the demand for private supplementary tutoring, and some of them significantly impact on the economic burden. The study recommends regulating the market of shadow education because of differentiated tuition fee in different tuition centers to cut down the burden of private tutoring for households. (shrink)

The moral reasoning construct serves as the foundation for one''s decision making when confronted with moral dilemmas. Significant relationships are reported between subjects'' writing skill and their moral reasoning scores. This research serves as a foundation for questions about writers'' moral reasoning and the ethical decisions each writer makes in written communication. In recent years there has been an increase in research conducted in the Middle East, with a corresponding increase in the challenges faced by members of the Research Ethics Committees. This study compares the structures of Omani and Jordanian RECs and investigates the perceptions of the challenges affecting the work of the REC members in Oman and Jordan. A convenience sample of 34 Omani and 66 Jordanian participants from 21 universities was recruited in this cross-sectional study. Almost 70% disagreed that (...) the members of RECs are unqualified, providing comments without justification; half believed that members have limited experience in research, and almost three-quarters that they have different opinions regarding some ethical issues. No significant differences were found between Omani and Jordanian REC members regarding their perception of the challenges, except for the perception that reviewing proposals is a time-consuming task and that multi-REC centres are less available. The regression model showed that there were significantly more male members of Jordanian RECs, and that Jordanian members were less likely to receive formal training. In conclusion, the current structure of RECs and the challenges faced by members need to be re-evaluated by decision makers to improve the overall quality of research activities, and to ensure that current REC members’ practices adhere to international standards. Imadaddin Nasimi (1369-1417), the greatest and bravest militant poet and philosopher of Azerbaijan and the entire Muslim East, who created the first but extremely perfect divan in the Azerbaijani/Turkish language, has been alien and foreign to the Persian-speaking community of Iran for many years, despite having a divan in Persian as well. In the days of the anti-monarchist revolution of 1978-1979 in Iran, Nasimi suddenly became the best-known, most referred to and most published poet, as well as the highest example (...) of someone who was bravely fighting for human honor and freedom, and as a poet, philosopher that sacrificed himself like Jesus to that end. After the revolution, Nasimi’s life and work became the focus of spiritual, scientific and ideological processes. This article, which was prepared on the basis of literature of various styles and levels published in Iran mainly in Persian, gives brief information about Nasimi’s manuscripts, works (in Persian and Turkish), divans and their publication, as well as books and scientific articles written about him. It also evaluates the ideas expressed in those studies about Nasimi and his poetry. In short, in the article, the reader is briefly introduced to all areas of activity related to the life and creativity of Imadaddin Nasimi in Iran. Since the political system of the Islamic Republic of Iran does not allow a person to rise to the status of a creative, glorious, and independent person, promoted by Nasimi, the poet’s ideas about the greatness, dignity, and struggle of a person have not only kept their relevance, but their importance has increased even more. Therefore, there is a demand for Nasimi’s example, his ideas and views in society. The fighter, scholar and poet son of the Azerbaijani people represents its unity and uniqueness. Today, Nasimi’s legacy is the object of political, religious, and ideological struggle in Iran, and Nasimi, with his ideas and example, acts as an active subject of the national liberation struggle of South Azerbaijanis. ʿImād al-Dīn Ibn Kathīr (d. 774/1373), is an important historian, mufassir, muhaddith and Shāfiʿī jurist who lived in the 8th century. Ibn Kathīr’s work titled Tafseer al-Qurʾān al-ʿAẓeem, beside its tafsir identity, can be utilized due to its rich ḥadīth content and its comments on isnad and text of the ḥadīths. Ibn Kathīr, due to his competency in history and ḥadīth, analyzed the ḥadīth rigorously and noted any necessary aspect regarding the isnad or the text. In this paper, the analysis (...) and criticism of ḥadīth texts in Ibn Kathīr’s tafsir is examined. Regarding the analysis aiming to understand the meaning of the ḥadīth, issues such as explanation of unknown words, utilizing the chapter headings, evaluation of all related ḥadīths, comments of previous scholars as well as Ibn Kathīr’s original interpretations are examined. Regarding the criticism of the text, issues such as general criticism under the heading of munkar which indicates a ḥadīth the text of which contains unacceptable meanings, specific criticisms due to conflict with the Qurʾān, the Sunnah, reasoning and historical facts, solutions regarding the ḥadīths which have conflicting meanings are examined. Summary: Ibn Kathīr (d. 774/1373) who lived in the 8th century is a competent scholar in fields such as ḥadīth, history, tafsir and jurisprudence. In this article the criticism and analysis of ḥadīths in the Tafseer al-Qurʾān al-ʿAẓeem by Ibn Kathīr who is an authority in ḥadīth and history are studied. Although the structure and plan of this book do not give it an appearance of a classic ḥadīth commentary, the rich ḥadīth content which it has, and the examination of this content with respect to isnad and text as in a ḥadīth commentary provide this book a ḥadīth commentary identity besides its tafsir identity. Ibn Kathīr’s tafsir is distinguished among other tafsirs by the ḥadīth commentary method and ḥadīth criticism that it employs. This is because it does not only provide ḥadīths as is seen in many other tafsirs, but also informs about the important issues that need to be known about these ḥadīths, and even in many times makes original evaluations. It is possible that Ibn Kathīr provides important evaluations about a ḥadīth which other famous commentators do not provide. He corrects some of the great ḥadīth scholars by showing the presence of isnads for ḥadīths that these scholars think do not exist. With all these aspects, Tafseer al-Qurʾān al-ʿAẓeem is an invaluable source for both tafsir readers and ḥadīth scholars due to its rich ḥadīth content, the skillful application of ḥadīth methodology and ḥadīth commentary. Ibn Kathīr’s tafsir is also an important ḥadīth source due to its very rich ḥadīth content. According to the catalogue at the end of the book, it includes over eight thousand ḥadīths which corresponds to a content similar to that of Ṣaḥīḥ al-Bukhārī. Looking at the studies over Tafseer al-Qurʾān al-ʿAẓeem, it can be said that it has been subject to many examinations with respect to tafsir, however, it has not received the same attention with respect to ḥadīth at a sufficient level. It is aimed in this study on one side to prove the value and originality of Tafseer al-Qurʾān al-ʿAẓeem as a ḥadīth commentary and on the other side to attract attention to the text criticism activities of ḥadīth scholars by using both specific criteria and concepts such as munkar.In our study the criticism and analysis of ḥadīth texts in Ibn Kathīr’s tafsir are studied under various headings. It is quite important to identify possible mistakes in ḥadīth texts as well as to understand the ḥadīth texts correctly. For this purpose the principles of text criticism such as conflict with the Qurʾān, the Sunnah, reasoning and historical facts have been used since the time of the Companions. Ibn Kathīr has approached ḥadīths in view of these text criticism principles and pointed to the mistakes in the texts of the ḥadīths which are in conflict with these principles. Often times, Ibn Kathīr criticized the points in ḥadīth texts which are not in line with the general principles of Islam and which he perceived not appropriate by using the term munkar in a general manner. He utilized this concept explicitly for isnad and text. He always warned the reader against baseless information. Finally, he pointed out to instances which can be determined as a result of the comparison of the various channels of a ḥadīth. Text analyses are efforts to correctly understand the ḥadīth text which enable to clarify the meaning of the ḥadīth. Efforts such as the explanation of the unknown words, the evaluation of all the ḥadīths related to a subject in a unified manner, making use of another ḥadīth in understanding of a ḥadīth, making using of the opinions of the previous ḥadīth scholars and making original interpretations, identification of the unknown persons in the text, making connections with the chapter headings to better understand the meaning, explanations of the contradictions arising from different ḥadīths and collecting different historical ḥadīths in a common theme contribute to a better understanding of the meaning of ḥadīths. It can be seen clearly how Ibn Kathīr applied these text analyses with success through sample ḥadīth texts selected from his tafsir.Two points that we think important are underlined at the end of our study. First, it is the exceptional position of Tafseer al-Qurʾān al-ʿAẓeem among the Qurʾān tafsirs with respect to ḥadīth content and analysis. When compared with the famous tafsirs that emerge in the tafsir history, Ibn Kathīr’s tafsir is easily distinguished. When the importance of ḥadīth in the Qurʾān tafsir is thought, it is important that the ḥadīth material is filtered with respect to its authenticity and the meaning of the ḥadīth is clarified at a sufficient level. Compared to the limited number of ḥadīths in the famous tafsirs that are used to explain the verses, the rich information with respect to isnad and text in Tafseer al-Qurʾān al-ʿAẓeem makes significant contribution in the explanation of the verses and provide the reader with valuable ḥadīth knowledge.The second point that we think is important is that the text criticism efforts seen in Tafseer al-Qurʾān al-ʿAẓeem help to correct the opinion that ḥadīth scholars ignored text criticism compared to isnad criticism. In this respect, it is evaluated that our study is a contribution to the recent studies that shed light on the text criticism efforts of the ḥadīth scholars. In this regard, it seems important to make use of a criterion such as “conflict with the inner consistency of a ḥadīth” among other criteria. Moreover, it is pointed out in our study that the munkar concept and the thesis that this concept has been utilized by ḥadīth scholars in text criticism, is a topic which attracted the interest of the researchers and the usage of this concept in Ibn Kathīr’s tafsir contributes to this thesis. This article reviews the research of “top rebirth scientist” Ian Stevenson on spontaneous past-life memory cases, focusing on three key problems with Stevenson’s work. First, his research of entirely anecdotal case reports contains a number of errors and omissions. Second, like other reincarnation researchers, Stevenson has done no controlled experimental work on such cases; yet only such research could ever resolve whether the correspondences found between a child’s statements and a deceased person’s life exceed what we might find by chance. al-Zarkashī, an ethnic Turk, is an important hadith, fiqh and commentary scholar who lived during the Mamlūks period. He was taught by some of the leading scholars of his era, such as Alā al-Dīn Mughultay (d. 762/1360), Imād al-Dīn Ibn Kashīr (d. 774/1372) ve Jamal al-Dīn al-Asnawī (d. 772/1370), and he grew up under their mentorship. Nevertheless, his only well-known student is Birmāvī (d. 831/1428). Almost half of his works have been related to fiqh and methodology of fiqh, and he (...) has also written some important works in the field of hadith. Among these, especially al-Tadhkira, al-Nukat alā Ibn al-Salāh, al-Nukat alā al-Umda fī al-Ahkām ve al-Icāba are worthy of mention. The work named al-Tadhkira, which we built our work upon, is the first known work to have been preserved in the field. Due to his being a first in his field, he was vastly studied as to how he evaluated the narrations and what kind of procedure he followed. In this work of his, not only the criticism but also the application of the text criticism adds to the importance of the work. Then, on the basis of this work, scholars such as al-Sakhāwī and al-Aclūnī made complementary works on the same subject. Summary: It is inevitable for a person to be shaped by the society he lives in. During the time when al-Zarkashī lived, Egypt was under the rule of the Mamlūks. The history of Mamlūks is examined under two periods: 1. Bahrī or Turkish Mamlūks (745 / 1344 - 794-1391) 2. Burjī or Circassian Mamlūks (784 / 1382 - 923 / 1517) period. Our author lives in both periods. About forty years of his life was in the period of Bahrī and the rest was in the period of Burjī. In both periods, the state did not have a full political authority in the country, but this was not the case in education and training. In fact, on the contrary to the political situation, scientific activities have accelerated by the arrival of many scholars to the land of Mamlūk because of the Mongol invasions coming from the east and the Crusades from the west. The increase of scientific activity was caused not only by the coming of the scholars but also by the support given by the Mamlūk sultans. In fact, they built many new madrasas in addition to the resurrection of the old ones. In addition to madrasas during the Mamlūks period, mosque, hāngāh, ribat and zāwiya are also among the educational places.Hadith, fiqh and Tafsir scholar al-Zarkashī is originally Turkish. He was born in Cairo at 745 under the conditions mentioned above. His family learned of gold and silverworking because of their subsequent settlement to Egypt, and they made their living with this craft. A person who performs this is called Zarkash in Arabic. Muhammad ibn Bahādır, who learned and did this job, was known as al-Zarkashī. al-Zarkashī, known for his love of science since childhood, was trained hadith by Alā al-Dīn Mughultay (d. 762/1360) and Imād al-Dīn Ibn Kashīr (d. 774/1372) in Damascus, and fiqh by al-Asnawī (d. 772/1370). Among his beneficiaries are distinguished personalities such as al-Subkī (d. 756/1355), al-Azraī (d. 783/1381) and al-Bulqīnī (d. 824/1421). The most remarkable of his student is al-Birmāvī (d. 831/1428).It is known that he wrote about fifty works in hadith, tafsir, fiqh, methodology of fiqh and other fields. Especially among these works al-Burhān fī ʻUlūm al-Qur’ān, al-Tadhkira, al-Ijāba, al-Bahr al-Muhīt fî Usūl al-Fiqh ve al-Mansūr fī al-Qawāid is worth mentioning. Studies on al-Burhān and al-Bahr were carried out at the level of Master and PhD.al-Zarkashī did not hesitate to criticize any person for whom he had found his mistake. For example, even though he has a great love for him, and even because of this love, he has been given the name of al-Minhāj, the criticism of al-Nawawī is the clearest indication of the value given to science. Not just him, critics of scholars such as al-Hākim al-Naysābūrī and Ibn ʻAbd al-Barr who are recognized as authority in hadith can also be considered in this framework.The work named al-Tadhkira which we have studied in our work is of importance in that it shows the accumulation of knowledge in the field of hadith. In order to compose this work, it is necessary to have enough information in this field since the riwāyas must be criticized in terms of isnād and text. To compose his work, al-Zarkashī has benefited from about a hundred and forty works related to hadith, tafsir, al-siyar, history, tabakāt, commentary, jarh - taʻdīl, ilal and maghāzī. The use of such works is an effort to reach all sources and right information as much as possible. Some of these sources are basic hadith books such as al-Bukhārī (d. 256/870) al-Sahīh, Muslim (d. 261/875) al- Sahīh, Abū Dāʾūd (d. 275/889) al-Sunan, al-Tirmidhī (d. 279/892) al-Sunan, al-Nasā’ī (d. 303/915) al-Sunan, Ibn Mādja (d. 273/887) al-Sunan, Mālik ibn Anas (d. 179/795) al-Muwatta, Ahmad ibn Hanbal (d. 241/855) al-Musnad, al-Dārimī (d. 255/869) al-Sunan, ʻAbd al-Razzāq al-Sanʻānī (d. 211/826-27) al-Musannaf, Ibn Abī Shayba (d. 235/849) al-Musannaf, Ibn Rāhwayh (d. 238/853) al-Musnad, al- Bazzār (d. 292/905) al-Musnad, Abu Yaʻlā el-Mawsilī (d. 307/919) al-Musnad, Ibn Hibbān (d. 354/965) al-Sahīh, al-Tabarānī (d. 360/971) al-Muʻjam al-Awsat and al-Muʻjam al-Kabīr, al-Hākim al-Naysābūrī (d. 405/1014) al-Mustadrak.al-Zarkashī divided the riwāyas he had studied into eight subjects. These are judgments, wisdom, zuhd, medicine, virtue, prayer, story, words and riwāyas circulating in language. For example, it is mentioned that there is not a hadith which is transmitted as a hadith, it is a word of a sahāba, tābiun or a person. He transferred on the riwāyas the sources mentioned in the sources, but also stated that he did not participate in some information as the place came.The author has evaluated the narrators of the riwāyas from the point of jarh and taʻdīl. He did not only evaluate riwāyas in terms of isnād, but also text criticism. This activity is a distinctive feature of his work.al-Zarkashī gave information about the misrepresentation of the name of the narrators. He also explained the strange words that are difficult to understand in the text. It is a manifestation of his knowledge in the fiqh area that some of the riwāyas that are considered weak are expressed in some sects. The author described some errors about the riwāyas. For example, he stated that a riwāya that is said to be marfūʻ is a mavkūf. al-Zarkashī also included verses, hadiths and poems about the riwāya that he had studied while writing his work or he defended it by saying that it is not the case of a riwāya that is said to be fictitious.Perhaps it is the weakest point of al-Zarkashī’s work not to give any information about some riwāya, only to mention their isnāds. He also found some riwāyas that did not have a reliable isnāds and stated that their meanings are correct. This knowledge has become an enlightening characteristic for later generations.This work has a great significance in showing that the majority of the riwāyas that spread among the people are not hadiths. As a matter of fact, 73% of the riwāyas examined in the work are weak or irrelevant riwāyas. This work of al-Zarkashī is unique. The existence of such a work has not been determined before him. As practical beings, we act with a sense of freedom, or, to use Kant’s memorable phrase, “unter der Idee der Freiheit.” This attitude is present whenever we are deciding what to do, and it is most clearly revealed when we reflect on what we take for granted while deliberating. Consider a young man, Imad, who lives under an oppressive military occupation and deliberates about whether to join the resistance, leave the country, or continue quietly in his studies hoping that (...) the occupation will be eliminated through the efforts of others. Taking any of these alternatives is likely to have momentous consequences upon his physical safety, his self-esteem, and realization of his goals. Yet, he can no longer tolerate his indecision and feels that he must commit himself somehow. One thing is apparent; Imad faces alternative courses of action, each of which he regards as open for him to undertake at the time. Were he to come to believe of any of the alternatives that it is no longer a genuine option, he would cease deliberating about whether to take it. Qaṣeeda-i Burdah written by Egyptian sufi poet Busīrī (d. 695/1296) as an eulogy for Beloved Messenger Moḥammed has received great attention in the Islamic world. This work has been recited both in cultural/social ceremonies such as weddings, holidays and funerals. On the other hand, it was also annotated, translated, and takhmīs, tesdīs, tesbī‘ and taşṭīr were written to it by the pen of scholars and litterateurs in literary circles. These activities, which have been carried out over and over again, has (...) been going on from the 15th century to the present day. Not only the reputed people, but also unknown ones or ones whose names were later forgotten have tried to translate it to their own language. The subject of the study is one of this type of poetic translations of the eulogy. Like its translator, date of this poetic translation is also unknown. This work was written in the remel baḥr type of ‘arūż in 162 verses using the spelling of the classical period. Although a significant portion of the rhyme words was adapted from the source text, it has a more understandable style than its counterpart. In terms of poetry, it is above the average. The translator decorated the meaning that he borrowed from the original text with his own poetic ability and tried to express it in a unique manner. For this aim, it is more literary, lyrical and successful than most other translations of Qaṣeeda-i Burdah. In the present study, text of the mentioned work was given with transcription along with mentioning of some of its features. Summary: Qaṣeeda-i Burdah written by Egyptian sufi poet Buṣīrī (d. 695/1296) has an important place in the Islamic world. Named by the poet himself as al-Kavākib-al-durriya fī madḥi khayr-al-bariyya, this work is also known as al-Qaṣeedat-al-mīmiyya since its rhyme letter is Arabic mim, as Qaṣeeda-i Bur’ah since it caused Buṣīrī to recover from a disease, as Qaṣeeda-i Burdah due to the rumor that this event took place while he was wearing a coat by the hands of Beloved Messenger Moḥammed. In order to prevent confusion with the eulogy of Ka‘b b. Zuhayr (d. 24/645) with the same name, it is known in cultural circles as Qaṣeeda-i Bur’ah. However, in literature, it is commonly referred as Qaṣeeda-i Burdah. The work was written in simple baḥr style of ‘arūż, and consists of 161 couplets. It has ten sections in terms of its content: longing for the beloved, complaining about the soul, eulogy for Beloved Messenger Moḥammed, his birth, miracles, dignity of the Holy Qur’ān, miracle of mi‘rāc, importance of jihad, sorrow, hope, prayer and request. The eulogy, which has an effective style, has gained great acclaim in the Islamic geography and has been read for various purposes for centuries. Some people recite it in wedding ceremonies, while some others use it in funerals. The sick people recite it with the hope of healing, while calligraphers wrote it for practice.Owing its fame more to its story rather than its value of art, the eulogy was translated into Eastern languages such as Persian, Malay, Pashto, Punjabi, Turkish and Urdu, as well as into Western languages such as German, French, Greek, English, Spanish, Italian and Latin. In addition, many annotations, footnotes, takhmīs, tesdīs, tesbī‘, taşṭīr and replies were written to it. For example, the poem annotated in Arabic by Ebū Shāme al-Maqdisī (d. 665/1266), Khalid b. ‘Abdullah al-Ezherī (d. 905/1499), Ibrahim b. Moḥammed al-Bacurī (d. 1277/1860), ‘Omer b. Aḥmed al-Ḥarpuṭī (d. 1299/1882) was translated into Persian by the men of letters such as Molla Ḥafıẓ Sharaf (d. after 810/1407), ‘Iṣāmuddin b. ‘Arabshah al-Isfarayinī (d. 945/1538), ‘Ali b. Ḥasan Zavareī (d. 968/1560). The work was annotated by Le‘alī Aḥmed b. Muṣṭafa (d. 971/1563), Sayyid Ḥasan b. ‘Abdurraḥman (d. 1071/1661), Naẓifī Ismail Aqḥiṣarī (d. after 1205/1790), Shaykh-al-Islam Makkī Meḥmed (d. 1212/1797), Moḥammed b. Fayżullah (d. 1231/1816), Moḥammed b. Aḥmed (d. 1318/1900), Anqara Governor ‘Abidin Pasha (d. 1324/1906) in Turkish language. Takhmīs was written to the work by poets such as Ṭashkoprizade Kemaleddin (d. 1030/1621) Khocazāde Asad (d. 1034/1625), Sayyid Moḥammed Sharifī (d. 1040/1631), Shaykh-al-Islam Yahya (d. 1053/1644), Suleyman Naḥifī (d. 1151/1738), ‘Abdullah Ṣalaḥī (d. 1197/1783), Shaykh-al-Islam Makkī Meḥmed, Mollacıqzāde Raif (d. 1238/1823), Muṣṭafa Maqṣud (d. 1258/1843), Yemliḥazāde Muṣṭafa (d. 1294/1878), Meḥmed Said Pasha (d. 1308/1892), Moḥammed Favzī (d. 1318/1900) while Ismail Mufid (d. 1217/1803) wrote tesdīs and Niyazī-i Mıṣrī (d. 1105/1694) wrote tesbī‘ to it.The work was translated into Turkish language by poets such as ‘Abdurraḥim Qaraḥiṣarī (d. after 888/1483), Kemal Pashazāde (d. 940/1534), Ahmed-i Rıḍvan (d. before 945/1538) Le‘alī Aḥmed b. Muṣṭafa, Shamsaddin Sivasī (d. 1006/1597), Kemalatī Meḥmed (d. before 1015/1606), Esasī (d. before 1041/1631), Sayyid Ḥusayin (d. after 1050/1641), Mehmed Ṭalib (d. 1089/1679), Sukutī Meḥmed (d. 1103/1691), ‘Abdulhay Jalvatī (d. 1117/1705), Sulayman Naḥifī, ‘Abdullah Ḥulvanī (d. 1159/1746), Aḥmed ‘Arifī (d. after 1195/1781), ‘Abdullah Ṣalaḥī, Ismail Mufid, Sivaslı Aḥmed Suzī (d. 1246/1830), Evranyali ‘Abdurraḥim (d. 1282/1865), Meḥmed Said Pasha, Qonyalı Fakhreddin (d. 1365/1950), Sazai Qaraqoç (d. 1933), Ilhan Armutchuoghlu (d. 1937), Maḥmut Qaya (d. 1945), but there are also translations whose translators are unknown. The present study deals with such a translation of the work. To our best knowledge, the translation that has not been paid much attention by scholars to date and was mentioned only by Ṣadıq Yazar. Even he articulated only a few sentences about the translation based on a deficient copy of the work. Both in the library records and in its copies, there was no information about the translator and the translation date of the work. The translation, which beginns directly without a section such as an introduction at the opening, was written in 162 verses with the spelling of the classical period. It has a remel baḥr style of ‘arūż structure with fā‘ilātun fā‘ilātun fā‘ilātun fā‘ilun rhythm. Although it has some ‘arūż mistakes, it can be said that it is successful in terms of rhythm. Using the source text rhyme of mīm letter, the translator directly adapted some rhyme words from the Arabic text, while converting some others to appropriate Turkish words. Although he used some of them only once, he used some others several times. This finding implies that the translator may have had difficulties in finding words for the rhyme. It is noteworthy that he used some of those words in different meanings, and he employed 99 different rhymes in 162 couplets. The translator used the original text for purposes other than the rhyme words. He used some words directly without translating them or only removed the ḥarf-i ta‘rif. He transformed some words to others with the same stem or to their counterparts in Persian. While converting some of the phrases to forms suitable for the structure of the Turkish language using various practices, he used the old Anatolian Turkish as well as living Turkish. Like Buṣīrī’s eulogy, the poem, which consists of 10 parts in terms of contents, is suitable for the contents of the source text, but it is not a literal translation. The translator, who cared about literary rhetoric, largely preserved or even contributed to the harmony elements of the text. He reinterpreted the meaning of Buṣīrī’s work using his poetry skills, and produced a successful translation in terms of poetry with minimal rhyme flaws. Considering other translations of Qaṣeeda-i Burdah, the translation has similarities with that by Uskudarlı ‘Abdulhay Jalvatī in terms of rhyme letter, with that by Sayyid Husayin Amasī in terms of rhyme, and with that by Ismail Mufid Afandi in terms of direct adaptation of some words in original text, while it has common characteristics with the translation by Naḥifī in terms of both rhyme letter and direct adaptation of most rhyme words from the original text. On the other hand, the translation has similarities with the translations by Kemal Pashazāde, Ahmed-i Rıḍvan, Esasī Afandi, ‘Abdullah Ṣalaḥī and Na‘imī in terms of rhyme letter, rhyme and adaptation of most rhyme words from the original text. However, it is simpler compared to the translation by Kemal Pashazāde, more loyal to the content of original text compared to the translation by Ahmed-i Rıḍvan and more robust in terms of rhyme compared to the translation by Na‘imī. It was then that Imade the fateful decision that there was no need for me to learn how to use this tedious device, as I could always rely on the students to perform the necessary computations. In the course of time, slide rules were (...) replaced by pocket calculators and personal computers, but I stuck to my original decision.My computer phobia did not prevent me from taking an interest in the theoretical question: what is a computation? This question goes back to Hilbert's 10th problem, which asks for an algorithm, or computational procedure, to decide whether any given polynomial equation is solvable in integers. It quickly leads to the related question: which numerical functionsf: ℕn→ ℕ are computable?While Hilbert's 10th problem was only resolved in 1970, this related question had some earlier answers, of which I shall single out the following three:f is recursive,f is computable on an abstract machine,f is definable in the untyped λ-calculus.These tentative answers were shown to be equivalent by Church [1936] and Turing [1936–7].I shall discuss here some of the more recent developments of these notions of computability and their relevance to linguistics and logic. The law of responsibility (compensation), which was formed around the concept of the ḍamān and was developed by the scholars within the system of furû‘ al-fiqh (substantive law) over time, constitutes one of the important parts of Islamic law. Although compensation law (ḍamān) was not addressed as a private subject in the first period fiqh literature, it is seen that the literature on this specific area started to emerge after the early period. It is the Hanafi jurists who first brought (...) together these issues that are scattered in the classical books of fiqh that are related to the law of responsibility. Compensation law took its classical form in the texts of the early periods and was shaped around the views of the founding imams of the Ḥanafī school (madhab). It has later been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Hanafi in the type of waqi'at works. These works were a product of the need for the law to adapt to the new conditions. These issues, which are related to the compensation law in the Hanafi school have been covered as a special section (chapter) in the studies that are classified as waqi'at, such as Usrūshanī’s al-Fuṣūl fī al-muʿāmalat (Fuṣūl al-Usrūshanī), ʿImād al-Dīn al-Marginānī’s Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn’s Jāmiʿal-Fuṣūlāyn. Later, the topics discussed in these works were developed and continued, and ultimately separate works related to this field have been copyrighted. In this study, the kinds of development and expansion which are in the literature and related subjects will be discussed by examining the above-mentioned works. Therefore; first of all, the first examples of Hanafi jurists related the compensation will be analysed comparatively. Afterwards, the place of ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah of Fuḍayl Chalābī (d. 991/1583), one of the Zenbillizade’s, will be addressed.Summary: The core idea of the law of responsibility, which constitutes one of the important parts of Islamic law, was stated in the Qur'an and Hadith, and then have accumulated by the contributions of the jurists (fuqaha), as they developed the idea of the law of responsibility within the furû‘ al-fiqh in relation to the systematic of the legal school (madhab) that they belonged to.These issues, which constitute one of the important parts of the law, were addressed by sprinkling among the topics in almost every part of classical fiqh books. In other words, the subject of ḍamān (responsibility) was not considered as a separate subject in the fiqh works of the first period. In this way, it is seen that the literature on compensation law started to emerge in the following periods, and at first several independent sections on this subject, and then separate works specific to this field, albeit limited in number, were written.It is the Ḥanafī jurists who first brought together these issues that are scattered in the classical fiqh books related to the law of responsibility. Compensation law, which took its classical form in the texts from early periods, shaped around the views of the pioneering imams of the Ḥanafī school, has been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Ḥanafī in the waqi'at works, which is a product of the need for the law to adapt to new conditions. Firstly, one of the Ḥanafī jurists, Majd al-Dīn al-Usrūshanī (d. 637/1240) dealt with the responsibilities arising from the contract and unfair acts in the 29th section of his book named al-Fuṣūl fī al-muʿāmalat under the title “Types of Compensation Required to be Paid and Their Situation”. The method and system that Usrūshanī started in this work, the Ḥanafī jurisits ʿImād al-Dīn al-Marginānī in the Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn Ibn Qāḍī Samāwnā in the Jāmiʿ al-Fuṣūlāyn continued to develop the compensation section in their books. Afterwards Fuḍayl Chalābī (d. 991/1583), one of the members of Zenbillizade’s family, enriched these issues and made it an individual work, named ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah. Marginānī titled the issues that Usrūshanī had handled in the compensation section and systemised it even more by gathering the fatwās on the related issues under one heading. It is noteworthy to mention that when the compensation sections of both works are compared, the way the subjects handled are exactly the same. But unlike Usrūshanī, Marginānī added the compensation for damages to the fetus in the womb and the responsibility of the person who brought back the fleeing slave at the end of the chapter. On the other hand, unlike them, Shaykh Badr al-Dīn added only the responsibility of the person who found the lost item. Considering that almost all of the topics in the compensation section of Sheikh Badr al-Dīn existed exactly in the compensation section of Marginānī, and that most of them were stated in Usrūshanī’s al-Fuṣūl, it is necessary to say that all of these discussions are based on Usrūshanī as the main backbone of this particular subject and that his work has a unique place in the Islamic legal literature. Chalābī’s ad-Ḍamānāt, is the first work that was written as a separate book in the field of compensation law. Even though in some modern works claim that the work Ghānim al-Baghdādī’s (d. 1030/1620) book named Majma‘ al-ḍamānāt fī madhhab al-Imām al-A'zam Abī Ḥanīfa al-Nu'mān was the first written book in this field; it is known that Chalābī's ad-Ḍamānāt had been written before Baghdādī’s Majma‘ al-ḍamānāt. As a matter of fact, the work of Chalābī had been completed in 984 Hijra, and the Baghdādī’s Majma‘ al-ḍamānāt was completed in 1027 Hijra. Although the subject sequence in Baghdādī’s work is different; this work is regarded as a continuation of the same tradition.An examination of the systematic and the content of the work reveals that Chalabi’s ad-Ḍamānāt is the continuation of the type of writing that Usrūshanī started and developed by Marginānī and Shaykh Badr al-Dīn. When compared with the compensation sections of these works before him, Chalābī has added new compensation issues to his book that are not addressed in these three works; such as partnership, mudaraba, suretyship (kafāla) transfer (ḥawāla), peace, legal disability (hajr), freedom of trade (idhn) and testament. Among the works mentioned above, works out of Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn and Baghdādī’s Majma‘ al-ḍamānāt are available as manuscripts in the libraries. Therefore, these works have not been used much in modern studies on compensation. In addition, the Chalābī's ad-Ḍamānāt is almost unknown. Although there is little information about this work in some bibliographic studies, it is noteworthy to state that this work is not used as a source in contemporary studies written in Arabic on compensation law. The fact that this work is available as manuscripts in Istanbul libraries is probably the reason for this outcome. It is also very difficult to say that this work is known and used sufficiently in studies written in Turkish.Usrūshanī’s al-Fuṣūl fī al-muʿāmalat and Marginānī’s Fuṣūl al-iḥkām are currently in the form of manuscripts, so there is no comprehensive study on the whole work and the compensation section. It is possible to see the compensation issues discussed in the work, since Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn, which has been published as printed, was translated into Turkish by an editorial group under the presidency of H. Yunus Apaydın. In addition, Kemal Yıldız, who translated the compensation section in this translation, published this section in Jāmiʿal-Fuṣūlāyn as a separate book with the name of “Sources of the Jāmiʿ al-Fuṣūlāyn and Compensation in the Practice of Ḥanafī School”. Yıldız, first introduced the sources of the Jāmiʿ al-Fuṣūlāyn in the first part of this work and then translated the compensation section from beginning to end by adding his own explanations and evaluations around the subject during the second part. Even though some introductory information about the books of Usrūshanī and Marginānī is presented in Yıldız’s study, the absence of information on the contents of the compensation sections of these books does not allow the opportunity for the researchers to evaluate on the subject wholly.
